time? a live report from capitol hill as fox 5 morning news starts now. there's your live look outside. there's nothing happening out there as far as the weather goes. at least not here in washington. out to the west they have a few things going on. but that will change later, as we'll find out soon. good morning. it's friday, february 22nd, my wife's birthday, so happy birthday. >> i love it. i was trying to figure out who is close to you near and dear. it's skylar's as well. good morning, i'm alison seymour. >> i'm tony perkins. >> hundreds of delights have been delayed because of the winter storm from colorado to kansas. it's dropped as much as 17 inches in some places. winter storm warnings in parts of kansas, missouri, arkansas, nebraska, iowa and illinois. forecasters say more snow, sleet and freezing rain is on

the way today. >> around our region there is one school delay to pass along now. page county virginia schools are on a two-hour delay. that's page county, virginia, two-hour delay. >> tucker barnes joining us now. all that snow, but nothing here. >> all that video we saw, we're going to experience nothing like that around here. we might get a little something, little wintry mix later this morning and afternoon hours, but we're not talking about whiteout conditions. you can see how scattered the precipitation is. it is cold enough to support winter weather at this hour. towards charlottesville starting to get possible echos of a little snow. honestly, much of this probably won't touch the ground over the near term as the atmosphere is still very dry. we've had the cold air around here the last couple of days. we got to moisten up the atmosphere before this can reach the ground. temperatures are cold enough to support a little winter

weather. 32 at reagan national. dulles is 30 degrees. bwi marshall is 30 degrees. the entire region is at or below freezing. that will be a critical player in the forecast later today, as much of what falls, and again i want to emphasize it will be very light, could fall in the form of a little ice, particularly this afternoon. nothing locally. out to the west, counties in purple, western maryland, parts of west virginia there, you have a winter weather advisory until 10:00 tomorrow morning. of course, out to the west temperatures will remain cold a little longer and the greatest risk for icing will take place out there, including the potential for freezing rain. that's why the winter weather advisory has been issued to the west of the city here later today. wintry mix developing during the day. again, very light amounts. parts of the area may not see much of anything, as the system is getting sheared and falling apart. the risk of a wintry mix later,

temperatures in the mid-30s. transitioning to a little bit of drizzle, and more rain in the forecast tomorrow. let's do traffic now with julie wright. happy friday. like the glasses. >> thank you. friday indeed. unfortunately, dealing with the remains of the vehicle fire, outer loop of the beltway, before you commit to 214, central avenue. lanes are open. but backups on the outer loop of the beltway headed north of route 4. heavy, slow and steady. that's how she rolls on that outer loop. let's continue inbound on 50, delays from 202 to the new york/kenilworth avenue split. delays inbound new york avenue, as you make your way past the 3rd street tunnel. accident activity cleared. traffic light delays only leaving northeast to northwest. outbound at florida, earlier

incident cleared. typical slowdown in manassas. traveling south on 270, below speed after 109 to the truck scales and tapping the brakes in germantown. that's a check of your fox 5 on- time traffic. developing in a south african courtroom we are waiting for a decision in the bail hearing of oscar pistorius. the judge should make the announcement within the next half hour. lawyers just wrapped up their argument, with the prosecution strongly opposing bail. prosecutors told the court pistorius is a flight risk, but his lawyer says he is too famous to leave the country. pistorius has spent most of the time with his head in his hands. he is charged with premeditated murder for the valentine's day shooting of 29-year-old model reeva steenkamp, who was his girlfriend. he says it was an accident. happening today here at

home, nearly two decades reign of terror has come to an end, as aaron thompson will learn his punishment in court. he pleaded guilty to two attacks back in november. but police have linked him to at least 13 other attacks in several states. he faces life in prison at today's hearing. he could still face prosecution in other jurisdictions where his crimes happened. also in virginia today, a likely vote on highway funding legislation. they're holding a vote on first major reform in three decades. republicans are split over a compromise to the transportation bill. it would eliminate one gas tax at a wholesale gas tax ask raise sales taxes to generate another $880 million a year for repairs andup keep for roads and highways. virginia democrats aren't sold either. they're upset about diverting money from the general fund.

a painful milestone for drivers in the district. according to aaa, gas prices have officially hit the $4 mark. that's the average price for a gallon of regular. it's also about 25-cent higher than the national average, and a quarter higher than the same time last week. we are closer to new gun laws in maryland this morning. a senate committee in annapolis worked late into the night and approved two big measures. sarah simmons has the latest. >> the maryland senate committee gave the okay for both, a change to gun control measures and repeal of the death penalty. on the gun bill, the vote was 7- 4. lawmakers changed the legislation to prevent anyone from owning a handgun who has been involuntarily committed for mental health reasons. that bill includes a ban on assault weapons. the committee also voted 6-5 on

another bill that would ban capital punishment in the free state. that bill is expected to pass in the full senate. the governor's gun proposals are scheduled for debate in the senate next week. allison, back to you. sarah, thank you. another big fight for lawmakers, striking a deal to avoid the sequester. with one week until the march 1st deadline now, pressure is growing. >> without a deal, billions of dollars in spending cuts will impact millions, including lots of workers in the d.c. region. sherri ly is on capitol hill this morning. does this look like it will be a bitter battle until the end? >> reporter: well, tony and allison, that's exactly what it looks like now. there are many people saying that they believe these cuts are going to happen. the biggest problem right now seems to be the calendar. the two sides are talking, but these sequester cuts are due to hit next friday. any last-minute negotiations are unlikely to change that.

to be a fly on the wall. president obama placing phone calls to republican leaders on capitol hill. house speaker john boehner and senate minority leader mitch mcconnell, all while the administration has been pounding the gop over sequester cuts. >> hear what the american people are saying, which is please compromise. please be reasonable. please do not adopt positions that represent a my way or the highway approach. >> reporter: and there is a white house effort to paint a doomsday scenario, if federal spending is cut by just over 2%. agriculture secretary warned of food shortages. >> it affects all the plants and production facilities across the country. >> reporter: the pentagon says military readiness and civilian employees will suffer and many republicans agree that the cuts will hurt. others say the president's insistence on new tax hikes ignores other reductions that could replace the sequester cuts. >> in you were to pay federal

employees about the same level you pay private employees that saves about $32 billion a year. other places to cut. you could cut foreign aid in half and save $20 billion. so we have a list of savings we could send to the president if he's interested and we could do this without laying anybody off. >> reporter: now, there is a campaign element to all this. the president has been crisscrossing the country, trying to drum up public support and put more pressure on congress to get a deal done. next week he will head to newport to talk specifically about the cuts to the pentagon. back to you. >> sherri ly, thank you very much. in other news, d.c. council members are holding a special meeting next week to discuss taking possible action against ward one councilman jim graham. two weeks ago an ethics board said graham broke the code of

conduct three times. he currently has oversight over how alcoholic beverages are regulated in the district. graham told fox 5 he hopes instead of punishing him monday, council members instead will call for a hearing to investigate. new leadership for anne arundel county. laura neuman was named as new leader. a former cop convicted of killing his wife learns his fate. the sentence the judge handed down to drew peterson and his heated courtroom reaction next. >> plus, a retired atf agent is dead this morning. he was killed as he walked his dog in northern virginia. what police believe may have been the motive behind this brazen attack. >> first, named after a legend,

completing new jersey's 3-2 comeback victory. the caps are still in last place in the eastern conference. tough year for them. in a couple of months, an arizona couple will welcome rg, just minus the 3. emmanuel vega and his girlfriend made a bet when the cowboys played the redskins last thanksgiving. if the cowboys won, she would pick the name. if the redskins won, he would pick the name. in case you don't remember, the redskins beat dallas, and in april they will welcome their son, robert griffin vega, who already has the nickname, little robbie griff. >> cute. they didn't do too badly in that bet. >> right. she is a cowboys' fan, and he is a redskins' fan. >> right. >> they make little bets all the time. this was a big bet. >> that's a big one. but they compromised on how to pick the name. >> right.

>> here's the bottom line. not going to be a major deal for us. we've been showing video of everything to the west. we'll get a chance later this morning of this light wintry mix to break out. and temperatures, a couple of different players. temperatures look like they'll be cold enough to support mostly a snow and sleet profile here when things get going later today. again, we're not talking about major accumulations. i won't show you an accumulation map. we're talking enough to coat the ground, you know, maybe some very light accumulations later today. 32 now in washington. cold air off to the north. boston is 27. area of high pressure is up there that will continue to funnel down that cold air during the day today. so our high temperatures will be slow to budge here. highs only in the mid-30s later this afternoon. for parts of the area, particularly if you're out to the west, those freezing temperatures could hang on all day long, and you have the greatest risk for the freezing precip later today. mixed in with the clouds you

can see we're starting to get echos here of snow, sleet, even a little freezing rain to the south and west. not sure how much is touching the ground. the area currently is very dry. will take several more hours here before i think this touches the ground. by late morning, early afternoon could be a light wintry mix. localized it could fall for a period hard enough that you get a light accumulation on the ground and could cause issues. it's why we have a winter weather advisory west of the city until 10:00 tomorrow morning. let me add later this afternoon and tonight, coastal component to this system. coastal low. that will drive up the coast during the day tomorrow. should warm up later tonight, mid- to upper 30s. and tomorrow with some rain showers around, highs will only be about 40. i know we've got a lot of winter weather lovers out there. for whatever reason, hasn't been our year. looks like this one will be a close call, but when all is said and done, not going to get a lot of anything. 37 the daytime high.

slow to georgia avenue. crash before you reach the beltway coming southbound out of laurel. outer loop delay leaving college park continues around through silver spring. no issues reported south on 29. travel in virginia, northbound 395 below speed leaving duke street to seminary road. earlier stalled car in the road now cleared. that's a check of your fox 5 on- time traffic. thank you. more headlines now, a manhunt stemming from a shooting and violent crash on the las vegas strip has spread to several states. police are looking for a black range rover and suspects in that vehicle that shot at a maserati early yesterday. the sports car ran red lights to escape the bullets, but smashed into a taxi, causing a fiery wreck. killed in that car was a rapper named kenny clutch. the cabdriver and his passenger also died. police say it all started with

an argument in the valet area of a vegas hotel. convicted killer drew peterson will spend the next 38 years in prison for murdering his third wife. the former chicago cop learned his punishment yesterday, but he didn't take it quietly. peterson shocked the courtroom shouting he didn't kill kathleen savio. he then gave an emotional 30- minute statement to the courtroom. he is still a suspect in the disappearance of his fourth wife, stacy. in northern virginia a retired atf agent gunned down. police say the motive was robbery. now a 25-year-old man is in custody. 55-year-old greg holley senior was walking his dog thursday night when he was attacked. the suspect was caught a short time later by an off-duty police officer after witnesses pointed him out. eric alexander smith is now facing first degree murder charges.

an update on yesterday's deadly house fire in prince george's county. 11-year-old girl remains in critical condition. a 36-year-old man, an 8 # and 4- year-old girls died in this. a woman and another 8-year-old girl also injured. they're recovering in stable condition we're told. firefighters are still investigating the cause, but say there were no working smoke alarms in that house. 21 minutes after 7:00 now on this friday morning. pope benedict is wrapping up his last few days as leader of the catholic church. who will step up to take on the role or who will be assigned that role? we'll get an update on the other side of the break. >> then a d.c. graffiti artist now part of a new documentary and exhibit. this morning hollie is learning all about cool disco dance. she'll join us live. welcome back. as pope benedict prepares for his final week on the job, there's new focus on who will be selected as successor. >> questions remain about when they'll convene. once they do, it's clear american cardinals are poised to have a big say. jennifer davis has more. >> reporter: pope benedict xvi's last days as leader of the catholic church are well mapped out. but there's confusion over when the conclave can vote on the successor. vatican says the pope could enact a new law to clarify next set. >> what will the chief shepherd look like? >> reporter: for the first time in his career, the archbishop of washington will be among the 116 cardinals choosing the next leader, joining others from philadelphia, boston, new york and chicago. >> it's a brand-new experience for me to actually be a voting member of a conclave. >> reporter: the american influences in the conclave will be unprecedented with 11 from

>> really into it, huh? >> fox 5 tucker barnes or some such thing. >> right. >> i've liked you. have you liked me? >> i'm about to. you know i like you. we have that wintry mix breaking out across the area. not going to be a major deal at all, as much of the moisture is being pushed off to the north and west of us. but got the risk of a wintry mix with cold temperatures later today. let's talk temperatures. it's cold enough to support this winter profile. particularly north and west. temperatures will be slow to budge out of the 20s today. cold air at the surface and aloft things will warm up, and that's why we'll be dealing with this threat of a wintry mix. 32 leonardtown. 30 baltimore. 32 in washington. our highs won't get out of the mid-30s today. chilly day. rather raw with winds out of the northeast. couple of things going on. wintry mix today. very light amounts. not talking about a lot. could be enough to cause issues, particularly to the west.

then a coastal low about here off the delmarva peninsula tonight and tomorrow. that will bring more clouds and a chance of showers from generally washington and points east tomorrow. saturday doesn't look great with rain showers in the forecast. here's, moving through the maps quickly, here's what's happening. weakening storm. this has been causing a lot of problems in the central sections of the country. that's weakening. as a little moisture gets thrown back across the mid- atlantic we'll be dealing with a light mix today as high pressure will try to lock in that cold at the surface. this is a typical winter time setup. and particularly to the west where temperatures will be slow to warm up you could be dealing with that wintry mix longer today. 37, cloudy skies. wintry mix. transitioning to rain or drizzle this afternoon. light amounts. perhaps light accumulations. 33tonight. light showers. wintry mix continues.

in the same position who are unmarried but living together. >> reporter: in its own 2010 report on issues to repeal of the don't ask don't tell policy, the pentagon warned about this very scenario. "if the department of defense creates a new category of unmarried dependent or family member reserved only for same sex relationships, the department itself would be creating a new inequity." >> this administration is using the military for social engineering. and i think it's significant that they're going beyond even what they said they would do or the time that don't ask don't tell was repealed. >> reporter: yet supporters of the policy say it's the only equitable thing to do, given that same sex partners have few options when it comes to marriage, unlike heterosexual

piece. >> yes. you're standing next to a cool disco dan piece we saw off of h street, probably early 2,000. this is a photo of it. the graffiti itself was probably done circa 1990, give or take a year or two. you can see the torn below posters coming off of it. this looks like a recreation of a piece that was made for a museum or art project. but this is a real true artifact. >> reporter: real deal. >> in 2000, 2001 when we showed it in georgetown, a contemporary curator at the time saw it and wanted it for their permanent collection. this is the third time they've shown it. this is the piece that kick started this exhibition. >> reporter: we were talking offcamera that we live in a city where we do a lot of nation's history. people from around the globe come here, because it's the nation's capital. but this is a d.c. story, and

the locals are excited about it. >> absolutely. this is a d.c. story. 100% true to d.c. i didn't grow up in d.c. i grew up in bethesda, maryland. i started coming downtown in the early 90s. most of the things in this show, i think it's a personal experience. i've had a great interest in the history of what was going on. i got into graffiti in my early teens. i met disco dan in my early teenage years and started hearing more stories about downtown and how this happened and that happened. i was a fan of punk and hard core music and that started, so much of it going on in d.c. from the early 80s, and wanted to learn more history and i kept digging and digging and finding more information. i started publishing magazines, doing books. >> reporter: now you have an exhibit. >> exactly. now we have an exhibit. >> reporter: tell me about this here. you were explaining to me earlier the significance of this. >> absolutely. this is minor threats record, out of step. the drawing here, the black

a 36-year-old man and 8 and 4- year-old girls did die in the father. a woman and another 8-year-old girl are recovering in stable condition we're told. firefighters are still investigating the cause, but say there were no working smoke alarms in that home. new gun proposals in maryland this morning. a committee in the state senate approved the governor's sweeping gun control measure. the vote last night was 7-4 in the senate -- i'm sorry, in the judiciary senate committee. it includes a ban on assault weapons. this is a top priority of the governor's. another vote by that committee would abolish the death penalty in maryland. the vote was 6-5 in favor of repealing capital punishment. the bill now moves to a vote in the full senate and it is expected to pass. allison?

happening today in virginia, the legislature votes in what would be the first major reform for virginia's transportation in years. it would use gas taxes and sales taxes to generate another $880 million a year for repairs and up keep of highways. on capitol hill, seven days and counting before billions of dollars in automatic spending cuts take effect. >> that means when congress returns from recess on monday, they'll have days to strike a deal. can it be done? fox5's sherri ly is live on capitol hill with the latest. sherri? >> reporter: tony, that is the $85 billion question. can they get a deal done? from the white house to capitol hill, dire warnings about the

possibility of sequestration, because the $85 billion cuts will be made next friday if they cannot get this deal done. in the d.c. region here, which has 21% of the entire federal payroll, we could see large layoffs, cuts to government contractors and federal programs. the fallout will impact everything from schools to the military and medical research. social security, medicaid, veterans benefits and some programs for low income programs are exempt. but everything else on the table. democrats want higher taxes. the gop deeper entitlement cuts. while both the gop and white house keep blaming each other for the crisis. >> if you were to pay federal employees about the same level you pay private employees, that saves about $32 billion a year. there are other places to cut. you could cut foreign aid in half and save $20 billion. so we have a list of savings that we could send to the president if he's interested, and we could do this without laying anybody off. >> hear what the american

would force our leaders to get together and make a deal. we are now seven days away. that was a year and a half away. t minus seven days and counting and you think it's going to happen. i think we're going to hit the sequester, and it's going to have -- i'm not sure it hasn't been exaggerated, but it will have a real impact on jobs in the government, on programs being cut back, on people who depend on those programs. and i think there's going to be a lot of political blaming. could have a bad effect on the general economy. we're going to talk to a republican senator and democrat senator, one about whether it's going to happen, and two, why and is there anything that can be done to stop it either before or after the deadline. extraordinary. here we are again. had the fiscal cliff january 1st. now sequestration on march 1. and the government runs out of money march 27th. it's like groundhog day around here. >> it really is. i wonder if these congress people get, the more people you

talk to, particularly in washington where it could have a pretty major impact if not on march 1, but within a few weeks, is the frustration and anger of a lot of the american people at this issue. they just feel like congress, between congress and the white house, they're not getting anything done. >> yeah. it isn't just washington, though obviously people here are most affected by it. it's around the country. you look at ratings of congress, very low. and you're exactly right. as i said, groundhog day, because it's one deadline after another and each time we sort of kick the can down the road. we don't get anything accomplished. depending-- regardless on which side you're on, we never get the deal that would solve our debt problem. $16trillionand growing and heading to debt as a percentage of gdp that's close to greece. and nothing happens. we'll be talking to these two. and we'll talk to two

d.c. council members are holding a special meeting next week to discuss taking action against ward one councilman jim graham. two weeks ago the board said he broke the code of conduct three times. graham currently has oversight of how alcoholic beverages are regulated in the district. the council will discuss whether to strip him of that power. graham told fox 5 he hopes that instead of punishing him on monday, council members will call for a hearing to investigate. anne arundel county has a new county executive this morning. the council elected laura neuman. she was chosen over 15 candidates to replace the former executive who was found guilty of misconduct in office. 8:25 now on this friday morning. thank goodness it's friday, right?

wife. now drew peterson has been sentenced. marianne rafferty has the story. >> the state police and i have never had such a gratifying in the courtroom. >> reporter: drew peterson is handed a 38-year prison sentence. the former chicago area cop was found guilty of murdering his third wife in 2004. peterson has maintained a glib, cocky attitude. burst out in anger when his sentence was read. he reportedly shouted, i did not kill kathleen, at the top of his lungs. >> we all got the opportunity to see a psychopath in open court. >> defendant doesn't have to prove his innocence and that would be the only reason to put him on. we feel the state didn't prove it was a homicide. >> reporter: savio's family

going on. jimmie johnson, michael waltrip both will be in the race. >> excellent. we understand how everything has to work here in tv. look, mike, let me start off with you. this is a big deal, historic, danica patrick becoming the first female to win daytona five on the pole in sunday's qualifying round. what does this mean for nascar? >> i think the main thing is if jimmie johnson or michael waltrip wins the pole, we're on the paper. if patrick wins, the front page, every major talk shows. there will be a lot of people watching her just to see what happens on sunday. they may not be fans, but they want to be part of something historic, and i think they will be. >> she's in a male dominated sport. so the fact that she beat all the guys and took the pole

position on sunday, that piques a lot of interest. they'll want to watch and see, can she stay up there? can she outrun the guys sunday? we know she has a fast car. we know she's very capable as a drive. what's going to happen come sunday? the intrigue. we don't know. >> right. and that's going to transcend the sport. michael, let me ask you a question, you just qualified for the race. tell us about the car you'll be driving sunday and the special meaning behind that car. >> i was so fortunate a couple of weeks ago, i went up to newtown, connecticut and sat down with some of the first responders, victims, families, teachers and said we were going to do something special for them. we unveiled the scheme of our beautiful number 26 text 8088 to newtown car. and smiles filled the room. a couple of the folks say they

saw people smile that hadn't smiled since that horrible event took place. we're going to raise a lot of money for that community. the road to recovery is going to be a long one. we want there to be funds there for them to rely on. secondly, during the daytona 500 when they see patrick drive off from the pole, they'll see their car. i'm proud. the whole nascar community has rallied around it and we're going to raise a lot of money for those people. >> excellent idea and we wish that people go ahead and contribute. it is a great idea. let me ask you, jimmy, you're a five time sprint cup champion and 2006 daytona 500 winner. what makes the daytona 500 unique and what's it like in that winner's circle when you do win? >> there's nothing like it. the history of nascar, the history of this race is what weighs on everybody's minds.

such a difficult race to win. the draft is very tricky to get right. down here we have seen some first time winners in this race. more than anything, it's the unknown. there are a lot of variables and factors that take place during the race. when you win, you have tremendous joy over that. but then if you're fortunate enough to win the daytona 500, you've won the big one. >> both these guys will tell you, they've been out there. this car is brand-new. it's not like driving cars in the past. all these guys are adjusting to. does it car level the playing field? some people think it does. some people think that's a big advantage for danica because the car is brand-new. >> darryl, we'll let you have the last word. with such big names, this could be a tight race. any predictions? could we see a surprise winner?
