in addition to the part you just mentioned there is going to be a section tomorrow which comey is going to explain a phone call that allegedly went from the president to james comey in which he will tell senators that he wanted to quote lift the crowd regarding the investigation surrounding former nsa official mike flynn. now, while this was coming out today, of course, the senate intelligence hearing was going o. the white house taking no opportunity to let this go, reading comey's statement. the president's personal lawyer, who's going to be handling the white house's defense on all of this issuing a statement today saying that, quote, the president felt completely vindicated by what was released in james comey's prepared statements. however, keep in mind these are his opening prepared statements. the white house lawyer took a very select section of that

in which the new jersey republican was accused of penalizing, a new jersey mayor for not supporting him during a gubernatorial election. there were criminal charges in that, christie was not one of those people but he did seek counsel. the reaction on this, i will tell you quickly, has been mostly positive from both democrats and republicans. had this been a partisan, had this been somebody from the political world, well, you probably would have seen a lot more push-back on this, this is somebody who knows justice department, this is somebody who is worked with both james comey and robert mueller. in too soon and too quick to say given the environment we are in right now, what his chances of confirmation are going to be, given the environment we're in here, but so far, the early signs have been receptive from both democrats and republicans up here on capitol. >> we know that. but we're all going to see

president was asking for loyalty and demanding loyalty. when you look at that, is there anything really legally damaging about something like that? what is is the most, you know, i guess, heat the part of this testimony that we expect that could be legally damaging >> the loyalty piece or lit nus as i would say is not that damaging in and of itself from a criminal standpoint or obstruction of justice standpoint, but when you put that in play with him wanting to remove the cloud, with him wanting the fbi director to walk away from the flynn investigation and the context upon which he asked these things, at one point, he put everyone out of a briefing meeting and said he wanted to talk to james comey alone and doing that meeting that's when he said that he wanted, can't we do something about flynn? he's a good guy, can't we make him go away? i got to tell you, that's intent, it may not be corruptible intent unders

obstruction of justice, but you got a witness, facts and something almost as good as tape, notes taken when the conversations took place, lawyers do this all time. whether they're public or private sector, while it may not be the white house tapes, this is a good as it gets if it holds up under cross-examination, this is a big important building block to obstruction of justice >> let's be honest here in dc going to have 50% of the people who support the president and say not big deal. he said he wasn't under investigation. game over. then you're going to have 50% democrats out there saying smoking gun. do you really expect minds to be changed that may tip that 51-41 one way or another? >> i think as we go through the building blocks as the investigation runs its course, may be. remember, impeachment is a political process. it's not a criminal process. and until the republicans decide they've got -- they can't afford trump in the layer, if you will, then they're not -- nothing will happen
6:40 pm
but watch the criminal investigation, because obstruction of justice is one thing. you can try to obstruct justice and be guideline of it. you don't have to complete it if you will. and you couple that with the public statements made by donald trump on nbc as well as the other public statements he's made and building a pretty good case for that. but look at the other elements, does flynn get immunity or not? are there any other witnesses targets or subjects? we got to let it unfold and ultimately the end of the report will either include obstruction of justice or recommendation of charges against others in the trump administration >> it will be interesting no matter what. >> it will be. >> on the edge of these seats, scott criminal defense attorney thanks so much for coming in tonight. >> thank you. >> a and a beautiful suit. >> i wore this the day before i was invited. >> good seeing you fox 5 will complete coverage of the testimony tomorrow, the broadcast live right here on fox 5 starting at 10:00 tomorrow, if you can't be near
