henry sanchez. >> after a complete and thorough assessment, our duty is to determine whether sufficient evidence exists to support criminal violations in violation of maryland law regardless of public opinion or political pressure. >> reporter: mccarthy said the decision was made due to a lack of corroboration. substantial inconsistencies and a review of footage from school security cameras, witness interviews and text messages exchanged between the girl and the defendants. but now those explicit text photo and video messages are leading to child pornography charges against both defendants. something montano's attorney calls outrageous. >> she was the one that took footage of hashes, video and pictures, nude pictures and also video. and she sent these r these to mr. montano. >> reporter: there are questions about whether the teens will be deported

deported right away. >> reporter: now, initially the judge ordered mr. montano to be released immediately but because of these new child pornography charges we're told he's being detained until monday which is his next hearing and they will decide then what happens next. as far as mr. sanchez, the other defendant, his next scheduled court hearing is on friday. reporting live in rockville, alexandria hoff, fox 5 local news >> shortly after we learned the charges had been dropped, we sat down with superintendent jim smith to talk about this development. since the incident at rockville high, he has launched a county wide review of safety and protocol procedures >> we've completed six high schools and we're using internal and external to do the reviews with the principal and staff. and we'll continue those, we'll complete all 25 by the end of may. all

a regular school building. immigration officials are speaking out following the arrest of a youth soccer player in montgomery county who was charged with sexually abusing one of his players. police arrested miguel floor rears on monday night, accused of having inappropriate contact with a local girl during practice. the girl is age nine, officials with immigration and customs african released a statement that says in part u.s. immigration and customs lodged an immigration detainer against a 47-year-old citizen on may 4th with the montgomery county detention center after arrested on local when immigration officials have probable cause to believe in alien is removable from the united states. a protest is happening at american university.

public will now be able to see police worn body footage introduced as evidence in a court of law. he didn't want to be on the wrong side of a common sense interpretation of the law. >> our interest in the videos came last summer when a defense attorney told us prosecutors were using body camera video in court to conflict drink drivers. and in his opinion, they were game changers, meaning, the old way of take indication to court was over. and the judge could see exactly how a defendant was behaving. but when we asked to see the videos, attorney general carl racine said we we don't have to get them from the dc police department. the statute as written he says says so. and so we asked. and this is what we received. redacted videos that obscured faces in conversations in effect nothing close to the way they were presented in court. our stories caught the attention of the dc open government coalition, which sent this three-page letter to carl r

the investigation start to do two years ago when a bank investigator in fairfax county reported that a group of at least a dozen people were intentionally writing checks from accounts with no available funds. investigator it's also found the group was building up bank credit through numerous deposits and withdrawals in a short period of time. police say the suspects committed these acts at nine banks in fairfax county county. >> we have seen thousands of dollars, thousands of cartons of cigarettes, we have seen vehicles and things. however, the source of where the money is going is still currently investigation >> the suspects were using addresses in both northern virginia and richmond, they were operating a cigarette tax fraud and smuggling ring >> a st. louis jury awarded a virginia woman more than $110 million in a baby powder lawsuit. it a

failed to disclose the cancer risk associate wanted i baby powder. the 62-year-old woman was diagnosed in 2012. they concealed that talc and baby products had can cause cancer, they plan to appeal the verdict. uber is at the center of an investigation by the justice department. they're looking into the company's use of secret software used to avoid authorities where its ride hailing service. it's known as gray ball. it identifies blocks rides to transportation regulators posing as uber customers. they claim the program was created to check ride requests to prevent fraud and safeguard drivers 18 members of a fraternity in penn state are facing serious charges. this comes three months after a student died after the pledging process. police say 19-year-old tot

we're told the driver of one of the cars suffered critical injuries and later died at the hospital. an outpouring of love and support for a fallen delaware state trooper a procession carrying the cassette of 32-year-old corporal stephen ballard went through wilmington. he was shot and killed while investigating a suspicious vehicle at a convenience store. his attacker was later shot and killed by police. fox 5 is continuing to monitor the custody fight involving a frederick maryland couple who posted controversial youtube videos of their kids. we told you about the daddyo 5 videos. they show them pulling prank that left their five kids in tears. protective services got involved after people watching the videos reported the couple for child abuse. then two children were removed from the home after a judge granted temporary custody to their biological mother. fox 5's lindsay watts is foow

she will give us an update. a chilling crime caught on tape in new york city. a tourist from germany was robbed and sexual assaulted early yesterday morning. tonight, police have released images of the man they're looking for plus video of the brutal attack. investigators say a man approached the 31-year-old woman and demanded her purse. the man punches her and knocks her to the ground continue to punch her and sexual assaults her. the woman is recovering. a dramatic scene in montgomery county when a car crash i do not the front of a home. it happened just this afternoon on ingram terrace in silver springs. police say the driver jumped the curb, crashed into flower pots, and landed on the front steps, luckily no one was hurt. and the house, well, it wasn't too badly damaged. let's get a check of the weather. gwen tolbert with more on what has been a very
