actually video evidence, video of lieutenant collins being attacked back on may 20th. but so far prosecutors haven't been able to determine if collins was attacked because of his race. but they're not done investigating and are still searching digital devices from the alleged killer trying to make that determination.etermin. says the alleged killer, sean urbanski was a member of a racist group on facebook. the state's attorney made it clear today that her work is not done as she tries to find out if hate was a motive. >> developing a motive is always a challenging aspect of a case and in this case and in every other case you can't get it wrong. it is, we believe the best that we can do to make sure that we are thorough. the most difficult part of any investigation is der

depends on who you ask and montgomery county states attorney says yes. >> john mccarthy shared his mounting frustrations with us here on fox5 this morning. >> under federal criteria right now if i said i was a member of ms-13, i admitted i was a member of ms-13, that is not sufficient under most criteria to certify you and put you into the database as a member of ms-13 even though you've told me you were a member of ms-13. we need a new statute to make it easier for us to target the leadership in these gangs. >> this is no doubt a nationwide problem. fox5's tisha lewis is here with more on the story. >> hi, jim, sarah. mccarthy did point out montgomery county has jumped from less than one gang related homicide to 18 in the last two years. a spike that's hard to ignore yet prosecutors say their hands are tied when it comes to convicted gang members thanks to complicated crit criteria. for example, for police and validating a gang member is

but two or more of the criteria listed here including self admission a reliable source says that that person, confirms that that person is in the gang, also a source of unproven liability says that that person is in the gang according to montgomery county. now, also gang tattoos or gang attire. now, for prosecutors much more is needed to successfully prosecute a crime as being gang related and mccarthy says the criteria is not uniform. now, we interviewed the county's positive youth development administrator who was once a former gang member and he insists rehabilitation is the solution. >> i've been doing this for 25 years now and obviously i have my previous personal street experience is that it's all rooted in the weakness or the fragility that occurs in the home. not blaming the parents per se but when you have these complexities going on

and when the society as a community or even systematically we're not working together to help strengthen families the end result is that we'll see more young people gravitate towards gangs. we need to be able to provide them a better deal. obviously it starts at home and what we can do to make sure that young feeble are nurtured, loved, they feel acknowledged, accepted, hopefully strengthen their weaknesses shortcomings as well as blessings and figure out a way to support that. >> reporter: county administrator and former gang member luis cardona says the focus should be on strengthening families over punishment. even show the county states attorney wants laws changed to help prosecute gang leaders for ordering crimes even if the leader himself does not commit the crime. even police are saying the laws have vague after an arrest is made. >> it can be frustrating. that's why we rely on our partnerships with our local prosec

partners and especially our residents who provide us information or we can learn more details and bring a stronger case. sometimes some of those guidelines and laws are vaguely written and that leads to multiple or wide interpretation of those laws. >> reporter: now, by many accounts the solution new federal and state statutes targeting gang leadership, more resources and tools to track gangs on social media. also, police say families churches and schools working together to identify gang activity can help stop it in its tracks. tisha lewis, fox5 local news. >> ♪ >> there is new video that shows persons of interest in a shooting in southeast earlier this week that sent a one-year-old to the hospital. this is the video. by the way, this happened on monday the 1300 block of i street. police are still looking for the gunman involved. the one-year-old has since been released from the hospital. >> a district teenager charged in a hit

killed a transgender woman made his first appearance in court today. it's a case that may end up being classified as a hate crime. 18-year-old star and what anderson is charged with aggravated as tall while armed. the weapon in this case was a stolen car. according to court documents anderson was under the influence of pcp and xanax when he hit devaughn washington at fourth and k last week. he took off without helping the victim. a man who lives nearby says he heard the collision and ran out to help. >> there was a young lady on the ground and she was surrounded by her friends and they were praying over her and they were talking about what happened. she was conscious. there's a lot of prostitution in the area. i don't know if she was but some of the other ladies i recognized as being frequents of the neighborhood. >> police say the victim and suspect did not know each other. they do say the victim remains in critical but stable

in the few minutes i've been out i feel like they're walking a little bit more slowly taking their time and that sun is a little bit more prevalent than yesterday and a bit of a breeze as well but it's all about those temperatures and we have been a bit warmer than that 94 you see. in fact, last hour it was 95 and we may have touched 97 briefly here in the district. but you can see as we look toward martinsburg, winchester, culpeper, it's in the upper 80's. we've had a few showers out there that have helped to rain cool a few of those spots. notice annapolis temperature at 80. they just had a big thunderstorm go through so that has cooled them off as well but what is not giving us a break is this, the humidity and when we combine it with the temperature it feels like 105. that's what we were trying to get you ready for yesterday. believe it or not a little while ago i saw quantico as high as 114 in the heat index temperature. i don't know if that was a mistake. they're back down to 102 now. it feels like 104 in manassas but you can see that the heat is really most intense along and east of

that's where that heat advisory is in effect until 8 o'clock. we're worried about that heat index lasting a little bit longer, so a few more hours with that temperature at 105 and that will take a toll on you, so if you've been spending a lot of time out we want you to cool down. we had a few thunderstorms right around the i-66 corridor. they just fizzled out so quickly and one storm that we have been watching that crossed annapolis with some pretty heavy rain and a lot of lightning is now on the other side of the bay pushing in toward chestertown and centreville moving due east with a good amount of lightning so that could not have been a fun trip across the bay bridge there if you were in the middle of that one as if that isn't scary enough, right? let's talk about the bigger picture here because we're still going to monitor for the possibility of a couple of thunderstorms later tonight. we see a new batch up toward the cumberland area. not sure how much of it we will see but we certainly know that for this evening we need to keep an eye on radar and we also keep it kind of hot. by 7 o'clock, maybe a couple

>> ♪ >> a gruesome discovery in the search for four missing men in pennsylvania. >> the body of one of those men has been found. 19-year-old dean finocchiaro was -- police were led to his body to a 12 and a half foot deep grave where his body was found along with other human remains. the area is on a farm in solebury township owned by the parents of 20-year-old cosmo dinardo who is

interest in this case. so far dinardo has only been charged with attempting to sell a car owned by one of the missing men. >> they're tenderly painstakingly referentially recovering the remains of people that they do not even know, that they never even met. i know more than i'm sharing on the relationships and i have to keep it that way unfortunately for the -- to maintain the integrity of the investigation. >> dinardo is currently being held on a $5 million bond. so far he has not been charged in any of the men's disappearances. >> there are new details about that military plane crash in mississippi earlier in the week and we now know one of the marines killed in the wreck was from frederick, maryland. the family of 33-year-old staffst william kundrot. 15 other service members were killed in the crash. the investigation still under way. >> some big m

today in washington as the new u.s. education secretary reviews federal guidelines for investigating sex assaults on college campuses. >> not everybody is happy. campus rape survivors is that supporters rallied outside the department of education headquarters in accident activity today. they're unhappy that secretary betsy devos wasn't just meeting with them but with a group of men once accused of rape. the women shared their stories of sexual assault and urged the secretary to keep title ix protections in place. >> when i was sexually assaulted i didn't even know title ix applied to me and i think a lot of us five years ago felt that way but we've had this national conversation and now georgetown requires every student to go through prevention education. that's because students demanded that their rights be actualized. >> democrats on the hill defended the rights as well of

have been outside. >> dare i say it could have been worse. hard to believe but without the cloud cover. because we had a little bit of cloud cover today, a little bit more shade, less sun. that kept temperatures down just a little bit. we did get in the upper 90's. sue mentioned earlier and you know what, i think that the heat index values are still way, way up there and will be for the next couple of hours. we did hav a a lot of thunderstorm activity earlier down to the south and southwest of town. all that just kind of weakened and dissipated quite quickly and then on its heels another big storm blew up moving right through annapolis. and off across onto the eastern shore now. it was severe for a time but look how quickly that storm just blew up right on top of the city of annapolis and moving quickly off to the east. again, it was severe. as a matter of fact i think it still is severe. yeah, it still is severe as it head off towards centreville and golds borrow. earlier a lot of lightning. to the south there's anoer

blow up down through parts of saint mary's county. this one has moved through over into northern parts of that county headed towards chesapeake ranch. it looks like this is going to be real, real small. it's having a hard time kind of getting organized and getting any stronger than what it is right now but we continue to monitor the skies for these thunderstorms. you know what i think through the evening hours we could still have one or two. i think most of us will stay dry right on through the evening hours but there's still going to be at least a couple more i think go up before it's all said and done. especially with all this heat and the humidity. checking on the heat index right now, not much has changed since we last looked at this but if you're just getting in and seeing it, it feels like 105 degrees for washington, 104 for manassas. there has been some cooling out there from those thunderstorms but even annapolis temperatures starting to come back up a little bit after that thunderstorm has cooled you off and over on the eastern shore in cambridge, it feels like

healthcare 2.0 you could call it is out now. you'll remember this is another attempt after 10 republicans abandoned ship on the last version in the dog days of june. this time out they are hopeful to at least turn eight of them, if they can get eight republican nos turn into yeses, then they'll have a chance to actually repeal and replace obamacare but take a look at this. this was a wild scene up here today in senate offices as democratic protesters who do not want obamacare repealed and replaced, well, they took to the hallways and set up shop outside of the majority leader mitch mcconnell's office today and as we have seen in recent weeks, as this kind of thing has gone on, once again, u.s. capitol police have had to move in and make arrests. so, what is different about this bill from the other bill? well, for example, this time they've added in about 45 million -- billion make that dollars in opioid prevention

they have also added to a tax fund for people on low incomes. they sweetened the pot in certain areas to get nos to become yeses like one of them senator ted cruz calling this the cruz amendment. they'll allow some insurers to celo cost skimpier problems. republicans are saying this is a much better version of their healthcare bill. democrats, though, countered very quickly saying this is even meaner than the previous versions. >> the revised draft improves on the previous version in a number of ways all while retaining the fundamental goals of providing stability and improving affordability. >> from what we're seeing, the new republican trump care bill is every bit as mean as the old one and in one big way, it's even meaner with the addition of something like the cruz amendment. >> now f-over on

side there was a different subject at hand today and the -- that would be the health of the trump presidency. the first article impeachment has been introduced by a democratic member of congress. california democratic congressman brad sherman says that he now has evidence based on former fbi director jim comey's testimony before the senate last month of obstruction of justice by president trump. sherman sat down with fox5 today. we asked him if this is not a bit premature given that special counsel robert muller has already launched an investigation and has yet to come to any conclusions. sherman says based upon what he heard in that meeting he has enough evidence to bring this article of impeachment. >> so, we have the sworn testimony. it matches the existing criminal statutes like a glove. we have enough to move forward now.

[laughter] >> that's right. >> a little ice cream. >> we got a little treat coming up. there's another shot. you can really feel the haze in one, can't you? hazy, hot and humid. we've had a little bit of that for the last several days. high temperature -- look, this was the hottest day so far of the year and we're going to celebrate that with a little ice cream coming up in just a little bit. actually i think national ice cream day is coming up on sunday. reagan national 97 degrees. not ard are. that fell shy. i think a couple degrees off the record thank did thatness. dulles was 94 and bwi was 95. we had some clouds out there today and with the clouds it kind of kept the temperatures down just a little bit. i think it could have been flirting with a record, maybe a 98 or a 99 but the cloud cover helped quite a bit. temperatures 94. now gaithersburg 89 degrees, dulles 91. we did have some thunderstorms pass through this quadrant to the south and is the west and that cooled things down. 91 in fredericksburg. okay, how does it feel out there when you s

it feels like 105. another thing the rain does, it puts a little bit more moisture in the air so perhaps just as uncomfortable now down here through and culpeper manassas fredericksburg quantico. as these thundershowers pass through, annapolis is still cooled from a pretty good little thundertorm they had. it feels like 87 there and middle 90's to upper 80's back out to the southwest. okay, so, technically there is still a heat advisory in place. this is going to go until 8 o'clock tonight. i just showed you. i mean, the heat index values were up around 105 so that's what this -- this needs to be in place when we have the heat advisory -- the heat index up to about 105. this runs until about 8 o'clock or so and we'll cool off a bit. we still scan the skies. we're not really seeing anything any in terms of thunderstorm activity locally. everything is across the river now, across the bay. we did have a lot of activity earlier but it calmed down quickly and dissipated. there was a lot of thunder and lightning towards culpeper,

madison county and 81. all dry now. could something pop up in the next couple hours? yes. but it would be real isolated. almost all of us will stay dry. there and there has been a little frontal system well to the north of us. it's still sitting here stationary. it will get a push over the next 24 hours and start to move in our direction but along this front, we've had showers on thunderstorms firing up for days and they've been kind of pushing clouds over the area, so it's those clouds that have helped to keep us a little cooler than perhaps we were thinking. i've we've had some 95's and some 97's. it could have been worse area wide without those clouds acting as a bit of a canopy for us. 9 o'clock, 86, still humid right on through the evening hours. temperatures will dip down into the lower 80's. tonight's low still very mild and maybe even some would say warm. 79 in the city. a lot of 70's around. a little cooler perhaps along i-81 where we're thinking lower 70's but there will be some clouds

they'll help to keep most of the temperatures up just a little bit. so, here's what we're thinking tomorrow. 83 degrees. there could be a thunderstorm tomorrow morning but again like this morning where there was a chance for it, doesn't look like a great chance, 83 degrees so we'll start out warm and we're going to heat up quickly. 92 by lunchtime and 93 at 5 o'clock. you can see the temperatures tomorrow, perhaps a shade cooler than today but still a lot of 90's out there and let me just so show you real quickly here, we do have a chance for some pretty strong thunderstorms tomorrow afternoon and tomorrow evening. these will need to be watched because technically speaking for tomorrow we're under a slight risk of severe thunderstorms. we'll watch primary threat from those will be some wind coming out of those thunderstorms. we'll cool off a little bit for the weekend, no the so humid. next week it looks like we'll surge towards the middle 90's towards the middle part of the week. back over to sim jim and sarah. >> breaking news out of pennsylvania and this is
