waived this mornings hearing the disgraced former assistant coach for penn state appeared in court to see if the mat earn should go -- matter should go to trial. he waived the preliminary hearing, good morning paul. >> reporter: good morning tony and alison. stunning turn of events here in bellefonte pennsylvania. i had just sat down inside the over flow courtroom that was just over here on the corner in the courthouse an next an area they had set aside -- annex an area they had set aside as i sat down, the judge walked in said are there any preliminary mappers to discuss. -- matters to discuss. sandusky's attorney walked up to the bench and it only took a second they came and sat down and the judge said mr. sandusky has agreed to waive his

preliminary hearing a groan went up inside the over flow courtroom everyone knew there would be no testimony at all. in fact we learned from one of the torns of the victims, they knew about this last night witnesses were never brought here to the courthouse. let's play a little bit of a remark from the senior deputy attorney general who came outside and spoke to the media, explaining what this means for his case. >> helps prosecution in a lot of ways, and, frankly, in addition to the technical prosecution in the case, again, i want to emphasize, what it would mean for victims in terms of not creating a second record because one already exists from the grand jury proceeding and

not having to go through the pain and suffering that is brought by a case like this, i think, is an important factor to consider. all right well, once again, breaking news, this morning, where jerry sandusky waived his right to the preliminary hearing, i think we have paul back with us now who can tell us a little bit more about what is going on in pennsylvania. paul. all right tony, lost that shot for just a second. we did hear from michael bonnie the defense attorney for victim number one he came out and said victim number one was very very nervous about having to testify but ready to testify, they had gotten an indication last night, that this preliminary hearing was going to be waived so he was never brought to the courthouse. now just a few minutes after sandusky indicated to the judge he wanted to waive the hearing he left through the back of the courthouse let's play that

right now. >> stay the course, we will waive the opportunity to present our side. >> why not. >> tell me why you didn't do a preliminary hearing. i will come back and answer your questions. >> mr. sandusky, are you looking forward to facing your accusers. >> the answer is yes [ yelling in the background ] >> this preliminary hearing was going the take all day today here in bellefonte we were expecting as many as 11 witnesses to testify including possibly mike mcqueary, he was the penn state graduate student who said he saw, jerry sandusky

engaged in sexual behaviour with a very young boy in a locker room on the penn state campus back in 2002 but he has been placed on administrative leave since the grand jury testimony came out because many in the public were angered by what he had to say they didn't believe he had done enough at that time to actually stop what he believed was the abuse of course we all know, the cards began to fall after that, joe paterno, the penn state football coach, head coach he was fired, the school president lost his job two others in the school administration are facing purgery charges, because of what mike mcqueary had to say. perhaps he had gotten the word as well we don't see him here today, that he was not going to have to testify we were all here and ready to listen at this hearing today expected to take all day long. it will not be held now.

jerry sandusky waived his right to a preliminary hearing back to you. >> paul can i ask a quick question what are we to make of this. we heard one of sandusky's attorneys saying we weren't ready to present our case today. theoretically they should have been ready we knew that the state was coming. is this just because maybe they didn't want to hear all of that at this time? or -- what do we make from this. >> some of the speculation on the part of sandusky's attorney was that he wanted to hear this testimony, lock it in, under oath, so he would know exactly what he was going to be up against when they go to trial. the fact they suddenly decided they didn't want to do that, is surprising, and is confusing. now, he did say to the media as he left the courthouse he will explain it we will have to wait and hear what he had to say, michael bonnie the defense attorney for one of the victims, victim number one said

he is hoping this is a precursor to a plea deal. >> all right paul wagner reporting from pennsylvania thank you. >> thanks paul. in other news this morning, four army soldiers killed in a helicopter crash in washington state last night two choppers crashed at a base south of tacoma, it is not clear if they collided in mid-air or crashed separately they want down in a training area near the base the army is not releasing the names of four soldiers killed in the crash two other soldiers were injured. now on to top stories here in our area. a police involved shooting in dc officers shot and killed a man suspected of randomly shooting into homes along clay terrace in northeast. stacy cohen is live on the scene with the latest good morning. >> reporter: good morning the police have been out here ever since that shooting last night however i don't see any cadets

out here combing the scene yet. it was our interpretation they were waiting for daylight to do more investigation. it happened around 7:00 p.m. last night when a man firing shots started walking through the neighbourhood. he was firing randomly some times putting his gun away and bringing it back out again. dc police were called to the scene neighbors speculated he might be high on pcp or some other what lieu sew know generals, police responded when he refused to drop his weapon the police fired their weapon he was shot, cpr was performed on the scene he did not survive he was pronounced dead. police have not released his identity pending family notification. no one in the neighbourhood was hurt. reporting live, back to you. >> good news out of that story stacy thank you. alison police in college park are looking for theseus februarys, you can see them on your screen they are believed to be connected to -- for these

suspects, you can see them on your screen they are believed to be connected to a robbery. surveillance pictures captured later show three men using the victim's credit card at a convenience store. >> possible new charges in a year old hit and run case in the district. davidson was found guilty of dui and leaving the scene in june a judge is ruling prosecutors can retry the case after one admits they forgot to file manslaughter charges in the original inditement prosecutors want to file new charges against the 31-year-old for a crash that killed 24-year- old ryan, in october of last year. occupy dc protestors are on a hunger strike refusing all food until congress grants full representation to the nations capitol. protestors fighting for dc voting rights plan to gather today, at the office of the chairman that over sees the

>> just four years ago there were 170,000 troops in iraq, it is down to 6,000 they are due to leave by the end of this month. president barack obama met with iraq's prime minister to talk with the future of iraq after the american presence is gone. one troubles issue is current unrest in syria. he wants him to step down but they predict civil war if that happens. joining us now is the director of critical threats project at american enterprise institute and expert on defense, military and iraq. fred welcome to the show. how did the meeting go yesterday with the iraqi prime minister and president barack obama. >> sounds like it went as we might have expected a general whitewash of the various problems that are confronting iraq, some pretty broad unsubstantiated statements and

how well things are going there. >> okay what would you like to see as someone who studied this part of the country and military. >> well, what i would like to see put in place has to be based on recognition there is serious problems including in the way the government has been managing its internal affairs and sectarianism threatening to unravel political stability in iraq. we need to support iraq militarily it is not able to defriend itself on the other hand we -- defend itself on the other hand we take to take an increasingly hard line to get him to stop taking action undermining peace and security in iraq. >> so, then, i would sense you don't agree with the entire pull out over u.s. troops in iraq. >> no, i thought that was a badly handled negotiation, bad decision it will have dire consequences for american national security the question is what do we do going forward now, i think the worst thing we can do in many respects is what

president obama did yesterday, declare blanket victory declare everything is okay because it supports the policy he prefers and really just turn a blind eye to the many many problems that remain and challenges that remain. >> this conflict seemed to be ongoing, nine years, what would the better course of action have been militarily speaking? >> well, no one imagines that when president bush signed the agreement that had us, all our forces out end of the year everyone expected that would be renegotiated, including the obama administration. they didn't think they would be able to defend themselves that we could leave and lose that leverage and not have any problems. it was a sudden decision that the president obama made to abandon negotiations i think negotiations themselves were not set up for success by this

administrations policy. we have gone off course in iraq the president has charted a new approach but has not outlined a new strategy. saying you are going to normalize it is not a way to establish this in iraq. they have never been able to understand america does have vital interests in iraq whether they like it or not. >> what does happen with our preseasons, our influence, you are saying i think that it is not that great in a time that we need it to be better. >> the problem we have, the shiite cleric waging war on us, within 72 hours he said he would consider the presence of american diplomats, an occupation. i understand american diplomats are no longer able to move

around iraq this is an entirely predictable problem we have not been tracking on the degree or the administration has not been tracking on the degree to which iran is playing for keeps in iraq their goal is to remove us from iraq entirely unless we admit this is something of a proxy struggle going on in iraq and start to play that and address what the iranians are doing and militia we are unlikely to have a lot of influence in iraq going forward, other than direct counter terrorism by which we mean al qaeda, as will be defined by the iraqi government and the real danger is that we will be drawn into being the hammer for a shiite sectarian approach. which we have seen before. we are out of time you had a short concise answer to what happens to the u.s. troops, off topic a little bit but they come home what is next? >> well, they will come home,

contraceptive. the decision crushed the food and drug administrations effort to make the drug available to all teenagers without a prescription. an important story government funded child care programs are under the microscope for safety violations the review out by inspector general, health and human services department examined 175 head start facilities, they come pine audits from centers in seven states including district of columbia, may 2009 to october 2010 out of 24 grantees examined 21 did not comply fully with head start requirements to conduct criminal or other background checks. 90% of facilities had toxic chemicals and cleaning supplies accessible to children more than 70% had open or broken gates leading to parking lots, streets or unsupervised areas. other concerns were a machete left near an outdoor play area, and a center in the district

welcome back 9:29 a.m. new this morning we are getting updates on what many are calling a major scientific discovery. one of two teams searching for a tiny particle believed to be the building block of the universe say they have narrowed the field where that particle might be. they is not actually found it the particle which is referred to as higgs boson only exists in theory but wharfies cysts -- what physicists use to explain why everything around us have mass. one team has not been able to find it they have narrowed it down, and they have narrowed it down to a cabinet in the kitchen, in the science laboratory. they are searching they thing it is in there.

>> definitely we have low cost vaccine clinics, low cost neuter services, fantastic humane education department that reaches out to the community, we go to schools and can do programs anything from bears to basic pet care my favorite is jeepers creepers. >> the need, all year round it is so great i know for humane society tell us if anyone is watching they want to get involved what could charles county humane society use. >> volunteers we always need people, foster homes for kittens and dogs, people to help us clean, to help us go to adoption events and find them homes. >> right how is the shelter now? how many animals do you have? is it over loaded? >> we can hold 80 cats we have 80 cages, of course in each cage there is usually litters of kittens we house about 30 dogs. >> is it easier this time of year or harder? we have said never ever give a pet as a gift but i am just wondering this time of year do people come in and open up their homes to animals

i drove through bumpy roads for hours on end to try to find this community, the story was supposed to be about how his family received chickens we get to this community he comes out speaking perfect english which is strange, gertrude is trying to eat the ornaments. he was able to speak english because of the chickens. i pushed the family why does it matter he speaks english. he will get a good job, he is teaching his neighbourhood friends they will all be able to get good quality jobs. chickens, produce eggs the family can eat, sell extra eggs, chickens can -- it is amazing even the goats, the manure provides fertilization. >> you have done your homework.

story of ebenezer scrooge. annie is getting a sneak peek. >> reporter: good morning tony and alison. so we are still here at the grill at morrison house here in historic old town one of the greatest things about this area, is that there is so much to do including visiting the little theatre of alexandria they join me now rachel alberts good morning. tell us about the neater and history it was founded in 19 -- theatre and history it was founded in 1934. >> yes, one of the oldst still in operation community theaters in country we are fortunate we have our own space we can have a long season, seven plays plus a christmas show every year. >> tell us about the christmas show this year what is the show and how can people come out and watch. >> christmas caroll which we do every year one thing little theatre does is we have different directors you may see the same script every year but it will be a little different

we just added another performance sunday. >> good. >> because we are almost sold out you can still get some tickets at our website. what does it take for the theatre to sort of pull this production together you are doing shows throughout the year. >> we are we have a huge pool of volunteers we use almost 100 each show it takes for cast and crew. we do all our costumes, build our own sets. >> costumes are made there tell us about the lady who makes them. >> annie broom all of us -- she is an award winning -- she is a watch nominee, costumer she has costumed these 31 characterses, and i think four or five costumes each many of them and done a spectacular job. >> i would agree costumes are spectacular we will see a little scene of christmas caroll can you set it up for us. >> yes, this is a scene where we have boy scrooge, scrooge as
