florida's system is unconstitutional. that's because it wrongly gives not the jury when it comes to whether a killer should be executed. and the jury's recommendation for the death penalty-- unanimous. 10 news reporter digging deeper into the decision. governor rick scott is still looking at the supreme court's drastically change florida's death penalty system. the ruling came down from the court - at the start of the 2016 legislative session saying: juries, not judges, should decide whether a defendant should be executed. attorney general pam bondi says she'll work with lawmakers to make the court-required changes... but says the impact on existing death sentences will need to be evaluated on a case by case basis. mother barbara freiberg wants to see edward covington put to death for

grandson and granddaughter... and hopes the court's decision won't halt it. covington waived his right to a jury trial - and asked the judge to sentence him. there are 390 inmates on death row in the state right now... of those convicted killers... the doc says 96 inmates are from the bay area. death penalty opponents have been pushing for change... protesting outside oscar ray bolin's execution.. the first in the state this year.. put to death after murdering three bay area women. herman lindsey spent more than a year on death row before the florida supreme court overturned his conviction. he and aclu leaders want florida's death sentences - converted to life in prison. kendra conlon, 10 news, wtsp timothy hurst's case out of

death penalty law. the jury voted 7- to-5 in favor of death-- after convicting him of murdering his boss in 19-98. florida carried out two executions-- despite the "pending supreme court ruling." we're one of only three states that allow judges to override a jury's suggested sentence. right now the crews of two us navy ships are being questioned in iran. it happened after the pentagon briefly lost contact with the vessels in the persian gulf. officials say the boats were traveling between kuwait and bahrain when "one of the boats" had mechanical trouble. it ran aground near the iran-held "far-see island." iran says the "u-s boats and 10 crew members" are expected to be released today. this comes only two weeks after iranian ships "fired off rockets" in the middle of crowded shipping lanes near an american aircraft carrier. new information about a deadly shooting inside a "wesley chapel movie theater." you may remember former tampa police captain curtis reeves, shot and killed "chad oulson"-- during an argument over texting. now-- oulson's widow is suing "cobb theatres" -- and a theater employee -- claiming they didn't enforce the

prohibition on weapons. the suit alleges-- that as a direct result of the defendant's negligence, chad oulson died -- and nicole oulson suffered permanent physical, psychological and economic damage. a convenience store owner is behind bars today-- after police say he abused the "food stamp system" for years. police say he used 1-point-6-million dollars of your money. st. pete police discovered "wail mari"-- was paying up to 50 cents on the dollar for food stamp cards. he would use them to buy items at warehouse stores and then sell them at his king food mart. police also arrested retailers who purchased mari's items-- and those who sold their e-b-t cards to him. new overnight...if you thought finding a parking space on anna maria island was tough...it just got tougher. the city of holmes beach commissioners voted 3-2.. in a first reading, to require a parking permit along a 17 block stretch beach. only property owners are eligible. police will issue violators a 35 dollar ticket... and will re-ticket every 2 hours. adjustments made

one mother is considering legal action against a nurse she claims hurt her son. that tops the look at our headlines around the nation and the world in 60 seconds. a mother in new mexico is furious after she says a nurse cut off her son's toe. the boy was born prematurely last april -- and has faced a number of complications since then. last month, a nurse accidentally cut off his left pinky toe while cutting tape... that was holding an i-v in his foot. the woman and her husband are considering legal action. a recall alert for walgreens stores across the country. eight ounce jars of "nice!" brand mandarin oranges... have been recalled after complaints that glass shards were found inside. at least three people found glass -- one person was injured. the jars have been nationwide. but if you have the oranges at home -- your best bet is to throw them away. and in ohio... a fugitive is leaving may help police catch him. donald chip pugh didn't like the wanted poster they're using to find him. so he sent police a selfie -- with the

were surprised by the study, but say the results shouldn't be taken out of context. sot/26:10 "this is something i do very rarely, so no, it doesn't affect me." scientists acknowledge that it's difficult to compare the two forms of smoking and draw a conclusion as to which poses the greater risk because people smoke in different ways. in the meantime, scientists warn, as with everything in life, it's buyer beware. in ybor city, charles billi, 10 news wtsp. the bay area is one step closer to getting a high speed ferry from tampa to saint pete. mayor rick kriseman got pinellas commissioners to hop on board and earmark 350 thousand dollars to help pay for it. the pilot project requires equal funds from tampa, saint pete, pinellas and hillsborough counties to move forward. the tampa city council is the last piece of the puzzle. mayor kriseman hopes to get their approval soon.. so he can start negotiating with the ferry service. tampa mayor bob buckhorn has said he likes the idea.. but wanted more details. if everyone agrees to a deal, the ferry service would start in october of this year and go through april of 20-17.

seem to get enough of this baby otter taking a nap on its mom's tummy. this is at the monterey bay aquarium -- in california. the mother otter sought refuge in the aquarium's "great tide pool" last month -- and gave birth shortly afterwards. the mommy otter was feeding and grooming the pup. staff say the wild otters can stay as long as they want -- but they will eventually leave so the mother can forage for food. coming up on 10 news this morning...there are 17 hours left to get in on a chance at more than a billion dollars. the numbers for the largest powerball jackpot will be announced tonight!
