we've got three days now until that debate on nbc and msnbc. perhaps the most watched debate in the history of american politics. >> this is a big weekend for the candidates. we'll have more on politics in a moment. but our top story -- charlotte. this new wave of protests there. for the first time a curfew was in effect overnight. did it work? nbc's gabe gutierrez has the very latest for us again this morning. hi, gabe, good morning. >> reporter: savannah, good morning. this night was much more peaceful. the mayor imposed a midnight to 6:00 a.m. curfew to try and did not strictly enforce it as long as protesters stayed peaceful. they did. so while the violence has eased, now the debate is raging over whether local authorities should release videos of the death of keith scott. [ crowd chants ] >> release the video! >> reporter: for the third straight night demonstrators took to the streets in charlotte but overnight no major violence while national guard troops moved in with only sporadic clashes with police in tactical gear. some protesters briefly closed

two officers were hurt. but unlike the past two nights when violence flared, this time, marchers were mostly peaceful, some showing appreciation for the national guard. officers choosing not to strictly enforce a midnight curfew. >> everybody continues like it is and it's peaceful, we can do this all night long. >> reporter: still, there was raw anger over the death of keith lamont scott and city officials' decision not to immediately release the video of the shooting. scs view the videos privately. the family's lawyers said they were inconclusive. >> we know the story that's been put out by law enforcement. they're saying that they found a firearm. there appears to be an object in his hand, but it is impossible to make out exactly what that object is. >> reporter: this member of the police union disagrees. he says he's seen one of the dash cam videos. >> mr. scott came out of the vehicle as ordered by officers but he had the gun in his hand. being ordered to drop it, he refused.

an eyewitness appears to show a gun lying at scott's feet immediately after he was shot. a police source says it's genuine. >> if there's an encounter, you go down and the weapon's right there, it's kind of obvious that a weapon was involved. >> reporter: some eyewitnesses insist there was no weapon, that scott was carrying a book. >> i think he was confused. i think that he was having commands yelled at him from multiple angles. and at the point he is shot, his arms are down and he's actually steppingk. >> reporter: and after seeing these videos, you are calling for it to be released? >> yes. the family is calling for it to be released. and i support the family 100%. >> reporter: the police chief has said to not expect that video to be released, citing the ongoing police investigation. he has said that a gun was found at the scene. but he says that the video shows no definitive proof that scott was pointing any sort of weapon at the officers.

you. >> gabe gutierrez in charlotte for us, thank you. we also have major developments overnight in the police involved shooting in tulsa, oklahoma. prosecutors have now charged officer betty shelby with first degree manslaughter in the shooting death of terence crutcher. she turned herself in early this morning and was released on a $50,000 bond. court documents say shelby reacted unreasonably and became, quote, emotionally involved to the point she overreacted. crutcher was shot as he stood beside his suv. 46 days to go until the presidential election. hillary clinton and donald trump will both take a break from the trail today. they are gearing up for monday night's first debate. >> tim kaine, clinton's running mate, will host an event in texas, while her daughter, chelsea, spends a second day in michigan. we'll talk to chuck todd about where things stand in a moment. but first, nbc national correspondent peter alexander sets the table. peter, good morning. >> reporter: willie, savannah, good morning to you. this debate is going to be a blockbuster.

today and through the weekend preparing for that match-up. donald trump with a more laid-back approach. in fact, he's going to be adding a rally tomorrow night in virginia, barely 48 hours before that match-up on monday. but overnight he made new headlines, in effect implying that hillary clinton shares responsibility for the unrest, in his words, that's afflicting our country. three days until the first in philadelphia, donald trump came out swinging. >> hillary clinton does not have to worry about the sirens and the gunshots at night. she doesn't worry about it. she's sleeping. >> reporter: in fact, clinton aides say she was working, including calling charlotte's mayor to discuss the recent police shooting and protests, and offering assistance. earlier in pittsburgh, trump pointing to the role he says drugs played in this week's violence. >> if you're not aware, drugs are a very, very big factor in what you're watching on television at night.

addressing the unrest in charlotte. even as our latest polls show clinton fortifying her lead of six points nationally, her critics are pouncing on a comment this week, suggesting overconfidence while highlighting her pro-union positions. >> having said all this, why aren't i 50 points ahead, you might ask? >> reporter: trump, answering on fox news. >> because she's terrible. i mean she's had a terrible record. everything she touches is bad. i mean, iju >> reporter: both camps gearing up for monday night's debate match-up. this weekend, trump will huddle at one of his private golf clubs prepping with top advisers, including chris christie and rudy giuliani. the candidate not doing mock debates, according to aides, sounds confident. meanwhile, clinton's preparing for the different trumps that might show up, a senior adviser says. with her running mate offering his own prediction. >> you're going to hear donald trump doing a lot of trash talking. >> reporter: and president obama

>> be yourself and explain what motivates you. she's in this for the right reasons. >> reporter: overnight we are told that donald trump spoke with the republican governor of north carolina about the situation there. a couple other notes about the debate on monday night. a clinton campaign spokesperson confirms that chelsea clinton will be in attendance on monday night. still unclear if the former president will be there or just within the last couple minutes i was told by the trump campaign that all of donald trump's children will be there, including his yost barron, and his wife, melania, will also be in attendance monday night. willie and savannah? >> peter alexander outside trump tower here in new york. peter, thanks. let's bring in chuck todd. good morning. as you know, hype is always really big around a debate but in this case it is warranted. isn't it? you have two very unpopular candidates who are going to have a huge audience and an opportunity to really change impressions that people may have about them. >> absolutely. even though there are three

is going to have outside influence. i think including the fact that the clinton campaign in particular i think believes this first debate is so much more important than any others. because if donald trump somehow comes out of this first debate seen as presidential, then all of a sudden there's no way of changing the trajectory of this race. i think the clinton campaign, in particular, views this first debate as a huge opportunity to try to put trump away early. >> chuck, let's talk about debate prep. about a year t donald trump prepared for his first primary debate, he was asked what he was doing for preparation. he said, "i am who i am. i'll do what i do." he actually mocked mitt romney for overpreparing for debates. >> right. >> can he get away with that theory and that philosophy in this big debate on monday? >> we're going to find out. i don't know if he can. i think there is no such thing as too much prep in this case. but in talking with folks close to him, they say you know him. he's not comfortable with scripted sessions. he's not comfortable with a lot

he is a reaction kind of guy and he thinks that that's his appeal and he truly believes that. so they're not going to do that. instead, one of the things to watch today and through the weekend is how both campaigns are almost trying to influence the conversation that takes place during the debate. so for instance, later this morning, i've learned that the trump campaign is releasing a new set of potential supreme court nominees, including republican senator mike lee of utah, all in an attempt to make sure that issue is brought up, because they think that rallies republicans. is putting out an ad, featuring all of the horrible things donald trump's been quoted saying about women. why are they doing that this weekend? trying to influence that topic and get that into the debate. >> and to say nothing of the expectations, game playing that goes on with both campaigns certainly before. chuck, thank you very much. we know you'll have a lot more sunday morning on "meet the press." chuck and i will be at that debate. we're going to cover it live on nbc. of course it is moderated by our

monday night right here on nbc, 9:00 eastern, 6:00 pacific. now to the latest in the investigation into those bombing attacks here in new york and in new jersey. police say this exclusive surveillance video shows the suspect, ahmad rahami, planting his second explosive in new york city. later, two men unload the suitcase and the pressure cooker bomb is dropped on the street. dozens of people passed by. one man even kicks it over. investigators say they found 12 sets of rahami's fingerprints on the device. meantime, rahami's father tells "the new york times" he warned authorities two years ago about his son's behavior and to, quote, keep an eye on him. now to a former congressman under fire this morning. anthony weiner is facing an investigation for allegedly sharing inappropriate text messages with an underaged girl. according to law enforcement sources, the case is in its early stages and includes a subpoena for wiener's cell phone records.

weiner said, quote, i have likely been a subject of a hoax. i have no one to blame for me for putting myself in this position. let's bring in ari melber, msnbc's chief legal correspondent. good morning. >> good morning. >> what exactly would federal investigators be looking for when they subpoena this stuff? >> they will be looking at his phone records and to see whether these allegations are true or whether there are other allegations of contact with minors which could be a very serious offense. >> they could cast a wide net, not look just at these phone records at issue with this particular individual but potentially see the whole record there? >> yes. they can go widely and look at the records, the contact, the data, what sometimes is called meta data, all those extra things that appear on anyone's phone. the law doesn't care much about what consenting adults say to each other. it cares a great deal about what adults may say to minors. >> would an investigation also include trying to contact this individual? >> that's possible. we don't know this morning how the feds are approaching this and how wide a net they will

but under federal law, if there is the belief that any individual used the internet to contact a minor for the purposes of any kind of sex crime, that can carry ten years to life. >> so it's interesting to see law enforcement agencies falling over themselves to look into this. the d.a. wants to look into it, the u.s. attorney, federal investigators as well. what would constitute a criminal charge in this case? >> in new york, under the law here, basically you have to have something that amounts to more than speech. contact with a minor and trying to get them to do something. but that can be at a distance. under federal law, it's all about whether there was basically an attempt to lure a person, a minor, or get them to go across state lines for the purpose of any type of sex crime. but, again, that doesn't mean that it has to be something physical or serious. it can just be anything that is not allowed with a minor. that's why this type of charge -- we don't know all the facts yet -- but this type of charge to even be investigated

out. ari, thanks so much. now to a dramatic showdown playing out 15 years after 9/11. today, the president is expected to veto a bill that puts it at odds with the families of many who perished that day. nbc's chief foreign affairs correspondent andrea mitchell at the white house this morning. good morning. >> reporter: good morning, savannah. well, few things unite bitterly divided democrats and republicans like respect for 9/11 families. and now as one of their final acts before the election, members of both parties are expected to join together and veto by president obama, siding with some 9/11 families who say that saudi arabia helped bank roll those attacks on their loved ones that that now deserve their day in court. 15 years later, these 9/11 families still say no one has paid the price. >> right now it looks like they're protecting a criminal enterprise. >> reporter: now turning their frustration toward president obama, who today is expected to veto a bill passed unanimously

families to sue saudi arabia over its alleged support for the 9/11 terrorists. >> we have evidence, we have plausible evidence. >> reporter: terry strada has been trying to get the bill passed for years. her husband, tom, killed just three days after the birth of their son. >> i've been teaching my children that their father, his lesson in life was do the right thing. and this is doing the right thing. >> reporter: all but 4 of the 19 hijackers were citizens of saudi arabia. but in 2004, the 9/11 commission found no evidence that the s government as an institution, or senior saudi officials individually, funded the attacks. still, some lawmakers are skeptical, including new york senator chuck schumer who co-sponsored the bill. >> if the saudis were not involved, they have nothing to fear from the legislation. but if the saudi government was involved, they should pay the price. >> reporter: saudi arabia has spent more than $5 million lobbying against the bill, which would change a 40-year law that limits american lawsuits against
