davidson passed resolutions asking the district to keep the seat open for every child who wants to stay at a neighborhood school. leaders in matthews and mint hill have talked about creating their own district. now school leaders will talk about those issues tonight. reporting live from uptown, tina terry, channel 9 eyewitness news. channel # to follow every development out of tonight's cms board meeting and we'll have complete coverage on eyewitness news at 10:00 and 11:00. the breaking news center right now. we're following reports in pittsburgh that two people shot and killed. five at a party. now police say it looks like the victims were in the backyard of a home this is for a cookout late last night when someone shot a gun from a nearby alley. now people were scrambling to get back inside. that's when someone else shot at the back porch. that was the filled with people. four people died right there on the back porch. the fifth victim died at the hospital. there are three others this

shape. they're not giving an exact -- list of the injuries at this point. they're just telling us it's very serious. police have not arrested anyone and they have not said anything yet about a motive. we're keeping an eye on this story for you there. we got new information overnight about a deadly pedestrian crash in north charlotte last night. police say 32-year-old kameka collins tried to cross sugar croak road before 7:30. the driver swerve today avoid her and hit her with his front bumper. she died at the scene. we spoke to a witness who said he heard the crash. >> i hear the impact you know -- really i don't see that -- the main accident. and the sense -- [ inaudible ] >> police say collins was trying to cross at the unmarked pedestrian crossing and was wearing dark clothes. but that part of the road is lit with street lights. police have not charged the driver and don't think speed or alcohol played a role in the crash. today a man accused of

due in court for a probable cause hearing. charlotte-mecklenburg police arrested bernardo gray last month. he used a bogus credit card to buy cars at three lots and when he put in a number in the credit card key pad each sale showed approved even though they weren't. he's out on bond now charged with obtaining property by false pretense. overnight in and around the home right here in albemarle. a murder suspect lived here with his uncle before killing him and trying to bury his body. tony hearne killed his uncle tiko. officials arrested hearne and linsey lentz yesterday after catching the pair trying to bury the body an hour away in commander county. the compare they were -- alexander county. the car they were driving got stuck and someone noticed them and called police. hearne told our cameras he was only defending himself when he choked his uncle to death. >> i never wanted to fight my uncle but he came in with his knife. and so when -- when we was

myself and he was choking me and i was choking him. >> hearne wouldn't tell us where the fight happened. police are still trying to determine that and if there were any witnesses. channel 9 learned hearne has a lengthy criminal past including assault with a deadly weapon. assault on an officer and animal fighting charges. he and lentz are both charged with murder and they'll face a judge on monday. this afternoon, democratic presidential candidate hillary clinton is due to speak at a campaign rally in durham with the north carolina primary coming up on tuesday. but she canceled a planned rally in raleigh. last night she and bernie sanders took part in a bilingual debate in miami and immigration was a big poppic. the moderator asked the candidates if they would deport undocumented children or adult who is don't break the law -- adults who don't break the law. >> stop the raids and stop the roundup and stop the deporting of people who are living here doing their lives, doing their jobs and that's my priority. >> i don't think that the secretary fully answered your

and i think the proof may be in the pudding. i will not deport children from the united states of america. >> can you promise not to deport immigrants who don't have a criminal record? >> i can make that promise. >> okay. >> meanwhile tonight the four republicans still in the race will face off in a debate in florida. the latest poll heading into next tuesday's primary will. trump leading -- there. trump leading rubio by more than 20 points at this point even though that's rubio's home state. complete coverage of clinton's appearance in durham and the gop debate all for you tonight on eyewitness news at 10:00 and 11:00. south carolina governor haley wants to end taxes on military retirement benefits. she wants to use $10 million from the state to cover the cut. in all the plan would cost the state $33 million a year. the supporters say it will attract military retirees looking for new work but critics say the plan takes away from the state's tax base. duke energy filed an appeal to fight the state's $6.6

spill into the dan river. >> that fine was issued last month but the spill happened nearly two years ago in eden. last night duke sent us a statement saying in part quote -- a year ago, the state found elevated levels of heavy metals in well water and near the allen steam plant. but this week the state said the water was safe to drink. some neighbors are not convinced. >> you're supposed to be watching out for us. and i feel like you have not been protecting us. so why should i trust you now? >> duke energy representatives told us they will continue to provide bottled water for neighbors but say there's no indication that coal ash ponds influenced the well waters. 270 charlotte rite aid employees will lose their jobs in may. channel 9 found a warn notice

doesn't say which positions are affected or why employees are being let go. last month the shareholders approved a $17.2 billion deal to be acquired by walgreens and experts say this would take away major competition and could lead to lower prices at checkout but the deal is not expected to close until the second half of the year. antitrust regulators still need to approve it. today the charlotte knights will host the job fair in uptown. the team is specifically looking to hire people for its food service and hospitality team. positions include concession cooks, cashiers, bartenders, and suite attendants. the job fair is from 4:00 p.m. to 7:00 p.m. at the bb&t ballpark. a new survey says charlotte will have one of the strongest job markets in the nation during this year's second quarter. a manpower employment outlook survey ranks the queen city as number one for job prospects from april through june. it predicts increased hiring among construction, durable goods and manufacturing.

it did say some financial companies plan to cut back. we have traffic and weather together every ten minutes. here's meteorologist vicki graf in severe weather center 9 where we are in just so warm out there already. >> it's already a warm start to the day and that's going to be the trend as we go throughout the afternoon. here's a view from charlotte tower camera. we could be dealing with again some patchy fog by mid-morning right around 7:00, 8:00 but it won't last very long. not everybody will see it. but look at these temperatures. 58 in charlotte. 55 in albemarle and 58 in rockingham and 54 in boone. so it's already a mild and warm start to the day. you don't have to worry about the winter laters morning. the threat for some patchy fog by 7:00. not a problem by 9:00 though 69 throughout the day -- though. throughout the day today. in fact, highs for today close to 77 degrees and tomorrow, or -- our average high for this time of the year is 61 degrees. and we will keep that warm around for tomorrow as well. but i am tracking the threat

welcome back. right now 5:14. beautiful look here at uptown charlotte all lit up now. it's 60 degrees already this morning. vicki is saying it's going to warm up even more and it's going to warm up fast. we'll be talking with her and about mark taylor has a few issues out there already and we'll have for you here on daybreak. this morning, an accused killer is in bars four years after police say he murdered a pregnant teenager. >> now investigators are releasing new information about what led up to the arrest. we first told you on monday prosecutors charged darne brown with the murder of hawa gabbidon and her unborn child. police say they were oleosus pix of brown but information from a community -- always suspicious of brown but information from a community helped prove their case. gabbidon's family. >> if i go to the corner and she not there -- why did he do?

be charged in the case. they would only say the investigation is not over. a woman who tried to hire a hitman to kill her husband is appealing her sentence. a federal judge sentenced sasha davis to ten years in prison and ordered her to undergo mental health treatment. in a handwritten letter filed in court, she questioned the treatment requirement. she requested a public defender to appeal her case. police in winston-salem are using body camera video to the roads. take a look at this. last year a police officer pulled over to investigate a minor crash. but then another driver crashed into the patrol car. that was blocking the right lane. the move over law says drivers must give emergency responders and other assist vehicles room on the road. body cam ares are becoming more and more common across the country but there are still questions about how and when they should be used. representatives for north carolina's state sheriff's and

yesterday. they say the cameras should not be a requirement. they also say officers should be able to decide for themselves when to use the cameras. the head of volkswagen's u.s. operations mike imhorne resigned effective immediately. the company reached an agreement with horne and announced an interment replacement. they were under fire after admitting more than 400,000 u.s. cars had software tests. the u.s. is suing volkswagen. thousands of north carolina wal-mart employees will see a boost in pay. the raids will kick in for more than 38,000 state workers and also get a share of the bonus earned in the fourth quarter of the year. all part of wal-mart's two year, $2.7 billion investment in higher pay for employees. one man is dead and a woman taken to the hospital after severe flooding in louisiana. police say the couple was trying to drive home when their

this is video of the flooding at shreveport. officials saith res 80 holmes -- say at least 80 homes are flooded. and in texas, people there dealing with injuries as -- tornadoes touched down in just 24 hours three of them hit. this is a look at the damage in mobile home parks in toller, texas. less than an hour outside of fort worth. >> it's horrible. it's -- it's sad. to walk outside, to all of this was very emotional. >> imagine that. houston a rain there expected to fall through the weekend and the city is already calling in extra firefighters to handle any potential rescues. we have traffic and weather together every ten minutes. here's meteorologist vicki graf in severe weather center 9. much calmer weather where we are but a lot warmer too than we're used to this time of year. >> that's right. and that same storm system in the west is going to have an impact on our forecast here as we head into the weekend. but it's still several days away.

now is the warmth that weirding with this morning. it's -- we're dealing with this morning. it's 61 in mint hill and this is normally where our afternoon highs should be. for this time of year. it's 54 in boone and 58 in shelby. and 57 in lancaster. you don't have to worry about the heavy winter layers. maybe a light jacket in some of these cooler spots but throughout the afternoon, we'll be warming up quickly by the day 72 degrees and motorbike another good day to enjoy the lunch break outside and maybe go for a walk or run today. by 4:00 we'll be close to 77 degrees yet again. the difference is, we'll see more clouds as we go throughout the day. and it is going to be a little bit windy from time to time. your neighborhood forecast for elizabeth, some patchy fog is possible early this morning. it's not going to be a widespread problem though. and it won't last very long. then as we head towards midday, 72 degrees. and by 5:00, closer to 75 degrees. some neighborhoods close to

this evening if you do have plans, again a mild anything. cloudy skies by 7:00 but still @ upper 60s and by 9:00 63- degrees and might be a good night to open up the windows and enjoy some of that fresh air. but changes are on way. so we told you about this storm system yesterday. bringing some very heavy rain and strong storms across parts of the deep south. this is going to have an impact on our weather as we head into the weekend. but watch what happens. as i take you through futurecast very heavy rainfall across mississippi and alabama and louisiana. that goes until friday. they could see up to about a foot of rain. as it moves eastward though, it loses a lot of that moisture. a few showers are possible for us here friday night. by saturday, again, an isolated shower or two. but the best chance for seeing rain will be on sunday. and even then it's not going to be a washout. rainfall totals will stay fairly low and as of right now not concerned with the severe weather threat either. but we'll be watching the data as it comes in and up indict you as well and you can get the -- update you as well and you

the dow is up right now. charlotte city leaders told channel 9 there are no plans right now for any disciplinary action as they investigate a city councilwoman's choice for an intern. city manager ron carlee warned claire fallon the intern arrangement with marty pucket goes against the city's charter, carlee says it's unlawful and a conflict of interest. pucket is a cfd employee and the vice president of the charlotte firefighters' association. it shouldn't be an issue fallon says. >> they try to bully me and tell me i can't have this and i can't do this. oh yes i can. the people elected me. >> this letter prompted the

part -- she says that she asked her intern to help her forward this letter to council the city attorney and the city manager. city officials say attorneys are looking into whether any action will be taken. the fallon or pucket are violating city policy. we have learned the nation's largest banks paid federal fines worth nearly $110 billion for their role in the financial crisis of 2010. the "wall street journal" reports of that $109.96 billion, roughly $50 billion ended up with the u.s. government. the treasury department got nearly $49 billion of the funds. about $45 billion was marked for consumer relief. the justice department saw at least $447 million while states received more than $5.3 billion. defensive end charles johnson back in charlotte after turning down a deal worth double than what the panthers were paying him. all new and ahead the realization he had while visiting other teams. >> i'm tracking a storm that may try to ruin your weekend plans.

to reliance over the -- bradford over to reliance over to hoskins. but again the live pictures up in just a few minutes. checking out conditions for the major thoroughfares coming inbound independence boulevard. still looking good. no big issues heading up to the john belk and brookshire this morning. john? this morning, tonight a local group fighting the toll lane project on i-77 will share its research on private toll road projects across the country. eyewitness news reporter joe bruno is live along i-77 in cornelius. joe? >> reporter: right now the head of the ncdot is reevaluating the toll lanes being built after the governor sent him to texas to find out why a similar project failed. it could be weeks until we fiend out what ncdot secretary found out. but tonight, the group fighting the project will give an evaluation of it. widen i-77 aholding a news conference to discuss -- is holding a news conference to discuss bankruptcy and failures.

struck a deal with the i-77 mobility partners to pay up to $12 million per year if the project isn't making enough money. i also obtained report that shows the developers expecting to make $5.1 million in 2018 when the project opens. in 2019, that number jumps to $24.6 million. and in 2020 it goes even higher. $34.5million. toll critics say it will be nearly impossible for the project to make anywhere close to that because of all the backlash. now the tolls have not been set yet. but ncdot says that it will likely be 14 to 40 cents per mile. reporting live in cornelius, joe bruno, channel 9 eyewitness news. thank you joe. count on channel 9 to follow every development out of tonight's meeting and we'll bring you deplete coverage on eyewitness news -- complete coverage on eyewitness news at 10:00 and 11:00. happening today a suspect accused of robbing a charlotte pizza delivery driver two weeks ago will be in court for the first time. yesterday, our cameras captured

rhodes into the mecklenburg county jail after officers found him in shelby. rhodes is accused of kidnapping the delivery man at gunpoint in the cherry neighborhood and taking his on a long ride to steal cash. we told you two weeks ago police responded to a call at the papa john's restaurant on fourth street. the staff told them they had not heard from one of their drivers. from that restaurant on fourth street, police later found the victim's car abandoned on baldwin avenue. the victim says the suspect kidnapped him at gunpoint and drove him to several atms up i- 85. he finally got away in arch dale nearly 90 minutes away. we reached out to the victim last night but he was not comfortable talking with us on camera. we checked and found rhodes has no prior convictions in north carolina. meanwhile police still looking for a second suspect. a female they believe helped rhodes commit that crime. charlotte-mecklenburg police have not made any arrests yet in a string of shootings tuesday and

west to east charlotte over the eight forehead. six -- hour period. six people were injured in the shootings which started on the gas station on the brookshire late tuesday afternoon. two women were upstairs when that shooting happened and they told us they were surprised that no one was hit. >> this parking lot is crowded. 24/7. but people are very fortunate that they did not get shot or hurt. >> now the next shooting happened just an hour later on the plaza in east charlotte. a woman was shot in the hand. police do not believe these shootings are connected though. the city's recent spike in violence has cmpd's chief asking the city for more officers. violent crime was up 18% in 2015. and it was led by murders. we sent out breaking news alerts following all of tuesday's shootings. you can sign up for those at wsoctv.com you'll be the first to know when news happens in your neighborhood. time now is 5:34. and happening today, u.s. senators will vote on a plan to

the bill authorizes programs to prevent prescription drug and heroin abuse. and give first responders greater access to drugs like naloxone to reverse overdoses. this morning three senators will give floor speeches criticizing republicans for blocking a democratic amendment that would have added $600 million to the fight. tomorrow night, abc's 2020 will air a special called breaking point -- heroin in america. it will look at several families struggling with heroin addiction and a lack of help. the special airs friday night at 10:00 right here on channel 9. some residents say north carolina's new sales tax is confusing. businesses like car repair shops started charging customers more for the work but analysts in the state legislature say it is created an uneven playing field between those who work in a store and those who work in ungenteelly. service process sided by those who -- provided by those who don't work for a certain business are not taxable.

calls about unfairness and the confusion. to see a breakdown of north carolina's new sales taxes, and how it will impact you, go to the website. wsoctv.com and scroll over to the news tap and you will have a link that says taxes. happening today, congresswoman al ma adams will make a campaign announcement and told us last night is that she will speak to her supporters at 11:00 this morning at first ward park in uptown charlotte. she didn't say what it will be about though. adams currently represents district 12 and is up for re- election. last month, district 12 was drastically changed when lawmakers redrew congressional district maps. the district is now a big chunk of mecklenburg county which is about 100 miles from adams' home in guilford county. discould be grocery chain food lion will give the local locations a facelift. the president met with reporters yesterday at the store in charlotte's neighborhood and she announced

the redesign effort. the local company wants its locations to be easier for customers to get around while shopping with a fresh decor. >> through this investment, our customers will have fresh, new store signs to be easier to navigate so customers can get in and out and on their way. >> construction at 40 of the 142 stores is already underway. and food lion expects the project to be completed at all locations by october of this year. the chain also announced plans to give second harvest food bank $1.5 million to help with the group's warehouse expansion project. this is a look at what the facility is expected to look like. you can see images of both inside and outside the facility. second harvest worked to feed people in 16 local counties. right now following a record season the carolina panthers are seeing players put aside money to stay with the team.

he signed a two year deal instead of signing elsewhere for more money. he said in a conference call yesterday he left some money open the table but called the panthers his family and says family doesn't leave each other hanging. the team also announced yesterday defensive end charles johnson resigned for a one year deal. the carolina panthers said on their website johnson did interview with several teams almost becoming a giant. johnson asked the team's general manager if he would leave the team if another club offered more money. gm said he wouldn't trade his experience that started as an intern there for anything. johnson said it was that conversation that ensured him he had to stay with the panthers because they're his family and they couldn't imagine being anywhere else. the team drafted johnson in 2007. now the parent -- panthers currently have 11 straits that includes cotchery -- free agents that includes -- also corner back charles tillman. you can stay up-to-date on the panthers and those 11 free agents by clicking on the web

go to the sports section and click on the carolina panthers' tab. we have traffic and weather together every ten minutes. here's meteorologist vicki graf. just how warm it is. >> it's already a warm start to the day and this is going to be the trend as we go throughout the afternoon. we're in the upper 50s to low 60s right now. this is normally where we see the afternoon highs this time of year. and this is going to be the springboard for what will be another warm day ahead. close to 80 degrees in some spots. now as soon as you step outside, you will notice some low clouds and a little bit of patchy fog going through the day we'll keep the clouds around today. but that's not going to be stop us from -- to stop us from warming up quickly. by 4:00 close to 77 degrees here in charlotte and also going to be windy throughout the afternoon. taking a look at the threat days the main concerns we're going to have right now allergies. if you're sneezing, sniffling, it's all thanks to the high pollen counts and that's going to stick around thanks to the strong winds from the southwest anywhere up to about 20 miles per hour throughout the day today.
