king pin el chapo and his interview with sean penn. your news starts right now. >> all right. let's get right to it. we're starting off tonight with a weather alert. the first snow showers of the season are on their way. thanks for joining us, everyone. i'm shawn yancy. >> and i'm tony perkins. there might be a few problems on the roads tomorrow but the real story may be what's coming after the snow. sue palka is here with what you need to know. >> it's been a long time since we've seen any snow around here. nothing has been able to be measured so far this season. as a matter of fact let me show you some stats that might surprise you. this time last year we had 2.4 inches of snow. and we have broken a record here in dc for longest we've ever gone without a trace of snow. maybe that record gets broken tomorrow. i would remind snow lovers that 80% of the snow we got last year fell after february 15th.

it's an alberta clipper because they begin in alberta canada and they move very fast. and that's what you're seeing the snow in the chicago area. here's what i'm expecting in this region. is it going to have a big impact? likely not. and the reason is we'll probably get into the 40s tomorrow. so a lot of the snow we do see will melt as it comes on through. visibility may be the problem and timing is definitely the problem because it's going to snow likely between 4:00 and 7:00, i'm talking snow squalls moving very quickly but that's potential for a slick spot here and there and a very fast drop in temperatures with strong winds. so there is big concern for a refreeze and i know that mayor bowser is going to have some plows and salting standing by just in case. a few inches in the mountains where a weather advisory is in effect. by this time tomorrow night we're back in the teens and

single digit wind chills. i'll have that coming up a little bit later. a lawsuit will be filed tomorrow against metro for last year's deadly smoke incident on a train. you'll recall that on january 1, '21 person died when an electrical malfunction caused a train to fill up with smoke at the l'enfant metro station. they have failed to disclose the chemical compounds as part of that smoke. the general manager has written a letter to the public saying the transit agency has taken several steps to improve safety. to a fox 5 exclusive. we've uncovered there's been another attack at a metro station. it's the latest in a strong of violent incidents. marina marraco spoke with the victims of this attack. she is live now in northwest with the story.

marina? >> reporter: yeah, tony and after all this was said and done the victim is telling us they wish that metro would have add least made these recent string of assaults public so they would have had an option to at east either have their guard up or chosen an alternate form of transportation. >> i don't know what was happening. i heard my girlfriend screaming. >> reporter: it was 15 seconds of terror for a dc couple too afraid to show their faces after being attacked by a group of teenagers on metro. >> i think there was about 10 kids who were just like all attacking us. >> reporter: it was 9:30 in the evening on saturday, january 2nd. the couple was waiting for the train at the metro center stop after spending a night at the movies. they were setting on a bench when he was sucker punched from behind causing him to lose his vision. >> it all happened quickly. they were hitting us in the face and head. >> completely unprovoked? >> yes.

we literally said nothing to them. >> reporter: he had two black swollen eyes, welts on his head, bruised wrists, she was left bleeding with a split lip. nothing stolen, just a twisted past time for this group of teens. >> it was pretty quick and direct. they came up, i noticed they had scarves over their face. they just said a few words about my shoes, about getting up, if i wanted to give them my seat and before i had a chance to respond, that's when they started attacking. >> reporter: the couple says had they been made aware by metro about the up tick of assaults, they would have likely chosen another way to get home. >> at this point i feel like if someone wants to attack me, they can. i don't really feel safe in the metro anymore. >> reporter: is there a point where they owe it to the riders to let them know that this is happening? >> we would have liked to have known. i think if i had had more information, i may have made a

different decision about riding the metro. >> reporter: and this is now the fourth known attack since mid december similar in its type. three of those four cases uncovered by fox 5. in this most recent one metro has yet to put out any sort of suspect description or surveillance image related to it. metro also pointing out that 2015 saw its lowest point for serious crime since 2008. tony? >> let me ask you a question. is metro giving any thoughts to riders about why these kinds of attacks keep happening? >> reporter: well, we asked for more particular stats, especially considering that they're calling this simple assault the majority of these cases involving assault. they say none of these crime reports are actually a given unless it's in a quarterly report which will happen this coming thursday and that will be before the metro safety board committee. we also asked them as far as

putting out an advisory allowing riders to pick whether in fact they want to ride the metro because of what's been happening. they say they've done so in the past but they have to see some particular trend or at least, quote, something that was clearly linked. for these riders the victims we spoke with today, they feel an advisory should have already been put out. tony? >> marina marraco reporting. thank you. >> fox 5 is in loudoun county now. police are investigating an apparent murder suicide. a husband and wife were found dead in their townhouse. the victims have been identified as andre and naomi howell. the incident is under investigation. no new trial date has yet been set as the judge delayed the trial. jury selection had been scheduled to begin today in the trial of officer cesar goodson. he is facing the most serious

charges. he was driving the police van that gray was in when he suffered that spinal injury which eventually led t his death. maryland's court of appeals postponed the trial after the first officer, who was tried, william porter, requested to block an order forcing him to testify in goodson's trial. >> fox 5 is in prince william county where several wes dents showed up for neighborhood watch training and you may be surprised by what they were told. it comes on a recent rash of robberies at 7-11 stores. tisha lewis joins us. >> reporter: the robbers are striking more than area convenience stores. residents say the crooks are taking over their neighborhoods as well. this is one of the newly installed neighborhood watch signs putting criminals on alert. even though they can be armed, it's best to remain unarmed due to safety concerns.

we spoke with several who attended tonight's meeting and they all walked away with different tools to fight crime. >> just learning how to react when something is going on. the active shooting situation and basically just like crime reporting, what to do, what to look for. stuff that could be like a little off of place, someone sort of open a door, just broken glass, someone breaking into a house and had to react to that. >> things have been happening in the community. burglaries, all kinds of different activities that would spur anyone in the community to want to do something about it. >> what did you learn here tonight? >> i learned there are a lot of things we can do to keep ourselves safe. i noticed a lot of my neighbors have bushes in front of their doors where someone can easily hide and that's something that when we start the neighborhood watch we'll let them them know it's something they may want to trim down to keep themselves

safe and to how to respond in case violence does show itself. >> reporter: police say they've seen a resurgence of neighborhood watch groups. learning what is suspicious, what to do when confronted with crime. an easy rule of thumb, according to police, anything out of the norm for the neighborhood is suspicious. they were also, the folks at this meeting, were also provided contacts for the police department and also advice on how to report a suspicious incident. >> we don't want them to be detaining or apprehending people. we want them to observe behavior in their neighborhood and contact police if they feel it's necessary. we hope the impact it will have is getting more people on board to paying attention to their neighborhoods because obviously the police can't be in every neighborhood all the time this allows us to keep each community safer.

tonight there is a political tug-of-war over the future home of the washington redskins. currently the team has an agreement to play at fedex field in landover until 2027. but the team recently hired a danish architecture firm to start work on designing a new stadium. an executive says the area around largo town center is the best fit for the team stadium but dc mayor muriel bowser has ideas of her own. >> here's the deal. we're building a soccer stadium. our soccer team is going to be playing there in 2018. and after that, we're going to have an empty rfk stadium. so my charge as mayor is to make sure that we have a plan for rfk by that time. >> when i've talked to the ownership and dan snyder of the redskins, they want a downtown field. they want an urban feel around

the stadium so people cannot only come during game time, but stay afterwards, come early and that's what they're going to see at largo. >> meanwhile the virginia governor has also expressed an interest in having the team play. >> i was thinking maybe my backyard. >> you must have a nice-sized backyard. yesterday's playoff loss to the packers was the redskins season finale in more ways than one. >> jim lokay. >> reporter: we saw the most work rg3 doing at redskins park today. officially it's not the end but it sure feels like it. he was cleaning out his locker. he didn't speak to the media but if you're the type that believe actions speak louder sthan words, look at what he left inside his locker. it's a long note in part saying,

get. that's not a bad thing. >> hopefully we don't have any more for next season either. >> it's a good groundwork. >> thanks jim. >> new footage is taking us inside the raid that ended six months on the run for drug lord el chapo joaquin guzman. mexican authorities released it. when you see it you're probably going to think you're watching a scene from an action movie. but it is from the moment they conducted a raid called operation black swan. this was thursday last week. authorities were confident he was hiding out here after receiving a tip. 17 mexican marines used grenades and gunfire as you can clearly hear and they moved room to room during the operation looking for him. they encountered armed guards inside and in the end the marines killed five of them. they found a hidden passage way behind a mirror that led to an escape tunnel that led to a

sewage system. he managed to get away but they managed tol catch him the next day. his lawyers are fighting his extradition to the u.s. in a rolling stone article published saturday sean penn revealed he interviewed guzman back in october. officials have said guzman called producers about a planned movie about his life and his contacts with sean penn here and an actress helped them track him down. penn wrote in his article said he didn't see any members of law enforcement tracking him. >> it's nothing new. actors going and seeking out meetings like this. i don't want to throw any other actors under the bus but i know a lot of serious actors and film makers who have been having meetings like this forever.

start work on designing a brand new stadium. prince george's county leaders say they want the team to stay but leaders from dc and virginia are expressing interest in being the new home of the redskins. >> it has been six months now since the dc fire lieutenant was charged with nektive duty for delayed response to a choking toddler who later died. >> the lieutenant wasn't disciplined and has chosen to retire. it's a development that deeply angered the baby's father. paul wagner has the details. >> reporter: last march 18th in this house, 18 month-old martin cuesta began choking on some grapes. calls were placed to 911. but it took 11 minutes for help to arrive. in part because a lieutenant assigned to this station three blocks from the house heard the call go out but failed to respond. according to this report, the lieutenant told investigators he didn't respond because dispatchers didn't put his

engine on the call and he was unaware the house was just three blocks away. today more than 10 months after losing his son, jose cuesta sat in his lawyer's office knowing little more than he did when charges were first filed against the lt last summer. >> extremely upset. i'm very disappointed that the lack of responsibility and accountability. the possibility that he can get away with these without any proper disciplinary action sickens me. >> reporter: according to the report the lieutenant's engine was not placed on the call because a new communication tablet like this one lost contact with the 911 center, which did not know that the engine and an ambulance were in the station in service and ready to respond. despite that, the lieutenant was charged because investigators say he heard the call go out and failed to respond.

>> wanted mr. valentine to know that i think of him every single day. because he could have saved my son. just doing his job. he was three blocks away from my home. three blocks away. he heard the alarm or the emergency and he decided not to leave. that contributed to the death of my son. so i think of him every single day. >> reporter: last year the dc city council passed the firefighter retirement while under discipline act. which can prevent firefighters were retiring under certain circumstances and under others fine them up to $5,000. in another twist to this story, mr. cuesta and his attorney are still in the dark over another part of the investigation. whether dc police are still looking into the nanny's actions

serve and protect the public when they're on duty, but when they're off duty it's a personal decision if they carry their guns. >> my hat is off to those officers if they're willing to do that because that could be very inconvenient. they're out there with their family an friends and they're still willing to respond to help people. >> reporter: the assistant chief was not happy to hear our report that off duty police officers were told they couldn't enter with their guns. >> i think it's unfortunate that private businesses here in the district of columbia wouldn't allow off duty members to carry firearms. >> reporter: the policy is off duty law enforcement cannot have a gun inside. howard theater is the only other one in the city with this no-gun policy for law enforcement. the kennedy center which is federal property allows them to carry. the national theater also allows it. the varn center has officers register their guns at the gate

but they can carry inside. the assistant chief said that every active shooter situation is different, but he explained that the public is safer when armed police are on the scene. >> when an active shooter is confronted with law enforcement, they turn to a defensive mode. so they're no longer trying to just kill people. they're trying to defend themselves so they're more -- their target turns away from the general public towards the officers. >> reporter: he said the nation's capital will always be say target for terrorists, but the city is well protected. >> we have more law enforcement officers in our city than most other cities. you're almost always going to have an immediate police response. >> reporter: it used to be a requirement that dc police carry off duty. their general council said it's now a personal choice. >> it's up to the officer what they want to do. i think if you talk to most of our officers when they're off duty, they will carry. because they're committed to helping people. >> reporter: emily miller, fox 5 local news.

>> we reached out to the warner theater today to see if they've changed their policy. they told us that no one with a weapon, including law enforcement, can enter their theater. warner theater staff says they have armed security of their own. so take a look at this. a defroster won't do much good here. it was parked near lake eerie in buffalo new york. rain, snow, freezing temps and as you can see the car is completely iced over. take a look at that. >> boy. >> goodness gracious. >> it looks like it was parked right by the lake. >> there's huge waves on eerie and ontario. >> you can see the splash. >> that is something. >> might as well just leave it there for a while. >> as long as it's not around here. >> i've got to say, arctic blast

is coming in and we've spent a lot of time making sure people are aware of these snow showers, but that's not the real story. it's the cold an the wind. >> tomorrow? >> for wednesday. by this time we're back in the teens in the wind chill department. kind of a brutal one that's going to be coming on through but we will see that tomorrow. before it gets here we'll actually get into the 40s, so that's not too bad, right? >> we like that. >> it will warm up, that's why we're not expecting to see a lot of accumulation either. because the road temperatures will be rather warm. but we will give you a good idea of when to expect a few snow showers because we know a lot of snow lovers have been suffering this year waiting for them to come on through. so let's start with the weather headlines and i can tell you that we will be clear and cold overnight and we'll start out on a dry note tomorrow. any snow showers we see scattered tomorrow afternoon will be between about 4:00 and 7:00 here in the local area. they'll move through really fast so if you're going to get a picture do it quickly.

no accumulation expected. there could be a couple of spots north and west on grassy areas, but it will get so dramatically cold after that front goes through that some of the wet spots could be icy. but wind will also do a good job of trying to dry that up. but we will be heading right back down and right now it looks like wednesday will be the coldest day we've had so far this season. tomorrow i wanted to show you most places should get up into the 40s ahead of the clipper system so it will supply a little bit of warm air, relatively speaking, first. and that's why it should save us a little bit from having too many slick spots because this certainly does not take a lot to cause problems. this is the system we're watching. it looks pretty good on radar and it's going to be moving to the north of us. so what we're going to be getting is a starved system of moisture. so it will come through a frontal boundary and strong winds and snow showers are in the forecast for the first time this year and if we get even a trace that will break our record or will finally be in the record books this year for the latest

snow measurable we've ever seen here in dc. the dusting though likely if you're going to see something along the mason-dixon line. we do have a winter weather advisory and they could get decent snow in the order of 2-4 inches. and ski resorts i want to give you a shout out with a long weekend. i think you'll get maybe 3-5 inch inches. and a whole lot of cold air to make more snow. at the noon hour, some sun, some clouds, but around 5:00 when we see these areas of snow showers developing. and they really could come through with reduced visibility which is why we're a little concerned about the timing with a lot of people on the roads at that point. look at this, by 7:00, most of it is over. but we're starting to get really cold and those wet spots could be a littleby icy and behind it strong winds tuesday night and wednesday, we're talking gusts

over 30 miles per hour. so that wind chill will be in the single digits and teens. wanted to show you again on wednesday one of the coldest days we're expecting that temperature of 32 degrees even with sunshine, that means all around the region we're talking about places in the upper 20s to low 30s and it's going to feel even colder than that. as we get closer to thursday, about 45 degrees again for the weekend. can you believe that saturday we're up near 50? we might have some showers late on friday and into saturday. but we get cold again for sunday and monday. and right now, while it looks like wednesday will be one of the coldest days we've had all year, next week starts to warm up again a little bit. >> i don't think this back and forth is helping people who have been sick. >> certain people whose voices have been compromised. >> it's down, it's up. >> i think it has a lot to do with the indoor of your house, the heat running, the humidity, no humidity and very dry. >> it's crazy. >> thank you sue. a maryland man spotted a

snake moftion in his mother's home so he called police and he grabbed his phone so he could fox 5 this. alexandra limon shows us. >> i've got to fox 5 this. >> reporter: sunday evening troy discovered an unwelcomed black snake on the floor of his mother's apartment. >> it kind of freaked me out and i didn't know what to do so immediately i called the police. >> reporter: prince george's county police said the job was really for animal control. but the officer who has been with the department for three years showed up and took matters into his own hands. literally. >> the next thing you know he came in there with jokes, asking me you all scared of snakes? . troy admits he had a hard time sleeping after the close encounter with the serpent. still he says he has one good takeaway from the experience. >> a lot of cops getting a bad rap and this cop took his time out to come, get a snake from
