stepping in. a ruling on the controversy travel ban. the partial win for president trump tonight, and what comes next following the major decision. fox 5 news at 10:00 starts now. thanks for joining us, i'm sarah simmons >> i'm tony perkins. a painful morning commute. not because of train delays. transit police used pepper spray to stop a suspect inside the gallery place metro station and that caused riders to cough, suffer eyes and more >> they were forced to use the chemicals after the suspect became combative. but passengers say they were caught in the line of fire. angelie hemphill is live with more. >> reporter: this incidents happened near one of the entrances to gallery place, where metro says the suspect tried to enter the station without paying, but some question if police put others in danger

his arrest. >> a concering scene for rush hour metro riders monday morning as they came upon four metro police officers restraining a man lying on the ground. metro police say just before 8:30, a man tried to enter gallery place metro without paying. after failing to follow officers' instructions, police say he became combative. and officers used pepper spray to subdue him. but some riders tell fox 5 the pepper spray was deployed more than once. filling the station like a thick fog. causing many passengers to struggle for air. >> i think there was definitely a better way to handle that. not pepper spray. since there's no circulation. >> reporter: one man e-mailed fox 5, quote, the gas, of course, went everybody causing

as a result of the contaminated air. large clouds are waiting leading to longer exposure. they were coughing, sneezing and eyes watering. the cell phone video even shows the police officers rubbing their eyes from the exposure. meanwhile, some metro riders think the situation could have been handled differently to keep everyone safer >> they're unbelievable odds in the era of terrorism but what you just described, jumping a turnstile, that doesn't warrant pepper spray >> they got to do what they got to do. you don't know, it could be crazy and he could put everybody's life in danger. you don't know what he's going to do >> what's the alternative? >> reporter: metro says they did not receive any customer complaints about being exposed to the pepper spray. they also say that suspect was not hurt. it's unclear if he's facing any charges. live in china

hemphill, fox 5 local news. fox 5 is getting results in an investigation you saw first on fox. our exclusive story filled with allegations of fraud and corruption in prince george's county schools and tonight, maryland governor larry hogan is calling for a state investigation. earlier, he spoke with fox 5 lindsey watts. >> reporter: the biggest news, he says he wants to see outside independent investigators looking into this. so that would go beyond any investigation by the maryland state department of education. the govern says that he has not seen any evidence of this alleged grade fixing and fraud in prince george's county schools. but he says he's getting requests after requests from people who are calling for an investigation. he says he's very concerned. >> we keep hearing all of this out cry. we haven't seen any evidence. but when there's smoke

awful lot of smoke, we just want to find out if there's fire. >> reporter: govern hogan wrote a letter to the state board of education requesting a thorough exhaustive investigation. the state board did not make a decision on next step. expecting more from the board and potentially a decision tomorrow. we asked govern hogan about a prior investigation by the state department of ed in the same claims. the state investigator talked to the school ceo and four people the ceo recommended in in case. >> we just found out there was this so-called investigation. it wasn't acceptable to other people and it wasn't acceptable to his. that's why we've asked instead to have the actual state board of education themselves, which is a body that oversees the school system and responsible for oversight, for them to conduct the investigation and to do a complete and thorough one that gets to all the facts. we'll let the state brd

education. in samples breezy, lindsey watts. metro riders are expressing outrage. they're pushing montgomery county leaders to call for the restoration of metro rail and bus service. the committee for transit said metro users are being negatively impacted. the montgomery county council sending a letter to the state asking for more transportation funds. but it doesn't mention restoring metrobus and rail service cuts that went into effect yesterday. >> before this week, the red line came six minutes or three minutes if you live between silver spring and grovner and now it's eight minutes, may not seem like a big difference, but the difference between, you know, a couple of extra minutes on the platform can mean crowds, waits, fewer seats on the train and much reduced quality of the commuter liability. >> the county council is scheduled to vote on transportation policies

tomorrow. now that the supreme court has weighed in the state department says it will start implementing a limited version of president trump's travel ban this week. that means travelers from six middle eastern countries are banned from entering the united states 90 days unless they have a credible relationship with someone here. the high court says it will take up the controversial case next fall. we get the latest from fox's doug mckel way >> the travel ban meaning as a whole with no break down on how the justices voted is a stinging blow to lower court rulings. the ban from syria, sedan, somalia will temporarily go into effect while the court agreeing to hear the issues surrounding the ban in its next term in october >> a huge victory for the white house, this case will now be argued again on the merits fully the first week of october. yet a decision some time in maybe december or january. but i exp
