7:38 am
>> that was one of them. and i think she took the wind out of her sails by apologizing if any of the speeches offended them. they made a 2005 speech at duke university where she said appeals courts are where some of the laws are made and people thought this was a sense she would be a judicial activist in the white house and it's proxy, some legal scholars that went on quite an offensive saying this is a judicial moderate who exercises restraint, look at her record of over more than 10 years on the appellate court. >> and sticking with the gop string, 9 republican senators did break ranks and did vote for her confirmation and was that surprising? >> tough juggling act. they have to play to their base but they're trying to expand to new constituency and even the ones that were opposing didn't want to seem to be bullying the

first latina and the third woman nominated to the court. so the vote went more or less as we expected. >> what does this mean for the idealogical split on the supreme court, 5-4, what does this mean for judge sotomayor to be confirmed? >> it's more or less the same split. there are five in the so-called conservative camp and four in the liberal camp and the real fight is the next nomination because that in all likelihood will split things -- will swing things in the liberal camps favor. so a lot of hearings were interest groups putting out markers for the next nomination. it's not that the president might have as many -- it's thought that the president might have as many as three picks. you compare that to bush and clinton who had two. >> the fight might get much more contentious in the future. >> in all likelihood. >> we have to end it there.
