morning to talk about it. and what a treat, she'll perform a song from the new album for us too. can't wait for that. and it's another soggy day out there. this is the scene earlier this morning on river road in bethesda. a tree down causing traffic trouble with lane closures but things are back open now and running smoothly now. >> but the question is how much rain can we expect today? we'll check in now with gwen tolbert in the weather center for that. >> good morning. we've had a long period of excessive rainfall over a few days and finally got a break and now the rain is back in the picture again. it will stick around for a little bit. let's look at our live doppler radar and showing you we do have light rainfall over the areas stretching from the i-66 to the east and then to the west, south of i-66 in new winchester along the i-81 corridor, we have pockets of moderate rainfall. and it will be the scene into the course of today. a look at true view then for the big picture, because you can see where the wide area of rain is. we have a couple of systems,

one off the coast. another one that is just pushing through the upper ohio valley and moving east. and you can see that into parts we'll have to deal with it over the course of a few days. talk about fall, it's definitely kicking in. 52 degrees right now at national airport. we have 54 -- 53 in annapolis. 52 degrees to the south in manassas and cooler to the west, 48 in martinsberg. so for today, our high only 48 degrees. well below seasonal. over cast with rain. a little on the breezy side with a cool northerly wind from 10-15 miles per hour and this is sticking around today, tonight, and into tuesday and may sneak into the early part of wednesday. so keep your umbrella handy because you need a jacket if

you're heading outside. back to you. our top story, we're about an hour away from the newest term of the state's highest court. >> we'll see the debut of the newest justice, elena kagen. marianne rafferty with more. >> reporter: the supreme's court's new term starts on monday and rubs through june and will show us how the new judge will interpret the law and she'll have to sit out on some cases. >> but the new wild card is elena kagen. we don't know how she will rule. >> she can't participate in cases in which she was involved in which she served in the obama justice department. and if she's already been a lawyer in the case, an advocate for one side, she can't switch hates and -- switch hats and sit in judgment. >> reporter: the first case is

for the church picketing dead soldiers. >> they are disrupting one of the most solemn rituals in the united states, funeral services for a fallen soldier. so that may make this case different than the ordinary political speech case. >> my thinking is that the supreme court will say there has to be some reasonable time, manner and mace restrictions on afternoon -- and restrictions. >> it's her first term but she has a background in the first amendment. >> reporter: after seven years with the same lineup of justices, there are changes. now three of the nine justices are women. since 2005 four new members have joined. two on the conservative side and two on the liberal side. marianne rafferty, fox news. >> they are expected to handle the 2,000 appeals that have

piled up and they are hearing an appeal by criminal dvd -- defend ants seeking shorter prison terms. four people are dead following attacks on tanker trucks outside of pakistan. militants first set fire to 20 tankers carrying fuel for nato troops. and then they started a fire hours later in the southwest part of the country. it's probably in response to a few pakistanis that were killed during a u.s. strike. there could be a new terror plot in the works. several european countries and japan have issued similar warnings and now concern is growing. sarah simmons is live from dulles international airport with more on the story. good morning, sarah. >> reporter: good morning, tony. the state department is issuing a warning to tell americans to be careful if they head to tourist areas overseas. they are not talking about a

specific threat to any country, but they are saying just be careful if you are traveling to europe as a whole. but there are reports out there that cities in the u.k., france and germany could likely be targeted. now the state department warned of al-qaeda plans to send teams of gunman to kill civilians, something similar to the 2008 attacks in mumbai india. they are remaining -- reminding americans of the potential for attack on public transportation which is a popular target in the past. some terrorism experts are advising americans to stay away from major monuments altogether over there. now i talked with some international traveler this is morning, a couple of them, one heading to london and another one heading there in a couple of weeks and i spoke to them here at dulles and here is their reaction to the travel alert. >> i'm concerned about it.

it's been pretty steady with the warnings over the past few weeks and they've made quite clear that the state department is concerned about it too. >> i don't plan on making any changes to be honest with you. meanwhile we have to be cautious and things are just as dangerous around here in the d.c. area as if going to d.c., bub -- dublin or europe. >> reporter: many are concerned about the impact this could have on the european economy. but again this is a travel alert. the state department is not telling people not to travel overseas, they are just strictly cautioning folks to be careful. live here at dulles. sarah simmons, back to you. >> thank you very much. investigators are looking into a deadly shooting near howard university. two people were found shot at harvard and 6th street around 1:00 yesterday morning.

a silver spring man died at a hospital. the other victim was treated and released. no arrests yet. an armed robbery that ended with a car flipped over in front of the mayor's home. three men robbed the eastern carry out and speed ramp. it turned over again in front of the mayor. police arrested three suspects after a search with helicopters. there is a warning for the university of the maryland following another attack. college park police say a student was walking behind anne arundel hall at 4:30 yesterday morning when three men approached. one man forced him to hand over his water and cell phone. there isn't much of a suspect description. police aren't sure if this is

related to a series of off campus situations. richard aaronington and his wife were arrested after marijuana being found in their house. the couple is charged with possession with intent to distribute. he was with cbs news in washington. former president jimmy and roslyn carter are joining habitat for humanity in the district today. >> they are helping rebuild homes in northeast and that's why gurvir is live on the scene now with details. >> reporter: good morning, al and tony. forget the rain. who cares about it on a day like today when you have the former president and first lady and a number of volunteers doing their part to help those who are in immediate for the most. and how about this for six degrees of generation. kent walker, great to have you

support to this organization? >> homeownership brings stability to a neighborhood and community in the way that nothing else can. and this is a particular community, there is 12% homeownership. and if we recognized if this community is to thrive, there needs to be a great presence of people saying this is my home and that's why we're here. >> and i mentioned you were from mississippi and there is a good contingent of mississippi volunteers here today. and they have a special bond to help people in need. >> they're coming here to volunteer for the event. there are some people who this is their 22nd visit with president and mrs. carter. and so our house leaders on these 12 houses have over 1400

welcome back. 9:14 now. rutgers university held a silent vigil last night for tyler clemente, the student who committed suicide last week after his roommate videotaped him having sex with another man and streamd it online. rutgers also paid tribute to clemente during the university football game on saturday. students are still in disbelief. >> that this happened, the whole thing is not a great situation for the university. it's just -- it's a loss. it didn't have to happen. >> it's just a weird thing for something to happen on the campus and take it that far. it hit everyone hard. >> authorities have charged two students with invasion of privacy. prosecutors are weighing additional hate crime charges. cyber bullying is being blamed on a number of recent student suicides. this morning we talked with the

program manager of the circle of respect initiative on how to prevent more tragic deaths. >> i think a lot of people can pay attention to children's behavior and how they interact with their friends. do they tend to want to control a situation. not so much that a bully is a bully, but the thought of their actions and what this means. obviously in some of the instances recently, we didn't think there would be ramifications past the immediate moment and there were. >> cyber bullying is defined as any use of technology or social media to distribute hurtful messages or sexual images of people. a local navy seal killed in afghanistan will be laid to rest today in just a little over an hour. lieutenant brendan loony was a football stand out in the late 90s. and as karen gray houston reports now, his silver spring family, friends and colleagues came to commemorate his life over the weekend. >> reporter: he was only 29.

the body of lieutenant brendan loony was returned where he was once co-captain of an undefeated varsity football game. loved ones stood in line to pay tribute. >> did you talk to his teammates, he was a man among men. ands you can see by the turnout here, he's touched a lot of people's lives. >> he was a special warfare operator, assigned to afghanistan. he was one of nine military personnel who died when their helicopter crashed late last month. three others on board were injured. the pentagon hadn't said what caused that crash. but the navy said they were supporting a special operations mission. >> words can not describe the incredible loss of our son lieutenant brendan loony. >> reporter: it was a painful loss for his family. a statement was read from the family. it said brendan made the ultimate sacrifice while protecting the ideals of our

nation. it goes on to say, although his life was tragically cut short, his spirit will live on. the community remembered him as a wide receiver, defense back in 1998. coach bill macgreggor has paid homage to him at every game. his number ten will be worn on helmets the rest of the season. karen gray houston, fox 5 news. >> funeral services for the lieutenant will be held this morning at the basilica of the immaculate conception and buried at arlington. firefighters had to rush in in wisconsin when the center pin came out of a ferris wheel. this stranded all of the riders. rescue crews were worried the ride could fall over from the 50 mile-per-hour winds blowing at the time. it took hours, but the firefighters rescued all 17 people, most of them were children. no one was hurt.

a car val ride in delaware is under investigation this morning. three adults and two children were injured when a ride malfunctioned at fright land, a seasonal halloween attraction. fire officials say part of the merry mixer came loose and flipped over. the manager said the rides are inspecting daily and the park hasn't had any serious problems with rides in the 14-year history. mexican pirates shot an american couple between mexico and texas and this morning they are looking for the bods on the rio grande. the wife reported the shooting to 911. >> are you sure that your hus got shot? >> yes. [ inaudible ] >> she said yes, in his head. there have been five attacks by pirates against tourists and fishermen this year but this is the first time they killed

someone. >> she said the bullets were hitting close to her in the water and realized her husband was hit in the head. she went back to try to find him. she went in the water to try to load up her body to bring him back to the side but she was being shot at. so she had to climb back on her jet ski and head back over here to where it's safe. >> reporter: police still have not found the body of that man, david hartley. they say the pirates in the area are working with mexico's drug cartels that control that lake. if you are planning on opening up that laptop this morning, you want to hear this next story first. the latest danger identified with the device. and holly is getting into the festive fall mood. good morning. >> reporter: good morning to you. now this is a gord with character. we are live at holin farms in delaplane, virginia. where they have pick your own greens and gords and more. and they even have the pumpkins

we have a consumer alert for you. congressman olathe yu cummings calling on the maryland governor and attorney general to impose a 60 day moratorium on foreclosures in the state of maryland. cummings said that he sent a letter to the governor, governor o'malley, and attorney general doug gansler claiming several families may have been wrongly evicted. he said there are numerous reports from multiple states suggesting that lenders may have acted fraudulently in

order to foreclosure on homes. so far no response from state officials. and verizon wireless admits it charges millions of customers for services they didn't want and so now the cell phone company is sending out refunds. verizon is paying customers back for improperly charging for web access or data usage. most of the charges appeared on bills as $1.99-megabyte fee. most will see a credit of $2 to $6 on their next bill. there what warning for those of you -- there is a warning for those who use laptop computers. people who work on them for long periods of time, particularly with it on your lap, can suffer from toasted skin syndrome. can cause permanent skin darkening and it can cause damage leading to skin cancer. searchers suggest putting a carrying case under the computer. it was a good weekend for redskins fans. dave ross joins us to break

it seemed similar. they got up early and had to hold on against the division foe and now 2-0 in the division which is huge. we'll start off with donovan mcnabb, who had, by his standards, probably the worst game all year. his stats 8 of 19, just 125 yards. this touchdown to cooley to make it 14-0 early and a bad interception in the third quarter and all of that is water under the bridge because the redskins held on to get the w. and again you and i know this, a veteran quarterback, they laid an egg against st. louis and this is why they got him and this is why he's in burgundy and gold this year and the eagles are just devastated because that's what they need next week. so can kevin kolb do what mcnabb did? but so far the early returns not good for kevin kolb. which is good for people here

and that's -- that's good news. 48 at gaithersburg. look at winchester at 49 degrees right now. let's look at radar and show what you is happening. we've had light to moderate rainfall across the area. there is light rainfall across the i-66 corridor and just light rainfall but it will continue into the course of the next day. a quick look at true view. we have a couple of systems responsible for this. one off the coast and then another pushing through the ohio valley and heading to the east. so this wide swoth of rainfall is associated with two different systems and they'll become one. and so as we go back to the weather maps, receipt's put it in per -- let's put it in perspective. we have the low pressure system with rain and then off the coast and we'll see them merge. and then a secondary will head

up to the south. so means a lingering period of rainfall for us, at least through tuesday, maybe sneaking to the early hours of wednesday. low pressure behind it so we'll eventually see drier skies -- brighter conditions and drier skies. 58 at warrenton: we're not seeing too much in the form of sunshine but we'll get the sun back moving wednesday into thursday. friday, what a great start to the weekend. plenty of sunshine and we're talking a high of 72. finally back to seasonal. thank you. the popular fox 5 crime drama live to me starts tonight and earlier i spoke with tim roth and kelly williams about the plot line of the season opener. they talk about how they end up mixed up in a plot. >> i end up in a bank that doesn't feel right. and i follow this guy -- i

hangs out. >> and makes us nervous. >> right. >> let me ask you this. do you find you are analyzing people more. you're on the set doing what you do and then in your real life, does it seep over? >> it can occasionally. i'll find myself catching something from someone and then realizing that i've done just that. and it's -- neither one of us expected to learn any of it. tim proclaims to be terrible at it. >> i'm awful. i'm terrible. i get it all -- all wrong. i think i've got it right and i'm all wrong. >> and there is always this undercurrent, whenever it seems like there is a male or female lead. but we learned about the personal life of cal. can we expect more of that? >> yeah, you will. a lot more character and background and kind of development.

it is that time of the year. time for pumpkins and gords of all sorts. but did you know -- but do you know if those popular holiday decorations are fruits or vegetables? which are they? >> i don't know. but holly i'm sure is going to find out and she's at the holin farms in delaplane, virginia, where they have over 10,000 pumpkins and gords on that one farm. holly, good morning. >> reporter: good morning. and i have the pumpkin life line to ask that all hist important question, it's the entire davenport family as they've been spending it out here with us this morning on holin farms. you are holding up well. but you're hearty farmers. >> we do this all of the time. but marjorie was still dragging

in her pumpkin, from last hour. it was a big pumpkin marjorie. >> i like it because it's shiny and it's really orange and it's good for carving. >> it's perfect for carving. this will make the perfect jack- o-lantern. and we tut it in a -- we put it in a cart. and i like it because it's next to the can of whipped cream. that's why i'm going to bring in shannon. we're not going to make pumpkin pie out of this? >> these are great for carving as jack-o-lanterns because they tend to be hollow on the inside and easier to carve and scoop out. this is a pumpkin better suited for baking because it is really dense. when you smack this, you -- you can tell it's solid. and a lot of deep orange meat in this pumpkin here. and to make a pie, this is great for making a pie.

i cut it in half and tie it down on a pan in the oven and roast it and it should be that smooth. and pound the flesh into a puree and make your pumpkin pie recipe. >> reporter: and it looks something like this. >> and i'm no martha stewart, but i try. >> reporter: move over martha stewart. is that a pie we could eat? what is it missing? >> whipped cream. >> reporter: exactly. i'll let mom fix that up for us. but since that is a funny looking pumpkins. and other funny looking gords that we have here. and tell me about the patch you have now. >> these are called either turk tour bans or mexican hats and

you can see why. and then further down the hill i brought up a couple of examples, these are called green striped kershaw pumpkins and these with here before the europeans came to this country. >> my sister's in laws would make kershaw pie. >> i was told they use the neck and this is called crown of thorns and you can soo see why. and there is a number of these. and they are all basically in the squash family as well as pumpkins. >> and some of these you can use to cook but a lot of them use them to be decorative. >> yeah, uh-huh. >> and as we come to the middle of the patch here where the pie set going ready to served up. are we having fruit or vegetable pie?
