damaging winds and torrential rain by mid afternoon. so be prepared for the possibility of strong thunderstorms later today. and here is your forecast: mostly cloudy and showers and thunderstorms moving in and some of those could be strong. high temperature a little bit cooler than yesterday. 87 degrees but plenty of humidity across the area. i'll have more details on the all-important weekend coming p. and here is julie wright with a look at the traffic on happy friday. not good on roads in virginia. a accident in shirlington involving the over turned vehicle. that is out of the way, but in the backup there was another fender-bender and this tied up the right side of the road past duke street. the accident now confined to the shoulder as you travel northbound on 395. so expect delays north of edsel road past duke street and then the pace improves toward the 14th street bridge. no incidents at the american legion bridge. traffic is running smoothly on

the outer loop and inner loop toward fairfax. that's a check of your fox 5 on- time traffic. all right. the government's cash for clunkers program already needs a tuneup after less than week. the trade-in rebate program is running out of money. the ambitious program could be a victim of the own success. >> here is a snapshot of the fund website. it still has $79 million left but the number might not be right. and matt acland joins us live on our top story. it might be too successful, too many people looking for those cars. >> reporter: that's so true. allison and tony, i don't have to tell you guys, over the last year car dealerships like the one behind me have been basically dead. no one coming in to buy a car. but that all changed this week with this cash for clunkers program. so many people coming in trying to trade in their old car for a

new one. that $1 billion up for grabs made available by the government is starting to run out. we're told about $100 million has been released but there are concerns that other pending sales across the nation may require that the entire $1 billion be spent. car dealers across the country are cheering this move by the government. some are saying it's been a long time that they've had businesslike they're experiencing right now. you can trade in your old car or truck for a newer more fuel efficient vehicle and get $3,500 to $4,500 for your vehicle. >> it's getting great traction, the problem is they didn't estimate how well the demand would be for it. >> for the dealers it's gone

from helpful to chaos. >> the dealersships are selling 3 to 4 times more cars before this went into affect. >> reporter: i don't think the government realized the money would run out this quickly. in fact the white house is already responding saying that if a deal is in the works, if you've been to your dealership and filled out all of the paperwork, that there is a possibility that the government is going to find funding over that $1 billion. and we are also hearing, tony and allison, that on capitol hill lawmakers are already trying to find more money to support this program so more people with go out and take advantage of it. live in rockville, matt acland, fox 5 news. back to you. >> thanks, matt. it could cost more to drive, smoke and shop in the district. the d.c. council has agreed to raise taxes to close a $662 million budget shortfall over the next three years.

a final vote is expected today. if approved the sales tax would go up, and the cigarette tax would go up 50 cents totaling $2.50 a pack of cigarettes. and that total cost would now make cigarettes $7.50 a pack. d.c. is eliminated the tax- free holidays. the council has voted to repeal the august and november tax- free weeks now. the program helped consumers buy certain items that cost less than $100 tax-free. the lawyer appointed by the d.c. council to investigate marion barry in an ethics probe is getting to work. our cameras caught up with robert bennett as he made the rounds at the wilson building yesterday to talk with the council. he is investigating the hiring of his ex-girlfriend and contracts that awarded money to nonprofit groups that barry is associated with. the councilman has denied any wrong doing: we'll look at the probe and the tax hikes and the

elimination of the tax hollies when we sit down thwi d.c. councilman at large michael brown later this hour. another big story we're following this morning, many questions lingering about a fire at a multi-million dollar home in the district. flames erupted wednesday night in northwest. that home belongs to peggy cooper cafritz, former president of the d.c. school board. she wasn't home, no one was hurt in the fire. it took about 150 firefighters four hours to get the fire under control. their efforts were hampered by problems with water pressure. the mayor and other city leaders are launching an investigation. >> we view it would be wholly responsible less than 24 hours to be able to come uwith any conclusion that would say with any level of certainty that we know this happened or this didn't happen. >> fire officials say it will

probably be a week before we leaed what caused the fire. another distracted rival -- driver. a metro bus driver is accused of talking on a cell phone behind the wheel. inbound number 63 bus driver was found using her cell phone while driving. that's despite thnew zero tolerance policy. john catoe says he is embarrassed by the driver and plans to fire the employee. the washington post is planning that prosecutors plan to call a new witness against ingmar guandeke. this is said to be the same man that attacked others and stabbed them in the back.

until now we have only seen banita jacks in court. wednesday a judge convicted jacks of felony murder and cruelty. prosecutors say she lived with their bodies for months. jacks told investigators the girls just didn't wake up. >> when they didn't wake up, why didn't you go get help for them? >> because i knew that this was going to happen. >> what was going to happen? >> a bunch of trouble for me. >> and at no point in the tape does jackson admit to killing her daughters and said she could never hurd -- hurt a child. she faces life in prison. her attorney plans to appeal. several local students quarantines in china because of swine flu fears are back at

home. they arrived at dulles from beijing last night during a summer school trip. half of the 22 students and teachers got sick. some were diagnosed with the swine flu and had to be hospitalized but have all recovered now. >> i was only in the hospital for a day because i had a small temperature so they took me in. but they tested me and i was negative so they let me out again. but some people were in there for a week. >> at the end of the week we did a couple tours, we saw the great wall and all of that, but that's about it. >> there is suppod to be much more. >> but it was fun. they treated us good. >> some of the students did stay behind. they were all offered an extra week in china to make up for some of the lost travel time. schools across the d.c. region are preparing for possible outbreaks of the virus when students return to the classroom. loudoun county school officials are working with the county health department. during a meeting yesterday they discussed plans for how and

where to get school-age children vaccinated. there is the first of many meetings to monitor children. the house energy and commerce committee will try to complete work on the health care legislation before the august recess. last night they approved a democratic written measure specifying that abortion coverage would not be required as part of basic government approved insurance packages. but that each region of the country should have one plan that does so. the energy and commerce committee is the final of three house plans or panels for overhauling health care. 7:11 right now. it's 76 degrees already. some problems you can solve over beers and others are more complicated. >> the president sits down with the professor and the police chief pushed to the front of the racial debate. and plus talk about a second

president obama brokering his own peace talks. at issue, accusations of racial profiling. the case sent shock waves around the country but last night was all about putting differences aside over a beer or two. doug luzader has more from capitol hill. >> reporter: some problems you can solve over a couple of beers and se are more complicated and this one isn't going away just yet. the white house wanted publicity for this unusual happy hour but only to a point. the cameras struggled to get a shot because they were kept at such a distance. what did these guys talk about? the cambridge police officer james crowley wouldn't say much. >> what you had today was two gentlemen agree to disagree on a particular issue. i don't think that we spent too much time dwelling on the past. >> reporter: an official white house photo show there's was a toast but there through been some tension too. the professor was arrested two weeks ago after reports of a

possible break-in. gates call it racism, crowley said nonsense and the president poureduel on the fire. >> the cambridge police acted stupidly. >> reporter: the president seemed to later regret that remark and invited both men to the white house for what some dubbed a beer summit. >> it's a clever term. but this is not a summit. this is three folks having a drink at the end of the day. >> reporter: but it was much more than just that. daht was -- it was an effort by the white house to diffuse a big distraction. >> and there were no apologies gates and crowley have agreed to meet. the judges in the virginia tech case will not preside over the lawsuits file by the two

slain students. the judges said there is a conflict. the victims are suing the state, the university and others. they are seeking $10 million in damages. just a matter of days since it took affect but you may be out of luck if you haven't already taken advantage of cash for clunkers. still ahead, why the government is struggling -- struggling to keep the program alive. new tax hikes all happening in the district and council member at large joins us live to discuss the hot topic. and then the last ditch efforts to make headway on health care reform before the recess. we'll talk with chris wallace about the progress on the hill.

senate. both sides are working at a compromise before the august recess. fox news sunday host chris wallace joins us live. good to see you. >> thank you, tony. good to see you. >> and i guess the number one topic is health care and whether or not they will get anything done before the august recess. tell us about what some -- what is going on this weekend. >> we'll talk to some top officials in congress, including the head of the house ways and means committee, that writes the house tax bills and that's charlie ryan gold. there had been talk on the part of the administration they would get bills passed, separate bills in the house and senate by the august recess. we're nowhere near there. it has gone through some committees and not others and the republicanfeel it's a victory for them. because they think when members of congress go back to their

districts and hear about the concerns that voters have about it, that their going to shy away. we'll see whether or not that happens. but i think the general feeling in washington is delay is no friend of health care reform. it's going to make it even harder when everybody comes back if september and now people are saying, instead of august, they're talking about october, thanksgiving, even christmas that we could still be talking about health care reform. >> chris, you are doing something interesting. republicans have been focusing on who are our up and coming leaders, though they've had many problems with some of the politicians having personal scandals and the like and stepping down from office and you're focusing on some of the rising republican stars. tell us who you are looking at this weekend. >> we're looking at congressman mike pence. these are the hot shots in the republican party. i think there is a feeling after john mccain and the defeat of 2008 that the party does need to rebrand itself and maybe needs to turn it over to

but they'll be sweating as they run through the doors because it's humid out there. temperatures right now, 76 at reagan national. 75 out at dulles. so very swampy weather. we're go with swampy this morning. we have a lot of tropical moisture in place and we'll see some rain move in and the -- and the possibility of strong thunderstorms moving in our direction. overnight, more the most part quiet conditions. rain showers off to the north and west. most of the energy is pushing south to north so i think we'll have the morning hours dry but by the afternoon there is an area of low pressure in the tennessee valley and most of this mess will be headed toward the washington area. so by afternoon, certainly showers in the forecast and the possibility of some scattered thunderstorms. and there is a lot of fuel in the atmosphere right now. so there is a possibility that

we could see some pretty strong thunderstorms out there this afternoon. because of that, we're under a slight risk of severe weather. so look out. if you hear a rumble of thunder, there is the potential to see some rain and cloud-to- ground lightning and hail from the storms as they move on through. and the forecast looks brighter for the saturday. during the day tomorrow temperatures will be about 90 with a lot of sunshine. much brighter tomorrow but we have to get through today. mostly cloudy out there. afternoon showers and thunderstorms will be likey. best chance is after 2:00 this afternoon. and some storms could be strong this afternoon. winds out of the south at 5-10 miles per hour. here is your weekend forecast. and again, tomorrow looks bright. should be a lot of sunshine. just a chance of isolated thunderstorm. a 10% chance late in the day tomorrow. our next frontal system approaches from the west and you can see the showers and thunderstorms linger to early next week.

and let's get to traffic with julie wright. traveling northbound on 395, the accident activity still in place north of duke -- duke street and that's toward landmark from edsel. no problems on the outer loop of the beltway toward the wilson bridge but the long-term construction project at eisenhower causing backup from van dorn past the scene. but again, the lanes are open all the way across the wilson bridge. inner loop looks great leaving oxon hill from maryland -- to virginia. here at coalsville, the pace slow and that's it. good pace leaving germantown out to the split. that's a look at your fox 5 on- time traffic. you can expect to pay more for the sales of cigarette and gas taxes in the district. the d.c. council agreed to increase tax this is week.

after members discussed spending cuts would not solve the budget shortfall over the next three years. the council is expected to vote on this today. and joining us to talk about it d.c. council member at large. >> this was the last result. i don't think anyone wants to raise taxes and sometimes it's necessary and right now it is. and when you look at what the mayor sent down. it had so many cuts that would affect the low-income residents in the city, we had to do something to balance that. so i'mreal proud of my colleagues on the council to do something to pay for the restorations and we did that. >> and we're talking about cigarette -- increasing cigarette sales, gas and sales tax -- i should say. and the question is who gets to choose what gets taxed more heavily? what is the thinking behind something like that? >> well we have a litany of taxes on the table that we can look at. and as a body, we discuss it

and we make the determination. the elected leaders make the determination. and frankly there are other taxes on the table that we saw but didn't move forward with. from an income tax to property taxes and we decidedn the sales tax for now. and keep in mind, if the pain doesn't end over the next couple of years, i'm talking about the economic pain, we may have to revisit the other taxes as well. >> this is projected to save roughly $50 million a year for the city. >> roughly. and that depends on -- we're still crossing t's and dotting i's as we speak until the legislative session. >> and where does the put the other jurisdictions, maryland and virginia? >> we're still better off, not just in this region, but in the country our region is better off. we're still feeling pain, but if you look north of the state of pennsylvania, they can't pay their employees. so they're really having

problems. we wish them luck. for folks out of a job, they don't care how well we're doing, they need to get back to work. and that's why we need to save some job training money. we saved the benefits for the low income benefits so families can eat and rapid housing money so try to restore some of it to make sure the low-income residents in the city don't feel pain. >> and also taken off the table, the two tax holidays. what was the thinking behind that? >> same thing. that's the problem. any time you're in a recession, if you want the services, you have to find a way to pay for them. this is one way to do that. >> and cuts and earmarks for arts and social organizations and staving off the hiring of new police officers. what else can we see as faas cuts that the public needs to be aware of. >> we wanted to try to be as responsible as we could be and disciplined as we could be so residents didn't see too much

of a service impact. but i think most resident understand we're in the worst economy since the great depression. so i think most people understand that we're all going to have to tighten our belts a little bit and we'll do the best we can and we're trying to be as responsible as we could be. >> and let's switch gears. the council being interviewed by robert bennett to determine whether marion barry may have crossed any lines in the hiring of his former girl friend. and i know you can't discuss any detail, but where is this investigation? >> well mr. bennett, who everyone truly respects, he'll work very diligently and responsibly in trying to figure out what recommendations we can have to have a better city and council and with the mayor. we have to do a better job of transparency so the residents of the district of columbia know how the government is operating and tat's what i think the end result will be. >> about 30 seconds left. let me talk with the summer jobs program.

there was talk when we spoke with the mayor that some council members want to cut the program short to stop the bleeding and there was big-time flaws in it. you told the examiner that ten come over instead. >> i think there was some sense of child dumping where young folks were put in jobs even if they didn't have nothing to do. we still have a lot of kids at home getting checks and we have kids that haven't been placed yet. so after last year's debacle it's better, but there is still work that needs to be done. and if you're talking about wanting to stand up and say how many kids are getting employees but not getting the kind of substantive work or the social training, then i don't know how good it's going to be. so we need to make sure we're being responsible. back when marion barry was mayor, he didn't have all of this technology and the program worked smoothly. for some reason it's not working out the way it is in the past. but it's a great program.

time traffic. enthusiasm is high but cash is low. now the government m pump the brakes on the cash for clunkers program and it is only one week old. now the white houstrying to find more money to fund the rebate program. matt acland counting the cash and joins us live with more. matt, good morning. >> allison, good morning. across the country this week, dealer have been saying that they've been seeing crowds like never before. as you know, over the last year, selling a car has been very difficult in the united states. but now this program, cash for clunkers, is so successful, so many people taking advantage of it, that the money set aside by the government is simply running out. >> reporter: it's been a smash hit with customers. but it may have run out of gas. the white house is reviewing the widely popular car allowance rebate system program. better known as cash for clunkers. the department of transportation officials are telling lawmakers they may need

to suspend the program as early as today because it's $1 billion budget may already be exhausted. >> it's getting great traction. the problem is they didn't estimate how well the demand would be for it. >> for the dealers, it's gone from stimulus tonight mear. >> reporter: cash for clunkers offers $3,500 to $4,500 towards a new more fuel efficient vehicle. it's been heavily publicized by dealers since launched on friday. but a just completed survey of 2,000 dealers found 25,000 deals have not yet been approved by the national highway transportation safety board. that's raising concerns that with about 23,000 dealers taking part in the program, sales may have already surpassed the $250,000 mark funded by that $1 billion program. >> there is kay ott in the showrooms. it's clearly bringing people into the showrooms. they're selling 2-3 times as many cars as they were before

the program went in to affect. >> reporter: what happens next? no one is really sure. we're told talks are under way in the white house and on capitol hill to make sure there is money for those who have made a deal with the dealership. there is concern they have surpassed the amount designated. and the white house has said they will make sure the money is there and on capitol hill many lawmakers would like to add more money to the pot. live in rockville, matt acland, fox 5 news. >> the good news is it's successful, and the bad news is it's really success: lawmakers say the program to expand to $4 million. that's the first proposal. tony, over to you. police are investigating a fire in the district.

flames erupted around 8:00 last night at a building on rhode island avenue in northeast. the building houses several businesses. the fire was so strong it caused part of the roof to collapse. no one -- was hurt. and flames erupted on wednesday night at the home on cambridge road in northwest. that home belongs to peggy cooper cafritz, the former head of the board of education. their efforts were hampered by problems with water pressure. the mayor and other city leaders are launching an investigation. >> we view it would be wholly responsible less tha24 hours to come up with a conclusion that would say with any level of certainty that we know this happened or this didn't happen. >> fire officials say it will probably by' week before we learn what caused the fire. a bus driver caught on

taxpayers that pay their money. >> police say the scheme had one flaw. the placards are all its same number. the lawyer appointed by the d.c. city council to investigate marion barry is getting to work now. we caught up with attorney robert bennett yesterday. he's investigating barry's hiring of his ex-girlfriend and contracts that awarded grant money to nonprofit groups that he's associated with. councilman barry has denied any wrongdoing. the d.c. council has agreed to raise taxes in an effort to close a huge budget gap. if approved the sale tax would go up to 6%. the gas tax would go up 3.5 cents to 20 cents aallon and the cigarette tax would go up to $2.50 a pack, raising the average cost for a pack of cigarettes to about $7.250 a pack. the vote is expected on the hike today which council member at large michael brown says it
