7:05 am
another person. court papers do not specifically name vincente grey or suleman brown but the documents allege they were transferred from candidate a to b and gore destroyed a photobook containing a record of these illegal payments. it totaled just $535 but could support much bigger allegations, ones logged by suleman brown mayor grey was paying him off to do some dirty work, brown made accusations after he was fired from his job as an accountant in the grey administration. council members believe the charges against gore may not be the end of it. >> certainly an ominous event because it means that he is entering into a plea, probably with some sort of arrangement to provide information on others. it means this is only one shoe dropping. this might be a centipede so there may be other shoes. >> reporter: councilmember, mary che led an investigation into the allegations, suleman brown made not long after that
7:06 am
and then the feds took over the case. the most serious charge tell knee obstruction of jus -- felony charge obstruction of justice he faces up to 20 years in prison on that charge but tony and allison we expect if there is indeed a plea deal he will probably get something of a lighter sentence in these charges. >> thank you very much. in other news this morning an investigation is under way into a police chase that stretched from prince william county into the district. it started late last night, when prince william county police tried to pull over a woman on 95 north. she was wanted on an outstanding warrant. the woman fled and police put out a lookout. fairfax county police spotted the woman who drove into arlington, where police picked up the chase on 395, she then drove into the district where u.s. park police continued the chase. the woman was taken into custody in southeast dc without

7:08 am
at an official press conference he quickly shifted into campaign mode. >> governor romney, his main calling card for why he thinks he should be president is his business experience. >> reporter: the president was defending his own campaign ads that have aggressively targeted romney's time as a private equity investor. >> one day we had a job next day we didn't. >> reporter: he had to contend with some of his own high profile supporters including a rising star in his own party, newark new jersey mayor corey booker fed up with ads from both sides >> it is nauseating to the american public enough is enough. >> reporter: booker would later try to soften what he said but not before the romney campaign turned his remarks and others from prominent democrats into a campaign ad of their own. but the numbers show why these attacks over the economy will continue. a new washington post abc news poll shows a dead even race, 47- 47, when it comes to that

single issue. as far as the overall race is concerned the same poll give it is president a slight edge but well within the margin of error. back to you guys. all right doug luzader thank you sir. new this morning a new era in space flight begins as nasa turns the keys over to private industry. >> first of its kind commercial space cargo ship blasted off early from cape canaveral florida. that is with we find steve goal balk live this morning. good morning. a different report today. >> reporter: yeah, not quite as spectacular as a space shuttle launching from florida's space coast but still nice to see something launch even if it is a private company's rocket and there is no astronauts onboard but we are 3.5 hours into this mission this is the first private spacecraft that will hook up with the international space station. that will happen friday if all things go well. so far everything is looking good. that was a picture perfect
7:10 am
launch, this morning. that falcon rocket they had to scrub at the last second saturday they got the lift off into this morning after 10 minutes, that capsule on top unhooked, it will rendezvous on thursday and hook up friday. this is the third demonstration flight they have to do for nasa before they can start fulfilling their contract. they will do 12 supply missions over the next few years, a couple scheduled end of this year so this is proving they can do it. proving this private company can get up there and do what they say they can do. it is a 1.5 plus billion dollar contract a lot on the line for space x so far things are looking good. eventually you could have astronauts flying, within 4 to 5 years, and they think this mornings launch will pave the way for astronauts, maybe space tourists to fly on one of these rockets. back the you guys.

7:33 am
about. >> just roll with it. >> let's kick off your forecast, look at the radar. we've surrendered, white flags fly being the heat and humidity with us for the next couple days. want to mention quickly that light green on your map that is a flood warning issued by the national weather service. reminding everyone we had heavy rain overnight in prince william county because of that, we have some flooded roadways, manassas, you are under this flood warning for a few more hours. in effect until 10:00 a.m., not raining currently but, with all the rain last night 3 to 4 inches of rain off to the south and west. most of the area, a few light sprinkles and showers, you will see more showers north and east, laurel, pushing up towards columbia, that is about it. otherwise clouds, fog, mist, that continues to cross the area as we continue to be under the influence of this very very stuck pattern the atmosphere.
7:34 am
you will be able to see the cloud cover, just not a lot happening. most rain shower activity off to the north. see that twist there as showers push up into southern new england. we are on the backside. might be a period of sunshine that will only help destabilize the atmosphere, increase the possibility of more showers and storms this afternoon. if you get sunshine don't be fooled showers and thunderstorms likely will return in the wake of that. out to the west, a cold front will fly through over the next couple days ring out the atmosphere and eventually bring in dry air. it will take a few more days, 66 washington, 70 quantico, 64 leonard town, and left turn looks like 54 all over the place north and west plenty of humidity as well. temperatures warmer than yesterday. 79 daytime highs plenty of clouds scattered showers storms back in the forecast. winds out of the east at 5. clouds stick around, showers and storms likely, 63, overnight low. your 5 day forecast unfortunately we are not going
7:35 am
to break out of the pattern, wednesday and thursday more of the same friday we will dry out the atmosphere and turn up the heat, and by sunday, and monday i think temperatures will get close to 90 degrees in time for our big holiday weekend, opening of the pools that kind of thing. >> that is a look at your weather, let's look at traffic julie. >> a lot is happening at this point. very busy on the roads, southbound 29, accident activity further south after randolph, you can see it is grid locked to the accident scene old columbia pike, 198 busy cleaning up a car fire. this happens to be the belt way outer loop, slow 95 to georgia avenue. what is unusual is inner loop. very slow going georgia avenue, 95 college park that is where we had accident activity, clean up continues, follow police direction to get by. southbound 95, as you work your way out, accident activity squeezing by to the left.
7:36 am
fatal crash occurred 4:30 a.m., still under investigation south of that. as you reach quantico only the right lane is able to get by. i've got delays as you travel out of day city. 395 earlier incident we had at king street has cleared. as you work your way out of virginia, wilson bridge, accident activity tieing up the left lane. still no verdict in the corruption trial of former presidential candidate john edwards a third day of deliberations set to begin today. for more on that and a closer look at all the new evidence we are seeing come out of the trayvon martin case, is jacob frankle an attorney and a former federal prosecutor. jacob good to see you. >> good to see you. >> we want to talk about these two cases. let's start with trayvon martin it struck us as odd we are seeing all these details come out before a trial in enest has
7:37 am
begun, -- earnest has begun is this unusual. >> it is but also relates to the high profile nature of this case. you are dealing with state laws, something called the freedom of information law. applies to united states government and different states. different states have different levels of that law. florida law is fairly liberal, in a sense that it enables whether it be media or anybody else to make an application under the state's freedom of information law and gain access to information. so as a result, where for example the federal system there is no way this kind of information would have become public in florida it has. and as a result, we are seeing more and more information, really that is directly relevant to the trial. if you go back to the beginning when pretty much people were making guesses, based on the initial reactions, and this is true any time you have a high profile case, what you really have is now more information,
7:38 am
that is coming into the public domain. that is being analyzed and in essence what you are seeing as a result is this case being tried, in the public, long before it ever actually gets to trial. and we have a jew durable system -- judicial system that is proud of the opportunity for defendants and the government to get a fair trial but when a case is being tried in such a high profile manner in the public domain you almost wonder, if there will be anything left when it comes to trial. >> more defined group of men and women who wouldn't have heard everything and made their minds up before. >> exactly. >> what is the worst case scenario as far as something like this going all the way to trial. could there be a mistrial or would they say we can't try this in court any more >> that is possible. the same thing, the jury is an issue defense always looks for, as a potential avenue for
7:39 am
appeal even though, as i appreciate florida law there is an opportunity for a hearing that is a proactive hearing, that defense lasts for in which they are going to assert this was an act of self-defense such as a judge may throw out the case even before trial but without prejudging, but what it really does is makes it difficult, for a judge and for the process, to select a fair jury, and you almost wonder, whether in a case such as this, such a right profile where you know coming in, -- high profile where you know coming in, to be able to get a jury that will fairly consider the facts you will wonder if you will get that jury. >> let's talk about john edwards jury out, considering the fate. 30 years on the line here. what are your thoughts about this. neither edwards or his alleged mistress took the stand what
7:40 am
are your thoughts >> that is always a strategic issue. we talked about that in the context of other cases as well. and rarely when a defense lawyer is able to effectively challenge the government's case, through cross-examination of the government's list often it will avoid putting its defendant on the stand to subject him to a government cross-examination, they would much rather let the person enjoy his constitutional right, sit back and be a challenge of the government's case. if there be conviction, critical word if there is not a 30 year case it will make it interesting for the lawyers whether some how this will expand the breaches of federal election law. there is a similar case where it is charged, it is political and you almost wonder if once
7:41 am
the jury really is called to task, to decide whether someone acts as a criminal intent whether this conduct was criminal, will they come back unanimously and commit. >> we will watch both of these hope you come back and help us sort all these legal issues out in future. jacob frankle a former federal prosecutor and currently a local attorney. tony over to you. 7:41 a.m. on tuesday morning. for the first time at a local military base, those injured in combat have a free place to call home while their loved one is recovering. another inconvenience for airline passengers after the break, what more and more carriers are now charging for in flight. we will be right back

8:07 am
some body no one has really been talking much about. this suggests to me the u.s. attorney is much further along, in this, than we in the media are. he knows a lot more than we do. that is understandable. he has subpoena power can threaten people with crimes, or prosecution and get people to talk in ways that we can't but i think for us in the media, we have to recognize they know a lot more, thing they know a lot more in the u.s. attorney's office than we do and we are sort of going to find out what they know as time goes on. >> but also obviously indicates this truly is a serious matter when it is all sewn up, there was questions, suleman brown is making these charges and you know, he has been an interesting character. >> several things. >> this confirms that it wasn't alba loney what suleman brown said. this guy seems very odd he made a lot of allegations a lot of

them were pretty off the wall. a lot were not true but the key allegations that he made, that he got, something -- money, job offer, job promise, in return for making a tax on adrian fente to help in the campaign we now have real evidence, that there was something to that. two important things to keep in mind about what has come out first of all the amount of money involved is trivial, and we are talking 500, $600 in you know, mishandled, misdemeanor money orders handed over in a phoney name. compare that to hundreds of thousands of dollars of tax payer money stolen by harry thomas junior, or jack johnson in prince georges county. so the scale of the crime here, you know, is really
8:09 am
disproportionate but the thing that is crucial for the mayor is he has been denying all along, that he did nothing wrong, that he knew of no wrong doing by anyone now we have what looks like a guilty plea by someone very close to him, it is very hard for people familiar with politics and the city to believe that grey did not know at least something about what this guy was doing so the mayors credibility is what is really on the line here, and what is really under assault and he is not saying anything on lawyers advice and that is -- raises a lot of suspicion. why isn't he announcing this, saying i had no idea this is outrageous, he is completely mum and just he looks -- it is very suspicious,. >> we must make the point his name is not included in these documents. >> it is not included in the
