the gift shop. his wife was the assistant manager. he was there to pick her up. he had his baby on his shoulders when this man who had already been told to leave the store once came back and caused trouble again. the little girl on her father's shoulder was taking a nap when the man in the white t-shirt and backward baseball cap takes a swing and then another and another and another. the little glare taking a glancing blow according do her father. i don't know what pushed him to go that far, especially with my baby sleeping on ply shoulder. the man who was struck agreed to tell his story along as we did not use his name. he said it was around 26789. thirty in the afternoon the man in the t-shirt allegedly attempted to steel something from the store and was asked to leave. another ten minutes later he was back calling people names, the victim 's wife is the store

security. that's when i stepped in and asked him to leave and then he proceeded to call me names and my daughter names and then he pulled out his phone to record us so i lightly pushed his phone out of my face. that's i guess his temper got out of hand and he just started whaling on both my daughter and i. he went into a rage. >> exactly glt victim says the man in his early 20s has a tattoo on his shoulder and was over six feet tall. fairfax county police have confirmed the basic facts of the assault. they said they were called to the scene. security was called to the scene. there was an ambulance called out here as well. they're hoping someone might recognize this man and get in touch with the police. you can call nem at 703-691- 2131 or another number on your screen now, 1866-411 tips. if you recollect myself that man, he was also with another person

perhaps someone might have recognized that man as well. live at fair oaks mall, paul wagner, fox5 local news. >> we have a big development tonight on a story you saw first on fox5. allegations of corruption in prince george's county public schools. today the maryland state board of education voted for a third- party investigation into these allegations. fox5 was first to tell you about claims of grade fixing and other fraud to boost the high school graduation rate. fox5's lindsay watts broke the story for us. she jiens us lie in baltimore where the state board of education met this afternoon. lindsay, what did they have to say. >>reporter: sarah, this is definitely big news from here in baltimore. it was a unanimous vote today to bring in outside, independent investigators to get to the bottom of what's been alleged in prince george's county schools. just today school ceo dr. kevin maxwell joined the calls for an investigation into his school system. it'she

has asked for that. his letter to the board was read before the vote. this letter is to serve as a request for a followup investigation by the maryland state department of education into allegations regarding the prince george's county public schools, high school graduation rates since my arrival. and that was just part of the letter . maxwell went onto say that he denies that he or anybody working for him is promoting students in order to inflate the graduation rate. four prince george's county brothered members contacted the governor saying they have evidence that in the last few years hundreds of students have graduated without meeting state requirements. they call it wide -spread systemic corruption. what they were asking for is an investigation like the one that was voted on today. we talked to the president of the state board of ed asking him when will this get underway? will it be

chief of staff in attendance. tonight they'll meet with president trump trying to figure out the senate majority leader sounded in an optimistic tone saying a better version of this billion would finally emerge from this current defeat. legislation of h this complexity almost always takes licensinger than anybody else would hope, but we're going to press on. we think the status quo is un sustainable for all the obvious reasons we've discussed over and over and over again. now to be clear, this billion which would have roled back much of obamacare had been in trouble since the start on the very day it was announced five republican senators came out in opposition to it. more joined in as the days went on. and this vote drew closer. be clear, the nail in the

congressional budget office report that scored this billion financially. it found that the senate version of the obamacare repeal would have left 22 million americans without health insurance at all. now, for democrats today, there was no spiking of the football on this. democrats from time cane of virginia to chris van holland of maryland and speaking to fox5 they say this moment they now hope will allow republicans to bring them into this process to finally once and for all address the serious problems that obamacare does have. i am again , if the process is bad, if you haven't had hearings to hear from the public, if you say we're only going to allow one party to participate and you only have 52 republican votes it's going to be hard to get there. if they want to, you know, solve problems rather than create more problems they'll allow the american public and they'll allow the democrats to participate in the discussion.

told police they gave the suspects $20,000 in exchange for gold which later turned out to be fake. the second time it happened earlier this month at a res trant in gaithersburg. the two men were talking to woman about the gold. fortunately, though, she figured out it was a scam before she handed over her money. they speak man darin, they target other individuals of chinese desent. it's a way for them to be close to the victim and say we have something in common. you're from china, i'm from china. i'm just a construction worker. i need help. exchanging h this gold i found into money so i can take it back to my family. police say this type of scam usually starts with them calling the victim from a number originating from china. there's currently a warrant out for their arrest. they were both previously charg ed in fairfax county for committing the same crime. getting ill

have a no chase policy. >> it is a first for the district starting today driver's license applications have a new option. people can check off to identify their sex. when the olympics asks you to identify as a man or a woman you can now mark box x to show that you are gender neutral. they say this is a big step april they applaud the district for its ground breaking move. that's really important for me because i identify as non binary which means that i am neither a man nora woman. h this new x gender marker is really important for people like me because it means that we are going to get license s that are more accurate to who we are. >> the mayor says the city has been a leader in lgtbq rights and general der issues and says the change is the latest example of that. >> let's take a live look outside right now in what has& been a beautiful day. it was difficult to come

much longer. we have a disturbance that's been passing on through. it's associating with the spin up through pennsylvania. we were kind of expecting a little bit of that to develop. but it should not last too long. it has done a good job of cooling off the temperatures again. it was already a beautiful day, but once the showers moved through the district we dropped from 82 to 78-degrees around 5:00. seventy-seven in gates but, dulles 80-degrees, 82 for manassas, but the best part of all once again even with these showers it's still a really comfortable night in terms of humidity with our current dewpoints in the 40s to near 50 that is unbelievable for june 27 . that is for sure. heading out to the baseball game tonight. maybe we'll have better luck against the cubs. if you are going i would say maybe an isolated shower in an early inning that would be it. the first pitch

>> they're shooting. that's shooting. wow, this was caught on camera as you can see right here. i was fireworks mistaken for gunshots. a group of young teens started in northwest d.c. chasing each other in the street . next you see one of the kids race their arm towards the other and then pow. a neighbor resident cap urd t the whole thing on camera. turns out the kids were playing with fireworks pointing them at each other. similar to how you would use a gun. this is one of the dangers associated with fireworks especially this time of year. the consumer safety commission was out on the national mall warning people about the dangers associated with fireworks the agency set off a series of dramatic fire work explosions to

get injured or even killed by fireworks. the commission offered up these fire work safety tips. they say you should never allow children to play with fireworks, never try to light them or pick up fireworks that fail to ignite. keep a bucket of water nearby and to always make sure to light fireworks one at a time. move back quickly. make sure the fireworks you purchase of course are legal in your area. the injury report for 2016 as a result of fireworks occurred in 2016 and unfortunately four deaths as well. the report for this year, the 2016 report was among the highest, not the highest, but among the highest so there seems to be a bit of an up tick. again, the consumer being mindful of the safety tips that we've given and the safety steps to take. according to the consumer product safety commission more than 50 percent of people injured by fireworks

percent injured their hands and fingers. as we approach the fourth of july holiday many of you wondering if you can catch the fireworks much there's a lot of places you can. the capital fourth festivities. that fireworks show will start around 9 p.m. at night. pu want to avoid the national mall crowds which is probably a good idea you can head onto virginia. alexandria will hold its sill braition on july 8 from 6 p.m. to 10 p.m. along the potomac river waterfront. reston will have a fire work show this saturday that starts at nine:15 and industry vienna's fireworks kickoff at nine:30 p.m. at south side park. here in maryland, annapolis will hold a parade at nine:15 p.m. p. bowie's independent day celebration will be held at the prince george's county stadium. the fireworks show will follow the bowie bay socks game which starts at six: 55 and in tacoma park a

>> this is fox5 local news the at five. more of your top stor ies now, police investigat ing a deadly overnight accident in prince george's county. it happened just before 2:00 this morning on silver hill rode near pennsylvania avenue in district heights. police say one person was killed when their vehicle hit a utility pole, flipped on its side and it caught on fire. no word yet on the identity of that victim. and take a look at this video of d.c. firefighters using an aerial tower to rescue a worker in in distress. fire officials say the man became trapped after the scaffold he was working on suddenly collapsed. it happened this morning at a building on the 2200 block of northest. it was held in place until firefighters arrived an update on the deadly apartment fire in

early saturday porng. investigators are still trying to figure out what caused it. the body of a man was found at a third floor unit which is believed to be where that fire started. hundreds of people were forced out of their homes. some even had to jump from windows to escape. three famil ies from capital city push charter school were victims of the fire. so far they've raised more than $6,000. we want to take you to some breaking news now. sky fox over the scene, on the beltway, the inner loop where we have three lanes that are blocked, major delays as you can imagine on the beltway. there is a disabled truck that's leaking full. again, this is the inner loop of 495 just before river road. hazmat crews are on the scene as you can see be a messy rush hour, 495 three lanes blocked inner loop just before rer

build a great wall along the southern border. the border is soft and weak, drugs are pouring in and i'm i'm not going to let that happen. after spending billions of dollars to defending other people's borders we are finally going to defense our borders. the wall gets built, 100 percent. you remember it was one of president trump's biggest campaign promises to build a big bold wall on the border with mexico and have mexico pay for it. where does that wall stand now? here's an update for you. officials with us customs and border protection say they are ready to begin building prototypes for the proposed wall. the price tag $20 million just to build the prototypes. up to ate designs will be constructed in sand daig on. a final design will event eventually be chosen. but it's unclear when the

place. the overall cost for the project about $1.8 billion. here in the district where several years ago city residents voted to decriminalize marijuana possession, people can grow, possess and share weed with each other but it's still a crime to illegally sell and distribute pot in the city. police say they're stepping up their enforcement. last year they busted 220 people for pto distribution. that's more than double the arrests made in 2013, the year before pot became legal in the city. as of april they've made 78 arrests so it's possible the overall number for pot distribution will be higher than last year. montgomery county public schools will spend more, $1.5 million to improve school security. the school board talked about the plans at its meeting last night for 22 high schools. the improvements are coming to the school this summer. >> coming up, the family of an

>> the family of an african-american man shot and killed by a white police officer in louisiana last year is still seeking justice. all ton sterling's family filed a wrong ful death lawsuit. they say the shooting violated sterling's civil rights and fit a pattern of excessive force

racism within the police department. we also filed what's called a survival, which we believe those last three shots were excessive and they caused mr. sterling to suffer and there is than the code the ability to bring a survival action and so on behalf of the children we're also seeking damages for the time that he suffered before he passed. sterling was shot six times. the justice department decided not to pursue criminal charges against the officers but the state attorney general in louisiana is still taking a look at the case. dozens of subway riders in new york city are recovering from a hair owing experience, it happened durpg the morning commute, the subway train was just feet from arriving at a station near harlem when suddenly the emergency brake turned on. the train lurched back and foshed and two of the ate cars derailed . a

really poured in a few areas this afternoon and evening and here's why we have these couple of showers around. there's a weak front coming through. it will cross the area really soon if it isn't already just about through. still producing comfortable temperatures low humidity, but just squeezing out enough moisture for some of these showers and storms mainly down to the south. a check of radar right new and you can really see we're drying out pretty nicely for those of you who are trying to get out on the nats, a very slight chance that you'll see anything at all. down to charles county we find a couple of weakening showers as i put everything in motion. the trend is for everything to keep moving away. lighter hours through charles county now. heavier stuff down to the northern neck to st. george island and off the tip of saint maries county there. a little l disturbance and for most of the rest of the night if there are some clouds out there they're going to slowly decrease and it's going to be another beautiful evening. i'll
