i'm tony perkins >> i'm shawn yancy. before officers discovered the mistake he ended up hurt and his mother had to be taken to the hospital >> the victim is speaking only to fox 5 lindsey watts joins us with the story. lindsey, the big question, how could this happen. >> reporter: the carroll county sheriff department were investigating a burglary. investigators go the information that one of the men involved lived in gaithersburg, got his name. there was more than one person by that name in the city. investigators somehow were able to get a search warrant for all an innocent man's home >> this is where they busted in the door. kicked this, didn't even kick it open. >> reporter: israel was in his bedroom when he was suddenly surrounded by swat officers. there looking for him >> this is where the officers stepped on me while they were tying me up. and then this is where they hit me with the shield when i was opening the door and

slammed me against the wall >> out of nowhere police came into his home and detained everyone inside. >> they take me upstairs where i see my whole family is tied up >> he says officers barged in on his teenage sister in the bathroom and his mother fighting cancer was so shaken had to be taken away by ambulance >> my mother suffers from multi-milo ma and under going chemo. her medicine had higher risk at heart attack when she had a panic attack it was serious >> the sheriff's office he admits this warrant was a mistake, they were trying to find 20 guns and money stolen from a home. turns out oriana's only connection is he has the same name as one of the people allegedly involved. both live in gaithersburg. and investigators felt that his driver's license photo matched surveillance video of the suspect. carol county got the

asked montgomery county police to execute >> well, you kind of look like him. you have the same name. so that gave us the right to break into your house and search everything. and tie up your family. that's not enough justification for that. i'm thankful honestly it was just me that got hurt. if it was my mother anybody else, would be so much more serious. >> reporter: he's he's not telling his story for a payout but for accountable >> these people need to be held responsible >> he says he made formal complaints to both the carol county sheriff's office and montgomery county police. i spoke by phone to the second in command at the carol county sheriff's office. he says they're taking a hard look at how they got to that point of identifying the wrong person. he also says there's an internal investigation that's underway right now. shawn and tony we will be continuing to follow up. what happens next by law enforcement >> absolutely. does anyone get punished? i know it was a

>> this is picture of the martin family entail tonight, they say they're doing well and are very remorseful. they've hired the fallston group known as the reputation agency to help them cope with the backlash. latest assignment, an apology. here it is posted on youtube. >> we're focused on making sure that our kids don't have to deal with so much backlash from our bad decisions and we realize now what kind of a situation we put them in. and we're just really sorry to them. >> the full youtube video is less than three minutes long, and we're told it's unscripted and toward the end, heather martin says she's sorry to her children. the video apology was, in part, the idea of crisis manager robert wine hold. >> we want to get family counting, we want to work with a life coach and

most put people's eyes. i've been inside the home, worked with the family the past couple days, very intensively and i can tell you they're very remorseful, in the process right now, again, of putting -- pushing the pause button and making sure they're providing the normal lifestyle they want >> robert wine hold junior once worked at the baltimore police department and department of justice. he's now worked in crisis management nearly a decade. and says the controversy is not the worst one he's seen. he's to manage this crisis on a personal and professional level. he helped the family craft this apology they posted two days ago. it now has more than 800,000 views. even so, the crisis manager said, while the daddyo five family, they are not media savvy. he said he talked about the court of public opinion and

he's gone as far as to teach the family how to interact with coworkers, friends and neighbors amid the controversy. we interviewed a neighbor who says his children play with the martin family children. >> obviously, youtube is one of those -- it's just that thing out there they're looking at all the time. we just kind of tell them that, you know, we -- we do things a little bit differently, we'll never do this to you. that kind of stuff. >> the martin family and children were told have been unable to to attend school since the video sparked outrage. the future on youtube remains uncertain, they've deleted their prank videos. we're told the family is scared because they say they've received threats. winehold said his job is to take their calls any time day or night and to reassure them he will do what he was hired to do. fox 5 local news. our region is getting much needed rain. looks like the

to be drenching us again tomorrow. let's check in with sue palka. i think a lot of people i talked to didn't mind the rain. it was the cool temperatures that was the problematic. >> good point. i'm showing you a headline that says april showers continue but the truth is the showers continue but feels more like early march. today's high temperatures only in the 50's. and those temperatures are really not going to budge much in the 24 to 36 hours. we're go going to show you part of that cool temperature regime is this wind direction in the 17 miles an hour in the district. that's keeping us socked in and also, gives that chilly feel to the air. so that's going to be the same deal again tomorrow. it's not going to change much. current temperature 55. i believe our high for the day was 57. we won't get much more than a few degrees cooler. than these temperatures overnight. but it is all about the rain, straight to radar, at the moment, we have a little bit of a lull in the precipitation but it's not

still getting a few showers around and drizzle. but as the night goes on, we're going to go see this really starting to fill in. and the reason this is kind of prolonged is the scenario of low pressure down over south carolina and cut off from the jet stream, having a slow time with not much wind to steer it. it will get closer to the north carolina coast and wednesday finally it's up along the midatlantic coast and that will begin the process of shutting down the rain. i wanted to show you as we look at futurecast. it has a good handle on the fact that the rain locally is light but watch what happens as i take this forward to 6:00, 7:00 tomorrow morning, here we go more widespread rain and maybe more drenching downpours that you see in the yellow and orange. extra time, take this out to the noon hour and some spots the rain is lighter. it continues to rain pretty heavily towards 95 and east, and we won't be quite done with it at 5:00. the commute for the evening looks like it will be a little less wet but it definitely

marina marraco is live tonight at college park with the latest. marina is the fire out yet? >> reporter: not quite, shawn, things here have definitely died down including that fire but you'll see here, crews still hard at work. there's at least three ladders from our vantage point that's not to say there's a couple more on the back side of this building, they will be here all night long into the morning. i just heard them say they're waiting for relief here at about 11:00. roughly 45 minutes some more crews will come in to relieve these crews on site. but the fire started as a two alarm fire and according to crews here, it appears to have started in a construction dumpster in one of the higher floors. now, because the interior of this apartment building was built with wood, that fire spreading incredibly fast and by 2:00 this afternoon, it was a five alarm fire with two specials, meaning you it was virtually off the scale more than 200 fire trucks out here from neighboring jurisdictions called in to assist and you'll see these skyfox pictures over the center t

building, this was apartment building set to open in the next month called fuse 47. you'll see the center courtyard. that made it really difficult for crews to get in and set up. especially on the back side of the building, where there was no room whatsoever for the ladders. the plume of smoke made the quality of the air oh so poor that at umd they cancelled classes after 1:00 this afternoon, seniors in a neighbors residential building were temporarily displaced and the adjacent section of route one was shut down for the majority of the day since the blaze started. the prince george's county acting fire chief says today's fiber was the county's largest fire in recent history. so much so that they had to use a chopper to help guide the boots on the ground to help fight it. take a listen. >> we did use the police helicopter air one that was able to get up and give us an

view where the video was stream into this vehicle, we got pretty good idea of what was burning as well as as well as some of the news helicopters as well. >> reporter: this man on your screen, this is 24 year-old trevon miller was arrested for flying a drone over the scene of the fire. his drone flying so close to the prince george's county police chopper, the pilot told investigators he had to evasive maneuvers to avoid colliding with that drone. now, the good news in all of this, there were very few injuries, just three to report. two firefighters, one with overexertion, another one who rolled his ankle and a third injury that was a resident who complained trouble breathing here. as for the apartment building, fuse 47, you can see behind me doesn't seem like anyone will be able to move in any time soon, esecially when it was set to open in the next month. no word yet from that apartment building management

live tonight in college park, marina marraco fox 5 local news. take a good look at this man, the fbi will try to get this picture back up they want to hear from you if you recognize him, one of two men suspected of robbing the driver of an armored truck late wednesday on 5th street northwest. investigators say the two men were carrying assault rival when is they approached the armored truck driver and demanded the bag he was carrying. turns out the bag was empty. the men took off in a car driven by a third person. the fbi is offering up to $5,000 for information leading to the suspect's arrest. it has taken nearly 100 days for the senate to confirm president trump's pick for agricultural secretary. they confirmed purdue for the post. he's an experienced politician with deal agricultural

other cabinet level nominees are still weighting, alexander accost today for secretary. >> i don't think anyone wants a shutdown. the president has been clear he doesn't want that. >> thousands >> developing, president trump appears to be backing off his demand to include border wall funding in the budget bill in order to prevent that government shutdown. during a meeting with members of conservative news outlets, he said he would be willing to resume talks to fund that wall later in september. congress now has until friday to pass the funding bill to keep the government open. the major sticking point include funding tax cuts and how to temporarily supplement obamacare. democrats have been up in arms over talks of funding this border wall. they warned for weeks now they would block any spending bill pthat included money for the wall. today, house and senate leaders said if the white house backed down from funding talks they would be able to meet the friday deadline

this is fox 5 local news at 10:30. and it is 10:30, i'm jim lokay >> i'm sarah simmons, first top story, a fox 5 exclusive. swat officers raid the home of a maryland family but it was all a mistake >> lindsey watts with the details. >> reporter: imagine sitting in your home and the swat team bursts in. looking for a suspect who happens to have your same name. a nightmare scenario and it's what happened to a montgomery county man. the door was damaged. israel was injured. he and his whole family were detained. the sheriff's office thought he was involved in a gun burglary when they were looking for somebody with his same name. the sheriff's office admits they did mess up. i'm told an investigation is now underway into how this happened. and the parents behind those controversial youtube videos where they pranked their kids now hiring a crisis communication firm >>

we got it. moving on to the rain. soggy day, we have another tomorrow. so everybody is ready for it and while the rain is a little lighter in many areas right now, it looks like it will just be a brief break or a lull in the activity because the storm system is moving closer to south carolina and it's going to crawl its way up to north carolina overnight. that will get

heavy rain. i wanted to show you radar.pnot moment. still damn and dreary. you can see these moving in from southwest to northeast. because these storms will be going to the coastal. you'll be able to see kind of the pin wheeling of the storm. that will be obvious on radar. tonight the heavier rain, you'll see this moving on into prince william's county and into fairfax and as we get closer to morning, heavy rain will also be pushing in our direction, there's the center of the storm down here near charleston, tomorrow it will work its way up closer to the outer banks and when it gets up to our latitude it cuts off from west to east. we could still use the rain, we had a moderate drought much of the area, i found it refreshing today and everything looked to green and gorgeous. it looks like we could pick up kind of r between tonight and tomorrow another inch in the rain bucket. which would be quite helpful. after that, we get
