so families can protect the possessions they have left before any new storms roll in. new this morning, district police are investigating a late night shooting that left one person dead. it happened around 10:15 in the 5,000 block of benning road in southeast. so far no suspects or motive in this man's killing. a hit and run accident caught on camera. a metrobus dashcam recorded the incident. >> now police in laurel, maryland hope this video will lead them to the driver. fox 5's ramp demarco is live in laurel with the -- lauren demarco is live in laurel with the latest. good morning launch. >> reporter: police as well as looking for the driver there are also trying to identify the victim. he remains in critical condition at this point. now this happened on wednesday here in laurel at the intersection of route 1 and 198. you can take a live look from the cam as you head from northbound route 1 on to 198.

that's where this occurred and a metrobus was stopped at the light. the dashcam recorded the video. we can take a look at that video. you see the white pickup truck make his way up on the ramp and then strikes a pedestrian off on the side of the roadway from the truck keeps going without stopping. a bus driver and a driver of another car did stop. but no one was able to get the license plate of that truck. it's described as an f-250 pickup truck with extended bed and supercab. model year between 2005 and 2007. there appeared to be some writing on the door. it was missing a brake light and only the left back brake light was working. and there's likely significant front end damage to that vehicle as well. police say it is unlikely that the driver didn't know what he or she had done when they took off. >> knowing that he hit someone and sent them down an embankment 30 feet, it's definitely surprising. >> it could have been an accident. but we don't -- we don't know because they decided not to

stop and continued on. >> reporter: now again, police are trying to identify that victim. he remains in critical condition in shock trauma. he's a white male between 50 and 60 years olds. they have been canvassing homeless shelters and also checking missing persons report. allison and tony. contact laurel police if you have any information. >> thank you lauren. a prince george's county family is stunned at the verdict in a murder-for-hire plot. 17-year-old stacy seaton was pregnant when she was shot to death execution style near her bowie home back in 2005. well, police arrested mcdonald abraham. he pleaded guilty and he testified that he hired jarvis tyler to kill seaton for stealing drugs and money from his apartment but a jury found the accused triggerman not guilty on all charges. >> present the evidence that we have. it was done in a very compelling fashion. we never know from one case to the next what's in the mind of

a jury. >> seaton's parents released a statement saying quote -- tony. allison, maryland has made history by becoming the eighth state to legalize same sex marriage. the governor roll mall lee signed -- o'malley signed the bill into law last night. but the bill won't take effect until next january at the earliest and opponents already started an effort to get the issue put on the ballot in november. they need 55,000 signatures. >> i can't tell you how big my heart feels right now. how warm it is for -- for the diversity that we're respecting in the state. >> here we have a very controversial bill that governor o'malley really shoved through the process. he twisted arms and did everything he could. >> if the issue gets on the november ballot, and maryland

voters reject the law as written, same sex marriage will not become legal next january. the battle continues to approve drilling of marcels shale in western maryland. there could be gas drills in garrett and alleghany counties. a new study found the wells would produce gas for 30 years and generate more than $200 million in revenue. environmental groups are concerned about the drilling's effect on ground water. a state panel is investigating if the drilling can be done without risk to public health. the senate voted down an amendment to end the mandate that requires most employers or insurers to cover the cost of contraceptives. republicans had argued that the original health care bill forces churches and religious groups to violate their beliefs on birth control and abortion. opponents to the rule are vowing to keep up the fight all the way to the supreme court. prince george's county

police say an executive review panel will now look into a traffic stop involving councilwoman karen toles. this after she was spotted driving 105 miles an hour on the beltway. she was only given a ticket for making an unsafe lane change. this morning john townsend from triple a mid-atlantic joins us to talk about the incident. thanks for coming in. were you surprised when you heard about this? >> i'm surprised that someone would be driving at twice the speed limit and that's not only aggressive driving, it's reckless driving and she should have been thrown into jail. >> and we were talking a little bit earlier off-camera about this. this is a part of the beltway -- you know, the whole beltway there are speeding problems. this is a part of the beltway where you say there tend these types of program -- to be these types of problems. >> this part of the beltway is the deadliest stretch of the beltway because of its design

and configuration and many people race at huge large speeds in that stretch of road. it's also deadliest part of the beltway. and so you have this perennial speeding problem on the stretch of road. the state police is aware of it. maryland state police and in a three year span they wrote over 100,000 speeding tickets to countdown on the speeding in the beltway. >> 100,000 speeding tickets and what we saw in this case was a ticket given for an unsafe lane change. you say she should have been thrown under the jail. typically, what would someone face? if you're pulled over and in fact if you're pulled over not on the beltway but beyond the beltway because you continued driving, what would most people face if you're driving 105 miles an hour? >> for example if you were caught at that speed you wow given a reck -- would be given a reck wills driving ticket or maybe aggressive driving ticket

under the smooth operator program. we know about the lane change, we know about the rapid speed. but the thing is she didn't have a radar operating and they were afraid that will be town out of court but -- thrown out of court but then you have to go to the standard the police use which is the reasonable personals standard. she -- persons standard. she says she was speeding to get to a meeting. that doesn't wash and so it was inexcusable and i think she realized that. but i think looking at what has been reported about the traffic history, there's some other problems there too. >> you have concerns about the whole incident. what are your primary concerns? >> my primary concern is because she is analectsed official, it -- an elected official, it sends the wrong message because in the last ten years we've had a lot of people killed in prince george's county. you are an elected official for that county. it it is wrong message to be

sended and secondly it's unconscionable. >> the councilwoman herself does she she wants to pay the fine. she was not issued a citation and i'm not sure how you pay a fine that you haven't been given but she does say she wants to do that and going to take some instructional driving courses before she gets into a county vehicle again. step in the right direction? >> step in the right direction. there's another ting we have to be concerned about too. the high speed chase. remember back in 2007, there was a similar incident on that stretch of the beltway in prince george's county. >> uh-huh. >> where a prince george's county police officer was chasing a motorcyclist. and two persons who were killed and 11 persons injured because of the chain reaction crash that occurred. >> . obviously a lot of questions about this. >> not only the councilwoman has to answer but also the prince george's county police department. >> well, they say they are going to look into it now. john, thanks for coming in. >> great to be here. >> we appreciate it.

welcome back. it's 9:13. polls are open in iran's parliamently elections. this is the first major voting since the disputed re-election of president mahmoud ahmadinejad and the protests that followed back in june of 2009. the balloting for the 290 member parliament could shake the political landscape for a successor in 2013. a high turnout will be seen as a major boost for iran's ruling islamic system. aide workers in syria have been given the green light by the government there to begin

delivering supplies to the rebels' stronghold in holmes 78 they will billions is allowed to -- also be allowed to evacuate the wounded. meanwhile overnight two french journalists injured in recent attacks were smuggled into lebanon shortly after midnight. one of them edith bouvier is expected to fly home later today. she was injured in a rocket attack last week that killed two other journalists including american reporter marie colvin. tony, thank you. thousands of american men and women have lost their lives at war. the sharrett family lost their son four years ago but it wasn't to enemy fire. private david sharrett was killed by what they called friendly fire. his parents questioned that day for years and yesterday they had a top meeting with top army brass and finally got to ask the most pressing question. david and vicky sharrett join us in studio and good morning to both of you. >> good morning.

>> first of all, thanks for coming in. i know this is difficult and we are very sad for your loss. i want to lets you know that's how we feel leer. but thanks for coming in. so let's start with your journey four years ago i had the paperwork that basically i'm assuming that was put out right? it was the day after your son lost his life in iraq. and it said that the group was attacked by grenade and small firearms during combat operations. when you saw this, what was your first reaction about your brave son who had gone off to war? >> that he was dead. and that that's what happens you know. sometimes that -- your son does. it was horrible -- dies. it was horrible. it was horrible. my first reaction was how am i going to tell my husband? he was at work. i couldn't call him on the phone. i knew i couldn't drive. and i was devastated. i fell down on the floor. it's awful. >> that first knock on door,

though -- the door, though, you know you're saying okay, they're telling me this, it must be true, this is what happened. was that your thought too? >> i needed clarity. the report that i got was the basic informs i had was from the -- information i had was from the "washington post." tom jackson said in the "washington post" that it was small arms and grenade fair. that's what we -- fire. that's what we come to understand about dave's death. of course you're in this fire storm of your own trying to process this and people calling and getting out of your work situation. calling students and people and trying to make sense of what happened and envisioning where he was over there. how he died and so i have these visions in my head of him walking down a village and attack taking place and how he went down and hopefully that it wasn't painful and those kinds of things, that was any initial reaction after having to inform

my students that i wasn't going to be able to come back for a while. >> right, when did you learn that it was something different? that it was friendly fire? >> our casualty assistance officer came to our home a couple of days later and said it was the possibility of friendly fire. and he just left it with that. he never confirmed that it was friendly fire. never said that there was going to be an investigation. now he was supposed to have done that because he had a script to follow but he never followed the script. so we never knew. we buried david arlington cemetery thinking that he had had just gone down in this horrible ambush. we really didn't have a lot of details. i -- asked our casualty assistance officer to have someone in dave's chain of command call us to clarify that. and i got a call from his lieutenant colonel. who began to relay to me the events of what happened, nothing of which included friendly fire.

and i asked him if he would put that down in writing for me because there are a lot of people in the kitchen, my mind is full of a thousand things, i'm not going to be able to accurately relay these things to other people so he e-mailed it to me. i told him on the phone, they said it was friendly fire and he denied it so loudly on the telephone that i had to pull the speaker away from my ear. he said that's not true. now later he clarified that, admitted to saying that to me. and yet said he was telling me that so just to clarify that dave hadn't been killed by helicopters. i didn't know if there were helicopters or submarines or ferris wheels involved in this thing. i had no clue. >> from that day to this, yesterday when you meet with the secretary of the army, a very rare meeting have you gotten the answers that you need? as you sit here today? >> no. >> no. >> and upon reflection, i think

i realized that this meeting that we had yesterday with secretary mccue was really more for the army than it was for us. sort of like okay, we've met with you. now this is all you're going to get. so be satisfied and go home. >> i had sent the secretary a detailed letter before christmas. i think more around thanksgiving. outlining a series of questions that i felt needed to be answered as a result of the last incomplete investigation that the army did. number four. the fourth investigation that was completed in march of 2011. a series of very detailed questions. we went -- i went in expecting to do a lot of listening during the meeting. we went in and sat down and i'm thankful for the meeting. >> right. >> but me said to me when he sat down, here we are, what do you want to talk about? the questions never came up.

they never came up. and they were significant. they still are significant and i think they need to be responded to because they go to the heart of what we've been through the last four years and that's getting accountability for the men who knew about all of this. not only the guy who shot dave and left him behind but his chain of command who did nothing about it. >> your story is included in a new documentary. it's called "a second knock on the door" and it highlights your journey and the journey of others in your situation and i just want to -- unfortunately out of time but this quote that i got from the material in the dvd. that you sir said we felt betrayed by the way our son was betrayed. they lied to us about our son. my sense is you still feel this way today. >> sadly, regrettably we do.

a parishioner who rue tinily takes me to appointments and often to church. your mother says basically that's insulting and tacky. what do you think dear daughter? so to my dad who i know is watching right now. thank you for asking my advice. imagine that. me, your daughter. you need advice from me. i'm truly honored. unfortunately, i agree with mom. don't be mad. just a little background now. neither my mom or my dad drive these days and if they need to run errands or make appointments or just go out, be out of the house, then we the family members, take them out. we take them where they need to go. but we work. we have busy lives, places to take our kids. et cetera. so this congregant of my dad pitches in. that's the background. now, here are my thoughts on this one. so this woman who so graciously takes you, here or there, father, is doing so because she holds you in the highest regard. she sees you really as a father

figure of sorts. not to mention a religious adviser or a teacher. so to give her money or even offer it really might hurt her feelings. and as mom said, insult her. and i know you would never want to do that. she is a lovely woman. and at the end of day, it just becomes a little weird when she's kind of like on your payroll you know what i mean? if you want her to drive, just keep her right there and hire a driver and keep it all business. when you mix money with what she's doing out of the goodness of her heart, it's like she's at your beck and call too and she's doing this because she treasures you and she wants to do that. don't get me wrong, i think you are being very thoughtful because everything is more expensive these days, right? she has a young family but she is not doing it for money. and i don't think she expects any money. instead i like mom's idea about giving the woman's family gifts during the holidays, maybe for her daughter, a nice thank you for the time that she takes out of her busy life to drive you
