approval rating is on the rise according to the latest gallup tracking poll, 47% of americans approve of the president's job performance. 45% say they disprove. this is the first time since the summer the approval ratings are in positive territory. investigators are calling a house fire in frederick maryland suspicious flames first reported at the home in the 3800 block of sugar loaf parkway 10:30 p.m. last night firefighters were able to keep it contained to two garages, it is considered suspicious at this point fortunately no body hurt. >> howard county investigators trying to pinpoint the cause of a motel fire. flames were first reported at white oak motel in oakridge. by the time the firefighters got there the second floor was engulfed all customers evacuated on their own. the cause again still under

investigation. police arrested a man accused of murdering two people and abducting a toddler in richmond. clemens was taken into custody late yesterday afternoon accused in the christmas eve murder of two people. he broke into the home, murdered the two people then stole an suv with a 2-year-old in the backseat the toddler was not hurt and is now back with his family. >> e motional plea for witnesses to come forward and help solve a christmas day murder. 23-year-old quentin perry junior was shot and killed walking near an austin hill apartment complex he was on the way home from the store after picking up items for his two daughters. >> last thing i said to him when he left i said i love you brother be safe. >> anyone with information should give prince georges county police a call. >> search continues for a

disabled maryland man now missing 11 days the 33-year-old left on a train he thought was headed from dc to alabama but never made it and no one has seen him since. >> mitchell smith is blind, has been missing for 10 days now and his family is plenty worried. >> you know, he is not knowing anything. he want to know where, what if he is okay. and as i say, that is what is so surprising to me, if he is okay why hasn't he called. >> relatives dropped him off at union station the evening of december 16th he had a ticket to birmingham a route he had taken many times before they turned him over to amtrak red caps who usual lies sort him to the train >> he has to haveassistance and get off the train he has to have assistance. we assumed it was amtrak who helped him on and off. >> that evening something went

wrong he wound up on a train headed to new orleans instead a virginia woman who was a passenger on the train tells fox 5 she heard amtrak employees tell him he could get off in charlotte and wait several hours for the next train to birmingham then she watched them help him off the train at the charlotte stop. now a charlotte police detective is investigating another new lead >> he said that in the confusion, he said i want to go back to washington and amtrak is supposed to have put him back on the train to come here. >> it has been 10 days christmas has come and gone and the 33-year-old is still missing his family wants answers. >> we have a human being missing who is dependent on help from others so that is a little disturbing i understand it is the holidays but that does concern me as well. >> i am ross slater, fox 5 news. >> family is hoping investigators can get surveillance footage that might

devastated part of 14 countries one of the deadliest natural disasters in recorded history. hard to believe it has been seven years. folks across the country have plenty to deal with in 2011. a look at this year's wild weather stories. >> mother nature hitting the u.s. with plenty of surprises this year. from hurricanes to an unexpected nor'easter headlines in 2011 were filled with stories of wild weather and natural disasters. a busy year for firefighters in the west and southwest. triple digit temperatures and dry conditions sparking thousands of wild fires in texas the most devastating blaze in state history, destroyed over 30,000-acres. >> oh, no,. >> reporter: and a deadly year for tornadoes, dangerous twisters ripping across the south back in april reducing thousands of homes to rubble,

killing more than 300 people across seven states in alabama alone, more than 200 people were killed. >> oh,. >> reporter: then in may a powerful ef-5 tornado touching down in joplin missouri completely destroying a small town killing 150 people. in august, hurricane irene, slammed states all along the east coast. the storm destroying homes, flooding roads and knocking down power lines. irene also creating a messy situation in maryland. check out ocean city and this reporter completely covered in foam. in vermont a dam is compromised causing hundreds to leave their homes. insult added to injury for arizona as a giant dust storm and record breaking temperatures, swept across parts of the state in august, temperatures reaching a

>> let's check with lauren hi lauren. >> good news morning commute not too messy we have the one incident we have been following i-95 virginia as you head northbound right near the mixing bowl let's take a live look from traffic land serious wreck there, fire truck at the scene everything is in the median for the most part, left shoulder there, looks like they are now blocking maybe the ramp to the outer loop. delays from before 7100 as you head northbound 66 slow traffic off and on from 50 fair oaks, but we did have a disabled vehicle, that has cleared out of the way still dealing with off and on the brakes there. lost our camera but things look great on the belt way no problems reported virginia or maryland. light delays off and on as you head past shady grove road other than that not much of an

issue. 95, bw parkway, running both directions between belt ways no problems route 50, john hanson highway. virginia drivers ticketed for driving without proof of insurance, may get out of that fine. several lawyers says the not illegal to not have proof of insurance in your vehicle. prince phillip p returned to the royal family's country estate after being hospitalized for a blocked coronary artery. he spent four nights in the hospital after complaining about chest pains. this is the most serious health care suffered by phillip who is known to be active and robust. pretty good for 90. >> it is actually. >> all right it is right now, 7:19 a.m. on tuesday. update on one of yesterday's top stories shooting of a soldier at his

the man accused of shooting and paralyzing a soldier at his home coming party is in custody. the 19-year-old turned himself in yesterday, he is accused of shooting christopher sullivan at friday night's party after getting into a fight over football with his younger brother soldier had been in kentucky recovering from injuries in a suicide bombing in afghanistan. police looking for three men suspected of holding up

three prince georges county businesses they robbed a burger king restaurant december 5th one of the men acted as a lookout the other two jumped over the counter and emptied the cash register one had a gun they believe the trio held up a wendy's last month and family dollar store last week. police say they have found the stolen van that belonged to the charity organization, treats for troops involved in a crash in the district four people ran out of the vehicle it was stolen from an arlington home last week. he started treats for troops a few years ago to make sure troops get something sweet once in awhile there were 50 pounds in the van at the times the not clear what they took from that van. >> no word on who won that $125 million power ball jackpot in maryland we know the winning ticket was sold at wesley's restaurant and liquor store on christmas eve an unidentified man called the ease tab

hospital to pick up a heart for transplant when the chopper went down it can no longer be used in another transplant because its viability expired the patient who was waiting for it, continues to wait for another organ. utah woman used facebook, to get her and her 17 month old disabled son rescued after they were being held captive five days she hid in a closet with the laptop and posted she would be dead by morning if they were not rescued someone saw the post is called police they got to the home and arrest add 33- year-old man. >> looking for an easy way to get rid of your christmas tree. starting to day prince georges county residents can participate in a freery cycling program leave the undecorated tree at the curb on your normally scheduled collection day and someone will pick it up. the program will be going on until january 31st. or leave it until the end

bad, 42 degrees this hour for national airport, 41 dulles, 40 degrees at baltimore, but clouds are in abundance everywhere and will continue to move in across the entire area ahead of a system that will bring rainfall plenty of that is across areas of the south and west of us we will see pockets of moderate to heavy rainfall throughout the course of the day as well. be prepared on the backside a lot of cooler air, areas along the allegheny front could see a snow shower or two. wet weather throughout the day by the time we get into late morning or afternoon hours, it will start to fill in and sticking around right through until the evening hours, we are not going to get much of a break this afternoon at all from it. a look at how much rain we anticipate. we are looking any where from a half inch to inch and a half overall. a little less than that to areas of the far southeast, here is future cast by the time we move into the afternoon hours it will be in full swing with heavy pockets of rainfall

across the region. once again keep the umbrella handy it will be around for your evening commute, around the 4, 5, 6:00 p.m. hour by the time we hit 7:00 p.m., it is all out of the way a ridge of high pressure will start to build in behind all this and that will set us up for drier air and sunshine with a few lingering clouds as we move into the later part of the week. a look at the 5 day forecast wet weather, gusty winds tonight as well winds are light this afternoon by tonight expecting them to pick up, 20 to 25 miles an hour that will be the same story wednesday that low pressure system pulls out and ridge of high pressure pulls in the pressure gradient between the two will be pretty tight we will see plenty of gusty winds not bad rest of the week wednesday to saturday, sun and clouds and slowly creep back to low 50s again by the end of the week. let's check now with lauren demarco. we do have the one trouble spot northbound 95 at the

mixing bowl just before the last hit we saw they had blocked off some of the lanes to head toward the hov exit for the outer loop let's take a live look and see what we've got going on now. looks like you are able the squeeze by, if you can still access the outer loop, far left there things are heavy and slow as you head northbound 95 approaching this accident activity, most part in the median you can see delays approaching the fairfax county parkway, slow traffic in the center of the screen to the left you have the hov lanes moving okay and southbound traffic no problems for you, 66 seeing heavy traffic, fair oaks towards 123, earlier disabled vehicle, your lane should be open at this point no problems to report on the belt way. nice easy trip through montgomery county. brief volume on the outer loop heading through silver spring. you are in good shape your lanes open inbound new york avenue, route 50 looks good as well. that is a check of your fox 5

until his release. we are going to ring in the new year this weekend of course joining us now as we take a look back at the old year 2011s biggest political headlines, political editor human events happy holidays. >> happy new year merry christmas. >> before we get to next year let's look back on last year what was the big political event headlines of 2011. >> in terms of american politics per se the presidential campaign started early, gets earlier and earlier every four years but on the other hand, all of the developments in american politics, were dwarfed by the clash on capitol hill between republicans and the house s the other end of pennsylvania avenue, president obama. and everything was transcended by the arab spring, when a fruit ped lar named mohammed, set himself on fire and took his own life, set off a fire that spread through the middle

east and changed the political development there forever. those dwarfed anything that would happen on the campaign trail and how the campaign trail moves up to top drawer. >> after that happened in 2011, as we get now close to the end of the year we don't seem to have settled much of that dispute between what is happening on capitol hill and the white house. >> it doesn't look that way and i think it is going to raise the debate to a very clear conflict over what role government should play in our lives what taxes will be like what the size of governments will be, and as negative and rank rows as the debate was it also set the stage for a very clear difference between the two major parties as they go to the polls in 2012. >> you mention the race for the white house we look at things on the republican side in 2011 we had a year of peaks and

valleys, candidates would emerge as a front runner and then falloff and then emerge as a front runner and then fall off a cliff. how did you find that compared to the past. >> not that much different to be honest with you, if you look at the democratic race, in 04, for example, there was a time when the national press and a lot of my colleagues thought general wesley clark was going to be the front runner, he did not even farewell in iowa and new hampshire. four years ago on the republican side, fred thompson was considered a top front runner and at one point lead all of the opponents he didn't do well when all the real voting came about. now newt gingrich had it for 73 days about as long as kim kardashians wedding. >> now we have to move forward into 2012 where eventually someone will be selected. we are close to iowa now what do you see happening. >> my goodness depends what

hour of the day it is. today it is just a little after 7:30 a.m., i would say that mitt romney and ron paul are fighting for the first place in iowa, and newt gingrich who had a lot of momentum has suffered some injury, shall we say, in the last week or so, but i think the big problem is less what he says, or any position he takes than the argument that he would admire namely, that he cannot organize, he does not have an infantry on the ground that is beginning to show in the hawk eye state. >> what do you think about what has been made in virginia and a lot of cam dates not getting on the -- candidates not getting on the primary ballot. >> you are referring to gingrich but also santorum who is a resident of the state and governor forry of texas. gain falls into that category

of one night stand for position of front runner it reflects a fact that not any of these candidates have fought beyond these early stages of the campaign beyond iowa, new hampshire, south carolina and florida which rounds out january. it is like the line in the end of the candidates, robert red ford wins the election and says what do i do now. i don't think they ever thought about what they do if they win those first races. >> is it possible in an election year like 2012 to have any political story that will prompt the presidential election. >> certainly i think if congress were ever to agree with the president on a budget finally, that would be a very dramatic story. if we were to see a stable government, emerge in egypt or libya, that was able to hold on and reign successfully for a few months, that would be a

in 2011 we saw 29 days, where the closing gain or loss, was 2% or more. usually we see five of those. 29 of those days just through november 2011 we are still counting, and when you put that into context per se, near retiree, pay a million dollars in their nest egg 2% loss in the day is $20,000, 4%, $40,000. you put those days together you can understand how panicked people are. people are still scarred, if you will, since 2008 afraid of seeing that big loss 30% or more. when they start to see 5 or 10% losses, that is when the panic comes in they are really just locking in losses at that point, smarter buyers are coming in and profiting. so generally, i mean you know, obviously depends on the individual but generally speaking better to just stay

would hire neutral financial specialist, they gather information for both parties rather than both parties fighting and lawyers working together in a non-adversarial manner. you kind of hinted at it but where did this come from? was it a group of attorneys saying there is a better way to do this? disgruntled people going through divorce saying i wish i had these people in my corner. >> well, it came from a combination of those things it started maybe about 20 years ago in minnesota, but recently taken place all over the world and there is an organization called the national association of collaborative professionals that has gotten together and cot fied this. it is being introduced in the legislature in maryland next session already introduced in

legislature in dc to provide another method for parties going through divorce that is not based in court and in fact the judiciary of maryland is so excited they have under written the training for hundreds of attorneys and provided a grant, so it can be low bono and pro bono attorneys for those with lesser means to participate. >> there is five associations of collaborative professionals and you can find a list of them on dc metro collaborative.org they have all the professionals listed and what they do but it is catching on in my practice, it is probably a third to a half collaborative law and people are interested in it and i have had couples that have gone through this process where had they been in a court pros is it would have been a disaster for example perhaps infidelity, perhaps there has been money spent inappropriately and rather than taking depositions and going through credit card accounts we have had a financial person

like onset? what are we seeing onset? >> the bulk -- it is kind of like a boat in a shape of a boat but not wooden it doesn't have all the intricacies what a real boat has. me and andy are in our suit and helmets with our cameras and stuff we are in a big grey room. you have to invent how cold it is you have to invent a little bit of motion with your body in terms of the swell of the water, actors usually rely on environment to inform performance but you have to become your own environment. which is the fun part it is so immersive you have to create all the time. >> you are onset with someone like steven spielberg is there more pressure for you as an actor do you feel this guy created some of the greatest films of all time. >> well, you always have to step up your game when you walk up to the set, you have to deliver, but you know, steven

spielberg had such a special lace in my heart -- place in my heart since i was a kid, for a long time i didn't think he was real i thought the guy was other worldly he was the guy who made dinosaurs live and i was like, how did he do that. so for me i was very humbled by the experience very grateful he entrusted me to play this role and it is intimidating at first but then, such a genuinely, down to earth man who drops his kids off at school and comes to set and has to leave early to pick them up that is who he is, >> i didn't realize they put all the suits on. >> andy circus was in rise of the planet of the apes. tomorrow kevin's interviews with jeremy irvine and emily
