month. >> just the latest ia string of incidents, including one caught sleeping at the wheel of a metro train. sarah simmons joins us this morning. >> reporter: good morning. this bus driver was caught reading behind the wheel. a 13 year veteran and officials say he should have known better and policy changes could be on the way because of it. >> it's a little unnerving. >> reporter: captured we the iphone, a metro drivereading on the job. >> he was constantly reaching into the bag and pulling out a book and reading and then when traffic would move s he would keep the book there and -- continue looking down. >> reporter: one person captured the picture during the evening rush hour commute. the bus was filled with 20 passengers and it was raining. >> all of our safety is in his

hands. >> reporter: nothing bad happened while on the bus, but this is troubling in the wake of the metro crash that left 9 op epledead. the driver there was not at fault. but this is the latest photo of metro drivers caught breaking the rules. a 14-year-old boy captured a train operator sleeping on the jo while his train sped along the green line. june 5th, another metro driver caught texting. this was the latest brought to the metro's attention. yet the metro -- metro says the driver will only get a reprimand. >> is that strong enough? >> that is what the policy is right now. >> reporter: and the policy right now is four strikes and you're out. >> it's the lack of accountability on the metro.

>> reporter: the transit authority just passed a zero tolerance policy for using your cell phone, using a pda or texting behind the wheel. at this point metro says that does not cover it. there is a possibility there could be policy changes coming, but metro officials want people do send in the photos so they can address the problems -- and try to make changes. steve. in boston, a former subway operator accused of causing a crash because he was tempting on the job appeared in court yesterday. he pled not guilty to charges of gross negligence by a person in control of a train. more than 60 people were hurt when the train slammed into the back of north trolley in may. a cultural exchange lands some group of 17 u.s. students in quarantine.

examiner testifying he found wounds on the oldest daughter that led him to believe her death was a homicide. banita jacks told the judge she believed her deceased boyfriend was jesus christ and her children were possessed by demons. now to the faceoff over health care reform. the president taking a swing at his critics as concern grows about the cost to you. today the president meets with key house democrats on the energy and commerce committee and the only one of three house panels that have not passed some sort of reform legislation. under the bill passed by the ways and means committee last week, taxewould increase for couples making $350,000 and individuals making $280,000. but nancy pelosi has a proposal

montgomery county, looking good at the american legion bridge. volume on the outer loop as you head around from 95 and college park into silver spring and bethesda. outer loop heavy at this point. and prince george's county at route 5 branch avenue the left lane is blocked with a disabled vehicle. no problems across the woodrow wilson bridge but seeing slow traffic on 66 eastbound from route 29 in gainesville past the visitor's center in manassas. that's a check of your fox 5 on- time traffic. well a boost for some road projects in virginia as governor tim kaine says the commonwealth has received more than a billion dollars in funding for infrastructure projects. the governor said $123 million went to highway safety and the rest toward bridge replacement and repairs and sewage plant projects. virginia is expected to receive a total of $4.8 billion in stimulus funding. however, you're going to need to keep this in mind the next

time you head out on a road trip in virginia, because beginning today 18 rest areas are shutting down for good, including a few along i-95 and one along i-66 in manassas. and that's why sky fox is right now. take a look. to left of your screen, the eastbound rest stop closed at midnight. they have the signs up blocking the exit lane. the westbound welcome center will close in september after the summer travel season. it is a cost-cutting move expected to save the state about $9 million a year. virginia is close to $2.6 billion in budget shortfalls. there is a full list of the rest areas that are closed on myfoxdc.com. just look under web links. well you can forget about the tax holiday in the district next month. the d.c. governor is canceling the august tax-free week. in the past it had allowed customers to buy items under $100 without paying sales tax but as will thomas discovered, ghe city i ha

virginia, was killed in combat outside of new delhi. he join the the marined back in 1994. he leaves behind a wife, a daughter and soon to be born son. he'll be buried at arlington on thursday. robert gates increasing the size of the army by up to 22,000 soldiers temporarily, the increase is meant to help ease the strain of wars in afghanistan. gates says the increase won't create new forces but will help commanders in the field and families back home by reducing the pressure of multiple rotations. the endorsement for bob mcdonnell in virginia as sheila johnson is now backing mcdonnell. johnson has donated money to tim kaine for the past nine years but she's given $15,000 to republicans as well. coming up next on fox 5 morning news. we're breaking down the battle

a couple ticks away from 7:30 and a time for a look at our top stories. a metro bus driver caught reading a book behind the wheel has got a light punishment. he was caught in the act by an editor for the washington examiner. it happened last month while the bus was in stop and go traffic. right now the transit authorities rules state that a bus operator caught reading the first time will get a written reprimand. and would have to be caught tro says it is taking another look at the reading policy. several washington area police officers stand accused of using their badge to protect an illegal gambling ring and ny are accused drug dealers. prince george's county police confirm the fbi is investigating and says none of the targets are on patrol duty and no one has been fired or charges. according to the post, two of

year and individuals making $280,000 a year. but house speaker nancy pelosi has a proposal to limit increases to couples making more than a million dollars and individuals making more than $500,000. that coming as the president is set to meet with other house democrats today. now for more on the health care debate we're joined by the white house reporter from congressional reporterly. does the latest push by nancy pelosi to change the limit, will that have impact. >> i think the president is getting pushback from the members of his own party in the house and senate. they're concerned about the price tag, a trillion dollars or morettached to some plans circulating in congress and the time frame. he said he wanted to get -- he wanted to get bills passed by august and now is pushing back and you think if there is more friction we'll see this debate go on into the fall. >> does that mean more concessions on the president's part?

>> i think they are accepting that but how far will it go from the orangeal goals which were to cover all 47, 48 million uninsured americans and that has a plan over 10 years pays for itself. getting the math right is because he wanted to make it responsibility and not creating a burden that is own -- onerous for grandkids. >> how does he win over the conservative democrats that are opposing to spending. >> it becomes a number debate more than a debate about coverage and the uninsured. there is a social imperative like this but this is becoming a budget debay or economic debate. he's trying to make the case that without a plan that pays for itself, you can't build a

sustainerecovery and you have to have price controls, get extractions from insurers and drug makes to make this work. and so i think he's trying to make this an economic debate. >> it seems like that is the big question that comes up among a number of people who may say well the government is proposing to put all of this money in but we still have the issue with the insurance companies, its drug makers and hospitals. are they willing to play ball here? >> some of them have made nonbinding concessions saying we, the drug makers and hospitals are going to extract x-number of billions out of the health care efficiencies. i don't think anyone disagrees with slimming it down. but if you're leaning on the providers to make all of the concessions and extract all of the efficiency, there is another part, you have to raise taxes and that is where it becomes a big political debate. >> michael steel, speaking on

behalf of the republican party has called this an experiment on the president's part, saying that you need to make some other changes here, perhaps saying that the whole thing is going to slow the economy in many ways. how do you -- do you counter that argument as opposed to what he's trying to do within his own party. >> what the white house is saying is that republicans lost the two most elections -- recent elections badly and they're trying to keep a broken system that is pricing more people out of the market and making american families vulnerable and they're trying to portray the republicans as stuck in the mud and the republicans are saying what obama is doing is assist in a government run health care system. >> and for those that don't have health care and aren't able to get the coverage they need, if any plan does go through, whether by august or

home. this happened after massachusetts police received a call about two black males breaking into a house. he claims the arrest was race- based. ted daniels has the story. >> reporter: henry grates, jr., handcuffed on his own front porch. at rest of the 58-year-old scholar has this neighbor and admirer alleging racial profiling. >> if it was me, trying to get into that house, i don't even live tere, i can guarantee you nobody would have called the police. >> reporter: according to this report, cambridge police were called to 17 ware street after a woman s a man trying to break open the front door. when they arrived, gates refused to identify himself as the homeowner and yelled quote, this is what happens to black americans and quote, you don't know who you are messing with. >> he should have given his identification. this would have never happened with him saying this is what happens to a black man in america. >> reporter: through a statement released by his attorney, he says he told the

past georgia avenue, delays on southbound 95. that's a check of your fox 5 on- time traffic. another metro operator caught in the act. a bus driver now reprimanded for reading a book behind the wheel. but this morning some people are ndering if the punishment fits the crime. sarah simmons joins us live from metro headquarters in northwest d.c. with more on the story. >> reporter: some of the riders are not happy with the reprimand. it was a written reprimand. and some people say here is a bus driver behind the wheel reading a book with 20 passengers on the bus. and the man that took the photo says it was rush hour traffic and raining outside at the time. this happened last month on the 42 route. the bus was in stop and go traffic on connecticut avenue between k. street and l. street. the picture shows the bus driver reading a book while driving. the rider, jp freer, the editor with the washington examiner,

sitting next to the driver and took the picture with his iphone. >> i noticed that the bus driver was constantly reaching into his bag and pulling out a book and reading and then wn traffic would start to move a little bit -- bit more he would look up and continue looking down. >> is reprimand enough for this type of behavior? >> it's what the policy is in place. it's something they want to look at down the road and in terms of possibly changing the policy. >> reporter: now remember, the transit authority passed last week a zero tolerance policy but that was only for texting using your cell phone and pda, that type of thing. in this case they say the man was reading a book. so it's a different policy at this point any way, so he will only receive a written reprimand. but it is something they'll continue to look into. and by the way, metro officials are encouraging people to send in their videos and photos of people doing things, employees, drivers doing things they think

may be wrong. they want to look into it and address the problem and make changes if need be. steve. >> sarah simmons, thanks very much. and apparently more and more drivers are distracted while behind the wheel as the new york times is reporting that the national highway traffic safety administration chose not to release documents out of fear it would lose federal funding. but here is what they found. researchers found cell phone use in 2002 was tied to 955 deaths and 240,000 accidents. and the research shows hands- free devises didn't help drivers concentrate any better. it found drivers using cell phones were four times more likely to crash. heads fun -- up if you're driving through the state of virginia. state has closed rest areas hoping close budget gaps. one is on i-66 in manassas and the others on i-95 in dale city. this is what you can expect to

which does this course, the riders edge academy of motorcycling. and one of the big things about motorcycles is that people are afraid that they're not safe. and so it must make the mva feel good there is a course like this out here? >> yeah. maryland has one of the top five motorcycle safety programs in the country. we operate 17 training centers across the state and harley- davidson is one of our training center. it's licensed and approved by the mva and individuals completing this course can earn their motorcycle license. and also this course is accepted by the district of columbia to waive the riding portion of the test. >> reporter: i want to bring in scott because he's one of the instructors. and obviously safety is paramount. give us an overview of some of the things you learn in the class. >> so like a car, you have an accelerator. you have a hand brake and a

foot brake, which is a lot different than a car so it takes coordination and you have a clutch lever and a gear shifter. so you're doing things with all parts of your body at one time. the skills yo learn is a good foundation to do things like the people are doing out here riding around right now. >> and we're seeing them ride around in a parking lot but they're doing certain drills. >> you'll see someone coming into a braking drill and use both brakes and use them smoothly. and we also have an exercise where there is a swerve, if you're doing over 18 miles per hour, is the safest way to avoid an obstacle. it's safer than trying to stop. >> reporter: do you find that most people find it's easier to ride a motorcycle than they thought or more difficult than they thought. >> if they take this course, they find it's easier. you don't get any bad habits and gives you good foundation so you don't -- when you learn some somebody that hasn't been riding for a long time or for a
