about, you know, i think the thing that really surprises a lot of people is someone talking about the president is even asking about pardoning himself if he could do that, your constitutional expert here, you understand how it works, it doesn't as though it's a clearwater yes or no >> i've been writing about this for the last 20 years, i've come to a conclusion what i think the answer is, if i were a judge, i would say no, the president can't self pardon wouldn't be valid but there are good arguments both sides, and until there's an actual case, there's really no way to know what a court would say >> hypothetically. if there were pardons handed out along the way, whether it be to, you know, children or other people in the administration, how does that work moving forward >> well, the pardon power belongs to the president. there's an office of the pardon attorney on the and the department

pardon power, so if someone hasn't been charged, hasn't been prosecuted. the president pardons that person, that reany possible prosecution of that person and can do a pre-emptive pardon, if there is an investigation, they can continue they didn't wouldn't be able to prosecute, that person wouldn't be able to plead the fifth as far as federal charge, it would make it easier for the investigation in that sense. but whoever is pardoned would be protected. as for pardoning himself, it's not clear they can prosecute a president while he's in office anyway. so, it's the president is going to do it. preempty totively bring the charges then if after he's out of office try to prosecute him anyway, challenge the validity of the pardon it would go to court and we would see the

what's going on, need to do more than probably just attack obviously. i mean, it's an easy target for them. what do you think the democrats need to focus on in order to kind of take things moving forward and kind of push their agenda >> i think on policy, i think democrats acknowledge there are flaws in the affordable care act. there are improvements and i think democrats need to be clear with their constituents that they're not just interested in beating the republicans in legislative fight. they want to fix the affordable care act. they want premiums to decrease or at least not to rise as quickly as they've been rising, that's part one. part two is showcasing the talent, like corey booker, harris you just showed. a lot of great young leaders >> let's talk about the special elections we've had.

honest some of these cases, you saw democrats make gains, but there's no still 0 for 5. so how do you move forward >> a little historical perspective. after obamacare was elected. democrats got pretty well wiped out in congress. seven straight elections, democrats won everyone, these elections took place in the districts of people who trump chose for his administration, because they were very conservative, and would be easy to replace. i don't think there's much significance that the democrats losses in these specials >> moving forward, for the democrats, this is really to mess up. i mean, they should be able to pdo pretty well i would think moving forward as long as a strategy like yourself having right strategy, drew litman, thank you for talking with
