morning. it should be a fun event. this looks like a really fun event. more on that in a couple of minutes. first let's kick it off with the weather forecast. standing outside, we're all commenting on how chilly it feels with temperatures in the low 50s. bring along a jacket as you run out the door. let's take a look at the satellite radar. and the shower activity. the showers off to the north and west today. that has been falling apart. but we're expecting more showers and the possibility of a thunderstorm around here later this afternoon. so bring along an umbrella as well, as it looks like we got the potential for some pretty good rains around here for a time later today, and during the evening hours. here are your cool temperatures. this is on the heels of a record high temperature yesterday at reagan national. yesterday reagan national, 82 degrees, and dallas is 84. currently we're in the low 50s. with some fog and low clouds. 52 at reagan national. 52 dulles. 50 at bwi. the planner for today, could be a peek or two of sunshine. lots of clouds around. cooler than yesterday. highs in the low to mid-70s.

with scattered showers and thunderstorms developing during the day. that is a look at the weather, more here from the rock and roll marathon coming up in just a couple of minutes. we have special guests coming up at 9:30. back to you at the desk. >> thanks, tucker. new this morning, a 9-year- old maryland boy who was the subject of an amber alert has been found. >> police located sylvia garcia and her son wilbur garcia at an airport in reno, nevada. authorities believe garcia abducted her son yesterday morning. she has been arrested and wilbur is safe. overnight prince george's county police found garcia's car in our area. it was at a building in bladensburg, maryland. garcia did not have custody of wilbur. fairfax county police are looking for a man who sexually assaulted a woman while she was walking in burke wednesday night. investigators say the suspect grabbed the woman on commonwealth boulevard and dragged her into a wooded area. the man threatened the woman with a weapon and then

assaulted her. so far, police only have a vague description of her attacker. the american soldier blamed for a shooting spree in afghanistan has hired a legal defense team. two military lawyers and two civilian once. clara simmons is in the studio with more. >> reporter: good morning. we're just learning as well that afghan president karzai is quote at the end of the rope with the u.s. saying the u.s. is not cooperating in the investigation with them. this situation obviously is getting really tense. and meanwhile, we're starting to get little more insight into what was happening with this soldier leading up to the shooting. the soldier's attorney says he met with the accused man and met with the family. high profile seattle attorney john henry brown says the day before the massacre, his 38- year-old client stood next to a friend as that soldier's leg was blown off. brown also says the soldier and his family were upset over a fourth unexpected deployment. >> he and the family were told that his tours in the middle

east were over. and then literally overnight, changed. >> reporter: some reports alcohol or marital problems may have been involved in the slaughter that killed afghan civilians. brown dispute the claims. >> a lot of love in the marriage. a lot of love and respect. two children. and i don't have any indication that alcohol was a factor. >> reporter: the u.s. defense attorney wrapped up a day visit to the country thursday where he discussed the u.s. timetable for withdrawal for the afghan president hamid karzai. karzai told panetta he wants the forces out of rural areas immediately and a full security transfer to afghan forces should happen next year and instead of 2014. panetta made clear the u.s. has no intention of changing the plans. >> we're on the right path. i'm convinced of that. the key right now is to stick to that path. if we do anything precipitous to back away from that, i think

that, in my mind, would -- could very well jeopardize our mission. now, we are also learning from the pentagon that the accused soldier will be flown to the federal prison at leven worth, kansas. the biggest maximum security prison. possibly as early as today. but defense officials say the move does not mean any formal charges will be announced soon. also, the afghan taliban cut off peace talks with the u.s. a state department spokesperson says the u.s. is prepared to continue the talks after things start to calm down and we hope they do so soon. it is becoming a very tense situation over there. >> undoubtedly. sara, thank you. north korea is announcing controversial plans to blast a satellite into space next month to mark what it says is the 100- year anniversary of the country's founder kim ill sung. but the united states says the plan launch violates a deal the u.s. has with north korea. secretary of state hillary clinton calls it, quote, highly

provocative. in our other top story, the army private accused of leaking classified documents to wikileaks is charged with helping terrorists. the military had already charged bradley manning with 22 counts, including aiding the enemy. now, prosecutors say which enemy, and publicly identify it as al qaeda. meanwhile, his lawyer is asking the judge to dismiss the case because he says the government bungled the case by not turning over all documents to the defense. fox 5 has learned dc council chairman kwame brown has joined a growing list of council members that received subpoenas. a federal grand jury is investigate are investigating the relationship elected leaders may have had with jeffrey thompson, a city contractor who has contributed hundreds of thousands of dollars to local campaigns. council members phil mendleson, and jack evans and evet alexander all say they received subpoenas as well. police are working to solve a series of anti-gay hate

crimes in the district. three attacks over the course of two days this week. the victims were either gay or transdepender. one of the victims was shot. one was assaulted and robbed. and the third beaten. two of them are still in the hospital recovering. police say they're committed to getting the suspects off the street. they don't believe the crimes are related. >> two metro workers accused of stealing money from fare card machines have reportedly worked out a plea deal now. court records in alexandria show plea hearings are scheduled monday for horace mcdade of bowie and john hail of woodbridge. the two men were arrested in january. prosecutors say they used the stolen coins to buy hundreds of thousands of dollars in lottery tickets. i do believe that gentleman's name is haily. >> that's what i think, too. a man involved in a horrific accident is now speaking out. he was dragged for blocks by a metro bus. his injuries were severe. >> he claims metro is to blame but says he is not getting what

he deserves. fox 5 wisdom martin has the story. >> january 4, 2007. the day john evans will never forget. the day his life changed forever. >> it was a thursday. it was a real warm day. about 70, 75. >> that day, evans was on his motorcycle. riding to southeast dc to see his god brother. >> as traffic came to a standstill, a car was turning to homeland security. >> the car in front stopped and caused him to hit the car and a witness told me what happened. >> he later recognized meleing in front of the car to the -- meleing in front of the car to the right side bumper and a bus was coming around and he was able to tell that it ran him over. >> he was underneath a metro bus and trapped and dragged for five blocks. >> he tried to stop the bus. >> evans was rushed to prince

george's hospital and later a hospital in baltimore. he barely survived but the damage to his body, his entire genital area had to be reconstructed. >> i wore a colostomy bag for three years. >> severe nerve damage in his leg. knee and foot damage. doctors initially wanted to amputate his leg from the knee down but managed to save him. >> you land in the hospital bed, you're crying because of the pain. >> he sued metro, after years of pain and suffering and litigation, last summer, metro offered him a settlement. the amount? $250,000. >> i didn't take the money because $250,000, you know, my medical bills, like i said, are lose to a million dollars. how do i pay a million dollars back? >> evans still has a jacket and boot he was wearing that night as a reminder of how close he came to death. meanwhile, he has filed paperwork to take metro back to court. >> i'm hoping that maybe they will come forward and say hey, we recognize that we did make an error.

and it is a thing that if you didn't hurt me, why would you offer me $250,000? >> john evans is also looking for a new attorney. metro says they can't comment on pending litigation. we will let you know what happens next. a birth control debate in arizona. women in that state who want to be reimbursed for contraceptive drugs through their health plans may soon have to prove that they're taking it for anything but preventing pregnancy. for example, proof of a medical reason, such as acne. a bill nearing passage would allow all employers to opt out of providing birth control coverage for religious or moral reasons. in the race for the republican nomination, rick santorum is campaigning in puerto rico, ahead of sunday's primary contest there. meanwhile, many experts suggest time is running out on newt gingrich's campaign. he is hoping for a win in louisiana's primary. scheduled for a week from tomorrow. but mitt romney leads in the

latest polls, ahead of the big illinois primary. set for next tuesday. and president obama's campaign is releasing a 17 minute mini documentary, touting the president as a determined figure who confronted the economic downturn. the road least traveled is narrated by tom hanks and describes how the president handled a series of crises with tough decisions. the documentary was made by davis guggenheim who directed the al gore movie about global warming called an inconvenient truth. coming up, strong storms ripped through michigan. we will take a look at the damage they left behind. and there is a chance that your ground beef could have something called pink slime in it. still ahead, how the government is helping schools decide if they should give it to students. plus, a big release from apple today. annie? >> good morning, tony. that's right. the i-pad 3 went on sale this morning at 8:00. that's where we, are here at the apple store in georgetown.

making headlines this morning. crews will examine damage in michigan today. where severe storms damaged more than 100 homes and destroyed 13. there are reports of at least three tornadoes. fortunately, no serious injuries were reported. the federal government says starting this fall, schools do not have to give kids so-called pink slime for lunch. it is letting them opt out of the filler that the meat industry calls lean finely textured beef. there has been a lot of it in meat but not necessarily on the label and contains ammonia but experts say it is not a matter of safety. >> the question isn't necessarily of safety. it is more of nutrition. and what you want to have in your food. if you're making something for yourself in your kitchen, you're not going to use

ammonium chloride gas to prepare your food. you're just not. >> the meat industry experts say the only way to know for sure if pink slime is in the meat you're buying is to ask the grocer or spend more money for organic. you will soon be able to donate your hotel reward points to wounded veterans and their relatives. today the maryland senator ben cardin and congressman dutch rupersberger will announce the first partners for the hotels for heroes program. national hotel changes marriott and wyndham and americinn have agreed to participate. they are calling on the rest of the hotel industry to join the program by memorial day. check out the latest pain at the pump. the national average for a gallon of regular is $3.82. but in dc, we're paying about $4.03. in maryland, it is $3.85. in virginia, it is $3.73. it is a big day for gadget

loves. the new i-pad hit the shelves. on sale. crowds are gathering in apple stores across the nation. especially any hugh is live in georgetown where people have been waiting all night long. right, any? >> that's right, allison. we got here around 7:30. and the doors opened at 8:00. we talked to people who were here as early as 3:30, 5:30, it is crazy. they're trying to get their hands on the third generation i- pad, that is being released today. and there are differences. the new i-pad three is a slight upgrade from the 2. a better camera and 4g capability and we talked to the techies and average joes this morning that were here as early as 3:30 a.m. >> because it is new. it is new. i have no other excuse. and i won't try to make one up. it is a new apple product. i love apple products. i have every i-phone, ever i- pod, it is what they count on.

they factor me in to their annual meetings. >> i had the one and the two. i waited in line last year for the two. which i actually sold mine yesterday to a friend but it is not as crazy as it was last year. maybe because everybody i guess wanted to keep their second one. it is not that big of a difference. >> now, something interesting, as we talked to a guy minutes after he bought his i-pad three, and he rolled up here at 7:45, into the door at 8:00 and walked out within minutes with the new product and i kind of feel bad for those who had to be here at 3:30. it is quite the hype. we should also mention there was a small protest organized by change.org and these protesters are demanding to stop the problems in china, where the bulk of apple products are manufactured, including the i-pad, and demonstrations are going on here, at the apple store in georgetown, as well as new york

it is time for ask allison. today's question, comes from a concerned grandmother. and we love grandmas, don't we? this grandmother write, i am a grandma with seven kids ranging in age from three to 11. i took them to see a g-rated movie, happened to be alvin and the chipmunks and the previews came on after we were seated and they were loud with adult material and very scary movies. i found myself covering the children's faces with my coat. i don't know what to do about this. i have not taken them to a movie since that day. why do they have to she scary and sexy previews before a g- rated movie? whom shoe i contact? what should i do?

>> i have seen more than my share of g-rated movies with my kids and i have noticed some of the previews have you tilting your head, how can they show all of this, isn't this content screened for the younger audiences but i didn't know the answer for that. but i thought, we have kevin mccarthy in every week to talk about what is new and hot at the movies and i reviewed on our friend chip, and kevin mccarthy with 106.7 the fan, joining us by phone. are you there? >> allison, how are you? >> thank you so much for this. i know you're a busy man but is inned this myself. and -- but i noticed this myself and this grandma wants a little help. was she imagining this and a little older and doesn't agree with the content or has it changed? >> no, it has definitely chained. it is interesting, i've been to g-rated movies and i've seen the same thing. the reason for it is basically before a movie start, generally about six trailers. and two of those trailers are picked out by the studio who is

rereleasing the movie. so for example, if you see lorax, universal pictures would pick out two trailer ares. the other four are -- trailers. the other four are picked out by the theaters themselves. if they're seeing a trailer that was not -- that had, you know, a questionable content or content not for kids for that movie they're seeing that is based on the theater's approval and putting the trail trailer in there. i talked to a move movie mom and she writes extensively on the subject. and she believes it is unacceptable. there is a contact called nato online.org. the national association of theater owners. and if you complain to them about the content you're seeing in these trailers, they will go back to theaters and make sure that that does not happen. because again, it is four trailers that are happening, besides the two that the studio

picks. >> and you're talking about like it would be riegle and amc, not just like the ones that i go to, in say, you know, silver spring. it would be the whole company that is that theater, right? >> right. >> okay. >> if you're in a riegle, and you see a movie, and you don't think one of the trailers is acceptable for the movie that you're seeing, you would just go online and nato online.org. and contact the person there. and you can tell them what you saw, because they're entire -- one of the biggest goals is to make sure that that experience is okay for the audience. and that should not be happening. you should not be seeing questionable content in g-rated movies in trailers. >> all right. and we have it online. i appreciate you calling in with that. it is nato online. all one word right there. we're showing it on the screen. nato online.org. this is where your concerns will be heard most likely. >> definitely. and a big thank you for movie mom .com. and she has extensive articles

we're back now with a live look outside. it is a gorgeous couple of days and the weather has just been magnificent. but there has been a smell outside. it has been snot so great. >> yes, this foul stench, pretty strong, it seems to be everywhere. people have smelled the odor, they say from fairfax county, in through dc, and then in oxon hill maryland and in other locations as well. viewers have been sharing their thoughts on facebook all morning long. there are dozens of comments, brandy benedict mahoney lives in centerville, and she says that her 9-year-old has autism and is very sensitive to smells. and she writes that he was really upset and nearly in tears over the smell.

she agreed that something smelled off bought she says she didn't pick up on it as well as he did. and now i can tell him that it is not just our neighborhood. well, we've called a number of places, including dc water and others and they have nothing to do with it. >> we called our garden guru derrick thomas, our resident garden expert and he gave the theory. he says possibly a combination of mulch, bradford pear tree, a specific tree there in bloom, and the heat, too. and the cloud cover, making the smell more stinky. >> so that's a theory. it sounds like a plussible theory. we don't really have the answer as of yet. >> we will continue to look into it. we just want it to go away. >> we sure do. tucker this morning is outside. he is at the rfk stadium. getting ready for tomorrow's big rock and roll marathon. hey, tucker. >> reporter: hey, tony. again, i have nothing to do with the smell and i'm here to report we have no smell at all whatsoever here in washington.

so whatever it was, it is out of here. talking all morning about the rock and roll marathon tomorrow. it promised to be a lot of fun. but sometimes, the run is for a more serious cause. bullet i mean still, having a good -- but i mean still having a good time and i'm joined by the leukemia and lymphoma society. these are runners that will be running for a cause here. and i've got some people that want to tell us a little bit about why you guys are involved in running. and i guess we will start with our friend amie and why have you joined the leukemia and lymphoma society. how far will you run? is it the first run? >> tomorrow i will be running 26.2 miles. >> whoo! >> my second marathon. and i have decided to run to help the leukemia and lymphoma society, to improve the lives of blood cancer patients and find a cure. that's why we're doing this tomorrow morning. >> lisa, you work for the society. tell me a little bit about how many people are running in the race tomorrow, and with you

guys, and how much money you hope to raise? >> we have 275 people running tomorrow. with the maryland and the national capital area chapter and so far we have raised $375,000. i think we're going to make it to 4. we're getting the word out there and keep raising through the next few weeks. a great time. >> unfortunately lisa will not be able to run this time. >> i broke my leg a few months ago. i will not be running. however, i will be at the water shop three with village costumes and 80 of my closest friends. >> will you be dressing qup. >> i don't think the runners will but they will stay cool and try to finish the race. >> the people with the purple shirt, they're a part of the seem. >> you should year go team when you see them. -- you should yell go team when you see them. that's our cheer. >> and ryan, tem us about your story. >> four years ago, this sunday, march 18, will be my four

in celebration of the late dr. dorothy i. height's 100th birthday, the dorothy i. height education foundation and national council of negro women are calling women throughout the world to engage in sers- related activities and the president of the association and the former secretary of labor joins us to talk about the kickoff event that kicks off tomorrow. an honor and a pleasure to meet you, thanks for joining us. and we're happy you're here talking about the work of this phenomenal woman. i want to ask you first, i know you were very close to dr. height. can you tell me about the woman she was and her legacy? >> her legacy is a legacy of service. i met dorothy height when i was just 23 years of age. she mentored me literally for my entire career. and she was someone who gave on an individual level, she gave on a national level. she gave on an international level. she was the only woman you know who was a member of the so-

called big six civil rights leaders. >> yes. >> and i can say there is no struggle, no great movement or issue of our day, that dorothy height was not involved in. it is ironic that this week, lyndon bane johnson called on congress to pass the viforts bill, that anniversary was this week and -- the civil rights bill, and that anniversary was this week and dorothy height was there. >> she was your mentor. what was her character like, her spirit? >> her spirit was a gentle spirit. always encouraging. she always wanted you to know that your dreams really were your only boundaries. she gave me confidence in myself at a young age that i probably would not have done the things in my life that i have done had it not been for dorothy height. >> are you the president of the education foundation in her name, and what is the foundation striving to do? >> the foundation is primarily an education foundation.

it seeks to help young people who wish to go on to college, to further their own educational tune opportunities and we are a big supporter of the national council of negro women and an organization that dr. height chaired for more than 60 years. >> tomorrow, it will happen at north shiloh baptist church in northwest dc. tell us what it will be. i imagine it will be a celebration. >> a celebration in music. with gospel artist nicky wyman. and we will have the wonderful bishop, to tell us what service really means, in her name. so we are looking forward to it. it is open to the public. >> can we still go? >> it is open to the public. >> and it is 3:00 to 5:00. 1500 ninth street in northwest. that is the program tomorrow. but then you're calling on a week of service throughout the

week. >> yes. >> because dorothy height was all about that. she used to say, simply to be in the struggle and service to others, that was enough of a reward for her. so we want women to take a walk with a senior, mentor a young girl. we're saying visit a homeless shelter and an abuse shelter, and take time to check up on your own health. do something for yourself, for your body. take care of your physical health as well as your spiritual health. >> and it all culminates of course with what would have been dr. height's 100th birthday. >> yes, the 100th birthday on march 24. so the entire week, around the nation, and abroad, we're hearing from women in africa and europe and the caribbean. we think it is going to be a great week. >> i cannot let you go without just saying that you are a history maker yourself. first african-american woman to become -- african-american to become the secretary of labor. what was that time like in the white house? this was not your first administration but what was that time like for you? >> for me, it was the experience of my lifetime.

i always used to say, you know, to be secretary of labor, in a country that was built on slavery, and then to have the it opportunity to work for all who labor, and to make sure that we have the opportunity to reach our highest potential, for me, it was the experience of my life. >> you are a phenomenal woman yourself. and you're carrying on the legacy of dr. dorothy height. we appreciate you coming to spend some time us with. and this is -- there is a title for, it and i'm trying to find it in my notes, a call for service, a special note to women. >> a special note to women. it is taken from the last chapter of dr. height's book, living with purpose. and she wrote it literally, finished editing it from her hospital bed, the month before she passed. and so we are taking a special note from that chapter in her

here, beginner style. they are giving scuba lessons from the travel and adventure show this weekend, and big wave dave has brought the gear and the pool along. good morning. >> it is going to be a great weekend. 84-degree water. just like bonair. a great place to go on vacation. >> how do the scuba dive lessons work. >> we have the dc area, four groups that are out here, wet suits, and towels and hair dryers and bring your swimsuits. we have to have parents in the water for children. and get a briefing and swim around for 15 or 20 minutes. >> have you found that scubaing is a great vacation. >> it is a great family trip. because you can be certified and traveling on your own, if you would like, or bring the family with you. >> let's start our lesson here. and obviously, technically, this is a bit of a feat. sko we're going to try to put our marchs on and miked on. and the mikes are in the mask and go underwater and talk to you from under the sea. all right. let's go ahead and get ready. >> we're all set.

academic training and pool training. and you can study online if you would like. you can visit your retail stores and find the pool work. and dive locally or tropical dives. very easy to go. and of course, come on out, and the pool is sponsored by bonair. >> and once you get that certification, that is worldwide, right? >> yes, worldwide. >> and for life. >> and if you're 13 years old, you can dive when you're 80. >> let's talk about the fun things you can do when you're scubaing. you might run into something like this. >> this is a crab. he is snuck into the pool. >> if you're getting certified for scuba, where are some of the best places to go? >> we can go all over the world. there are places every here with the quarries but you can hop on a plane and go to the

caribbean. bonair. the islands. >> when you go scuba diving, and you hope to bring your own gear or can you rent it? >> you can do both. i personally travel diving and bring my own gear. a mask and a snorkle. and rent the gear locally, too. it depends how much you are going to dive. >> is it a costly thing to do? >> the scuba, you can do it in your pool and buy your mask and snorkle and it is around $500. >> if you're coming out to do the scuba experience here, i'm guessing that is pretty popular? or do you need a lot of time or come and sign up? >> you want to get here early today. it gets quite busy. it is a fantastic time.
