>> gators are questioning him to learn more information. >> so far charges have been filed against a driver who'll struck and killed a six-year-old boy in southeast. xavier lucky was attempting to cross livingston road when he was hit last night. fox5 has learned it happened on the little boy's birthday. >> police say the driver initially left the scene but returned after calling 911. fox5's paul wagner joins us live from the scene tonight with more on the story. paul. >> reporter: yeah, hey, guys, we have not learned much about the driver at this point. we've asked mpd a number of

questions fifty via e-mail. no charges have been filed. police want to conduct an investigation first. around 8:30 last night little xavier lucky six years old as you mentioned on his birthday was trying to cross livingston road here apparently attempting to get over to that playground right across the street in oxon run park. let's show you some video from last night. the section of the road where xavier lucky lost his life curves to the right for northbound traffic and runs along a stretch of three story apartment buildings. police say xavier was attempting to cross the road when the unnamed driver struck him and kept on going. it was just after 8:30 in the twilight hours. there are no speed bumps and there are no crosswalks that would assist pedestrians waiting to get across to the park and the

xavier lucky was in kindergarten at henle elementary where according to a letter sent home to parents he was remembered as a "sensitive boy who had many friends at school." his teachers appreciated the effort he made upon his schoolwork and his cooperative nature in working with others. shannon smith was down the street when she heard the collision. >> i heard a boom. and i heard a holler. somebody hollered. said you hit that child, you hit that child. i don't even know at that time because he was in a truck and xavier was so small i don't think he really knew he hit him and i think that's why he continued until he realized what really happened. we've been complaining about this a long time. marion barry did have one when he was the mayor. as time went on you see they keep constantly messing with the streets so no on

there isn't a crosswalk and it should be one. >> reporter: now, this is a memorial that is slowly been growing as the day has gone on here. a couple people were just here a minute ago adding some balloons and they have planned now a 7 o'clock vigil here for xavier lucky. again, to reiterate no charges yet for that driver. again, it's pretty standard these days for an investigation to go on for quite some time and the police to come to a conclusion before they file any charges. we don't know anything about the driver at this point. live in southeast, paul wagner, fox5 local news. >> to charles county now where six suspects are charged in connection with the fatal shooting of a waldorf man. police say 35-year-old samuel jemeni was shot on tuesday inside his apartment. investigators say the shooting happened during a dispute about property. six suspects including two females were

they face armed robbery home invasion and murder charges. >> take a good look at this surveillance video. d.c. police need your help finding two people of 90 a burglary. it happened last wednesday at a business in the 200 block of kennedy street northwest. police say the suspect forced open the door, stole an atm machine and then took off. if you recognize the suspects or their clothing, call police. >> a virginia woman who is an undocumented immigrant is now being detained by ice and it's causing quite a controversy. >> civil rights organizations are banding together to try to step in to help the local mother of two. fox5's alexandria limon is live in fairfax with the latest developments. alex. >> reporter: and in fact, there is now a protest here involving several dozen people. it's happening right across the street from the ice offices here in fairfax and these people community members activists are here to support that virginia woman who was detained and is now being processed for

among them are her two young children and her husband who came here with a message. [speaking foreign language] >> reporter: now, he only speaks spanish but he says this is incredibly difficult for their family because he says she isn't a criminal. she's a good person and he doesn't understand why she's being deported. 30-year-old ileana cruise mendez arrived at the ice washington field office in fairfax with her two kids thursday morning for a regularly scheduled check she dh them. according to organizations like casa and peco national network that held press conferences to support her, she was detained by ice and transferred to woodbridge where she's being processed for deportation. even though she has no criminal background only a traffic violation according t

>> they are distraught. they have two young children. the father right now is going to the house -- i mean to the school to let the children know he's going to pick them up early and let them know that, you know, what has happened so, everybody's very distraught and we're concerned for her and we're hoping that she's reunited with her family tonight. >> reporter: all of this comes on the heels of new numbers released by ice that show a nearly 40 percent increase in deportations during trump's first 100 days in office compared to the same period in 2016. according to ice, those people are known or suspected of being in the country illegally. the report says that 75 percent of those arrested had criminal offenses ranging from homicides to drug charges. but it also points to data that shows ice arrests of people with no criminal records jumped nearly 150 percent from 4200 in 2016 to 10,800

the arrests of cruz mendez in virginia falls into that category. >> what they're doing is targeting people just like ileana, they're targeting long term residents, they're targeting people that are not a danger to the community. >> reporter: now, i also did reach out to ice to ask them nor a comment about why this woman specifically is being detained and processed for deportation. they have not gotten back to me but her attorneys who are here today tell me they were told it's because she filed for refugee status and was denied and then filed an appeal and that, too, was denied. however, they say they have other clients who have also filed for those protections and were not deported when they came for their regularly scheduled check. so, again, it's unclear why this person is being detained and possibly deported. reporting live in fairfax, alexandria limon, fox5 local news. >> a community meeting will be held tonight to consider

general's name from a high school in virginia. the controversy surrounds jeb stuart high school in falls church. tonight's event will include presentations for people both for and against the move. a watchdog group claims they have e-mails that contain discussions between school board members about changing the name of the school. a name change would ultimately cost taxpayers $1 million. coming up, who says kids play dates can't be fun for parents, too. >> a new beer garden where kids can play and parents can drink is coming to the district. hey, matt. >> hi, guys, a lot of people are talking about this one today but right off of 14th street this car lot, well, if the beer garden gets their plans approved p-it will be placed here and it's also going to have something a little special as you were saying, a place for the kids to play. we'll have reaction to this. also, some neighbors are not too happy about this new beer garden going in. we'll have more on that coming up. >> and it's one of the hottest toys on the market

there's a very pleasant breeze out here and that breeze is out of the south obviously a very hot direction for this time of year. but what is also -- what it's also doing is keeping the temperature at reagan national from getting as high as it did yesterday. more on the temperatures in a moment. we also want to alert you to the fact that in the heat and humidity that we've had now here in day two, a few stronger thunderstorms have developed and we've been watching one for awhile now and you can see it right along interstate 70 as well as the second one along interstate three corridor. so far they're not severe but i'll say this as you look up towards damascus and it just moved through buckeystown south of frederick this likely has quite a bit of heavy rain, could have hail that could be about a half inch in size. it's moving east at about 30 miles an hour. and you can see some of the cities that may be affected by this including mount airy here, just about now, lisbon at 5:23 to elders berg carol

high lands. that will bring you some cooling relief that's for sure and the other storm we're watching out toward the winchester area that's going to be moving into loudoun county so steven city getting some of that with the heaviest rain and obviously they have some lightning with it. typical garden variety summer storms although they are a little bit on the strong side so we'll watch them to see if anything changes with that. now, back on to our temperature story. because of the south wind reagan national at 87, not sure we hit 90 there today. we certainly did in many other locations but winchester is now rain cooled at 79. hagerstown 91. here's your evening planner so you have an idea of what we're looking forward to for the rest of the evening. maybe a pop-up thunderstorm but fairly isolated, 84 degrees at 7 o'clock. by 9 o'clock about 81 and by 11 o'clock, 78. aren't the big headline -- and the big headline for tomorrow, one more hot day, could even be a little bit hotter than today because the wind direction will be out of the west and there will likely be a few more storms around as tomorrow a frontal boundary is going to approach and a couple of t

>> ♪ >> this is fox5 local news at 5:00. >> here's a look at more of the top stories now. police arrested two suspects in connection to a new carrolton man. police say eric hernandez martinez and josé campos are accused of killing juan heinz. an autopsy revealed ponce died from trauma to his body. no word on the motive. the suspects are charged with first and second degree murder. >> the man shot by two arlington county police officers during an attempted traffic stop has died. we also learned there was a warrant for his arrest. authorities say officers tried to pull over 28-year-old daniel boke on 395 at the glebe road exit yesterday afternoon. as they walked to the suspect's car the driver reportedly hit one of the officers with his vehicle. the officers then opened fire.

committee. four panels now up on capitol hill have made that request. all after the same thing, answers about whether or not comey was fired as fbi director by president trump in an effort to shut down at the fbi's investigation of possible connections between the trump campaign and the russian government. now, this we do know. after months of political battles over this issue there was a rare sign of bipartisanship on capitol hill today, both democratic and republican leaders voicing a similar message. let robert mueller do his job and let the process play out. >> as i said before, i believe that the professionals in the justice department need to do their jobs independently objectively and thoroughly and i believe that the special counsel, which is robert mueller now, helps them do that. >> i think that the selection of bob mulle

choice. he's got a record of being independent. he's sorted bipartisan. that's good news but in no way does that slow down our investigation. we're full steam ahead. we actually have different goals. he's investigating criminal -- possible criminal prosecution. we are trying to, you know, ascertain facts. >> reporter: now, this all came on a momentous day, the entire u.s. senate was briefed by this man today, u.s. assistant attorney general rod rosenstein. now, as you know rosenstein is the man hoop hired robert mueller as special counsel. it was also rod rosenstein who was used by president trump as one of the reasons that he fired jim comey after a letter that rosenstein had written critiquing comey's handling of the hillary clinton e-mail investigation. now, sources at fox5 have spoken to who have directly spoken to ross sen stein tells us he was furious over t

at one point considered resigning officers himself later decided to stay put and then yesterday naming robert mueller here the former 12-year fbi director as the special counsel that will now handle this russia investigation. now, the way this will work is mueller is going to be looking into whether or not there were any connections between the russian government and the trump campaign. and whether or not any federal laws were broken. so far 17 u.s. intelligence agencies have determined that russia did try to influence the 2016 election. and in the short term analysts say mueller might be the right man at the right time for the job. >> he has been very emphatic for years about the fbi's independence, its neutrality. he hadly hadly -- he is

little something cruising across in the upper levels of the atmosphere and you get this heat and humidity and just like that i'll tell was we'll end up with some thunderstorms. look, i just saw if sue is listening to me, we just -- i see we just have a new warning here. i tell you what, i can do this. we got a new warning, thunderstorm warning in nornorthern sections, we'll let sue take care of this. show on the radar if you can. max three will do it. this storm just blossomed in northern connections of carl role county. westminster is right there. this is up towards the northern sections of that. all of this moving to the east now and most of this activity has been 15, 20, 30 miles per hour and it has been producing some pretty good wind. has been easily up over 40 miles per hour with these storms. another strong storm right here around germantown, too, is coming on through. now, this one has a lot of lightning. it's headed right into laytonsville now and look at all the reds underneath the lightning. that's indicative of very, very

a history this evening that some of these storms tracking to the east at about 30 miles per hour have produced some hail up to penny size, okay, so there is that possibility. this one heads to brookeville about 5:51, brighton here, dayton and clarksville by about 6:01. again, this is all tracking trag off to the east 20 to 30 miles per hour. big picture shows you where the activity is coming on. it's scattered mainly to the north and west. i'll blow through this because i already had it set up. winchester this storm has already passed east of you. i know there's still a lot of lightning. this is headed towards and across i-81 and it's gotten mostly east of i-81 now. it will cross over the higher elevations heading into purcellville and loudoun county so we'll continue to watch these storms. again, mostly as they're headed off to the east at about 25 to 30 miles per hour and there is the severe thunderstorm warning again for northern sections of carroll county. we'll get you the update on that. no doubt probably extends until about 6:00 or

probably 6:30. we've cooled a little bit. most locations were over 90 degrees. not for national. cooled by the south wind coming across the river. some scattered thunderstorms at 7 o'clock. we're dry at 9:00 maybe a lingering shower to the east of us. temperatures will be cooling down into the 70's went stay very mild overnight tonight. lower 70's for lows here in town. maybe a few mid to upper 60's north and west and tomorrow we do it one more time with temperatures upper 80's and lower 90's. winds will be out of the west tomorrow, okay, so in advance of more thunderstorms tomorrow afternoon, westerly winds should warm us all up into the upper 80's to at least 90 to 91 degrees or so. fredericksburg is 91 tomorrow t-culpeper 90 degrees, winchester 86 and keep in mind tomorrow afternoon and tomorrow evening, we will be under a marginal risk of severe weather. we could have again tomorrow more showers, more thunderstorms, some with -- i think even a

of something severe. we'll be out in front of a fairly strong frontal system which will cool us off for the weekend. dry tomorrow morning to start things off. temperatures very mild even warm quickly. 88 or so to 91 for a high and then we'll develop these thunderstorms later in the afternoon. your seven-day forecast looks like this. look how much cooler for the weekend. we'll only be in the middle 70's so much, much cool earl cor saturday and sunday. no more heat waves. we break the heat wave tomorrow. that's good news. we'll stay on the thunderstorms too this evening, guys. >> all right, leggett to breaking news right now that we are following. there is a bus crash that has been reported. this is in temple hills. what we're hearing right now from first responders is that it was a bus versus a car, that the driver or at least the occupant of the car we understand did not survive. there are no injuries reported on the bus. at this point we don't know if we're dealing with a
