baltimore washington parkway are open this morning. police stopped all southbound traffic after a deadly accident overnight. investigators say a man's car broke down and he got out to have a look at it and was hit by mother vehicle. traffic was diverted all mother. police have identified a man whose body was left in a box last tuesday. they say 36 jack ono vasquez was shot by marvin valencia on constitution avenue. valencia was -- valencia was angry vasquez was having an affair with his wife. he was seen driving a honda minivan odyssey with maryland tags saying paln cia. day three of deliberation

in the chandra levy murder trial. yesterday jurors worked without sending a note or asking a question. they also had a bit of a late start because of tighter securities at the courthouse. guandique facing murder charges for the death of chandra levy. paul wagner continues to blog from the courtroom and you can find information under our home page. he'll join us in the 8:00 hour. now to the corruption investigation in prince george's county. detention hearings for two of the three police officers have been postponed. chong kim and richard delabrer appeared in court yesterday. some of his rell 62s -- his relatives came to his defense yesterday. our other big story this morning, a stunning admission from ft. detrick. the army post did admit it did spay agent orange in an area

where there is now said to be hundreds of cancer cases. in response to public concern the army corp of engineers conducted a report and found the toxin was conduct decades ago -- conducted decades ago. they are now calling for a congressional investigation. >> to be honest, we need to get the epa out of the way and there needs to be a congressional investigation to where it is nonbias. these are the same people who said we didn't spray fields, the same people who said the water is safe to drink. >> well the fort down played the report saying there is no health risk at ft. detrick. also following a developing story out of new zealand. a mine explosion overnight. a blast that trapped about 30 em apparently made it out alive. police say electricity to the

mine went out before the big explosion and the loss of power may have caused ventilation problems and that may have led to the blast. two dozens miners and other workers are trapped about one mile underground. the case of the missing ohio family took a tragic turn yesterday when authorities found the bodies of tina herman, her son cody and family friend stephanie sprang. police believe 30-year-old matthew hoffman is responsible for the murderers. the three victims and her daughter disappeared a week ago. earlier this week the girl was rescued from his basement. more charges are expected. new this morning, president barack obama has arrived in portugal for a summit with nato leaders. air force one touched down a little more than an hour ago. during the summit the president's afghan war strategy will be in the spotlight. nato is expected to set control

of their own security by the end of 2014. the president will meet with the russian president. they're due to talk about the nuclear treaty they signed back in april. it needs to be ratified by the senate and the president is pressuring lawmakers to take a vote before the end of the year. the 40-year political career of new york democratic congressman charlie rangel hit a low point yesterday. the ethics committee recommended he be censured for violating fundraising rules in the house of representatives. minutes before the end of his two hour sentencing hearing, rangel who was a korean war hero and a 20-term lawmaker from harlem, new york, finally broke under the strain of his ordeal and disgrace. he apologized but avoided saying he was guilty of the 11 violations of house rules. >> mistakes were made that i assume responsibility for, and i admitted wrongdoing to my

committee. an explanation for my faulty behavior, for my irresponsible behavior, for the bad conduct that i've had. >> it's up to the full house to vote on the censure recommendation by the committee. could the tsa agents soon be screened out of their own jobs. one member of congress want to give the airport security agents the boot. doug luzader has more from capitol hill. the complaints before the tsa screening procedures may have hit a tipping point. >> reporter: most passengers are just putting up with it, but more and more are saying enough is enough. >> it's ridiculous. and it's not safer. they're just doing it to have us be fearful and there's no reason for it. >> reporter: some think the new scanners see way too much and the other option, a patdown, isn't much better. it's to the point that a district attorney in california is threatened to prosecute tsa agents. >> if it's skin to skin and somebody were to take their hand and put it underneath

somebody's blouse inappropriately and go skin to skin, that's a felony. if it's a touching over the clothing, under california law, that's a misdemeanor. >> reporter: one airport in orlando wants to take advantage of a provision to replace tsa with private contractors. and one republican congressman who is likely to head the house transportation committee next year said the time has come. >> i think it needs a complete revisit and maybe now this personal intrusion with the private person patdown is the straw that will break the camel's back. >> reporter: the head of the tsa is unwaivering. >> so if your question is do i understand the sensitivity, yes. if you ask if i will change the policy? no. >> reporter: it's not clear what impact the private screeners would have on the process because they would still be required to follow tsa procedures. doug luzader, fox news. it is 9 minutes after the hour on friday morning.

remains of the car fire still there on the shoulder. on 355, traffic will slow from father hurley to middle brook and then game preserve road past 124. no accidents on the outer loop. slowing 95 to georgia. this is inbound suitland parkway, heavy volume in from stanton road. traffic slows to the douglas bridge headed for the free way. that's a check of your fox 5 on- time traffic. general motor was in bankruptcy protection a year and a half ago and now driving back to financial health with the new stock offering yesterday which pay be an indication of recovery for the troubled car industry. but there are still skeptics who say it's just one step in a very long journey for american car makers. joining us now is ken thomas with the associated press. >> good morning. >> let's talk about gm and take us through the last year and a half or so and where we were

yesterday. we saw the ipo funneling money into the company. >> yesterday was a pretty significant moment for the company. they were able to go public again. the government reduced it's stake from 61% to 33% and the taxpayers got some money back. >> was this just a one-time shot in the arm for gm or is there enough staying power that the company can continue on without continued government assistance? >> that's a question. the company has posted three straight profitable quarters. they've done very well with recent launches. they have the chevy cruz that came out recently, it's a compact core they are hopeful for and the chevy volt will come out next month. that is more of a limited production vehicle but still will get attention because of the technology. >> gm has been successful in already paying back billions of dollars to the government. will they be to the point they

can pay everything back? >> that's the question. at this point the government through the ipo will receive half of what they put in. they put in about $50 billion and for -- the stock was trading yesterday around $34 a share. for the government to eventually get everything back, it would have to -- the stock would have to trade at about $53 when they eventually sell their last third. >> so a little ways to go? >> yes. >> but positive steps as we've moved forward from the cliff we fell off of a year ago. and let's talk about other american automakers. ford didn't take any help. and their stock trading at about $1 a share. what have they done? >> the key word with ford is planning. in 2006 after alan malawi moved over to arrange the board they

raised $23 billion in 2006 from the private markets and that made a big difference in 2008 when the credit market completely shrunk and companies like gm and chrysler weren't able to get any money. ford had the money that they needed to do their turn-around plan and as you mentioned, the stock is now trading around $16 a share from $1 two years ago -- $1.50 two years ago. >> and what about chrysler. i know they have new vehicles and people saying the new grand cherokee may be the savor for this company. are they putting the focus on the vehicle themselves moving forward. >> chrysler had a different approach than general motors through the process. they've been much more quiet as they try to turn to -- return to profitability. the cheap grand cherokee is an important launch for them. they have about 10 refreshed or new models coming out and sometime in 2011 they're supposed to go public.

but they still need to get their balance sheet together. they have not been as profitable as gm. >> let's look at the broad picture now. when we look at the american automakers, the big three that carried this country for so long, there is the question of how they stack up against the foreign automakers, whether they be european or japanese. where do we stand? >> most of the independent groups put out show the big three have made strides. they've cut the gap on quality reliable with some of the japanese automakers. so they are making progress. but as you say, this is an incredibly competitive market here in north america. you have honda, toyota competing heavily. you have german automakers like volkswagen and in the last two years hyundai was strong.

>> and are we to the point now, is it coming back or are we just now value conscious shoppers looking for the best value out there? >> i think it's more of the latter. there are some consumers who want to buy american. i think ford got a good hit from not taking the bailout money. a lot of customers who came to them said that's part of the reason why they bought ford. but in the end, there are so many options out there that i think most consumers are probably going to go for the best deal and look for what they need. >> gm being the big story with the initial public offering yesterday. ken thomas with at associated press joining us this morning. thanks, ken. dozens of cardinals from around the world gathering in rome and that includes some of the newest, including archbishop donald wuerl from washington. his remarks from rome coming up. plus the chilean miner

stories making headlines this friday morning, today is the eve of what is known as a consistory. the pope will create two dozens new cardinals. one of them donald wuerl. he spoke about the change in everyday life. >> i think this is something we need to be very aware of. it's a fundamental right, freedom of conscious and people need to have that freedom guaranteed. what we're seeing around the world, that's a serious, serious issue. it's been challenged, it's being diminished. >> today about 150 cardinals

as freshman on capitol hill get ready for the office lottery, president barack obama is in portugal for a nato summit. fox news sunday host chris wallace joins us from capitol hill. chris, good morning. this weekend you're sitting downtown with the secretary of state hillary clinton. good morning. >> yeah, we will. and there is a lot to talk about. and they're having this conference of nato in liz bon. and remember when the president announced the troop surge in afghanistan he said we would begin pulling the troops out in 2011, six months from now, but now it turns out we intend to be there -- he intends for us

to be there through the end of 2014. so we're going to be involved with a significant number of troops for the next four years. we'll talk with secretary clinton about that and i host of other foreign policy issues. >> and the controversy surrounding the guantanamo bay prisoner. what message does this send to the people who say we don't want these people tried in civilian court. >> and that's another discussion i want to have with secretary clinton. remember this is the test case, this is the case that the justice department brought because they thought it would be the easiest and as you mentioned, he was quitted on 280 counts, he was convicted on only one and that raises serious questions about whether you can get a trial with all of the protection that are afforded to people, usually u.s. citizens, in federal courts. and get a conviction. so we'll be asking secretary

clinton about that. >> here on the homefront you're talking about the republican governor's association becoming a powerful block leading into the elections in 2012? >> right. and one of the people being mentioned is a possible candidate and who has just been named the head of the republican governor's association, governor rick perry of texas. and his platform is very interesting. what he said is i want to see the next president, whether it's him or somebody else, who will make washington as insignificant to everybody's lives as possible. he wants power taken out of washington, returned to the states, given to governors and the officials closest to the people. and i want to mention real quickly, i don't know if you watch the food network, but our power player of the week with did you have goldman, better known as the ace of cakes. >> he's a friend of the show. i've been out to his shop there in baltimore. he's an artist true and true. and you can eat his art. >> that's exactly right. and i had not met him and i went to charm city cakes up in

saturday and sunday will be sunny days. very, very nice. on saturday we get up to about 60 degrees. that's great, with 60 degrees. and then tuesday we're into the mid-60s the way things are looking now. here is a look at the current temperatures. we are at 44 degrees now in washington. northern gaithersburg 32 at the freezing mark. 38 in quantico. dulles airport 35. baltimore 38. annapolis 41 degrees. so temperatures generally ranging from the low 30s into the mid-40s. that's a pretty wide range this morning. speaking of wide, we pull this out and show you all across the mid-atlantic and the northeast. binghamton, new york, 29. pittsburgh, p.a., 35 at this hour. satellite radar composite, things look good. i stepped outside a short time ago, plenty of sunshine and bright skies this morning and you can see what clouds are out there are generally not in our area. well off to the north and well

out to west. so we won't worry about that. might there be a couple of clouds coming through but for the most part sunny skies for today. so the forecast for today looks like this: sunny skies and cool. high of 52. winds shifting this morning, out of the west northwest at 5- 10 miles per hour. tonight cold overnight. clear skies. low in town, the upper 30s. about 38. that means many of you will have your temperatures in the low and mid 30s for tonight. so a cold one. five-day forecast, we talked about the temperatures. there you have it. check out tuesday, 67 degrees. chance of some rain showers moving in here on tuesday. then things shift for the holiday next week as we'll see generally cooler temperatures, downright cold in parts of viewing area as we head into thanksgiving weekend. that's a look at what is happening with the weather. now here is julie with more on the traffic. >> thanksgiving day, and another day for it is i get to eat pumpkin pie. >> you don't restrict it just to thanksgiving day, don't you? >> i'm trying to, tony.

let's get the latest on the redskins now. ryan torain unable to play on monday night because of a set back with a hamstring. yesterday unable to practice. clinton portis has been practicing but limited yesterday. he hasn't played since week four after tearing his groin. said he's still being cautious. joining us now dave ross and the sports junkies.

forget about all of that. you just talked to chris cooley and what does he say about the game on sunday? >> great to be on the with the guys because you get to talk to chris cooley in the morning. he says the same thing after a win and a loss, which is good, i guess. you can't get too high or too low. >> he is frustrated. we talked to him about third downs. they're the worst since they started taking the stats. >> that's not good. >> so he's concerned about the lack of production in the offense. he's growing frustrated. >> and steve talked about the fact that portis is out. ryan torain, they show him riding a bike on the side line. but keel and williams is one of the true bright spots. five touchdowns in the last four games. >> there haven't been many bright spots and one of the bright spots has been brandon banks. and because of galloway struggles and williams not stepping in, they are expecting brandon banks into the lineup and we might see some plays on the offense from him.

which would be great. >> and we talked to cooley about it. they've been dreadful on third downs. five for the last seven, 21% on the year. 0 for 10 in the game against philly. they've been awful on third downs. and on the road against a good tennessee team who has beaten good teams, they pounded philly early in the year. one at new york against the giants. they have to convert third down. >> we talked about it last mike shanahan, kyle shanahan, the slogan this year was are you in? are you guys still in at 4-5. >> i'm out. and here what is i'm doing. i'm ready to punt it away. punt away after nine games. look, i think the losing culture of the redskins over the past -- since daniel snyder has taken over is too big for even shanahan to overcome. and we're seeing it through the first nine games. i'm punting him away. >> i totally disagree. >> they won four games last year. >> they won four games last year and they've equals that. a lot of us thought they would

but farther out to the west, temperatures in the 30s. 32 now in pittsburgh, 37 in roanoke. here is what is going on. we have cool air in place. high pressure in place too. means calm conditions. we won't get any rain showers or anything like that. but it will be a -- cool today. then for tomorrow, in advance of the cold front, this always happens, we warm up a little bit. so we're looking at 60 degrees for tomorrow. but then the cold front comes through and drops temperatures a bit for saturday night and sunday. and then we'll get another warm- up going on. here is your five-day forecast. it's up and down really for the next several days. try to stay healthy, i'll do the same. 52 degrees today in washington. tomorrow 60 and sunny. sunday mid-60s and sunny. monday and tuesday well into the 60s. could see some rain showers on tuesday and maybe on wednesday as well. there you go. >> thanks, tony. >> it's not a bad-looking forecast. >> no. julie wright how is the roads? >> not so bad. we started off this morning with problems on the bw parkway

narrowed to one lane for work on the wilson bridge project. the lane closures start tonight at 11:00 and go through sunday evening. drivers should choose alternate routes in order to avoid the major backups. a new survey from triple-a finds a lot of folks are reading text messages while driving on the beltway. it's just one of the surprises in the report. as roz plater shows you now, triple-a said texting and driving is not just a teenage problem any more. >> it's the largest highway construction in the area of the country now. >> reporter: john townsend is talking about the massive construction project on the beltway near tysons corner, making driving hazardous at best. but here is the stunner. in september his agency surveyed 1,000 drivers who travel the northern virginia beltway regularly and 65% admit to being on their cell phones, not just talking, but texting too. >> you're playing with fire. you are putting yourself in

harm's way. and because the lanes are so narrow in much of that construction area, you are jeopardizing the lives of other drivers and construction workers. they have 2,000 construction workers in that area. >> reporter: and half of them said they were responding to their jobs. >> all of us, because of the economy and also because of pressures on the job, feel obligated to answer a text or a phone call from a supervisor or from the job site. and so we're calling on employers in the area to sign a pledge and swear they won't jeopardize the lives of their employees. >> reporter: jennifer smith has a focus driven group calling for tougher laws against talking, texting and driving. she lost her another years ago because of a 20-year-old on a cell phone. >> working with strict laws and heavy penalties. the on the thing that will get people to change their behavior. it feels like you are the next

more on our big story this morning, sherry? >> reporter: well, steve, between the chunk of concrete that fell through the ceiling here at the farragut north station, and those continued escalator problems, it's been nothing but trouble for metro over the past few weeks. we now know that the construction crews doing work on connecticut avenue didn't dig deep enough to puncture the ceiling of the station but did get too close to a ventilation shaft. for now the panels and holes in the ceiling have been shored up where a briefcase size piece of concrete fell on the platform on wednesday where passengers could be waiting but no one was hit above the station on connecticut avenue. city work crews were doing construction. crews dug down eight or ten inches, the station is 15 feet below, but it appears they were beneath a ventilation shaft. a piece of roadway felt through the empty shaft and through the ceiling and into the station. >> we may not have had detailed enough drawings and that goes

for metro and us. so we relied on them for the drawings. they may not have had the level of detail to know the distance that we needed to be away from the ventilation shaft. >> reporter: now this all comes on top of metro's escalator problems. they said they have inspected the brakes on all of the 568 escalators. the emergency inspections were ordered after several people were hurt in an accident last month. some board members yesterday now said metro should consider replacing the escalators but the general manager said they just need to concentrate on better maintenance for now. now metro is replacing the escalators at the foggy bottom station but that could take a year and just last week a report came out raising serious concerns about metro's escalators, saying that the station's inspection, the brakes were questionable and could fail with a full load. that's the latest here on northwest, back to you. >> sherry, thank you very much.

president barack obama is in portugal this morning, he arrived a few hours ago for a big global security meeting this weekend. afghanistan tops the agenda and so is the u.s. nuclear treaty with russia. as wendell goler reports, the president is pushing the senate to ratify that treaty. >> we'll have a verification hearing. >> reporter: hours before leaving for the nato summit in portugal, the president made another appeal for the senate to ratify the new start treaty during the lame duck session. >> if we don't, they went don't have a verification regime. no inspectors, no insights into russia's strategic particle. >> reporter: henry kissinger and james baker back at the white house. but jon kyl is pushing to hold the issue until the new congress convenes next year. he wants more than the $4 billion being offered for the

arsenal and wants more time to debate the treaty. dennis mcdonough said the president shares some of kyle's concerns but -- >> we believe we need to make sure this is ratified before the end of the year. >> reporter: in lisbon, getting troops out by the end of 2014 is said to be just a goal. >> it does not mean that all coalition forces would be gone by that date. >> reporter: officials say the frap withdraws will been troop withdraws will be based on conditions. >> the reason was to put more pressure on the pakistanis and afghans to step up to the place. but it did the opposite. it really weakened their resolve. >> reporter: plans now call for afghans to take over security next year in some of the more stable provinces and to gradually expand control of the country. karzai will try to reassure a nato conference to include all 48 countries, and that his soldiers are up to the task.

school. >> i think if you got caught cheating, that's your fault. you shouldn't have done that. you shouldn't get a second chance. >> but a policy instituted this year at the fairfax county school told teachers to give students caught cheating a chance to, quote, recomplete that work. >> everyone deserves a chance. >> it's morally wrong to teach that. and i teach infants and toddlers and the big principal is consequences. >> reporter: the principal reverted back to a different policy to allow teachers to decide whether they want the students to redo the work. and parents created the facebook page. >> they can talk about what was on the test and they may have even had a chance to scan the test before they got caught cheating. >> reporter: and parents are frustrated by another new

policy that allows a student to carry a grade of "i" and even into summer school. >> i didn't understand it first. it was thrust on everyone and not explained very well. >> reporter: the principal said the extra time gives, quote, every opportunity for a student to show mastery of a concept. >> math and science is especially very sequentially -- sequential. and if you don't know formula a, you can't learn formula b. >> reporter: parents say there is an alternative a.p. course. >> people move to fairfax county for the schools. i did. i school shopped as a teacher for the best education for my kids. i regret that looking at what they're trying to put in place. >> reporter: the principal at west potomac now said the incomplete grade cannot spill over into summer school. he said everybody will have an actual grade by the end of the official school year. as for the school system, they didn't want to talk to fox 5 on

lunch. yesterday they lunched for about an hour and a half. we watched them come back. they all looked like they had the same doggy bag so they spent the same -- they went to the same place to have lunch and then they all came back with their food. so they looked like they're getting along. we haven't seen any divisions yet. and they all seem to be happy and smiling. but, no, it doesn't surprise me at all that its taking this long. we have a lot to go through. there is grand jury testimony and there is photographs and there is the evidence that was found in the park. and then there is the testimony. and they were all allowed to take notes. and so they have their notebooks to go through and look at as well. so who knows? i'm never going to predict what a jury will do because i've seen too many things that you can try and make a prediction and then you end up being wrong. and so i'm not saying anything. >> right. >> as you're hanging around down there waiting and there is

about 20 reports do -- reporters doing this and them saying, what is your gut feeling? what will happen? i'm right down the middle. i'll wait and see. >> they didn't ask for any questions or clarification of the law or anything, so a truly quiet day. can we make anything of that? might they have what they need since they took notes or might they have gotten to a point where they don't need information. >> you can speculate all you want. you have no idea. it's difficult to read juries. perhaps if we saw some divisions where we got some notes to get some insight into what they were thinking, maybe. but we're not getting any insight at all. the only speculation among reporters is that these jurors probably don't want to go into the holiday next week without a verdict. and i'm sure a lot of them have plans for the holiday and they probably want to get out of town so who knows? >> well we do know paul wagner will be up here with me and we'll be talking about the
