defense. the prosecution believes that this was first degree prince edward island meditated -- first degree, premeditated murder in 2010 he kicked in the bedroom door of his ex- girlfriend's bedroom, and assaulted her they believe this was a robbery and burglary breaking and entering he is accused of those crimes as well taking her computer and throwing it in the trash defense believes yeardly love, died another way and they are going to call six doctors in this case including a cardiac specialist and a neurosurgeon they believe atterol and alcohol played arole in her death. there is a pool of 28, they finally got to that pool last night 20 past 6:00 p.m. and then each side gets to strike a number of these people from that pool of jurors so they can get down to a panel of 12 and three alternates we

what they are complaining about folks are being unfairly ticketed they are asking drivers to stop ticketing commuters here and they were concerned it is targeting elderly people in the area we have some folks respond on facebook agreeing with that saying they are being charged too much across the city, at these locations let's look at the numbers fines for speeding in dc are based on number of miles for hour over the posted speed limit if you were driving 1 to 10 miles an hour over the limit you would be fined $75, most of the speed cameras only register a violation once you are around 5 to 10 miles over the limit many people are receiving fines of $125 up, a recent report by the daily caller found city brought in more than $12 million in profit, from speed cameras in 2011 we spoke to some of the demonstrators here today including reverend bennett who stands to run for dc council here in ward 7.

we believe this is a dangerous place to cross because of the traffic but we believe there needs to be a much more comprehensive study on that. >> i want them the slow down but i can tell you how they can do it here on this street what they did on my street which is put a light. >> well, we also talked to a neighbourhood commissioner for this area of ward 7 she says they did try to get a traffic light here the speed camera was all they were able to do i can tell you guys, and i think one issue is that when folks first get their first ticket it is because the speed camera was just put up and they will get one and possibly more tickets before they even realize it was a speed camera and they violated the limit and all of a sudden they have this wrack up of tickets, again supporters say hey, you just need to slow down if you don't want to pay these are for safety, the city

began moving tents out, it wasn't very confrontational then around 5:00 a.m. as protestors got moved out of the park entirely there was a big scrum on k street and people running, riot shields, things getting thrown. >> were you scared by all this? >> you know, it is kind of what happens when you cover occupy dc, some times it gets crazy. >> let's talk about the status of the movement now, now that we have had this kind of clean out that has gone on and new rules being enforced, what do you thing the status, how did the occupiers feel at this point. >> i think they are a little shell shocked honestly right now it has been a little quiet on campus just because everyone is trying to figure out what to do they have been having discussions about where the movement is going forward frankly a lot of occupy movements have been evicted they say it was a good thing it

allowed them to focus on protesting issues and getting on the streets as opposed to defending camp. they are talking about protesting foreclosures, starting general assembly meetings for people to talk about their concerns in the community that sort of thing. >> speaking of that we've got the big cpac meeting tomorrow a conservative political action conference that will be going on and there has been talk they may try to disrupt, that meeting, have you heard much about that. >> yes, as i reported in the examiner today, there is definitely plans to not necessarily disrupt but divert attention they are partnering with a lot of labor unions who are planning to be there i am not entirely sure on the details occupy doesn't generally talk about what they plan to do but they will be there and loud. >> once they started enforcing the no camping thing, where -- you know people they can't sleep there, any more, they are

there some times during the day where are they going now at night? >> a lot of them are staying with friends you know people who live in the city and coming to occupy or kind of opening their houses to people who don't have any where else to go churches have taken a lot of people in, i know up on thomas circle, they are holding a lot of occupiers stuff like their tents, some people are just sitting on the streets some people -- >> so at this point what you believe is that it is kind of a refocussing now on planning what is going to come next for them. >> definitely. it is a transition period for them it is going to be a little hard to figure out what to do next but they have been talking about it they have a plan they know this will be a long term movement. >> we will see what happens tomorrow with the meetings going on audrey whalen a writer for washington examiner has more about all this in today's edition of the paper alison. >> thank you coming up a big shake up at the susan g komen

there is a shake up at susan g komen for the cure organization. the former vice president for public policy is resigning she says she stands by the decision for komen to cut ties with planned parenthood komen reversed that decision last week. making other headlines this morning the catholic archbishop who overseas the military is criticizing president obama's mandate for all insurance plans to cover birth control.

archbishop wrote to all military personnel saying the decision to force even catholic schools and hospitals to provide coverage was a blow to a freedom you have fought to defend and for which you have seen your buddies fall in battle end quote. the white house says it is trying to address these concerns but spokesman carney said the president is sticking with a policy of no reconsideration. >> it does, the president is committed to making sure that all women, have access to important preventative services. >> republican presidential candidates have decried the white house policy as an assault on religion and the catholic church. >> meantime a public college in pennsylvania wants students to have access to the morning after pill. students can get plan b from a vending machine, for $25. the machine also sells pregnancy tests and condoms, plan b is vailable without a prescription to anyone 17 or over but sold at pharmacies,

days many folks have been calling in complaining about money they say is missing from their refund checks. >> the company in question is called insubstantiate tax service this morning they have unhappy -- instant tax service this morning they have unhappy customers but some who say they are satisfied after our story aired. more on the latest on the story you saw first on fox. chef chef the numbers he -- the numbers he quoted me were over $1,000 difference from what irs told me my actual return was. >> when i go to pick up my check it is short and i am like this is not right and she said oh, irs is holding your money so i say okay well, i am going to call irs and see i call them they said no we sent them all the money paid out to you we held nothing back. >> reporter: that was monday night at instant tax services district heights location tuesday after seeing our story a crowd of clients went back to the store to check on their money we did too.

>> someone said you guys weren't giving refunds. >> reporter: one of the store managers said all the people who complained to fox 5 got some money back and penny said the owner called her personally to apologize, they blamed it on a technical error at the irs. >> all five clients have been rectified the last client just came in they have all been refunded for the money the irs had not returned fully >> we have been here over 10 years never had an issue. >> right. >> the irs says there was a delayer youing refunds for tax pay -- delay issuing refunds for tax payers who filed before january 26th many of them are not aware of the fees instant tax service is deducting from the refund. >> i saw a different number than what i was told so with the number she gave me that i would get back it was almost like $500 difference from that so i mean, the only thing i can do is just pray i get my money.

suggest? >> yeah, absolutely we have a lot of folks valentines day couples will be moving in together, i am a big fan of both i think you should have separate accounts and joint account separate ones first look you need bills in your own name you need to have your own bank account, if in the event of death or divorce, you want to make sure you have some financial history attributed just to you and you alone now let's talk about the joint account here is the bottom line 64% of couples according to a survey by smart money magazine when they move in together or get married 64% of us throw all our money into one joint account now when you consider that 50% of marriages end in divorce and the number one reason is money, maybe 64% of us putting everything in a joint account isn't such a good idea here is my plan put your money into a joint account but the key here is the money that you contribute to that account must be ear marked before it

ever gets deposited so you know ahead of time this joint account of money will be used only for maybe it is the mortgage or future family vacation or taxes or you know insurance, whatever the case is, if you know what the money is being spent on before you put it in, you never have to argue about where that money goes if you diffuse the money bomb it will never go off. >> here is a big one though how about when you start off with one person in the relationship making a whole lot more than the other person how you know do you both put in the same amount in the joint account? >> yeah, it is easier than a lot of folks thing viewers ask me this all the time friends ask me this here is what i have found the work the best all right first thing you need to figure out how much money each of you are bringing what is your net income maybe one partner makes $5,000 a year one brings $3,000 a month to the table so your monthly income is $8,000 between the two of you then let's look at that joint
