before we check the weather with tucker, we continue to follow breaking news out of montgomery county, where firefighters are still on the scene of a raging, once raging apartment fire. several people had to be rescued in the 14100 block of castle boulevard. >> that is where we find fox 5's wisdom martin who is monitoring this situation. he joins us live on the phone. wisdom? >> reporter: tony and allison, these are the woodlake apartments here in montgomery county. now, i'm told that -- i just spoke with the fire department spokesperson, i'm told that eight people had to be rescued by ladder. this fire started around 7:23 this morning, with flames shooting up high into the air. smoke into the area. the entire building had to be evacuated. it was a two-alarm fire. i've been told there was very

minor injuries as well. several people have been displaced. two-alarm fire with about 100 firefighters battling the blaze that started in the back of the complex. they're not sure what the cause was. it's still under investigation. in a few minutes they say they're going to have an update for us as we're out here now. i've also spoken to some of the people who lived in that apartment complex and some of the people who live in the building next door. in particular, one man who lives next door, he said people were knocking on the doors telling him there was a fire, the fire alarm went off. he started to run outside and ran outside, saw the flames and smoke and also saw on the building that was on fire, one of his grandson's friends and his mother on the balcony of the burning building. he says he felt helpless, because there was nothing he could do. the good part is he says they got out without getting injured at all. again, eight people had to be rescued by ladder. there are several very minor injuries. the fire department is still

a few showers during the course of your day, and into the evening hours. temperatures now, in the 70s. 79degrees in washington. 70 frederick. 71 in ocean city and 72 in fredericksburg. lots of clouds. could be a scattered shower. highs in the mid-80s. clouds will hold the temperature down a little bit. changes this weekend. more heat and humidity on the way. i'll have details in just a minute. back upstairs to you, tony. tucker, thank you. new this morning, montgomery county police are investigating a deadly motorcycle accident. it happened around 10:30 last night on east village avenue and double land road. officers say the motorcyclist struck the curb of the median and hit a tree. the victim was 46 years old. the search continues this morning for the suspect in a sexual assault case in gaithersburg. a woman was allegedly attacked by a man at knife point monday

night and sexually assaulted. there's more information about the suspect's description on myfoxdc.com. if you have information in this case, please contact montgomery county police. topping this morning's stories, alleged threat against the first lady and it came from a police officer who is assigned to protect the first family. let's get the latest from fox 5's sherri ly live at police headquarters in northwest. good morning. >> reporter: good morning, allison. d.c. police and the secret service are investigating this alleged threat. the officer accused is assigned to the detail that leads the motorcade for the president, vice president, and the first lady. that's what makes these allegations all the more troubling, given the close access he had to the first family. a law enforcement source with knowledge of the investigation said the officer made the threat against the first lady after arriving late to a

motorcade assignment. the officer who is a 17-year veteran asked why he was late, and he said, i don't care about that, expletive. i'd shoot her in the ahead if i could. a lieutenant heard the remark or heard about it and reported it. if the officer did say that, the former attorney for the d.c. police union calls the statement reckless. >> i think police officers have to act responsibly. if he made that kind of a threat, even in jest, i think he should face administrative charges and dismissed from the police department. >> reporter: d.c. police would only simply say it is investigating an allegation of inappropriate comments. according to the "washington post," after making that threat, the officer then used his cell phone to retrieve a picture of the firearm he said he would use. the officer's police powers have been revoked and he could face criminal charges, pending the outcome of this investigation. that's the latest here at

police headquarters. back to you. thank you. the pressure is building for mayor gray to more thoroughly address the illegal activity in his campaign. >> congresswoman norton released a statement yesterday saying he must clear this up quickly. the mayor says his attorney has told him not to say anything more than he has already said. >> i think you all are probably as frustrated as i am. there are lots of things i would like to address at this stage, but because of the continuing nature of this investigation, which i've said all along there's nothing i'm going to say -- >> three council members have already called on mayor gray to resign after finding out about a $653,000 shadow campaign. the mayor has made it clear he has no plans to step down. jeffrey thompson, the man suspected of funding the shadow campaign has left the

accounting firm he founded. a spokeswoman says he sold his stake to his partner. his home and office were raided in march. he has not yet been charged, but the associated press says two people familiar with the investigation have identified him as the source of the shadow campaign funds. on the campaign trail now, president obama heads to virginia for a two-day trip. he'll stop in virginia beach today, followed by hampton and row. tomorrow in the richmond area and then to fairfax county. former new york city mayor rudy giuliani is also in virginia. he's campaigning for mitt romney, along with virginia lieutenant governor bill bowling. mitt romney could be close to picking his running mate now and rumors are swirling that topping the list is former secretary of state condoleezza rice. she is on the top of the drugbe report.

it's a controversial news source, true, but has a history of being right. the report says she could be romney's pick, but she has repeatedly said she's not interested in the job. >> how many ways can i say it? not me. >> she is very interesting, skilled in foreign policy. a lot of people like her. she's never been a candidate, which is a minus. >> another minus, she did work for the bush administration and romney is not talking about the process, and romney is also not talking about the process for selecting his running mate. usually the v.p. candidate is not announced until just before the party convention. that's still more than a month away. tony? allison, two weeks after that devastating storm and this morning almost two dozen families are told they have no place to live. yesterday 65 families were forced out of the riverdale

towers apartment complex. this morning prince george's county inspectors say more than half of the units, 43, where safe to live in. county officials are telling those residents they can return immediately, but the other 22 units are not safe. an emergency shelter was quickly set up at bladensburg high school. >> how much will a room be per day? >> seventy dollars per night. >> can you afford that? >> if it is, like, four or five days, yeah. anybody can make that. but if it is months, nobody can afford that one, i believe. >> the 22 condemned apartments might need up to three months of renovations. at 9:09, coming up next, a report on the penn state section scandal spotlights the late joe paterno. what it found coming up. >> plus, new information

penn state's culture of silence let sandusky prey on young boys. that is the assessment of the internal report. it says the university engaged in a "total disregard of the safety and welfare of the child victims of jerry sandusky." the report also found former penn state president, former football coach paterno, and other top leaders hid critical information about sandusky to protect the university. >> i think what this does, this really does provide a road map and ultimately the civil cases are going to proceed. will have no bearing on

sandusky's sentence, and everybody is worried about that. he is going to jail. he was convicted. the real test will be when a report like this is issued, does the company, in this case, penn state, respond as the recommendation dictates? >> the chairwoman of penn state's board of trustees says the panel believes paterno's 61 years of service to the university is now marred by the scandal. the special prosecutor in the george zimmerman case releases another batch of evidence. among the items released are transcripts of interviews with neighbor residents who heard yelling or shots the night martin was killed. also transcripts of police reports about several previous calls they received from george zimmerman about allegedly suspicious people in his neighborhood. the prosecutor also released a photo of martin's hoodie sweatshirt. joining us now to talk about

the importance of the materials is attorney joel schwartz. he is a former federal prosecutor and now a defense attorney. thank you for coming in. >> good morning. >> a lot of information was released. some of it very interesting. let's talk about, before we get into the specifics, overall were you surprised at the release of this information? >> well, i'm not surprised of the behavior of both prosecutors and defense attorneys in a big high profile case. but what i think the problem is here, the potential problem is, the prosecutors releasing information to the public, which is the jury pool, the group from which the jury will be selected, which ultimately may not come out in the trial of the the only obligation a prosecutor has to release information before the trial is give the evidence necessary under the constitution or under the state law to mr. zimmerman and his defense attorney. in some respects, he has to responsibility not to release it to the general public in advance of trial, because some of it may not come out into the

testimony. evidence about somebody's reputation in the community, or prior acts he did weeks or months before the evening in question, those things are weighed carefully by the judge, if the defense raises motions, to see whether it is something that will help the jury or mislead the jury or unfairly prejudice the defendant. the big risk is, that you can never use evidence of a prior bad act or reputation for violence to show or to allow the prosecution to argue, he did it before, so he must have did it this time. >> some of what was released was about zimmerman's behavior before this incident happened in terms of calling the police a bunch of times to report suspicious activity and that kind of thing. you're saying that might not be allowed by the judge? >> well, i think the things that are the most remote are the least likely to come in. his activity with regard to what he did while on the

neighborhood watch, that may be deemed as more relevant, as long as it's not seen as so prejudicial to mr. zimmerman that it will mislead the jury. on the one hand you talking about the idea there were a lot of calls he made. i guess the prosecutor would argue that, use that to argue he sees danger behind every corner. on the other hand, one nugget where he sees a guy going through the trash and he says, i don't know what he's doing, i don't want to approach him. that shows that he's reluctant to be the person to confront someone and he's a watcher, but not a doer. that plays into what i think the defense theory is. >> i want to get back to your main point in a second. race is -- has been made a factor in this case. from what you've seen of the material released, it doesn't seem to show him to be a racist, it seems to show the opposite. >> charges a lot of talk -- there's a lot of talk about race, for sure. there's a lot of commentary

about the police officers who got to know him in the context of this night watch stuff that said they didn't think the act was racially motivated. that's their opinion. and he's not a racist. but has a hero complex. on the other hand, there is testimony, or not testimony, there's statements apparently by an ex-girlfriend that says he does have negative attitude towards african-american people. that shouldn't come in, because it's reputation evidence. and except under specific circumstances when the defense puts one of his character traits at issue, then and only then can the prosecution respond by rebutting that or showing evidence contrary. >> the release of all this material, is it prejudicial and might we hear the defense object to all of this saying -- what's all this out in the public now? everybody is talking about it. >> i think the smart thing really is for the judge to act. i mean, the defense attorney has done a good job about using the public and using the press as a way to advance his case.

i don't know whether the special prosecutor is trying to influence the jury pool or get out ahead of the defense attorney. he has to turn over favorable evidence to him. for her to put out the unfavorable evidence as well, if nothing else, will tamp down what the defense attorney will ultimately put out to the press. he can remind the public the local police messed up this investigation so much, they had to bring the feds in, and therefore you shouldn't trust what the local police does. there's a little nugget in the report what was released that says an officer pressured a witness to identify the person in the hoodie as martin. you can say, that's unreliable. another thing the defense can use out of this, they can use it to remind the community and the jurors that the fbi has looked at this case four months and have found no evidence of racial motivation. >> very interesting. great to have your input into

stuff? with me is mary with the mount olympus berry farm. picking out a melon is tricky? >> no, it's really easy. we don't bring them unless they're close to getting ready to eat them. watermelon, give it a nice thump. you can feel the vibrations. if it sounds hollow, it's pretty good. sounds like your slapping a wet diaper, overripe. >> reporter: nice comparison there. what about the smell? >> no smell with the watermelon. that's a cantaloupe. >> reporter: what is interesting is the variety of produce you have. i didn't realize how many different types of eggplants there are. this bin here, believe it or not, is all eggplant. we even have stuff in here i thought were tomatoes. tell me what you have here.

>> what i have here is most folks are used to the typical santana eggplant. here we have a sicilian, which is very good for -- probably the sweetest thing i've got. >> reporter: good for eggplant parmesan? >> perfect for that, and grilling. this is a green eggplant. a lot sweeter than this. skin is not as tough. very, very good. we have a neon eggplant. similar to the zebra. a lot of people like this handling wise, because it doesn't have the stickers. then we have an asian eggplant. i like this, because you can cut it up nice and easy. this year we started grilling for folks that are from the west african cuisine. it's a garden egg, and used mostly in stews. i wouldn't use this on the

grill. it's bitter. >> reporter: still an eggplant? >> still an eggplant. then turkish and thai eggplants. >> reporter: you have some i haven't seen before. you have your basic bell pepper here. then you have these purple ones. tell me about those. >> this is a tequila. >> reporter: what's that? >> tequila pepper. very good, nice purple pepper. it's got nice bell pepper flavor to it. it's very good in salads and such. >> reporter: there's also there red one, your son came up and say, hey, you want to try this? i thought, there's no way. this is probably hot. but it's not. >> no. it's probably the sweetest pepper i have here. it is incredibly sweet. very good sauteed or to snack

♪ tell me something good ♪ is it friday? must be. the school year may have just ended, but many parents are looking ahead to next year, including one mother who wrote in for today's ask allison segment. she's lived in her neighborhood 15 years or so and thought her daughter was friends a neighbor's daughter. and they worked out an agreement for the two girls to stay in the morning and come together after the bus for a short time as well. basically for the two middle schoolers to have each other as company before and after

school, because the parents work. turns out the viewer's daughter is not happy with this situation. here's more from the viewer's e- mail. she writes -- good luck with that, that's all i'm going to say. viewer, this one is tough. your daughter has to come first. that's more important than anything that you're a good mom rather than a good neighbor, in my opinion. this other girl will be in your

home before and after school. that's your daughter's sanctuary. school can be stressful. she deserves to come home and not have that in her house. but there are real ramifications to your moves now. you and the other mom have reached that agreement, one your daughter initially was on board with, or so you thought. you learned afterwards she wasn't. basically, to switch up now close to the new school year means this other mom will have to scramble for before and after care because your child doesn't like her former friend. kids can be fickle right now with friendship. i have three daughters, i hear it all the time. one day they like this person, even their best friend. the other day they want nothing to do with them. really talk with your girl and makes sure she understands what this fallout will be. you told me this child's behavior was questionable at school, that she was a bit of a bully, your daughter says, on the bus as well, and your daughter doesn't like that behavior.

good for your baby. but have you talked with your friend about her child's behavior? she probably would appreciate knowing what her child is doing. i know i would. as tough as it will be to hear, i want to know how my child is perceived and what she's doing at school. in the end, if your daughter doesn't feel comfortable being with this other girl for what would be a comfortable part of her day, end it now. give the other mom ample time to make other arrangements. brace yourself for the real possibility that you could lose a friend and your daughter could face a bit of backlash in school, she said she's bit of a bully. that's a real here. something to think about. in the end, i believe you're aallegiance is to your daughter. good luck. also, tony, some things, maybe pay a neighbor to watch both kids and that way they don't have to be together. it won't disrupt the whole -- >> pay a neighbor? >> pay a neighbor to come watch the kids.

mysterious and spooky. all together ooky as well and they are the addams family. >> holly morris is part of the cast of the musical now playing in d.c. she joins us live from the kennedy center. >> reporter: their house is a museum when people come to see them. they really are a scream. i came last night with my family, and we all enjoyed it. we laughed and walked out snapping our fingers. these are two of the big reasons why. we have doug back with us, who is gomez, and jonathan, who is the dance captain. look at them all ready. ready to do a little tango. >> oh, yeah. >> reporter: we were talking about jonathan's role in the show, or i should say roles. it's amazing when you're the dance captain. explain what all you have to know.

>> i'm a swing, and i have to swing from part to part. i have to be responsible for knowing all the ports in the chorus and i understudy the part of lucas and i teach new cast members. >> reporter: you have to know the entire show inside and out? >> yes. >> reporter: your job is easy. >> that's what people don't understand, all the work that goes in. if somebody gets hurt during the show or gets sick, he's got to jump into costume, put a face on, and he's on stage in a minute and a half or two minutes. >> reporter: also we were just sitting here talking about chemistry. there's a lot of different parts that go into that. you were saying you all feed off each other. as the lead, everyone else in the cast looks at you to see what kind of night you're having. >> absolutely. yeah, i think to some degree we work off each other. so if i am not ready, that would be a very bad thing. i've got to be in a state of 150% readiness so i'm the first person who speaks. then i think everyone takes their cue from the leads in a lot of ways.

and i in turn take my energy from my fellow actors and also from the audience. if the audience is having a really good time, we feel it and it definitely gives us a lot of energy. >> reporter: you have to give 110% every single time. this has stuck with me, we're looking for lightning in that bottle every night, at that moment. >> i think that's why we fell in love with the theater in the first place. we were talking about the music man and i saw robert preston in the movie when i was growing up, and you watch this thing and it's like watching michael jordan do a layup. it's magic. you go, i want to do that. it is, it's like lightning in a bottle. when you come out on stage, your responsibility is 150%. >> reporter: it's your job. >> people who bought tickets, coming to the theater the first time, you want to give them the same thing you had. >> reporter: we're going to try to create lightning in a bottle magic. i try to do this sparkle thing every morning. >> you're already a sparkle. >> reporter: i'm going to sparkle with your and the
