independent competency evaluation, due to orders by the judge, police are unable to question her about the whereabouts of the children. attorney tells fox5 while he is sympathetic to what the family is going through, at this point the court proceedings going on right now are not designed to find the children, a criminal proceeding, seeking to sanction her for her alleged conduct. >> says constitutional right to remain silent. turner says a question he would like to ask that judge. >> his kids, you know, and another judge ruling, would he want it ruled the same way? would he rule the same way if it were his children? i kinds of doubt it. >> i mean, you know, he would definitely like to question, they feel there is a good possibility, obviously, that the lawyer would get up there, and that she, you know, may not say anything. but at the same time, having the ability to do it, is a tool, and in this case we need

after visit ago tropical smoothie cafe, includes worker at the chain's gainesville location. tonight we're taking closer look at the time line of events, and asking why the health department, and tropical smoothie, waited two weeks to notify the public about the help tight link. >> fox5 lindsay watts with the latest. lindsay? >> reporter: tropical smoothie here closed for the night, the chairs are stacked, the doors are locked but even earlier when it was open it was very quiet out here. the owner of this franchise location tells me that his business has been cut in half. ever since the virginia department of health announced frozen strawberries from egypt, used at this location, and others around our region, will likely linked to outbreak of hepatitis-a. that was a week ago, it was on august 19th, the health department put out that alert. but listen now to when the ceo of tropical smoothie said he found out about this. >> on august 5th the

us about a potential link between frozen strawberries from egypt. we voluntarily and immediately removed all of those strawberries from all of our cafes. >> and that two weeks that went by is specially important, because after you have been exposed to hepatitis-a, you have about 14 days to get a vaccine, and potentially keep yourself from getting sick. so i asked the health department why the delay, and the answer tonight, what i'm told, is that when they contacted the ceo here, to tell them about this link, they had preliminary information. they didn't feel it was enough to go public with this, potentially naming the wrong product, or the wrong business. >> this whole situation has been enough to keep a lot of people away from here but we want to point out we did speak to customers today, they feel perfectly comfortable coming back. >> only short period of time, so, we

humid. we'll check in with again toll bert with a look at the forecast. please, tell us it won't be as humid as it was today. that one slapped us in the face. >> break in the humidity but just for tomorrow. by sunday it is creeping all back in again. so very short lived. but i'm sure, regardless, it will be very welcome. today was a very hot day, as well, hot, steamy out there, here is a look at the highs, breaking a record at dullos airport, 98 degrees, and that broke a report that was setback way back in 1998. so unbelievable here, with these temperatures. ninety-five at reagan, and 93 at bwi. so as we take a look at where we stands right now with the temperatures, it is still pretty warm out there for this hour of the night. currently we've got 86 degrees at dc, 82 at annapolis, 79 at dullos, 81 at manassas, 80 degrees at fredericksburg, dew point currently have dropped little bit. they're into the low to mid 70s, couple of upper 70s there. but it is still pretty sticky

out there. so here is a look at what it actually feels like when you step outside. heat indexes showing it feels like it is a hot 94 degrees in the nation's capitol this hour. we've got 88 at manassas, 82 at baltimore, and 86 at culpeper. now, we've got frontal system. that's making the difference in our dew points. take a look at where it is right now. as it continues to move to the south, behind it, the drier air will start to kick in. north of it right now we are already seeing a big difference. but to the south of it, still pretty warm, sticky. but that will be our saving grace for tomorrow, in terms of getting rid of some of that humidity, at least for little while. as it moves its way through, clearer skies for tonight, and still warm. your full forecast is just ahead. back to you. >> now, to montgomery county, just few days away from the start of a new school year. but, it is going to be a challenging start, for many families, and their children, who lived at the flower branch amounts in silver spring. they are their buil

destroyed in a gas explosion just couple of weeks ago. fox5 jennifer davis went to silver spring to show us how the children and their families are coping. >> two weeks after the deadly blast here in silver spring, 55 families, 120 people in all, are working very hard to get their lives back on track. and there really is a special focus on the 19 young children who used to call the flower branch amounts home, now displaced, and yet still have to start elementary school on monday. today we spoke with two elementary school principals who say they're committed to helping these children adjust back to a daily routine after the tragedy here. now, these 19 children are between the grades of pre-k and fifth grade. they're in various situations now, and temporary or new housing after their families lost everything in the blast here. these 19 children attends two nearby elementary schools, that both held open houses today. staff has been visiting with the children, and the

principals at oak view and new ham hire elementary schools spoke with us how they're trying to help these student when they come back to school on monday. >> we had staff members who were going to the shelter, playing games with the kids, reading with the kids, staff members was trying to help kids go to sleep at night. one of the things, kids have been having trouble sleeping. so she was, you know, with one of the little kids i think until midnight, to see if they could go to sleep. >> just about anything they need, as long as we know what it is, you know, we've had some stories, one where one of the teachers were talking to a student, and the student said i just want something that's just mine. because they lost everything. and so we asked what that was, and the student said i would like to have a book bag. can i have a book bag with school supplies, 30 minutes later we had it, we made sure he knew it was his. >> we are intent on focusing on learning. that's what kids are used to when they go to school. and, you know, psychologist woul

>> sung to new low in howard county, stole donations meant for a children's charity. tonight police need your help tracking them down. robbed 7-eleven on frederick road in ellicott city. police say the three men, or people i should say, wearing dark colored winter clothing stole the donation jar and cigarettes, also stole cell tone from the store clerk, there is a rewards up to $1,500. if you were trying to get through the thirds street tub they will morning you were most likely trapped in the traffic tie-up there. that's because the tunnel was shut down for nearly an hour, while police were is her clinic for a suspected bank robber. they released surveillance pictures of the suspect late tonight. they say the man robbed the pnc bank on seventh street north wells, around 11:00 this morning. the suspect was last seen going through the third street tunnel. >> and a crash involving

department vehicle under investigation. in howard this morning, in columbia, maryland, police say the truck was responding to apartment fire when it was hit by a car on route 175 near done inch road. the collision caused truck to hit three other vehicles, this that were sitting at a red light. that intersection was closed for three hours, fortunately, no one was seriously hurt. >> central italy, hoping is fading anyone else will be published from the rubble. more than 280 people known dead, but officials fear that death toll could climb. fox's john huddy has the latest. >> reporter: the earth continues to shake in central italy. magnitude 4.8 after shock today rocked the towns and villages leveled by wednesday morning's earthquake. >> there is a lot of fear for everyone. one thing, people are safe, at least there is that. >> reporter: there have been hundreds of after shoc

wednesday morning, including more than a dozen today. this adding another problematic layer to the already exhaust i have search and rescue effort. now, slowly, and painfully, becoming a recovery operation. what we've been saying now are these crews basically clearing out all of the rubble and debris, and just putting it in piles like this. and then these piles, we've been seeing people's pictures, family pictures, clothing, and children school books. the stories of survival have given some hope that more people will be found, but time is of the essence, and time is running out. search and rescue efforts have been hampered by the constant tremors, critical roads and bridges, leading into the towns, have been damaged, making them impassable in some areas for the heavy equipment needed to help. these trucks remain parked along the road in the town where the main aid and relief camp is located. tom maher, told me, firefighters in search teams here are exhausted, but

>> to montgomery county, kids head back to school monday, a number of school buses are being equipped with cameras, to capture knowing going around the school buses when stopped. approximately 100 buses will be mounted when cameras on the outside of the busses to catch those drivers who pass by when buses are picking up and dropping off student. violators will face a 125-dollar fine. police tell us during pilot program last year, 2500 violations were recorded in a five-month span. and that was just on five of the buses. >> we have far too many drivers that can't see this big yellow school bus because they're too focused on talking or texting on their cell phone. and finally, we have a lot of drives that just don't understand the law. they're un informed. >> a private vendor is supplying $1,200,000,000 of camrys to the county for free, in exchange for the first $12 million in citations collected, the county's entire school bus f

by the time we get to sunday. jet stream to the north of us, all of that hot, humid air in place, ridge of high pressure builds in, that sets us up for a weekend full of sunshine. so, just few clouds here and there. but at least the skies will be sunny. but will be definitely hot. so do take care. it will be a great weekend to go to the beaches, though. lots of sunshine, at all of our beaches, temperatures into the 80s, the water temperature will be about 74 degrees, it will be pretty comfortable. and also pretty pleasant as far as our beaches go. a lot happening in the tropics that we're keeping our eyes on. we have number of disturbances to talk about. this is gaston, which is actually moving it way to the northwest. very slowly. no watches or warnings in effect for any of these systems. then this low pressure system between the bahamas and cuba. that's expected to leave fair amount of rainfall over parts every cuba do. see some lots of flashflooding and mudslides as a result of it, as well. the convection seems to be intensifying it. we have another system here
