confinement at fort leaven worth. >> according to the army times bail's attorney john henry brown said the accused shooter may have watched a fellow soldier get a leg blown off shortly before the shooting if true it is one more piece of the picture building of a troubled soldier. the 38-year-old and his wife had financial problems behind on their mortgage they just decided to sell their home for a loss another house they owned had been condemned in 2002 he was arrested for allegedly assaulting a girlfriend there was a hit and run accident court records show he paid a fine for he suffered a traumatic brain jury in iraq -- injury in iraq in 2010 but was deemed fit for another tour of duty. >> it was a tragedy and one of the terrible casualties of war and why we try to avoid them. i am proud of the treatment we give to our veterans and men and women serving but this is one of those terrible aspects. >> i am confident there is

that unusual? with these wars we have been fighting recently? >> no, and the problem in this particular situation is, whether or not individual i suppose was enthusiastic about it or not and i don't believe he was i understand he thought he was done after three, there was a fourth added, i also understand there is some other circumstances that might have contributed to less than enthusiastic attitude including a promotion he was denied including seeing friends injured and killed, and the other part of this tony too that important, is iraq and afghanistan have been extraordinarily violent wars, all wars are violent but specifically for a lot of these folks in combat they have seen a lot of possible action he is one of those people. one of those folks who was thought of as a very good soldier, a very capable soldier

but it takes its toll it adds up overtime and this is perhaps one of those situations. also, other problems as we heard in your piece, back home other things may have contributed to the action. this is a difficult situation any way you cut it. >> having said all of that you know, i just want to characterize for everybody obviously we are all trying to understand what would make someone do something like this. so that is why in the media i think we are hearing a lot about the circumstances of his deployment what was going on at home and the stresses and all that kind of thing and in terms of whether or not he is guilty and in terms of whatever trial that happens, does any of that matter? >> well, he is going to have to go through the process, and it does have to happen whether or not it matters, i honestly

can't say yes or no, from a military perspective, justice has to be done from a diplomatic perspective justice has to be done as well from a humanitarian perspective the same has to happen but just for a second, think about afghanistan which is very different from iraq, granted there was hostile action in iraq, granted iraq was a place where al qaeda was running unleashed for a good long time you have the taliban in afghanistan, essentially, not doing the same as al qaeda but doing -- conducting similar kinds of operations, they are no longer able to send large groups of people in to lose them all so they are choosing what to do and how to do it for judiciously this is the taliban but this place is a very osseter place if you look at video of afghanistan it is a

very very unmodern place, very difficult meagre survival subsis stance situation going on in many of these out posts we hear as well about him consuming alcohol allegedly, this is something the military is strongly against but situations like this often happen >> it is a difficult situation we are out of time very quickly in terms of the investigation of this the collection of evidence isn't that going to be extraordinarily difficult? the people who were killed i assume are already buried you have to bury them very very quickly, is it not going to be difficult to collect all the evidence to make a case -- not necessarily to make a case but get all the information needed. >> let's just say i don't think this is going to be your standard case i don't think it is going to follow the same procedures as a typical case, where you have evidence collection, detailed evidence collection. but the thing that is most

tragic virginia tech case just decided a couple weeks ago just because there was a delay in warning the campus about a terrible incident that was going on, the school became liable for two jury verdicts of $4 million a piece. >> interesting, the connection there, because one leads to the other snowballs let me play devil's advocate from the college recruiter or college point of view with the student athlete and an employer with these social media sites this isn't like your tax information this isn't how much you owe on your mortgage this is what you could see if you were a facebook friend for example, what would be their reasoning for wanting to be involved in this way with a student athlete or potential employee. >> well, in some situations what people would want to see is what is going on in their personal lives today their personal and professional lives are blurred ever more with everyone using this stuff but the problem is, is it all right for someone to come into your

personal apartment and bug your personal apartment? i believe there should be a line drawn. if you have an electronic account an employer or school should not have access to this information. >> okay so now there is two pieces of legislation? >> yes. >> does one deal with college level one with more professional level? >> exactly one deals with colleges and college studentapplicants the other deals with employees and job applicants it is great legislation. >> what does it prohibit. >> basically prohibits a coach to require a student athlete to facebook friend him or install software monitoring into their device. or allow a college to let you have a peek at your personal password protected content the other is the employee side, applicant side you can't access

this content. employers don't want to look at this electronic content any way if you find out about a protected status such as religion or race, or national origin you may end up getting a job discrimination lawsuit from a job application. >> where are we now as far as these bills working its way through the maryland legislature. >> i have great news to report both have flown through the senate, one 46-0 and one 44-0. both on the house side there is a good chance of both pieces being passed however we still need to have a house vote on it and then the governor sign it so i am very hopeful eventually, in the next several weeks this will happen and this will become law be the first two laws in the country, to handle this type of information. >> until that happens i guess maybe this is too big of a question what happens in the meantime i am sitting there lookin to get this job they ask for this, i refuse legally am i
