. ka this is fox 5 local news at 10:00. right now at 10:00, his officers were wrong. the university of maryland police officer cheese is speaking out after officers pepper sprayed and arrested two women during a graduation party. once the case racially motivated. >> bomb detected devices getting resistance tonight. some say the safety measure could be an invasion of your privacy. >> first, a tragedy in france. a man purposely drove a truck into a crowd of people during a festival. tonight, dozens are dead. the latest on the still developing story right now at 10:00. >> we thank you for joining us, i'm shawn yanez. >> i'm tony perkins. tonight at least 77 people dead. 20 others gravely injured following an attack in the southern french city of nice. crowds were gathered for the bastille

who was behind the wheel deliberately drove the truck into the crowd and began shooting at people running away. that driver was then shot and killed by police. a stash of arms and grenades was found inside of the truck. fox 5 marina marraco. >> reporter: we saw people gather here and mourn. back in december, that first attack that took 137 lives in paris and now this attack in southern france in nice today is bastille day, the 14th of july celebrated through the france and the french cold in his as a day the national day that celebrates the republic of france. right here in washington dc, there was to be a party to celebrate to. here

ambassador and folks as they arrive were hearing of the news, some didn't find out until they were inside when they saw their ambassador, he was choked up. there was is somber mood. usually there's dancing and partying. if you would owe activate it you would do so with the fireworks, dancing. a good old time. none of that took place, so much so that the night was cut short. there was a moment of silence and the somber faces you can see them as they walked outside. >> all of this was shock. some of us didn't even know what had happened. and to immediately we saw that the ambassador was extremely mov moved. it wasn't what it used to be, we used to have dancing and music. >> we're not french. we wanted to show that we care.

major terrorist attack on france in past year and a half. in january of 2015. isis gunmen killed 12 people at the charlie hebdo in paris. they were getting defense. last november 13th, isis attacked several locations and killed 130 people and injured hundreds more. the terrorists did he do 98ed suicide bombs outside the city soccer stadium. gunmen targeted people and on the street another group killed people and held them captive inside a concert hall that marina just talked about. today's attack was different than the others. right now, it appears the terrorists may have acted alone. of. of. police say the man behind the wheel was the only person in the truck. we spoke with a terrorism expert. he explained what this means. >> there's no shortage of soft targets. you can't harden

weekend. beach forecast and how long this heat wave is going to last, coming up a bit later. tony? . we're following developing news from college park, the police chief at the university of maryland admits that his officers went too far when they used pepper spray at a graduation party in may. the incident was captured on cell phone video. lauren demarco smoke with one young man. >> reporter: the police chief is calling this an embarrassment. he suspended one officer without pay for two weeks. says at one point the use of pepper spray could have and should have been avoided. this is a graduation party. the crowd prominently african-american, one man said it was terrible particularly with all the incidents going on across the country. >> the worst thing that i

was one police had their knee on the back of the young black male's neck. we already are scared. >> reporter: he recorded some of this cell phone video the night of the party. he says there is no question the officers use of force was excessive. body camera footage with members of the media, lindsey watts was there in her words, this is nothing compared to her images. the body camera video won't be released until monday. police chief david mitchell is not mega excuses. along with the suspension of one officer, all of the charges have been dram against the two people arrested that night. and he's ordered a review of use of force procedures and training in areas of implicit bias and diversity for every officer. >> first of all i feel pain

detection equipment in its own backyard. tisha louis fox 5 local news. a man who allegedlyshot and killed a maryland firefighter and seriously injured another will not face charges. they were killed and wounded last april when they responded to an emergency call in temple hills. today, the prince george's county state's attorney announced that darrell lump consistent, the homeowner was indicted on six weapons charges but not homicide. >> there was no good result as far as i'm concerned, there was really -- this is the kind of case that unless you can bring back the firefighter who was -- lost his life and you can, heal the one who died, to me, it's a difficult case. >> if convicted, lump kin could face 45 years in prison. new details about an up skirting incident in arlingt

police released a picture of the man accused of looking under a woman's skirt and recording images of her. police say surveillance video at the courthouses metro station caught part of the incident and the alleged suspect. they say he used a cell phone to take pictures up the woman's skirt as he was riding up the escalator. she later confronted him. they now want to know if there are more possible victims. if he had inappropriate contact with you. call police. >> and. tracking metro tonight, the transit agency is facing a new problem. money, metro's expenses are still going up, even though revenue is going down. ridership fallen dramatically. metro leaders safetrack repairs can reverse that trend. national park service is have been fun. sarah simmons is

escorted him to the church for service. he is survived by a wife and two daughters. >> a verdict in the trial of the fourth officer charged in the death of freddie gray is expected on monday. lieutenant brian rice is the highest ranging police officer accused. he shared with rick less endangerment and misconduct. both sides wrapped up closing arguments. paul wagner has the latest from baltimore. >> reporter: brian rice was the supervisor on duty the morning freddie gray was arrested in april of 2015. in today's closing arguments both the prosecution and defense argued on whether or not it was reasonable or unreasonable for the way rice acted. prosecutors said it was unreasonable. he should have made sure that freddie gray was seatbelted in that van that morning. it was the general order of the police department that all arrestees be seatbelted in. but the defense said no, it wasn't basically because there was a growing

freddie gray was combative and rice wanted him out of the there. >> on the morning of april 12th, 2015 he and several other officers were on put bicycles patrolling the neighborhood where he was arrested. prosecutors said lieutenant rice should have known that a new general order had been issued requiring officers to seatbelt in police vans all suspects placed under arrest and as a shift commander, a reasonable officer follows orders and leaves the by example. prosecutors also told the judge with a small measure of compassion, freddie gray would still be alive. but the defense said there is no evidence of a corrupt motive. the state has not proven tests case and called elantra rice's actions that morning professional correct and reasonable. rice, the defense says wanted to get gray out of there because he had become combative and prosecutors failed to

the lieutenant's decisions were unreasonable. he suffered a catastrophic injury. he died seven days later. death ruled a homeless. his family paid millions. he had this to say about the closing arguments. >> the medical examiner's were all over the place. i believe it comes down simply to whether or not the judge accept the state's proposition that simply by in the belting freddie gray that he is criminally responsible that that in and of itself shows this reckless disregard for the welfare and health of freddie gray. >> of the six officers facing trial in this case, two have been acquitted and one trial ended in a hung jury. so far, there has not been a return to the looting and violence and rioting that we saw in the city after freddie gray died in april of 2015. in baltimore, paul wagner fox 5

>> orlando police are investigating an overnight break in at pulse night club. this comes just a little over a month since a gunman opened fire inside the club killing 49 people. the break in happened some time after 11:00 last night. shortly after law enforcement turned over the property to its owners. the club openers say the intruder pride wood from the entry way to get inside. no word on a suspect or motive. this was a pretty exciting night for jim lokay. he had the opportunity to throw out the first pitch at the game tonight. did he knock it out of the park or miss the mark? coming up in sports. port . girls, we're heading to break, take a look at this 14-year-old north carolina girl. turning heads because she's the only female football player on her high school team.

weather made it hard for firefighters to battle the fire, yesterday in los angeles more than 230 firefighters tried to put on it a fire and dangerously close to homes. it's already charred more than 30 acres. mandatory evacuations are underway in colorado. the wildfire has scorched nearly 13,000 acres. back at home, we're dealing with heat and humidity. >> lots of humidity. today was the hottest day of the year. 2016. what we did not get was much in the way the thunderstorm activity. looking like tomorrow won't feature much. when we have a west wind it gets us so hot.

atmosphere a little bit. certainly very humid but i kind of steered those storms in a different direction. the main theme as we head forward through friday and the weekend is going to be the continuation of the heat, i don't think tomorrow will be quite as hot as today was. we got up to 98 degrees. the mid 90's will be back tomorrow, the humidity will still be there. the yes, there could be a few storms tomorrow. most i think are also going to pass to the south. our futurecast is not seeing a lot of activity even for the southern suburbs. of we look at the weekend. it's still hot but now looks like it's closer to 90 or 91 or 92. a lot better feeling than today. but still hot and typical july. we have a light break in the heat wave in the middle next week, kind of builds back in again. the heat bottom line is continuing. a hot today at 98. tomorrow we take it down
