temperatures right now across the area, not too bad. 42degrees at baltimore. 47degrees at dulles. 46 at d.c. 45 to the south at fredericksburg. little chilly this morning. we will get a warmup and temperatures are going to be fairly on the up side into the low 60s. mild today as well. the jet stream giving us an advantage of getting a little flow of southerly air. the clouds will definitely be sticking around. by midday, we'll be around 59 degrees. the same at the 5:00 hour. today's high will be about 61 degrees. some changes coming up in the five-day forecast. i'll have those details a little later. back to you. thank you. the grace period is over for icc commuters. had had been free to ride since the road opened more than a week ago. that road connects i-270 in maryland to i-95 in laurel in prince george's county, maryland. the icc will cost drivers 25 cents a mile at peak times.

twenty cents a mile for offpeak times, and ten cents a mile overnight. all day standardoff with police topping our stories this morning. occupy protestors refuse to take down a building they put up saturday night. >> u.s. park police brought in an armored vehicle, a giant air bag, and a cherry picker. let's get the latest from fox 5's stacey cohan live in mcpherson square this morning. quite the assembly of heavy tools there. >> reporter: really is an unusual combination of equipment. let me tell you what happened yesterday. of course, it was law enforcement that brought in all the objects, and that is because there was a conflict over a structure erected by the occupy d.c. group on saturday. it was about a 15-foot wooden structure, a house-like structure that the protestors said was going to be used to help them with the winter cold

and to show an example of affordable greenhousing. well, law enforcement said no thanks, you don't have a permit. you have to take it down. when they didn't, it led to a standoff. some of the protestors climbed the roof of the structure and refused to get down. that is when late yesterday the armored car rolled in. they brought out an air mattress in case anybody jumped and yes, they had to remove some of the protestors with the help of a cherry picker. >> when you're building a building in a municipality, there are government inspections to ensure safety. that's not something that took place and our concern for light safety issues. >> reporter: so the structure was removed. bulldozed more specifically from the camp here at mcpherson square. it was on the southwest corner of the camp i am told. the protestors here this morning, all is quiet. i will tell you the metropolitan police department have been casually strolling through mcpherson square all morning long. there are several police cars parked on the circumference of

the park. but there's been no conflict. total of 31 protestors were arrested yesterday. reporting live, i'm stacey cohan. back to you. >> thank you very much. new this morning, montgomery county police on the scene of a possible break-in at a sears store in white oaks shopping center. a store alarm went off after 12:30 this morning. police are currently on the hunt for suspects inside and outside that building. as soon as we get more information on this one, we'll pass it along to you. the search is back on for a sanitation worker who disappeared friday. charles duckett went out to retrieve a dead deer at the triadelphia water shed. his boat returned with the deer inside, but duckett was nowhere to be found. crews from several agencies have been searching the area since then. duckett's family and friends spoke out over the weekend. >> we thank those who have spent the last few days looking for chuck.

it means a lot that so many people have been searching and we hope the search will continue. we are not giving up. please help us find him and keep him in your prayers until we do. >> montgomery county fire and rescue resumed their search about an hour and a half ago. woman accused of going on a crime spree in maryland and virginia makes an appearance in federal court today. stephanie schwab is expected to enter a plea. she is suspected in two bank robberies and two carjackings. the d.c. council plans to hold a closed door meeting today to discuss a so-called personnel matter. this comes three days after federal agents raided the home of councilman harry thomas, junior. ward 5 representative is accused of funneling $300,000 in city money from a charity he runs so heck use the money himself.

thomas maintains his innocence. he has offered to repay that money. the council can't remove him in office, but they have options, including a formal reprimand. the race for the white house is down one this morning. the republican or the remaining republican field is wasting no time fighting for herman cain's supporters. >> he dropped off the race saturday. but he could still play a big role in the process. our sarah simmons is back to explain. >> that's right. herman cain's fortunes may have been falling, but his former rivals know he has a deep well of supporters. >> reporter: cain gone, but not forgotten. >> i am spending my presidential campaign. >> reporter: the dust barely settled on his announced withdrawal, and already other candidates courting his supporters. >> our office had call after call of people wanting to switch over and support me,

because people realize i'm the true tea party candidate. >> reporter: for now, gingrich seems the most likely beneficiary. many believe cain supporters were already defecting to gingrich with more to come. but yesterday, one leading republican in congress made his distaste for gingrich surprisingly clear. >> i just found his leadership lacking and i'm not going to into greater detail on that. i will have difficulty supporting him as president. >> reporter: still, polls show gingrich is poised to do well in iowa. with cain supporters in play less than a month before the caucuses, the race could quickly change. >> i think that newt gingrich probably the likely beneficiary. we're seeing that, we've been seeing it at least a week now, maybe more. i would not be surprised to see a santorum boomlet as well. >> an announcement today could further shake things up.

fox affiliate in atlanta is reporting cain is expected to endorse gingrich. we'll be keeping a close eye on that. back to you. >> thank you very much. we will find out later this morning if the supreme court will take up the case of the of a man accused of touching the vice president on the shoulder. the man expressed his feelings to cheney and touched him, leading to his arrest by the secret service. he claims his arrest was because of his criticism of the war. developing overseas today, hours ago the united states and other nations promised continued support to afghanistan, even after combat troops leave in 2014. secretary of state hillary clinton says the u.s. is prepared to stand with the afghan people for the long haul. but she stressed in return they must make commitments to reform, fighting corruption and

strengthening the rule of law. a british court has given the wick e location founder -- his lawyers argue there is a question of whether police and prosecutors have the power to issue extradition requests under european law. he has 14 days to submit a written request to the supreme court. a rebuke to vladimir putin. his party barely won the majority. but there are claims of ballot stuffing and other fraud. police detained people for protesting against the results. >> reporter: russian police arresting dozens of protestors in two cities sunday, as voters casting their ballots are calling the process anything but free and fair.

>>(translator): i'm here voting for freedom of choice, which we don't have. and i hope we get a normal parliament in our country at last. not as it is today. >> reporter: authorities detaining dozens more in saint petersburg. >>(translator): these are the most despicable elections in awful history. >>(translator): we're seeing a violation of our right to vote against someone and of our right to vote for the party we want. >> reporter: as the president is seen here casting his ballot, prime minister vladimir putin's support is eroding. the united russian party is still the clear winner, as the ballots are counted. but the poll numbers are adding up to a significant loss. united russia stands to lose many of the 300 seats it currently holds in the 450 seat

assembly. putin speaking today saying the voting was optimal and really reflects the situation in the country. the stakes are high for vladimir putin, as these election results will pave the way for his return to the presidency. in september it was announced the president and putin would switch roles. yesterday's election results showed support for putin slipping. he is though still on track to win the presidential vote in march. the virginia governor's race is getting a lot of attention from both parties. next, a closer look at the newest man to throw his name in the hat of candidates, the attorney general. plus, red carpet rolls out in the nation's capital. a look at the recipients of the

just a celebration of movies, music and broadway at last night's kennedy center honors. the annual awards ceremony brought out some of the biggest stars, here to honor some of the entertainment's greatest. among the honorees, yo-yo ma, neil diamond, and meryl streep, who was all smiles on the red carpet. >> you've won many awards. how does this compare to the academy awards, all of the other great things you've received? >> well, the academy is very august. but the president, the president of the united states, on behalf of the people of the united states. it's an amazing honor. >> the kennedy center honors will air on another network at the end of the month. tony? you've seen all you needed

to see there. virginia's attorney general has all but guaranteed infighting. cuccinelli's announcement he'll run for governor is already causing division in the gop. joining us with more is robert mccartney, metro columnist at the "washington post." he wrote about this in yesterday's paper. i guess in a way it's not a surprise, because cuccinelli is aggressive, made a name for himself nationally. things look to be rather easy, not easy, but set for the republicans for the gubernatorial race and now -- >> tony, bill bowling, who is the lieutenant governor, he's been the heir apparent. he basically cut a deal two years ago with now governor mcdonald, that mcdonald would run first, and bowling run, and not challenge mcdonald two

years ago and the deal was mcdonald would support him in 2012. so bowling could be governor. cuccinelli, the attorney general, the tea party favorite, well known sort of fire brand, confrontational guy, he was not party to that deal. but he told people, a lot of republicans say he told them he wasn't going to run for governor. that he was going to run for re- election of attorney general. he made noises about possibly running for the u.s. senate seat held by mark warner. instead now, he's saying something that a lot of people have been expecting, that he was in fact going to challenge bowling for the nomination. this just creates an instant rift in what had been a very unified republican party in virginia. >> you refer to it as a back stabbing move. >> in the sense he let people understand he wasn't going to do this, that he was going to run for re-election as attorney general or do something else. that he didn't have his eyes on

the governorship. he let people believe that. >> why would he do it now? he's a young man. he certainly could serve out as attorney general for another extended period of time and then run later on. why do it now? >> i think that's a good question. i think partly, you know, six years, to wait six years, that's a long time. who knows what the political climate will be like then? he's very popular now with the base, with the republican base. i think he might have felt this was his best chance, if he was going to move up, this was the time to do it. you tend to -- virginia has this pattern of sort of each party gets the governorship two turns and it flips. that's going back several flips. that's the way it's been. he might feel like the democrats might be set to win four years down the road.

who knows what motivate -- what particularly motivated him. but this is going to be -- he's going to challenge bowling. there will be a split in the republican party in virginia for the next, basically 18 months, until the primary, which is in june 2013. >> doesn't this just make the democrats lick their lips? >> they're licking their lips. they are certainly looking forward to seeing the virginia republican party tear itself apart. but i would caution them against getting too overconfident. the republicans have won three straight state wide elections. the most likely candidate they have to run for governor is terry mcauliffe, not held office in the state of virginia. basically best known for having been a big fundraiser for bill clinton. lived in virginia that time, but basically been a national fund raising guy, not a

virginia guy. he didn't even win the primary last time to run for governorship on the democratic ticket. so i think the democrats should be, you know, wary of this. they may be happy to see this is happening in the republican party, but if cuccinelli gets the nomination, which is a good chance. he's very popular. >> formidable. >> yeah, popular. better known than bowling. but bowling will have mcdonald's support going in. if cuccinelli gets the nomination and wins, the way the republicans have been winning in virginia, then you're going to have, i would say a more conservative, more assertive, i would say more radical conservative in the governor's seat than you've got now. >> going to make for an interesting couple of years. that's for sure. robert, thanks for coming in. hopefully we'll see you later this week. >> there's a lot coming this

osu's president says he doesn't know what more stadium security could have done. one student was airlifted to the hospital and remains in stable condition. eight others hospitalized, including two with broken ankles. no need for parents to panic, supposedly. a new study is out about teen sexting and reveals good news. turns out it may not be as widespread as people believe. the study shows only 1% of kids age 10 to 17 years old have shared racy photos of themselves or others. the research suggests it's more common among older teens. previous reports said as many as 20% have participated in sexting. you can find the study in the journal of pediatrics. ahead of wednesday's 70th anniversary of the japanese attack on pearl harbor, survivors are gathering in hawaii today. more than 3,000 people attending the ceremony. some survivors will be joined

about 10 minutes. the dow is up 140 points. all right. keep it up. on friday, markets of course soared after november's unemployment dropped to 8.6%. they then closed flat. this morning investors apparently are optimistic that european leaders will agree on a plan to restore long-term confidence in the euro. it could take longer for you to get your mail or where you want it to go. the postal service may end its guaranteed next day delivery service. they'll announce the cost cutting proposal later today, hoping to save $3 billion with this plan. these cuts would kick in in the spring. postal service is also considering hundreds of closures of processing centers and laying off thousands of employees. that's the down side in all of that. still ahead on fox 5 morning news, today's pet project. may seem like a good idea, especially when you see these guys, but we're going to tell you why giving a dog or a cat

fun holiday show. she's in the tree. hello, annie. >> reporter: this is the highlight of my morning, to be a part of this tree. i have my bulbs straight, my garland is nicely done and perfect. i'm good to go. i have my own bib. so thank you very much down there who gave me this. for 25 years, they have put on this particular show. it's unique, one of a kind. you have to experience this firsthand. joining us now is tony, the director and he is quite fun, everyone. definitely come out here. very animated. tony, good morning. >> good morning. >> reporter: how are you? >> doing well, thank you. >> reporter: thank you for being out here today with us. talk about how long have you been here and what does it take to put this production together? >> this is my 19th year. i was talking earlier, i started as a page turner in the orchestra and this is my 13th

year directing the show. it's a monumental task, but we enjoy it. to learn the music we start in august. i listen to, as soon as is easter over, i start listening to new music for christmas and then it's great to sing christmas music through the summer. >> reporter: there are several shows going on friday through sunday. but over the years have you had to add more because of the popularity? >> yes. i think when we first started there were two shows, and then we did three shows over two weekends and we added matinees and decided to do all five shows in one weekend. >> reporter: here down below me i have bob sheldon. hello, bob. >> hi. >> reporter: how are you? >> wonderful, thanks. >> reporter: arlene, his lovely wife. and betty jane. these three have been on the choir 25 years, is that right? >> right. >> reporter: what do you like most about being a part of this? >> this tree? >> reporter: yes. the whole production. >> it's a part of the wonderful ministries of this church, number one.

disappoint. you always come with the adorable dogs. you said there's a down side of course. >> there is a down side, unfortunately. there are so many that need homes. unfortunately, particularly as christmas time, people want to give pets as gifts. not the best idea. we recommend you give the potential donor a card that says, this is good for the adoption fee at the rescue or shelter of your choice. >> great idea. >> you want to match the dogs. don't give an older person a large dog. >> right. >> 180 pounds that will drag him or her down the driveway. basically it's a matter of matching the pet to the household. >> and it's a personal choice, too. you're talking about a friend who will be with you hopefully for, you know, maybe even 20 years. >> absolutely. which is another reason an older person might not want a puppy. maybe a laid back older dog, doesn't require a lot of maintenance. and the financial issue is very important, of course, too. >> let's talk about that. dough boy is weighing gwen

down. we have with us danny. i want to talk about the financial commitment. danny, whom i have here, you might not know it, but he's been through several procedures. it's costly. >> danny has been to the emergency clinic and treated for a number of weeks. we're still collecting donations on his behalf, because the vet bills were well over $3,000 for one puppy. that is a huge consideration when you get any dog, but particularly a puppy. >> you think you're giving a gift of love. who do we have with us today? >> i have dynamite. you have danny. >> i have danny. >> gwen has -- >> litter mates, right? 11 weeks old. >> they are. and laura has dixie. the same litter. came from west virginia. unfortunately, large over population problem with virginia. litter mates. mom is a terrier mix. we're not sure about dad.
