here is the inner loop, outer loop getting thick as well. no big issues here. good news. coming from the west side from gaston on 85, 19 minute mark on 321. i'm in the breaking news center following two stories. hickory officers charged this man for a murder in a busy mcdonald's parking lot. they caught eric yount about 30 miles away three hours after last night's shooting. police say yount shot richelle lail and cod by watts who workers say -- cod by watts who are workers. officers believe this is part of a domestic argument. a witness said it happened near the mcdonald's play area. >> it makes me want to hold my kids tight. you never know what will happen.

younts will be in court on murder and attempted murder charges. we are learning more about the relationship and as soon as we get new information we will have it for you. breaking news in caldwell county. one person is in custody for the stabbing of a mother and toddler. the suspect stabbed the woman on fairway acres drive south of lenoir. the toddler was seriously hurt and airlifted to the hospital. we are checking another child for injuries as well. we are asking how the toddler was injured and information about the suspect and his charges. we will update you as soon as we learn more. a major development that could impact the future of the i-77 toll lanes. the texas company that worked on a similar project in austin filed for bankruptcy. it's owned by the same parent company leading the project here. eyewitness news reporter joe bruno learned what north carolina leaders are doing to prevent that from happening here. joe? >> reporter: what happened in texas is what people in lake

for years could happen to the i- 77 toll lane project. now the governor is calling for leaders to review all legal and financial options to potentially get out of the deal. the i-77 express lane project being built by the i-77 mobility partners a subsidy of cintra. another project being build in austin, texas declared bankruptcy yesterday. now the head of the ncdot is flying to texas to meet to transportation leaders to talk about the future of the i-77 project. this comes after my 9 investigates tuesday when i uncovered the amount of money cintra expects to make from tolls. for the partial year, $5.1 million is expected to be made. in 2019, $24.6 million. toll protestors and some politicians are hoping that the

>> if this project is filing for bankruptcy, it's kind of a house of cards. >> cintra's projects in the united states have failed before like in september of 2014 which the spanish company's project in indiana had to declare bankruptcy. reporting live in cornelius, joe bruno, channel 9 eyewitness news. >> thanks, joe. today the cms board of education will discuss the search project for a new superintendent. it will meet at noon. we told you last month the board voted to extend ann clark's contract through june 30th of next year. this will give them time to find a new leader. new this morning, a study says green schools aren't worth the money. conservative think tank john lockdown foundation looked at green schools in several north carolina counties. they use more energy than similar nongreen schools. in iredell third creek elementary is the first lead

in the country but the think tank found it spends nearly $7,800 more per year on energy than the district's average elementary school. the man you see in this video here showing a officer punching a suspect has an attorney. the department is investigating whether officers used excessive force. >> eyewitness news reporter angela hong is live with the family's responges. >> reporter: the family is outraged at what they see in the video. they know malcolm elliott was driving without a license during the hit and run crash. they say the repunches are uncalled for. we showed you the video tuesday. you can see seven police officers surrounding elliott and one officer hits him suhl multiple times with closed fists. only channel 9 was there as elliott returned home from the hospital. his parents say they have hired an attorney and they want to see the officer's body camera

cmpd said they are not releasing the video. the family says something must be done because they believe this is an excessive force case. >> i just want the officer to be counseled, whatever he needs to have done to correct their problem. >> we reached out to city leaders and they have been advised not to speak publicly about the case until an internal affairs investigation is complete. in the next 30 minutes you will hear from law enforcement expert who told us what factors could make this an excessive force case. reporting live, angela hong, channel 9 eyewitness news. veterinarians are evaluating nearly 90 cats rescued from an iredell county home. animal control took the cats out of a pine wood circle home in mooresville. officials say two of the cats were found dead inside the home. they say tips from rescue

lead to the investigation and a search warrant. >> these folks think they are doing the right thing. they are bringing the cats in out of the cold and trying to take care of them. they get overwhelmed and, so, they don't understand what they are doing is bad for the cats. >> animal services is reaching out to local rescues to help the 88 cats find homes. no charges have been filed against that homeowner. happening today, we should learn if the state will seek the death penalty against two suspected murderers. they are accused of killing benny bennett junior at a gas station two days before christmas. you may remember s.w.a.t. teams went to their home in northwest charlotte to arrest the pair last month. a stand off lasted several hours. charlotte may get a direct flight to cuba after american airlines agreed to operate

flight from the queen city to havana. "usa today" says the u.s. department will allow 110 daily flights to cuba but only 20 can go to havana. american airlines requested 14 daily flights to the capitol plus two additional weekend only flights. u.s. carriers in total applied for 51 flights to havana. only 20 are on the table. new this morning, e- cigarettes are no longer allowed on commercial flights. anthony foxx finalized the rule yesterday. he said passengers on flights in or out of the u.s. are not allowed to smoke on board. the department said electronic cigarettes are under the same restriction as tobacco and they want to limit passengers exposures to harmful chemicals. one supreme court justice will be the swing vote in deciding the most signature knife capital abortion indicates in decades. the court heard arguments about

doctors that perform abortions have hospital privileges which could force most clinics to close. justice kennedy was concerned the remaining ten clinics would not have the resources to handle 870,000 abortions a year the state handles. at one point he suggested sending it back to a lower court to look at the issues. if the supreme court holds on to the case they will likely announce a decision in june. if it's a tie, the state law would stand but it would not set a national precedent. benjamin was the top wide receiver in 2014 but tore his acl in training camp last year. that left many fans to wonder if his presence would have made the panthers better. head coach says he may give his players extra time off because

it's common for them to burn left over chemicals. officers arrested two people inside the home. they are charged with manufacturing and trafficking meth. three other people were taken into custody and face lesser charges. south carolina governor mcnikki haley said a solicit tore and county councilman should refine for driving drunk. officers arrested councilman calvin washington for dui. they say he crashed into the night. that driver had serious injuries. last week we told you troopers arrested lexington prosecutor done any meyers after they saw his empty car crashed into a utility pole. this is the third dui arrest for the prosecutor. new developments on a $4.8 million gold heist in north carolina. the fbi arrested a second man

a new starbucks will be at the entrance to the park. it will open may 21st. similar lot meck len big police met with residents to talk about the number of vacant homes. residents told officers tuesday they are concerned because it has allowed vagrants and squatters to move in. they are working to get the properties repaired and boarded up. cops on the corner event was designed to meet more people in the community. they hope by being more visible it will detour crime. the national commander of the american legion is asking south carolina lawmakers to cut taxes for retired military veterans. dale barnett spoke at a joint session of the house and senate. he said the move would attract young retirees to the state.

biggest month on record for gun background checks in the united states. the fbi said there were 2.6 million checks last month up from a record 3.3 million in december. background checks spike after mass shootings. last month there were several including one at a lawn mower factory in kansas. another involving an uber driver in kalamazoo michigan. >> the town of pageland has an interim police chief after several officers walked off the job. next chesterfield county sheriff is taking steps to keep

quar a charlotte store robbed at gunpoint. we were there when they took four suspects into custody including a 15-year-old. the resources that officers used to track down the suspects moments after the crime.

let's head over to mark taylor in the traffic center. what are we seeing on 77. >> traffic is picking up a bit. nice ride folks heading out, taking 77 near the john belk freeway out of uptown, dry conditions. clear heading south. emerging from the collector lane, no big slowdowns. 85 near staple road, busy here. starting to see the sunrise coming in from gaston and cleveland county through the university area and over to the interchange with i-77. john. i'm in the breaking news center following a store we we brought you last hour. in the last 15 minutes or so police cleared the scene of an armed robbery at the 7-eleven in southeast charlotte. we were the only crew there. around 4:00 police arrested these four suspects. we blurred their faces because we are told by police one is

we are not sure which one. the two suspects waited in the car outside the 7-eleven while the other two robbed the place at gunpoint. we are told no one was hurt. a police dog was brought in to try to track the suspects down as they sat in their car just around the corner. 30 minutes ago on daybreak, channel 9 told you the suspects scene in this video hired an attorney. we are asking experts whether a cmpd officer went too far by punching a suspect. angela hong has an expert's take on the video. >> reporter: we asked former federal prosecutor and fbi agent quentin williams. he said it's too early to tell if the officer used excessive force but he agrees it's controversial. we showed you this cell phone video tuesday. it shows several officers, seven officers surrounding

one officer is seen punching elliott multiple times. the key is to find out if the officers were attacked or felt threatened because officers are trained to defend themselves. if someone is restrained, williams said there is no reason to punch the suspect. >> you do need to interview all the officers involved and interview the witness who took the video. and any other witnesses who were around to understand exactly what was happening as the bunches were being thrown. >> reporter: williams says that the police body camera footage will be important. we did ask them to take a look at the video but they told us they can't show it to tuesday because it's a part of the investigation. state representative rodney moore says he is considering drafting a bill that would require more transparency when it comes to police body cameras. in the next 15 minutes, you will hear from malcolm elliott's family about what

angela hong, channel 9 eyewitness news. >> thanks. today this gaston county woman will be back in court on charges she killed her husband and two other people. police arrested crystal gambino accused of shooting her husband. police found the bodies of two men inside the bedroom and woman outside. all three were naked. police say they met online. after the murder crystal went to a home nearby in stanley and told a relative what happened. one of them made the call to 911. >> my sister-in-law has told her family that she killed her husband. she caught him sleeping with another woman. >> the caller told police crystal dumped the woman's body on a burn pile in the backyard but they doubted the story because she made up things before. they responded to a 911 call on

rolled over on the phone. hours later they found them dead. the case will head to a grand jury monday. this morning after a two- hour closed door meeting we know chesterfield county sheriff jay brooks will act as interim police chief in pageland. this is one day after most of the town's force quit after council voted to reinstate police chief larry brown. brown was on leave for four months but we don't know what that was about. while the issue gets sorted out, sheriff brooks will have three deputies patrolling the area per shift. >> this will offer chief brown an community to concentrate and to get his staffing back up to where it should be. >> so, for now, chief brown will be working under the sheriff. the two are scheduled to meet with the town administrator on monday. at that time the sheriff says that he should know how many pageland officers will report

in 90 minutes, voters in north carolina can cast their ballot for the presidential primary. >> we have a list of early voting sites at wsoctv.com. >> reporter: early voting starts today and it will run until march 12th. there is a major change that impacts everyone that wants to vote. for the first time in north carolina, voters will need an i.d. to cast a ballot. if you don't have a driver's license or government i.d. card you can vote absentee. unaffiliated voters can participate in the democratic or republican primary. this march, voters will decide the party's favorite candidate for several major laces including -- raced r -- races. >> after the election we will

start focusing on the next primary that will be out there. so, let's not lose sight of march 15th. >> reporter: the north carolina primary is march 15th but that congressional primary is on june 7th. reporting live in cornelius, joe bruno, channel 9 eyewitness news. tonight's republican presidential debate will be down to four candidates after ben carson said, quote, he doesn't see a clear path forward for him in the election. new this morning, donald trump released his health care plan how he plans to repeal and replace obama care. he wants to allow the sale of health insurance across state lines and make individual's health insurance premium payments tax deductible. it would not require all americans to have health insurance even though he said last month he liked that part of obama care. later this month, mitt romney is expected to speak out against trump.

performing medical tests on kelly and compare it with his twin brother to determine what the effect space has on the body. vice president joe biden's wife was in texas to welcome kelly home. she brought him beer and an apple pie. new this morning, north carolina will spend $50 million to make roads safer. governor mccrory announced the funding saying he wants to reduce the risk of hydroplaning and add new turn lanes. the highway safety program will just crash data and input from community leaders to identify the biggest hazards from across the state. the south carolina senate will work on a new bill to raise $400 million yearly for state roads without raising the gas tax. this comes after some senators are filibustering the proposal for several weeks. they object to a current bill that would raise the gas tax

we first showed you the cell phone footage tuesday. you can see seven officers surrounding malcolm elliott. they were trying to arrest him for a hit and run crash. we were the only station there as elliott came home from the hospital yesterday. his family has hired a lawyer. his mother does not condone her son's behavior but feels that officers need better training to better handle these kinds of situations. now, we did reach out to city council and cmpd. they declined to comment until an internal investigation is completed. reporting live, angela hong, channel 9 eyewitness news. the state is expected to release the latest numbers on mumps cases in our area. there are 14 probable and confirmed cases including three in mecklenburg and two in in iredell. it's a mild virus but hard to
