are going the decide. yesterday there did seem to be some indication, making it look like they might strike this thing down what was your impression. >> i think you have to remember in a case of such great significance, in this very like polarized time, that justices are not going to throw softballs they are asking difficult questions because this is an important case they will do that whether they are inclined to up hold the law or strike it down. begins burg and briar their questions indicate they are more inclined to up hold the law the rest of them it is hard to predict you have to be careful about predicting the outcome based on questions they are asking they will ask tough questions and the government, is in a difficult position having to articulate a limiting principle where as the challengers have an easier time, you know, bringing forth the parade of horribles what could happen if they do up hold the law. >> how about justice kennedy people are watching him very closely his line of

questioning, and the like, what do you think about that. >> he kept reiterating he is concerned about the relationship between the federal government and individual. kennedy is known to be very concerned about federalism and he seemed to be pressing the solicitor general to articulate a limiting principle if he is inclined to up hold this law he wants to know where does it stop if i up hold this law then what else can congress do he wants to make sure he is not just opening the door for unlimited federal power. >> today they will talk about several billty sever ability if they strike down the law, are the two linked together if one goes the rest have to go. >> right there are three ways to do this those challenging the law would like the entire law to fail in their view every provision of this law is tied to the individual mandate but the government counters that you know there is some

provisions of the law already in effect obviously not every provision is tied if the government gets their way they would like two other provisions of the law, to fall with the mandate that is the guaranteed issue and community rating provisions which require insurance companies to provide affordable coverage to everybody. and the government says well, those only work if you have the mandate because the mandate brings healthy people into the insurance pool and keeps costs down and there is a third way the court could go and this position is being advocated by an attorney appointed by the court and that is, to allow the entire rest of the law to stand if the government strikes down the mandate. >> got you. all right. now it is very complicated, it really is, let me ask you about this, the tax thing yesterday there was the talk about is there -- is the penalty that people might face, is that a tax or not a tax now the

government seems to be saying on the one hand, well, it is not a tax it is a penalty, but on the other hand they make the argument i want to make sure i am saying this correctly, this part of the law has to be implemented before it can be struck down which seems to indicate it is a tax are they arguing both sides of the fence here? >> well, kind of the government is walking a fine line because on the one hand they do right their taxing power as -- cite their taxes power as an individual mandate but tax for the purposes of irs code means one thing and something else in other circumstances, the argument was about whether this tax law, requires the court to postpone a decision on the mandate, um, and if the penalty provision, the penalty i am referring to is what people would pay in 2015 if they do
