follow a developing story occupy wall street protest in new york city cleared. >> but not without dozens of arrests fox 5s. sarah simmons back with the latest, sarah. >> reporter: well, alison and tony police in riot gear started the sweep in lower manhattan, early morning hours take a look the city deemed the park an increasing health and fire safety hazard. so the order was given to clear out the demonstrators what you are looking at now are live pictures coming to us of protestors being allowed back into the park, there has been a back and forth going on this morning, they were told to get out, by police so they could sanitize that park, so the crews went in cleaned the area where people have been camping out for the past two months officers made 70 arrests including some people, who chained themselves together, protestors were told they could return but without their sleeping bags, tarps and tents but just minutes ago associated press is reporting that a court

order will allow protestors to return with their tents to the park mayor bloomberg, just held a news conference as well to explain the decision to clear the park here is what he had to say. >> overtime, i have become increasingly concerned as had the owners of the park, brook field properties the occupation was coming to pose a health and fire safety hazard to the protestors and surrounding community we have been in constant contact with brook field yesterday they requested the city insisted on enforcing no sleeping and camping rules in the park. make no mistake the final decision to act was mine and mine alone. >> now, a similar story happening at the occupy camp in oakland california police evicted protestors for a second time in recent days oakland's mayor, had allowed demonstrators to previously re- establish their tent city but say they pose too many health

to live by certainly rules that traders and the like have to live by, but they on capitol hill some how are exempt from those rules. >> that's right it is a double standard corporate insiders using inside information to benefit that is a crime politicians using incite information, to make their own investments that is not a crime perhaps it should be. >> when we talk about this kind of thing, it seems to me, there would be opportunities for any of these politicians to kind of opt out of certain discussions or what have you or certainly just not to use the information they hear, to make financial decisions. why do you thing they don't do that? it would be relatively easy to do. >> some times doing the right thing is not as easy as it appears, rather than opting out of discussions politicians should opt out of the opportunity of using that inside information to make their personal investment they should not engage in personal public offerings, not trade

stocks they have information on it is better for them to put all their assets in a blind trust and have that managed passively so long as they are in office >> i know you are not an expert on this question but do we know if any congress people do that. seems most stories we hear are people who are using this knowledge to their own personal advantage. >> that's right. there is good evidence that members of congress, senatormembers to house of representatives, on average have greater investment returns than the typical citizen that gives appearance they are unusually skilled, highly lucky or that they are using inside information to their advantage. >> one point this particular piece on 60 minutes made is that one, not only do they do better but they do extremely well, while they are in congress, being a congress person or senator itself does -- i mean it pays well. >> it does. >> more than most americans make but you can't become rich doing that job but many of them become rich while in office. >> they should become rich in

their ability to serve the public not rich in ability to pick individual stocks or participate in ipos that allow them to gain specific gains on specific corporations for which they have inside information. >> one thing you mentioned was the blind trust seems like it should be instituted what about these ethics rules that allow these types of activities to happen any chance we will see changes in that? >> well, the office of congressional ethics has no teeth and the congressional ethics committee has few eyes, certainly the standards could be tightened i think it is a good idea to enact reforms that would prevent members of congress from participating in ipos and individual stock trades so long as they are in office. >> right now are we relying on congress to police itself? >> the foxes are watching the hen house. yes. >> well, there you go. mark rohm with georgetown university i am sure we will hear a lot more about this in the coming days thanks for
