is checking out the secret sister exchange and why it's proof that you can't trust everything you see on social media. >> reporter: yeah. you log on to your social media account and believe me, you will be able to find someone sharing the secret sister gift exchange. add your name to the list and pick one person, send them a $10 gift and you are supposed to receive gift after gift after gift after gift. some say 36 gifts in me cases. that was too good to be true. it is. it's a hoax. hoaxes like these date back to the days when people used to send letters. whatever that is, asking for money, and in return you get cash as well. on top of that the secret sister gift exchange is also illegal because remember that letter, those chain letters? they are illegal through the united states postal service. they look at it as a form of gambling and the secret sister gift exchange is a form of a

facebook or some other law enforcement agency removing it from social media sites? >> the responsibility ultimately falls on the users to what information they are going to post. so there is no responsibility on the social media site to block that. again, it's up to the users, what they are willing to share. >> we posted this story on facebook. sure enough, there are some of you who have tried gift exchanges like this and >> emily is one of those individuals. she says that she did this for a children's book exchange. sent out six books in exchange. nothing for her kid. nothing. >> and there are other comments from you saying that you participated in gift exchanges right now that seemed totally legit. >> even if the hoaxes seem harmless, it can hurt you in the end, even if it's $10. it really can hurt you in

you might have seen it online over the last few days. yelp has started to include health inspection summaries for certain restaurants across the state. >> so now when you go check out reviews, menu or prices for a restaurant, you can also see if they passed their latest inspection. >> a good thing. maybe a bad thing in some cases. >> you can't get bo zimmer all the time. >> i do always call bo. >> here are a few things you inspections. t.j. says i am all for it. most other states require it to be posted by law. if they are a reputable place, they wouldn't have any issues showing it at all. >> mark says no food service gets away with no inspection violations. if there aren't any, then the inspector isn't doing the inspection properly. >> so how will this change your view of local restaurants? would a bad inspection stop you from going to your favorite place to eat?

lunchtime to see what impact it would truly have. >> reporter: downtown st. petersburg is a booming area with lots of restaurants to choose from. yelp employees are probably busy adding health inspections to all of their reviews. will you take the time to check them out? i hit central avenue downtown to ask some customers. why is that important to you to see a restaurant's health inspection first? >> well, i want to know that the environment is clean and i am not going to get sick as a >> reporter: yelp has posted the health inspections. do you think that's a good idea? >> i think that's an excellent idea. >> i think that should be on there, yeah. >> yes, i think so, because that proves the quality of the restaurant. >> reporter: so if they had a few things wrong, would that dictate whether you go in or not? >> if they were minor. but if they looked like they failed the food inspection that , would concern me. >> yeah, definitely to some degree. i wouldn't take it too seriously maybe for just minor

definitely. >> more information out there that might not be good for them? >> that's right. yes. >> almost no one knows health inspections better than bo zimmer. we watched your restaurant red alert. growing up in north carolina, the health inspections were clear. a, b, c, et cetera. you knew where that restaurant stood. in florida you have the reports. >> right. it's interesting because the state of florida does not issue a numerical even a pass-fail. they list the violations. they list out high priority violations, intermediate violations, and basic violations. >> even the best restaurants, do they have -- >> most restaurants are going to average 10 to 15 violations. i would see a restaurant that has 15 basic violations than one that has four or five high- priority violations because those are the ones that have the greatest probability of making someone sick sick.

>> right. but even some of those. hand washing issues can be a high priority violation. the state wants to make sure that employees are washing their hands. so they look at the ones that have the probability, the greatest probability of making someone sick and those will be high priority. >> okay. the other thing we should talk about is the fact when it comes to looking at these in a yelp review, if i don't know how to read a report, i am not going to understand that. does the state of florida really need to change how things go? >> that's one of the restaurants' arguments, is that these just a snapshot in time, and if you are taking a look at this on a bad day, that could really hurt the restaurant's reputation for a long time. >> and sometimes we see in your reports where you go back a couple months later and things are fixed. so who then -- if i am looking at the report from may and it's now july and things have changed, whose responsibility

weekly basis. now it's gonna be up to yelp to make sure that information stays up to date so you don't have an old report from six months ago that is still up. >> and this is not the first time that we have seen restaurants and yelp battle it out. you might remember the negative reviews, the battle over that. in fact, a couple months ago the house of representatives passed the consumer review fairness what's that? it prohibits businesses from suing you if you post a honest but negative review on a site like yelp. the senate has passed a similar bill. neither has been made into law. >> the only thing i worry about about health inspections, and i listen to bo zimmer, that green slime stuff that i know it's bad. other than that? >> in the ice machine? >> see, you know about it. green slime in the ice machine. we don't have to worry about

>> well, it's going to be close to 80, i think, by thanksgiving. let's soak up the cooler weather and get into the spirit and get the music playing. and everybody knows that this time of year we get it, obviously, and typically we get short bursts of it, too. especially this time of year. two days. three days tops. average right now is 78 for a high and 64 low. today we were 80 degrees. we were right on the dot as far as the low goes. take a look at october. j beginning of october was when the rainy season ended. 54 was cold for us. that was on the 23rd. we have not been that cold or cool, whatever you want to call it, since. we have had some 50s, yeah. but look at the forecast for tomorrow morning. about 62. sunday morning 49. 46 on monday morning. so this is where it gets the coldest. then we gradually start to warm

from. if you recently moved here, you're on vacation, you are on the beach. you have the swimsuit on out there. if you have been here maybe say five years or so, your blood is starting to thin a little bit, you are probably looking for the jacket, especially first thing in the morning. if you are a florida native you are like, forget it. put a fire in the fireplace when it's 40 degrees. it won't last long. it should be really nice out there and sunshine will warm us up a couple clouds today. you can see the sun setting. a little bit of smoke out there. you can see it in this shot over the gulf of mexico. the temperatures, we are talking about 40s in the morning. we are in the mid-to-upper 70s right now. it is fantastic out there. tomorrow morning upper 50s to near 60. that's not bad. that's about where we've been. as we get into thetic with, that's when the cold air -- the weekend, that's when the cold air gets here.

not by much. saturday evening 8, 8:30, 9:30, 10:00 a front comes through. 10% chance for a shower. you wake up sunday morning 48, 49 degrees. only in the 60s on sunday afternoon. i do got to mention the winds, guys, because they are going up saturday night into sunday. boating looks good for most of saturday. the afternoon and evening not good. sup i think we will have small craft advisories in the area with north-northwest winds to 20 to slow warm-up. tuesday and wednesday close to 80 degrees. and we asked you a minute ago what you consider cold. when do you bundle up? and you voted here. below zero degrees, 2% of you said that. that's fair. you should bundle up then. the winner is 20-40 degrees. >> that's where i am. >> i am 40-60. >> i am in between.

this situation? >> and no matter how long you think about it, you just can't figure out what you would do. it's not an easy answer. that is especially at the case in this story. >> a man in alabama is facing 40 years in prison. his crime killing the man who sexually abused his young daughter. >> that dad is facing 40 years in prison. the abuser -- >> the one that raped -- >> the young daughter served 27 months. just a little more than two years. a lot of that fair? 10news reporter and father of a young girl phil buck takes on that question. >> reporter: so many of the stories we talk about have two sides. it's rare we come across a topic that's true black and white. one of the things that makes this job so complex is not just looking at two sides of an issue, but that gray area in between where most of real life actually takes place. but this case is pretty clear cut, right?

reason. i mean, we can't just have vigilantes taking the law into their own hands. come on, man. you're a father. what if someone did this to your daughter? i know. i know. but murder is wrong, and two wrongs don't make a right. use your common sense, man. this guy is a sexual predator. murder is the right thing to do. in fact, you would be doing the rest of society a favor. but doesn't that set a dangerous precedent? i mean, if this guy is out there settling scores on other people in different situations? fine, fine. don't kill the guy. enjoy the rest of your life knowing that this guy hurt your daughter and after a couple years was on the street enjoying life as a free man. we did this to prove a point. the essence of the debate was still real. i am a father. i do have a young daughter. i was wrestling with some of these feels, as were so many people on our facebook page.

response. carol writes that this man shouldn't serve anytime whatsoever. the scumbag deserves what he g got. the law is the law. murder is murder. debbie would have done the same thing in his shoes. and erika says we can't take the law into our own hands. the law is the law. looking at some of the stats on these comments, we got 84. they are still coming in. as i said, it's a strong response to this story. nine people say he should be given an award. 12 said they would have done the same thing in his shoes, and 38 people say this man should not serve any jail time for the murder. pretty clear agreement from all of you on facebook saying the criminal justice system got this case wrong. guys. >> that's hard, you know, because having been on both sides. law enforcement officer and a

take a look at this video. you see deputy wayne wagner with a woman he pulled over in march. initially, she was charged after the deputy claimed she pushed him and snatched her license back. she filed a complaint. the schauf says the video revealed the deputy used excessive force and covered it up in his report. he made it clear that he doesn't take situations like this lightly. >> at the end of the day everybody, eia you don't tell the truth, you don't work here. it's that simple. everybody knows the rules. deputy wagner elected not to follow the rules and now he has to face the consequences of his actions and bad decision. >> we have contacted the victim's attorney and they are hoping to speak with her one on one coming up tonight at 11:00. hear what they have to say about the traffic stop and the deputy's firing. you probably remember getting that first job when you were a teenager.
