and with dry conditions across the region look for a high, 50 degrees, more details on the forecast coming up shortly right now we get you an update on traffic with julie wright. good morning to you sir we are checking out that drive courtesy of the crew in sky fox for those travelling southbound on 95, not an easy commute delays from 198, trying to merge on to the outer loop of the belt way, it will remain slow as you work your way around from route 1 college park accident activity after georgia at the mormon temple has been cleared over. other side of town travelling inbound from the west, we have delays travelling in from fair oaks, down to 33 miles per hour towards the capitol belt way we check out delays from gainsville you are about 15 miles for hour trying to make your way in towards manassas.

virginia, montana, stay to the left to get by here. that is a check of your fox 5 on time traffic. today's big story, jerry sandusky an hour away from coming face to face with half of his accusers the attorney for the former penn state assistant coach said he welcomes today's preliminary hearing on more than 50 counts of child sex abuse involving 10 boys. the accusers allege they were assaulted in showers, lockers or his home. he continues to defend himself against the charges. >> struggles with the idea he loves kids but when he says that people can interpret that as sexual connotation. his attorneys will likely focus on reports of inconsistency. that report claims a close

family friend of mcquery claims he did not actually see sandusky assaulting that particular child he only heard what he calls sex noises coming from the showers. vote on capitol hill, republicans ready to push a bill through the house of representatives to continue a cut. it forces work to begin on the key stone oil pipeline from canada to the gulf. president obama has promised to veto it. some of the top stories this morning a police involved shooting in the district the suspect has since died. >> officers say he was firing off a gun into homes and an apartment complex. live in the northeast stacy good morning. >> reporter: good morning police will still remain on the

scene, 12 hours after this incident started trying to continue their investigation of this man firing a gun throughout this neighbourhood we are in the 5300 block clay terrace, northeast washington it started around 7:00 p.m. last night neighbors began the call the police because there was a person walking through the neighbourhood with a weapon firing indy scrim inaptly at homes, randomly people were frightened -- indy crim inaptly at homes, randomly people were frightened. they think in all there were as many as 30 gunshots. during the course of officers arriving on scene, the gunman continued to fire, officers gave commands for the gunman to drop the gun he did not the officers fired their weapons at the suspect and he went down. they immediately went to where the suspect was, and began to

night a university of maryland student walking back to his apartment was held up at gun point surveillance pictures later showed men using the victim's credit card at a convenience store. four demonstrators with occupy dc are on a hunger strike and shea they won't stop until congress gives -- and they say they won't stop until congress gives full voting rights. yesterday they tried to meet the senate majority leader. police in riot gear in baltimore removed occupiers from downtown. they were denied a request to continue their protest in the plaza city police moved in around 3:30 a.m. in what we are told was a peaceful raid. the race for the gop presidential nomination is becoming what republicans were trying to avoid a flurry of negative ads.

wash way that is a check of your fox 5 on time -- parkway that is a check of your fox 5 on time traffic. a federal judge will hear whether the government is violating the constitution. yesterday they announced they would block over the counter sales of the morning after pill. some government funded child care programs are under the microscope for safety violations. a federal auditor found the violations at over 100 head start centers across the nation. hey, maureen. hi alison and steve. the report is due out today inspector general, health and human services department they examined 175 head start facilities it compiled audits from 7 states may 2009 to october 2010 while the review was just a fraction of 1600

head start grantees it raises red flags about the safety of children in such programs. out of 24 examined, 21 did not fully comply to conduct criminal and other background checks. 90% of the facilities had toxic chemicals and cleaning supplies accessible to children. other concerns included a machete left near an outdoor play area, a center in the district with expired formula in their refrigerator. they are suggested on site monitoring and reviewing so yes, sir tiff policy changes head start is federally -- so yes, sir tiff policy changes, head start is federally funded. >> thank you. it is right now, 20 minutes past 7, up next why it will

for the guard later today. even though they traditionally started in massachusetts the tradition dates back to 1607. appears martin o'malley's trip to india was successful. he says nearly $60 million in business deals were signed during the recent trade mission and deals worth millions more are in the works. it included stops in mumbai and new delhi. later today we will hear if the federal reserve will raise rates any time soon. most economists do not thing this will be any major announcements but the fed will fine tune its strategy for communicating future changes in interest rates. doing so would help as sure investors rates will not rise before a specific time. according to deloits annual

cost you 40 minutes worth of time. travelling on the belt way, braddock road. jimmy is checking on both sides of the belt way. we are getting mixed reports which loop this is on the belt way they are checking for an accident north and southbound side as you try to work your way out of annondale. we had an incident west virginia, montana. that has cleared as you work your way past. no problems here 395 across the 14th street bridge heavy, slow and steady same for 295. that is a check of your fox 5 on time traffic. texting while driving and other distractions behind the wheel will be the focus at a national transportation safety board meeting today. they will take a closer look at the case of a 19-year-old police say caused a deadly highway pile up in missouri last year while texting. ntsb will determine the cause of the accident and could come

out with new recommendations on texting while driving. national media has descended on a small town courthouse in belfont pennsylvania. jerry sandusky will come face to face with some of his alleged victims. we will be joined for a couple minutes by paul, good morning i have covered many many preliminary hearings during my time, in pennsylvania, very few drew this much attention. tack about the crowd and the attention this case is getting. >> reporter: this entire downtown area here in bellfont has been shut down there is no traffic being allowed through here. we are expecting this hearing will take place 8:30 a.m. this morning, there are about 100 seats in the courthouse about 40 set aside for media and general public will get about 40 seats you have to be credentialed to get inside even

the general public. there was a lottery just to get a seat inside. there is an over flow room across the street for the news media and there are cameras inside the main courthouse, they will take the picture from inside the main courthouse and send it to the over flow room that is where reporters will be in there as well. about another 40 to 50 reporters that will be in the courthouse an next. we are expecting 8:30 a.m., the hearing to get under way this is a preliminary hearing jerry sandusky had the right, to waive this hearing but he wanted to face his accusers according to his lawyer. we do expect there will be a number of these young men, who have made these accusations to be escorted in through the back of the courthouse we don't expect these young men to be identified they may take the stand and they may not have to give their names at this point. let me also point out for people in the washington area, this is very unusual we normally don't see this, in preliminary hearings in the washington area where witnesses

are actually brought in to testify in a preliminary hearing we may see a police officer or two but generally you don't see the witnesses. >> interesting twist how they do things in pennsylvania with preliminary hearings the essential reason for it so that the judge, magistrate, district justice, would have the determination whether or not there will be enough evidence to send this case to trial. sounds like in this case it is sandusky's attorneys want this to happen to get a better idea what types of testimony they might hear from these witnesses to better set their defense when it goes to trial. >> reporter: that's right. sandusky's attorney has said he wants to lock in their testimony, he wants to hear what they have to say, that will then lead to his defense azure mentioned there is a bar that has -- defense as you mentioned, there is a bar that has to be set here. the judge has to hear enough evidence to say okay i have heard enough we will go to trial. there is a slim possibility

sandusky himself could take the stand we don't really expect that. i think the testimony a lot of people want to hear is from mike mcquery in the past couple days a story came out in the patriot news that said there was a third person at this meeting with him and his father, another man a doctor who said mike said he didn't see any actual sexual assault inside the showers that day and that is opposite of what mcquery said from that incident back in 2002 inside the football house, in state college. so, mcquery's testimony will be very interesting to hear what he has to say under oath in front of this judge. >> let me ask you real quick paul we are running short on time but mike mcquery, said as the state's store witness in this case, -- star witness in this case using their words not ours, but seems the alleged

victims, they will get the testify it seems a slam dunk they will get to send this case to trial but how much weight is on mcquery's testimony, and being the quote unquote star witness when so many others have come forward. >> he is the only one who claims to have either seen or heard, we will hear what he has to say, jerry sandusky engage in some kind of sexual activity with these young boys. opposite that, is the allegations from the young boys, so he is a secondary witness, if you will, that has come forward to say i saw this. so his testimony, is a very very important one. i know you will keep track of things there. continue your blogging and updating go get your seat we will talk with you soon. >> okay steve. >> paul wagner live in belfont pennsylvania. we are coming up on the 2 year anniversary of the haiti earthquake there is still so much more to do for that

making headlines, three band members at florida a and m are under arrest accused in the beating of a woman during hazing rituals, police say the three hit band member brea hunters legs breaking her thigh

bone causing blood clots the beating came three weeks before a drum major at the school was killed, during a drum trip to orlando. hading was involved in that case. hunters may be to blame for shooting two middle school students in south texas. one boy is in critical condition, the other in stable condition awaiting x rays shots may have come from hunters on adjacent farm property three hunters were taken in for questioning but no immediate arrests. january 12th marks the three year anniversary of a devastating earthquake that marks haiti. >> foxes aiynsley ear hart has more. >> reporter: some notable names on hand in haiti lending efforts to make the impoverished country a better place. kim kardashian, minister lewis fair can, celebrity shift ron duprat and oprah winfrey to name a few. she plans to highlight the country on a new show airing on

air or crashed separately. an army spokesperson said the accident happened at a training area, at joint base lewis mccord and an investigation is under way this morning. dc police take down a man suspected of randomly shooting into homes. this happened clay terrace northeast dc last night. the suspect has since died stacy. >> reporter: good morning the police are still out here, more than 12 hours following this shooting. a man apparently was walking around the housing project in clay terrace firing shots, witnesses say he had a gun he would pull out the gun and begin shooting then once again conceal the weapon. begin firing more. apparently he fired in the direction of some of the homes no body that we know of was injured in this shooting. however dc police arrived on the scene they got called he was maybe on pcp because of his

erratic behaviour. they warned him to put down the weapon he did not. they shot him cpr was performed on scene but he did die. some witnesses say as many as 30 shots were fired from that weapon. police have identified him but his name has not been released pending family notification. stacy cohen back to you. >> thanks very much. alison. former penn state assistant football coach jerry sandusky heads to court today. his lawyer said the excoach is eager to face his accusers as many as 10 young men could publicly testify today. he is being accused of more than 50 counts of child sex abuse. joining this morning with more on what we could here is an attorney. good to see you joseph. >> thanks for having me back. >> preliminary hearing what does that entail for jerry sandusky.

>> it is a proceedier, where by prosecution will have to convince a judge that the prosecution has sufficient evidence to link, sandusky, to the commission of a crime. if a judge is convinced then the judge will hold the case over and set a day for trial. >> expected -- we are expected to hear from mike mcquery he was the assistant coach the one who came out with the initial -- the first person to visit as key witness in this who said he witnessed some activity between jerry sandusky and a young child. we might hear from these accusers seems like a pretty good case might be set up. >> it does. if you look at the grand jury report, that lays out the evidence that likely will be presented at the preliminary hearing that probably will be sufficient for the judge to say yes, i think sandusky is linked to the commission of a crime and there should be a trial. we could expect to hear, from some of the victim's themselves we might hear from mcquery although he is a secondary

witness, if you would, that would provide some coobserving ration to the direct testimony of the victims of the offensive sandusky conduct as alleged. >> he said he is looking forward to this today, perhaps to hear what his accusers are saying to maintain his innocence or what have you. should we believe he is looking forward to this day? at the very least very emotional. >> you are looking forward to it in a sense you want to put the prosecution to its test you want to be able to be in a position to gauge just what and how strong the prosecution's evidence is you want to be able to confront your accusers, you want to be able to nail them down lock them into a particular point of view or particular story. a preliminary hearing provides a unique opportunity, for a defendant for a person that has been accused of a crime, to question, the witnesses because in a criminal case unlike a

civil case, there is not typically an opportunity to engage in that fact finding before trial so it is typically in a criminal case you get to trial, you have a general sense of what the witness is going to testify to but don't get to confront them question them cross-examine them or put them to the test. here, the defense, sandusky's team will have an opportunity to do just that. >> do we expect sandusky to take the stand? >> i wouldn't expect he would do that, it is not necessary. really, i think it is more locking in the prosecutions case and gauging just how strong of a defense that you have, and what you need to overcome charges. >> what would be next after this the judge would then have to decide if this goes forward. that is what we can expect next. >> the judge will decide is there enough evidence to have this case set down for trial there will be a trial.

years regarding the federal work force. extend that two year cost of living pay freeze for another year you would actually average the retirements of newer federal workers over their highst five years compensation as opposed to highest three years which might reduce benefits overall and force all federal employees to pay a little more into their retirement and take the load off tax payers and federal government. >> sounds on the surface it might be good news for the government not so good news for all the federal workers living in washington. >> especially newer ones less than 5 years experience those hired beginning 2013 the idea is that they are respecting the fact there are retirees planning for 20, 30 years to retire newer ones will have to face a different calculation if thispasses. it is likely to get through the house if only because republican leaders will put something up that would

ultimately fail. a lot of provisions are in the senate a lot of democrats don't have a problem making federal adjustments for employees but this whole issue over the key stone pipeline that would run from canada town to texas, house republican proposal essentially makes that decision forces the president to sign off on it, sooner rather than later he would rather wait until after next year 's election. republicans argue it creates jobs, spurs economy why wouldn't you want to do that. if it does not go through, what happens then to these proposals? >> they keep coming up in different spending bills. it was proposed earlier this year, got kicked out of the 2012 budget it is in this again. frankly the thing to keep in mind if republicans do some how win the house and senate it is the type of thing that would probably happen very quickly after that and get passed in both chambers because there is

enough political will to make it happen. what you are seeing now is what federal workers would consider a more humane proposal it would effect newer workers as opposed to all workers republicans have been pushing for this since 2009 every time a new big spending bill comes up they put it in there. all those fiscal commissions have suggested a similar proposal. >> seems so long the government jobs or curby jobs, -- cushy jobs things have changed. public sector continues to cut jobs,. not to get too far ahead of ourselves but if republicans would gain control of house and senate loud would that change the federal work force. it would come pet a lot of -- compel a lot of people to retire if. there has been fear if many years a retirement tsunami or a
