death. she was shot outside of a car parked here along prince place in upper marlboro overnight. police were called to the scene around 1:45 a.m. both banks and a mail is victim were shot outside of a vehicle. police have not released any information, both were taken to the hospital, banks was pronounced dead. the other victim is being treated and is expected to recover. overnight our crew captured video of police searching the car for evidence before it was towed we're told there was a dog inside of the vehicle at the time of the shooting. the animal was not harmed. it was taken from the scene by animal control. back out here live right now, there's some family gatherishing across the street, because elisa lived here with her mother in an apartment. we went to that apartment. the family told us they do not wish to speak on camera. i have spoken with friends who are very upset. shocked by all of this and

investigate right now the events leading up to the shooting, figure out what exactly happened here last night. that's the latest in upper marlboro. back to you. is safety a concern on election day? should all polling places be gun free and would that make them safer with emotions running high on both sides of the race? elections offices in our area are trying to figure out how to handle election day and the presidential race like no other. fox 5 in manassas. . >> reporter: we want to discuss the upcoming election, because who isn't talking about it? i'm join here by rob williams, a chairman of the board of elections here in prince william's county and also by bob marshal, state delegate here in virginia. my first question is, the idea of gun free polling places, the

i know the issue came up at a recent elections board meeting. so why did it come up and what was the conversation around it? >> there were two questions that came up, one from election officer concerned about their safety and wanting to carry their issued concealed carried weapon in the polling place and from a different officer wanted their church facility, which is not a gun-free zone to be declared as a gun-free zone and the board discussed it and our advice to follow the - our advice, but follow the code of virginia. if the law allows it, and it does not create an issue at the polling place, that officer is allowed to carry their concealed carry weapons. or we'll reassign them. in the case of the other one, we don't tell election places whether or not they can make it a gun-free zone or not. it's entirely up to them and as long as they follow the law in virginia, we're acceptable to that h. >> reporter: mr. marshal, one of the questions that came about

places could be considered a way to intimidate voters. what do you say to that >> it's not like the black paths in philadelphia who had billy clubs out and were intimidating voters. the law allows it at a private facility. it doesn't allow it at a school or state courthouse. to me, that's fine. >> reporter: private facility can make their job decision to make election day a gun-free zone; correct. >> it's their property. >> reporter: there have been a lot of allegations by donald trump that the election is rigged. with those statements out there, are there room for violence at the polling places? because people are feeling park the on both sides of this presidential election. >> a study from 2012 indicated one out of eight voter records

information. they additionally mentioned 1.8 million dead people are on the policy in virginia and harrisburg who recently had a situation where 19 people were dead. i asked the chairman of the state board of elections how could this happen? he didn't know. he got almost 700,000 never voted. 350 off, a million people sitting there waiting to quote vote in the name of somebody else. >> reporter: they were registered to vote but nobody voted in their place like the deceased >> so far but i have run into people who acknowledged to me that they're not citizens who are registered but registered by accident. my wife recently got a driver's license and told she was registered to vote but wasn't told she had to be a citizen. >> reporter: any last words. >> i've been an election officer 15 years, we believe we have fair and honest elections, we always want to make sure that the database is accurate and current.

struggling right now for resources. we want to make sure we address that. by and large, i think you're going to find it's a fair election in prince george's county and i think we're going to be free of violence. >> thank you both so much for joining us and with that laura, i will send it back to you. >> thanks. a smoking regulation is making its way through the dc council. it increases the legal age for smoking from 18 to 21. supporters on the council say it will reduce smoking while oth say finding young people is not the solution. matt ackland joins us with more. >> reporter: smoking is dangerous and the best thing to do is keep young people away from tobacco products but disagree on whether or not it's a good idea to finding them at younger age. even when the fines seem a bit out of whack. we put this together to show the full council debated the issue

issue that the civil penalty written in this bill would give a younger smoker who buys tobacco a $50 fine. but if you remember, we've done a lot of talking about this in the past. smoking pot in public in dc, well, only comes way $25 fine. now, council member yvette alexander says it's more about the health message rather than the amount of the fine. >> we up the age, because years old. if we up the age to 21, we think it will eradicate a lot of team smoking and addictions four nicotine >> to alexander who's the head of the healthy committee. she will agree to reduce the tobacco fine to $25. but councilman david grasso who chairs the education committee says finding younger smokers isn't really a good idea.

this is fox 5 5:00. a robber caught on camera in georgetown. police need your help identifying the suspects. this happened last thursday in the 1400 block of wisconsin avenue. you can see the four suspects snatching purses from behind the display case. a female employee was punched in the face and head. if you recognize any of these guys, give police a call. dc police made an arrest in

a popular diner. 26-year-old willie quinones charged with the crime. a second suspect is also being questioned. police say the men got away with cash an purse. steaks and eggs diner was robbed back in september but so far no arrests. a village is being held for a teenager girl stabbed. 18-year-old kae into a fight. jones stabbed minor, who later died. they say it was a fight over a cell phone that led to the incident. court documents also revealed minor and jones had been in a long running dispute. when the two met on the metrobus monday, tempers flared >> jones has been charged with second degree murder and made her first appearance in core earlier. paul wagner joins us with the story tonight. paul? >> it was just after 4:00 this

walked into the well of the courthouse. i should say the courtroom seat 10 here at superior court. handcuffed and shackled. family members of kaelia became emotional. some of them breaking down in tears. there was a hearing that lasted about ten to 15 minutes before the judge decided that jones would be held without bond. at that point, kaelia minor's mother broke down in tears and there was even some applause, wh upset over. let's show you some video that we shot this week as this story has been followed. according to a court affidavit filed in the case, the two teenagers began to fight as the number 62 bus came to a stop at kansas and empty mer son just after 8:00 monday night. . witnesses say jones and minor began arguing on the bus before minor grabbed jones' phone and ran off the bus. when jones caught up to her,

and jones retaliated by stabbing her one time in the chest. then according to witnesses, minor went looking for her phone saying, quote, i don't give an f what happens to her. i don't give an f if i stabbed her. i want my f-ing phone. then according to the court document, jones walked away, grabbed an uber and took it to southwest where she threw the knife in a sewer, smoked marijuana and called her parent to tell them. jones went with her parents to the first district station where she turned herself kaelia minor's mother left the courthouse without speaking to reporters but did speak with fox 5 last night. just after the arrest was announced and here's what she had to say. >> she just was taken too soon. and she supposed to take her sat wednesday for college and stuff. and she supposed to graduate next year in june. she supposed to take her school

police are asking anyone with information to give them a call. a police officer is lucky to be alive tonight after he was nearly crushed by his own squad car. take a look at this dash cam footage. the crash happened monday on interstate 94 in wisconsin, the officer had been helping a driver install on a bridge when a pickup truck rear-ended his squad car. as he was walking toward it. fortunately, the officer and the truck driver walked away without any r very lucky, incredible video as the car just goes straight toward that officer. absolutely incredible video. meanwhile, a texas youth football team's season is ending early after backlash over a player's silent protest >> it followed in the footsteps of collin kaepernick and needle during the national anthem.

elisa was the government president for the past 2016. of she graduated just this past may. prince george's county are investigating the events leading up to her death. she was shot outside of a car parked along prince place in upper marlboro overnight. police were called to the scene around 1:45 a.m. both banks and a male victim were shot. police have not released information other than say he is legally an adult. both were taken to the hospital. banks was pronounced dead but e recover. overnight, our crew captured video of police searching the car that was here for evidence before it was towed away. we're told there was also a dog inside of the vehicle at the time of the shooting. the animal was not harmed. it was taken from the scene by animal control and back out here live along prince place, the shooting happened up here behind me across the street in a development is where elisa lived with her mother.
