coming up on fox 5 morning news, breaking news out of colorado. a gunman opened fire in a movie theater, killing more than a dozen and injuring at least 50 others. this happened hours ago during a midnight showing of "the dark knight rises." the latest on this developing situation and the and gunman straight ahead. >> plus, mother nature strikes again, bringing heavy rain and more power outages. and for people living in one d.c. neighborhood, they're fed up. fox5 morning news at 7:00 starts right now. there's a live look

outside. there are some clouds out there, perhaps storm clouds. we'll find out about that in a little bit. this is friday, july 20, 2012. good morning, i'm tony perkins. >> and i'm alison seymour. we continue though follow the breaking news out of a denver suburb. at least 14 people are dead, 50 others hurt after a gunman opened fire during a midnight showing of "the dark knight rises." >> this happened at the century 16 movie theaters in aurora, which is about 10 miles outside of denver. our own sherri ly is live in the newsroom with the latest on this still developing story. >> witnesses say the shooter fired into this crowded move e theater right after the movie started. bullets pierced the walls, even hitting people in the next theater. some apparently thought the gunfire was coming from the movie. people scrambled to get out of the theater. some of them bleeding and clearly shot. many were dressed in costumes

for the premier of the latest batman move. ten people died at the theater, another four people at area hospitals. at least 50 more injured, two of those in critical condition. police say the gunman set off some kind of gas canister. you're looking at video of people outside. people bleeding, a lot of chaos going on outside, with people unsure of exactly what was going on. that shooter apparently opened fire, going down the road, shooting at close range with some type of automatic or semi- automatic rifle and a handgun. police arrested the gunman outside the theater in the parking lot next to his car. the denver post is reporting he is a 24-year-old. he wore a gas mask, bullet- proof vest and emptied one clip and continued to fire.

police found guns, and other weapons inside his car. the mayor there says everyone is still in shock. >> of course we've got different theaters throughout the city. i would not have expected the security to be any different than it normally would have been for a movie premier. i think this is one of those random acts that no one would have expected and it's just a terrible situation. >> these are live pictures outside of that movie theater right now, where police remain on the scene. so far, police have not released any type of motive in this attack, but clearly this is an on going investigation with details still coming in. the suspect's apartment building we're told has been evacuated and is being searched

by police for other weapons or bomb making materials. police have scheduled a press conference around 11:00 denver time to release more details about what happened. there is also word that the threat level may be raised as a result of this shooting. but those details still coming in as this story develops. of course, we will be staying on top of it for you. back to you. >> sherri, can i ask you one quick question, and i know you're getting all the information downstairs as it comes in. earlier this morning there were some reports they were looking for an additional suspect. are they no longer looking for an additional suspect? >> no longer looking for an additional suspect. police did hold a briefing earlier this morning. they are now saying that they have one suspect that has been arrested and taken into custody. but they do not believe there was anyone else involved. this was apparently just one

gunman firing at close range, we're told, with some type of automatic or semi-automatic rifle as well as a handgun. clearly, this is a very chaotic scene there. a lot of people were dressed up in costume, so it was hard for people to tell what was going on in there. in addition, the movie theater had filled up with that gas that the suspect reportedly set off and people couldn't really see what was going on. so they're still out there. they're investigating this, and as we get more details, of course we'll be bringing them to you. >> the tragic part of this, any life is a huge loss. this movie would have attracted people of all ages and sadly we are hearing some of the victims may be very young people. >> from what we understand, some of the injured are children. there were children being seen carried out of the theater by people.

some of them did not appear to be moving. it's unclear whether those children are among those who were killed or whether these are just among some of the injuries. but clearly we have a wide range of people who have been killed and injured. this was a 12:30 a.m. movie. this was the premier of that new batman movie and some people brought their children during the early morning hours to see that premier and some of the victims again, we do know are children. >> all right, sherri ly reporting from the newsroom. thank you very much. we'll check back in with you a little bit later. six minutes after 7:00 now. we want to get updated on our weather forecast. obviously we had strong to severe storms come through last night. tucker barnes can tell us what to expect today. >> good morning. more of the same in the forecast today. temperatures in the mid-70s. later this afternoon, we have a flash flood watch, potential for additional heavy rain.

storms moving in from the west. 76 now in washington. humidity 87%. winds out of the north and west at 6 miles per hour. the good news is the initial band of showers and storms that moved in last night well to our east. getting a break there. notice to west virginia and eastern kentucky cloud cover and showers redeveloping. low pressure will move in and along this frontal system, and as it does so, increased enhanced chance for showers and storms this afternoon. morning dry and cloudy. later this afternoon, look out for the showers. some could bring heavy rain. because of that, flash flood watch, starts at 12 noon, potential for 1 to 2 inches of rain in a short period of time. we know what kind of damage that can cause. all the counties west of the chesapeake bay under a flash flood watch starting at 12 noon today. i think the timing will be after 2:00, 3:00 today, through

9:00, 10:00. that will be the worst of it. generally cloudy skies here the first half of the day. temperatures only in the mid- 80s for highs. that's the good news. more details on the weather and a look at the weekend ahead. we'll do traffic with lauren demarco. good morning. >> a northwest d.c., 16th street at arkansas avenue, north of spring road, reports of a wreck. also eastbound lanes of greenbelt road remain closed at good luck road because of an ongoing accidents, knocked down a pole and they're trying to clear that out of the way. could be the case through this afternoon. look from traffic land, outer loop of the beltway, usual stretch of volume, 95 past new hampshire avenue. not too bad. all of the volume rather light on this friday morning, so that is good news. 355, montgomery village avenue, signals are dark. one of many intersections where the power went out. so treat those as a four-way

stop. 95, 395 incident-free. south joyce street near army navy driver is closed there. that's a check of your fox 5 on time traffic. allison? thanks, lauren. last night another round of severe storms ripped through the d.c. area. residents had to deal with torrential rain, high wind, thunder and lightning. a viewer posted this picture on twitter last night of the standing water at first street and b street in northwest. it is the third time in nine days the bloomingdale neighborhood has experienced this kind of flooding. pepco wants a 4% rate hike and the public service commission is facing a deadline today to decide on it. a lot of customers have criticized the utility for the long delays in restoring power after severe storms. at a hearing yesterday, the power company got blasted by

angry customers, council members and state lawmakers. >> i think that it's fine to talk about things like undergrounding and hiring more alignment and improving communications. they are not the problem itself. the problem itself is pepco. >> because they were reporting restorations when they weren't. they were reporting they were not aware of outages that had been reported. and they were reporting that there were crews and there weren't crews. >> coming up next hour, we are talking live with washington post columnist robert mccartney who was at yesterday's hearing. we have sad news related to last month's derecho storm. dillon cooper was found unconscious on the night of that storm on haycock road. somehow he touched a live wire and died five days ago.

we continue now to follow breaking news out of colorado are police are on the scene of a mass shooting. >> at least 14 people dead, 50 others hurt after a gunman opened fire during the midnight showing of "the dark knight rises." this happened at the century 14 theaters in aurora, that's a suburb about 10 miles outside of denver. witnesses say the movie just started when the gunman came in through an exit door, apparently kicking open that door. he set off some type of gas canister and opened fire. they say he stood up front and fired at very close range with a rifle and handgun. these are live shots now from a helicopter over the gunman's apartment, which police have descended on and they are looking for other weapons and possible explosives. earlier we were showing you video of hundreds of people running out of the theater. it was pandemonium there after the shots were fired.

some had blood on their clothes and others dressed up in batman gear. this video shot by someone there on the scene, you can see that man with bloody clothing. apparently people started running out of the theater. police say one suspect is in custody and we are hearing reporting they have also gone to his apartment as we said. >> statement coming in now from president obama of course, he is in florida now on the campaign trail, but the president, his words are he is shocked and saddened by horrific and tragic -- the horrific and tragic shooting in colorado. the president speaking there. again, live pictures of the suspect's apartment as tony mentioned, the suspect spoke of possible explosives there at his residence.

we have yet to find out exactly what was there. but so far it appears that that scene didn't show imminent danger. they found nothing when they first went in, but they are on the scene and will be and we'll bring you anything that happens breaking and developing in this story again out of colorado, where at least 14 people were shot at the premier of "the dark knight rises." we'll have more on that in a little bit. tucker barnes is here. man, last night, i have to admit, i thought here we go again. because it was like the derecho. lot of lightning, clouds rolled in, rain blowing against my house. >> yes, very heavy rain and localized flooding. could do it again this afternoon. not guaranteed, but the ingredients are there in the atmosphere that we could see locally heavy rain, mid- to late afternoon, moving into the evening hours. just clouds to start the day. cloud cover will hold

temperatures down a little bit this afternoon. highs only in the mid-80s. the threat of rain and a flash flood watch which goes in effect for most of the area starting at noon today. 76 in washington. little better overnight, temperatures cooled into the low 70s off to the north and west, warm and humid start. all the water in the atmosphere will serve as energy for the storms later today. 70 now in winchester. 75 this morning in fredericksburg. looking at our satellite radar, cold front we've been talking about the last couple of days, is a stationary boundary now. possibility we could get showers and thunderstorms redeveloping i think any time after about 2:00, 3:00 today through the afternoon rush hour into the evening hours, and some could be heavy. talking about 1, maybe 2 inches of rain in a short period of

i've been checking out what some are writing in. headed up to the 11th street bridge, heavy with traffic on 295. yellow, traffic new york avenue heading into downtown. if you are traveling the beltway, 95, college park into silver spring typical delay. but lighter than usual. everybody is moving from the heavy volume, you'll be off and on the brakes. beltway here, past van dorn street looks good. to the right is the outer loop where it typically starts to slow. now everyone is moving. 95 looks great here from newington into springfield. no problems on 395. 66 brief volume headed into centreville. everyone is moving. space between the cars there. allison, over to you.

checking headlines now, in a boston courtroom today the man accused of plotting a terror attack on the u.s. capitol and pentagon is expected to enter a guilty plea. authorities say he planned to fly remote control planes with explosives into the buildings. he ordered the explosives from undercover agents last september. the charges carry a combined maximum of 35 years in prison. but under a plea agreement, attorneys are requesting a 17- year sentence. there is surveillance video and you're seeing it here, of the man suspected of blowing up a bus filled with israeli tourists. it shows him at an airport carrying a backpack which authorities say carried the explosives. officials are using dna samples to try to identify the alleged

bomber. u.s. official says it's believed hezbollah was behind the attack. at the united nations for the third time russia and china have blocked a vote on a resolution aimed to end the civil war in syria. another vote is scheduled this morning on extending the mission in syria. the deadline is tonight. meantime, in syria, the rebels have taken the key posts along the border with turkey and president assad appeared on television for the first time since the bombing that killed three top defensive officials. closer to home, the u.s. coast guard says diesel fuel from a barge that sank in lake heron has reached the shore line. it sank yesterday during a storm and the tug boat also overturned. the dredge was carrying about 1500 gallons of fuel when it sank. it's unknown how much escaped. no injuries reported and everyone on board both vessels said to be accounted for.

here we are now with more pictures coming out of aurora, denver. i'm sorry, aurora, colorado, near denver where police are continuing their investigation into a mass shooting, just a few hours ago overnight at a movie theater in aurora at one of the showings of "the dark knight rises." a gunman opened fire in a theater, killing at least 14, possibly up to 50 others injured. they've been taken to area hospitals, we're told six

different hospitals around that area. now we are told that the youngest victim apparently is a 3-month-old child. we don't know if that victim was killed or injured. but that is what we know now. >> police say that the suspect apparently acted alone. they did find the suspect near his car behind the theater. they found there a gas mask, a rifle, handgun, at least one other weapon found inside of that car there. his name has not been released. but they have taken one suspect into custody. no other attackers, no groups that he was working with. but that's all we know. apparently there will be a briefing out of colorado in several hours from now at 11:00, 1:00 our time. we'll get more information then for sure. >> i think what you're seeing here is the apartment complex where the gunman lives. apparently there may have been some indication from the suspect to police that there are explosives at his

apartment. we are told they are evacuating that apartment building, or perhaps have evacuated it. i don't see movement right now. they are checking his apartment for additional guns, ammunition and possible explosives as well. as allison said, that gunman has not been publicly identified. but he is in police custody. he is the only suspect in this case. there have been reports very early this morning that police were looking for an additional suspect. they now say they are not. they have the one suspect in custody. >> we of course will continue to cover this developing story all morning long. we want to take a short break, we'll see you on the other side of it. it's 7:28 now. 76degrees on a friday morning. with it. 72 the dew point in leonardtown. 72 in washington. very sticky air this morning. here's your satellite radar, frontal system right across the washington area. been talking about it the last couple of days. it's going to set up here later today. what's going to happen is area of low pressure will develop to our west, and as that moves through, it will wring out the atmosphere of all this moisture. potential for very heavy rain around here, i think starting early this afternoon, through the evening rush hour and evening hours. perhaps thunderstorms, too. because of that flash flood watch for most of the area west of the chesapeake bay starting at noon today. could see 1 to 2 inches of rain in a short amount of time. we have to be concerned about urban flooding, and watch the creeks and rivers this afternoon. flash flood watch goes in effect at 12 noon. the concern is localized heavy

we have live pictures from arlington. south joyce street between army navy drive is closed because of flooding. look at all that ponding there trying to get that out of the way. this is underneath the 395 overpass. south joyce street between columbia pike and army navy drive closed until further notice. you definitely want to avoid that area. let's move along to trafficland. traveling the major arteries, good news is not much in the way of volume. 95 running well heading into springfield. 395 also looking good, incident and accident-free at this point. traveling the beltway, light volume through virginia and maryland on the outer loop, brief delays from 95 past new hampshire avenue. that's a check of your traffic. tony? lauren, thank you. we continue to learn more about this breaking news out of a denver suburb.

now at least 14 people are dead and 50 others hurt, after a gunman opened fire during a midnight showing of "the dark knight rises." this happened at the century 16 movie theater in aurora. that suburb is about 10 miles outside of denver. our own sherri ly is live with the latest on this developing story from our newsroom. sherri? >> tony, the gunman fired into the crowd at close range, hitting people at random. some of them children. people scrambled to get out of that crowded movie theater as shots were fired. you're looking now at a live picture of the apartment where the suspect lives. swat teams preparing to go in searching for possible explosives or other weapons there. as the shots were fired in the theater, some people were dressed in costume for the premier. the shooting erupted during the midnight showing of the new batman movie, "the dark knight rises." the wounded ran from the theater. if you look at youtube video that we have, you can see that

some of them were running from the theater with blood on them, clearly injured in this shooting. others reported police carrying and dragging bodies out. ten people died at the theater. another four at the hospital, with 50 others that were injured. police say the gunman set off a gas canister, filling the theater with gas and opened fire with an automatic or semi- automatic rifle and handgun. according to our fox station in denver, the suspect emptied one magazine, reloaded and kept firing. he was wearing a gas mask, black boths and a bullet-proof vest. the shots even hit the theater next door. some initially thought the shooting was part of the movie. the suspect was arrested near his car in the parking lot, and he had a rifle, handgun and at least one other weapon inside the car. one person in the theater describes what he saw.

>> all i saw was, i heard the sound of metal canisters clicking around, and i saw plume of smoke. took me a second to realize what was going on. as people were running away, i hit the ground so i wouldn't be hit. >> police say the suspect did tell them of possible explosives in his apartment. that is the building that was evacuated and is going searched as we speak by police. they have not said if any type of explosive or additional weapons have been found there. police have not released the employeetive for the shooting, but the fbi is now saying that this does not appear to be terrorism related. police in aurora, colorado are saying they believe this is just one person involved. the gunman has been arrested and no one else was involved in this shooting, despite earlier reports. one witness reported seeing a girl that had been shot in the cheek and another girl shot in the stomach who appeared to be about nine years old. one denver area hospital where

victims have been taken now says the youngest victim was 3 months old. it's unclear if that child was killed or is among the wounded. another hospital is reporting two people still in critical condition, so the number of dead could still go up. tony and allison. >> sherri, thank you very much. from that live picture that we're seeing, that live investigation into the apartment of the alleged shooter, continues now. it looks like police are being very careful. most of the officers have backed away from the building. there are a few right there and that particular window and air conditioning unit is being checked by some sort of device. so the investigation of this apartment continues. we're going to join -- we're going to join the coverage of our fox affiliate station in denver for some witness comments. let's listen in. >> you know, big guns. you have people laying around

everywhere. nothing is controlled. it was weird. >> reporter: the one question i have for you, you said you went out the front or the back of the theater? >> the front. the exit where we were at was directly next to the front entrance of the theater. >> reporter: when you ran out, you said police were there. they got there fast. didn't take a long time for people to get inside? >> yeah, i don't know how long everything, you know, like when it started or anything. but right after, immediately after the alarms went off, the police were right outside the exit door. so, it couldn't have been that long. i don't know for sure, but. >> reporter: you're going to a movie, packed house. i mean every seat was taken? >> yeah. and actually, we were trying to get tickets earlier that night for the 12:05 showing, which i don't know which theater it was, but that was one of the theaters where everything happened and we were supposed

to get tickets for that and they didn't have enough, and they opened up another showing at 12:10 and we happened to get tickets for that, so, you know -- >> reporter: you could have been in that theater. >> yeah, i'm just glad it didn't happen to my sister or my girlfriend or anyone else. >> reporter: how are they doing? you said you're doing the best you can. you had a younger sister and a girlfriend. how are they doing now? >> they're doing all right. i guess they just feel pretty much about how i do. it's crazy, you know. you know, none of us have ever been in a situation like this, so. >> reporter: like something out of a movie? >> it didn't seem real at first of the it didn't start coming to all of us, after we saw everything, the girl laying there, the people laying around shot or injured or whatever. we saw the guy being helped out

by the police officer. like, what really made us panic, like and -- when it really hit us was there was people still exiting out the front, and all of a sudden they -- a few people looked back into the theater and started sprinting out, like a whole crowd of people, and that's when we were like, you know, like it just hit us, like whoever is doing this could be right there, like about to come out the front door and start shooting everyone out there or something. and that's when we started running to the car and trying to get out of there. >> reporter: ben, i can't imagine what you've been through. i appreciate you talking to us. glad to hear you're safe and your family. if we hear more information, we'll let you know. hang in there. sorry for everything you had to go through. >> that's one of the interviews being conducted by our sister station in denver, ktvr,

a statement, just a tragedy. >> absolutely. and again, that's going to be the focus of discussion in the next few days. i tend to disagree with most of the political insiders about governor romney picking the running mate. not just for this reason that we've discussed, but also because people are focused on so many other things. remember, recent events aside, this is the first time that you've had a former olympic star as a major party presidential nominee. he'll be going to london, and that's what they'll be talking about. i think it will be later rather than sooner. but certainly before the republican national convention. >> before the convention you believe? >> certainly. >> okay. at this point, what are you hearing, though, from your sources about who they say the top three or so might be when mr. romney does choose a running mate? >> i know the smart money says at this point it will be ohio senator rob portland.

but the smart money is not always the right currency. i can remember in '08 before senator mccain announced his running mate, he kept asking me in i knew pawlenty and could i discuss him in detail. that was the sole topic of our discussion before the program. it turned out the running mate's name began with p, but it wasn't pawlenty. so at this point i can't say. i know there are other names mentioned, along with senator portman, chairman of the house budget committee, certainly senator marco rubio of florida. >> your thoughts on governor jindal? >> he is a very good person and i've interviewed him a couple of times. you better be prepared and not have a lot of things scheduled

on the day you interview him, because he has a lot to say and he knows the facts and details. he's a fascinating person. one of the most intelligent people i've interviewed. i'm not sure whether he wants to be vice president. and that's something that friends of mine in the pelican state tell me all the time. governors hayley of south carolina and governor martinez of new mexico, whom i interviewed last week, fascinating prospects for vice president. but both lean against it because they say they've only been governors less than two years and there's so much more of an experienced table of candidates to choose. governor hayley in fact said she would turn it down if she was asked to be governor romney's running mate. >> same word from condoleezza rice, too. we'll have to wait and see. >> yes. >> we thank you for coming in today, john. even though it's a sad day. >> my prayers are with the

breaking news from colorado, 14 dead after a rampage outside a midnight showing of "the dark knight rises." we're tracking every update with live team coverage. good morning, i'm tony perkins. >> i'm alison seymour. right now a gunman is in custody after a mass shooting outside of a movie theater in the denver suburb of aurora. i apologize, it was inside that theater. making it more frightening. >> the town's police chief says at least 50 others were hurt. sherri ly is following the story. she has been all morning and

she joins us live now with the latest from our newsroom. sherri? okay, we don't have sherri yet. what we can tell you is that police do have a suspect in custody. he is apparently a man in his early 20s. some 14 people shot and killed. up to 50 others injured. they've been taken to upwards of six area hospitals. some of the injured are in critical condition. some of those shot are children, including one 3-month- old. we do not know the condition of the 3-month-old who was shot. police are also outside of the suspect's apartment. the suspect apparently indicated to police that there were explosives inside that apartment, so that apartment is now being carefully searched. sherri ly is with us now in the newsroom and she can update us with more. sherri? >> tony and allison, witnesses say that shooter fired into

this crowded theater right after that movie started. bullets pierced the walls, even hitting people in the next theater. some people apparently thought that this was gunfire coming from the movie. people scrambled to get out of that theater. you can see in this youtube video some of them bleeding and clearly shot. many were dressed in costume for the premier for this movie, "the dark knight rises." 14 people dead, at least 50 more injured. police say the suspect set off some type of gas canister and opened fire inside this crowded theater. witnesses say there was not an empty seat in there. he fired at close range, with some type of automatic or semi- automatic rifle and a handgun. some of those bullets went through the walls to the next theater. and a number of children are among the victims, the youngest

one being treated at a hospital is reported to be just three months old. it's unclear, according to our fox 5 station in denver, the gunman wore a gas mask, black clothes and a bullet-proof vest. police arrested the suspected gunman outside the theater in a parking lot next to his car. they found a rifle, handgun and another weapon inside. the denver post reports he is a 24-year-old. police did swarm that theater almost immediately and witnesses reported seeing officers carrying and dragging out bodies from that theater. police say the suspect also mentioned possible explosives inside his apartment. swat teams have that building surrounded. it has been evacuated and they are in the process of searching the apartment right now. police have not said whether anything has been found. they are not releasing a motive

yet and say there does not appear to be any other person involved in the shooting. the fbi is also saying this does not appear to be terrorism related. some of the victims we are now being told are being treated at hospitals, not only for gunshot wounds, but some with shrapnel wounds as well as chemical exposure. >> sherri ly, thank you very much. want to mention that the atf confirmed they have explosive experts, including bomb dogs and the like at that apartment that is being searched now. the white house has issued a statement from president obama a few moments ago. it says "michelle and i are shocked and saddened by the horrific and tragic shooting in colorado. federal and local law enforcement are still responding and this administration will do everything that we can to support the people of aurora in this extraordinarily difficult time. we are committed to bringing whoever was responsible to justice, ensuring the safety of our people and caring for those

the metro area. this happened in aurora, about 5 miles from the theater complex. now we have fire trucks that have pulled into the streets that are surrounding, and basically what they are doing is using the cherry picker on the fire truck, the extension ladder, and they are trying to get into the apartment complex from the air, from ladders. swat team members with guns and rifles and automatic weapons, bomb squads from several jurisdictions. they are ready to enter the complex, and they have evacuated the complex, and they are going into the apartment thinking that there are more bombs or more explosive devices in that apartment complex. right now it is a very tense situation, as you mentioned, the fbi and the bomb squad are coming to the area to go through that apartment complex to try to make sure it is safe for residents in the area. >> all the people who live in

that building have now been evacuated, correct? >> that is correct. they have been evacuated for about, oh, probably an hour and a half now and the situation continues to be fluid. as i mentioned, adams county sheriff's department, aurora police department, denver police department, several agencies on the scene, making sure this apartment complex is safe. the surrounding buildings, probably 10 apartment complexes, two stories in height. one is a three-story. they are emptying those out. people are sitting out in the front of the apartment complexes in lounge chairs. this is a terrible situation and the hope is that there are no more explosive devices in this suspect's apartment. >> jon, i hate to put you on the spot, but we're looking at a car with its trunk up and looks like it is being searched. it's a white hatch back.

is the suspect's car? >> we are not sure. but if that is in the theater complex, that may be the car that the suspect erupted next to. when he came out of the theater police were pretty much waiting for him. most of the theater complexes around the metro area that were showing "the dark knight rises," there were police at those theaters, within moments at the shooting. just a terrible situation, where you had people walking through blood and going into the parking lot. i guess the worst sight anybody i talked to, one of the police officers coming out with a 3- year-old limp in his arm, shot several times in the back. just a horrific scene. no explanation for any activity like this.

8:15. welcome back. we want to update you on the breaking news out of aurora, colorado. you're looking at live pictures of these pictures, i am told are at the movie theater. are these at the apartment building? i think these are at the apartment building. these are live pictures from the apartment building, where the gunman who fired into a crowded movie theater in aurora, where he allegedly lives. it is being searched for possible explosives and other weapons. the gunman apparently indicated to police that there were explosives in his apartment. we have been looking at live pictures as well from the movie theater where that mass

shooting took place overnight. some 12 people are dead according to our denver affiliate. 50 others hurt after a gunman opened fire during a midnight showing of the highly anticipated new batman movie "the dark knight rises." hundreds of movie goers immediately started evacuating the theaters with some difficulty. some say they thought the attack was initially part of the movie. police say the suspect in custody is a man in his early or mid-20s. we are expecting to get more information during a press conference later today. that is planned for 11:00 denver time, which is 1:00 here in our area. now we want to get a check of our local forecast. tucker barnes is with us at the desk at 8:16. how is it looking today? >> warm and humid start. lot of clouds out there at this hour. later this afternoon we could do another round of showers and storms. could be locally heavy rain. flash flood watch starting at noon today. too much of a good thing. need the rain, but not the heavy rain. but looks like it's in the cards for our friday afternoon.

a little bit of wiggle room, saying i don't particularly want it. i think part of that may be face saving in case they don't get it. on the other hand, whether they would turn it down be i'm not sure many of the people who have been mentioned would actually turn it down. in fact, pawlenty early on was saying, i don't want it, and now he's saying it would be an honor to be picked. it would be an okay job to have. >> i think that's a better residence than the white house in some ways. hidden, off the beaten path. >> let me put it this way, you and i will never have to worry about either of those. >> you're right about that. one quick note on syria, another changing story, and i guess one of the big questions is, if assad goes, which could happen any day now, possibly, then what happens? >> well, that's the huge question. we're going to be talking about that with these two intel chairman. because there are all kinds of

pepco officials in the hot seat when they appeared before the montgomery county council yesterday. they were criticized for unreliable service. "washington post" metro affairs columnist robert mccartney attended the council meeting yesterday and joins us now. you made it out okay. >> i made it out. i have power at home. >> you have power. right-- >> i did lose it in the last outage. as usual. >> as usual. that's the issue. it's like when it rains hard, when there's a bolt of lightning, the confidence level goes down. they talked about this. can you tell us about the meeting? >> the meeting put mainly pepco, but also the regulators in the hot seat. they are very critical of how long it took pepco to restore service after the last storm. and the council members offered various reasons why they were

so unhappy with pepco. but they wanted better performance from pepco and they wanted tougher crackdown on pepco by the regulators. >> what was the defense or did they go on the offense, what was pepco's reaction? because it seems like a lot of times when we talk with pepco, never seen a storm like this, fast moving, the backup failed. what was their response? >> it was very interesting. i heard something a little different from what we've heard from pepco before. what they basically said was, we've made a lot of investments since 2010, since the big storms and all the uproar and out rage in the 2010 problems. we've made progress in terms of day-to-day reliability. in terms of, you know, you're not going to lose your power as often just on a blue sky day, just when the weather is fine. this was a real problem. pepco had one of the worst records in the country in terms of losing service even when the weather was good.

they said they have made the investments and things have improved there. their basic position is when you get a big storm like the derecho, when you get a hurricane, microburst, tucker can tell you all about that, they basically say we can't do better than we're doing now. their basic line on the derecho was we restored service as quickly as possible. and i'm not sure -- this was sort of a new approach from pepco. and i'm not sure that either the regulators have enough power to really force them to change that yet, or that the council has sort of, and other politicians, have sort of wrapped their brains around what's going to be necessary to get them to restore service more quickly. one thing that came up that's relevant in this, is that congressman hollen who represents montgomery county, democrat in the house of representatives, his people, his office put together a study

that showed that across the river, virginia dominion power was much quicker to restore power than pepco. pepco says, oh, you can't really compare them to us. it's apples and oranges. but they didn't really provide a very clear or to my mind, reasonable explanation as to why dominion was able to do it quickly. that stuck in the craw of the council members. >> let's talk about the rate hike. congressman hollen is saying, not so fast. can you talk about this? >> hollen and other politicians have said pepco should not get a rate hike. they're requesting 4% -- or would be 4% on customers' bills, so $66 million overall. hollen and others say they shouldn't get any rate hike given how bad the service is.

the commission sees it differently. the public service commission basically says we'll penalize them, we won't give them as much as they requested. basically penalize them how slow they've been in the past to make investments. but it sounds like to me, at least, unless they really decide to come down hard, partly because of the political climate, i think they'll give them something. i think they'll give them some part of the rate increase, and we're going to have to find out how much. >> and that happens today? >> the deadline for doing it was a week ago, but they moved it a week later because the storms slowed everything up. they said that we would hear today. >> all right. >> that's going to be a big story. >> affects a lot of us. robert mccartney, thank you for being here. >> good to be here. >> sad day, but we appreciate you being here today. tony, over to you. thank you very much. we continue with the breaking news this morning out of aurora, colorado, where there's been a massive shooting at a movie theater there. 12 people killed. this is a live look outside of

premier of the batman movie. police say the gunman wore a gas mask and set off a gas canister. ten people died at the theater, another four at the hospital, and at least 50 others were injured. fox station in denver is reporting the gunman emptied one magazine and reloaded and kept firing. many of the movie goers didn't know what was going on. they thought the shooting was part of the movie. then alarms went off, people started screaming and yelling someone was shooting. the suspect, believed to be acting alone, was arrested in the parking lot next to his car. police found a rifle, handgun and another weapon inside. victims are being treated at area hospitals. some for shrapnel wounds and chemical exposure. of the victims, a 3-month-old victim and 6-year-old child. police have evacuated the suspect's apartment as well,

identity of this 24-year-old alleged shooter. his name is james holmes and that is the latest coming in now, as we look at pictures, and we're dipping into our what's called a live stream, basically looking at the coverage of our sister station in colorado in denver, kdvr. >> these are live pictures now of the apartment building and the apartment of that alleged shooter, who indicated to police that there were explosives or at least an explosive in his apartment. police have evacuated that building and are now pulling out a window of that apartment. they've been very careful there. we are told fbi and atf on the scene as well. let's listen in to the coverage. >> take a look, i mean, this is still a very active situation happening at the apartment complex. we do have crews all over

aurora this morning. we have several reporters at the movie theater still talking to witnesses, still active scene there as well. investigators continue to comb through cars in the parking lot and say they'll check every vehicle for explosives. they want to take every precaution possible. >> we're looking at what we believe to be the suspect's car parked outside of the theater. so much you're looking at right here. that's the suspect's car. detectives, investigators looking at it. it has been searched. appears to have been cleared. if you look closely at the top of the car, there is a handgun on top of the car on its sun roof. and clothing to the left there scattered near the dumpster area. it appears to be riot gear. we can see boots, helmets, gas mask, possibly a vest. if you look closely along the sidewalk, a trail, what we believe to be blood, coming out of the theater. that is the theater exit that goes in between the dumpster and the building to the right of your screen there. no word if that is blood. but it certainly appears to be,

as possibly someone injured running from the theater. >> we want to talk for a moment about the victims here, because we have been speaking with officials from several local hospitals, victims taken to six area hospitals. one doctor said the age range, 3 months old to 45 years. a lot of parents bringing their kids, a lot of teens, early 20s. let's go live to justin joseph who was at the theater. justin, you have firsthand experience, because in fact you tried to get tickets yourself. >> reporter: that's right, i was able to get tickets at north field, and that is something i noticed immediately, there were a lot of families coming to this theater, a lot of people showing up very late, because this was a high excitement movie. a lot of people dressed up and speculating that may be how this man was able to blend into the crowd before all of this

happened. we're hearing sirens in the distance. if you look behind me, you can see much of the parking lot is cordoned off. police are still looking through the vehicles looking for explosives. they have said they wanted to make sure it was secure before they started investigating inside. we got out here around 1:30 this morning. it was a very different scene. there was a call put out to all jurisdictions for any available officers to respond to the century 16 theater in aurora. and that's what happened. there were probably anywhere from 100 to 150 police cars here. people from the bomb squad, ambulances. they tried to set up a perimeter as they moved into the mall to make sure they had the only person who was responsible for this in custody. when all of this started they thought may they have two

shooters. they were searching for another shooter. we learned they believe they only have one shooter they're dealing with. when we got on scene earlier, there were a number of people showing up, a number of people in adjacent theaters, as well as a number of people in the parking lot. i was able to speak with some of them. >> i heard multiple gunshots and there was a mass of people flying out of the building, and there was more than five, multiple, multiple shots. it was crazy. >> i was in the theater and all i saw was some smoke, and then i heard gunshots. >> reporter: tell me about the scene. >> yes, it was panic. people heading for the exits, trying to get out of there. >> reporter: did you see anybody injured? >> yeah, i did. >> reporter: tell me what you saw. >> people bloody, being carried out. sorry. >> there were people coming

the statistics are alarming for hiv and aids. to raise awareness, the aids conference is set to kick off in d.c. for the first time in more than 20 years. here to tell us more, founder of hiv awareness month and the found of the well project. thank you for coming in. we appreciate it. >> thank you for having me, tony. >> the statistics are alarming and there are other stats that

are equally alarming. first, tell me why you feel like we still need an hiv awareness month. >> it's a good question. if you think about it, 1.2 million people in this country living with hiv, and 20%, or one in five don't know it. so we're talking about a problem that is very pervasive in our communities, but still flying below the radar screen. certainly far more invisible than you think here. 50,000 americans are infected with hiv every year. this is a preventable disease. we're talking about a disease where we actually, unlike cancer and some of the other conditions that you often hear these compared to hiv, we actually have something we can do something about. so that's part of the reason we created national hiv awareness month, because the united states, the u.s. government has been a leader globally in the fight against hiv and aids. we have made enormous strides in the developing world. as a matter of fact, reducing

the rates of new infections in sub saharan africa, but not in the united states. >> that's striking. when you hear about the efforts and organizations such as yours are making here. is there still a sense of maybe denial, where people don't want to talk about it, don't want to get tested and that kind of thing? >> absolutely. we have done such important work in helping people kind of category gorize who they think about get hiv. as a person with hiv myself, i sit next to people on planes who say, it's horrible what's happening in africa. and it's right. what they don't know is what it looks like here in our own back yards and communities. the infection rates in this country are alarming and there's something that every one of us can do. >> so the message really is know your status. >> yes. >> and get tested.

because number one, there are things that you can do to prevent getting it. >> yes. >> and number two, one of the other positive stories is that people are living with hiv full lives, long lives, as opposed to when this first started. >> if you test positive, there are treatments. this has been an unbelievable month. two very historic events happened, one is the approval of over-the-counter hiv tests. in the coming months you can walk into your retail pharmacy and buy an oral swab and test for hiv on the spot. the other is the approval of a new medication for prevention of hiv. both of these have happened in the context of national hiv awareness month, as well as the arrival of almost 30,000 visitors to the district for the international aids conference. >> big deal. you want people to get tested. i want to put up on screen where people can get tested

theater overnight. midnight shooting at the premier of the latest batman movie. you're looking there at the theater this morning. quite a chaotic scene, as a gunman who has now been identified by fox news as 24- year-old james holmes out of aurora, colorado, went on just a deadly spree there. 12 confirmed dead. up to 50 hurt in this shooting. >> that suspect is in custody. he provided no resistance. police took him into custody there at the movie theater just behind the movie theater. his car is still there. it is continuing to be searched. his apartment also in aurora is being searched as the gunman indicated there may be explosives in that apartment. that is being searched now by police, fbi and atf officials who are on the scene there. we're going to have more on this breaking news from aurora, colorado in a couple of moments, including from our sister station there and our local news as well in a few moments when fox 5 morning news returns.
