park. police say that morning around 8 o'clock they were called to the park about a body that was found. during their investigation they learned 14-year-old elias portillo and a 13-year-old boy approached the victim francisco sagastizado and demanded cash from him. now we're told when sagastizado refused, that's when portillo, if the 14-year-old stabbed him several times. now, officers pronounced is ing ssagastizado dead at the sc. almost two weeks later when they were interviewing a witness at this park that's when the witness said he spotted the two suspects walking by at the park. now, police detained the juvenile at first for questioning and then later arrested both him and portillo. again, they say for committing this horrific crime. >> it's certainly troubling to

certainly to our community that two young people so quickly escalated to extreme violence which led to man being killed over something so trivial as a small amount of money. >> reporter: now, both portillo and the juvenile are currently facing first and second degree murder charges. portillo is being tried as an adult. the other tried as a juvenile and that's because of that age difference, the one year gap from 13 to 14 years old. according to maryland state law. but we're told that that could change depending on court proceedings. again, we will keep a close eye on that for you. for now we are live in adelphi park this evening, kristen leone, fox5 local news. >> ♪ >> fox5 was first to report monday that the united medical center obstetrics ward was shut down. now a southeast woman says her baby was delivered stillborn and she's blaming umc for it. >> she says equipment wasn't working there wasn't enough staff and

concerned when she checked in about her baby not moving in the womb. womb. >> fox5's tisha lewis joins us live from southeast with more on the story tonight. tisha. >> reporter: well, we are prohibited from being on the property at united medical center so we're across the street but we're told that for the obstetrics wardlame- shutdown. we did ask about this specific case and this woman that you're about to meet. a hospital spokesperson cited privacy rules and regulations and did not answer any of our questions. the district department of health did not respond. though patients have plenty to say on social media and in person. this southeast woman who you're about to meet is still in mourning after she says she lost her baby when she came here first and received inadequate and unacceptable care. >> well, as soon as i walked in i told them what was going on and they told me they was ta

delivery room. once i got up there, she gave me a gown took me to change my clothes and everything but no one came in the room for about 30 minutes. she finally came in the room she asked what was going on. she was trying to hook me up to like the machine that they hear the heartbeat and everything but the machines wasn't working. she finally called in a doctor. the doctor came in with a sonogram machine. it was so black you couldn't even see the baby once he rolled everything over my stomach. >> reporter: that was the final straw for 26-year-old rakita hill and her family who were prohibited from joining her in the examination room at united medical center. >> my sister kept calling my phone like what's going on, why they not making it a urgent matter. she then she basically went to the doctor and was just come on, put your stuff back on, we can go to another hospital. >> reporter: that same day t-july seventh the baby was delivered a stillborn at washington hospital center nearby

immediately treated by doctors and staff. just one month after the baby's passing, the d.c. department of health issued a ntice to united medical center restricting the hospital's license for obstetric and related newborn services for 90 days. >> they gathered every department, every department gathered with their own departments and had a meeting about it and it was a big one in the auditorium. >> reporter: for rakita hill it's too late and her message to united medical center. >> maybe if they was more urgent about the situation then my daughter could have been saved and could have been here with us today. >> reporter: the baby was delivered seven weeks early. the hospital says in the next three months o-it will review cited deficiencies and hope to fix those cited deficiencies involving three spate cases. they're going to be looking at clinical assessment screening and delivery protocols. everyone was

about this closure aren't also the specific story you just saw. tisha lewis, fox5 local news. >> ♪ >> we have new video tonight of an actual shootout in the district. two gunmen fired multiple shots as a person holding a baby almost gets caught in the crossfire. take a look here. it happened last week in the 3600 block of 22nd street southeast. you can see the two gunmen wanted by police are firing multiple shots. a person carrying a baby actually fell during the gun fight. police say one man was shot. he was taken to the hospital with nonlife-threatening injuries. >> fox5 in montgomery county where a montgomery county public schools now at the send of a new lleyto lawsuit tonight. john vigna was sentenced to 48 years in prison for sexually abusing multiple young girls. vigna taught third, fourth and fifth grades over the course of 20 years. that will lawsuit filed against the district was filed by a lawyer on behalf of one of the

there were several red flags that vigna was not safe. >> the d.c. fire departmentally is asking for your thoughts and prayers for dayne smothers jr. the rookie firefighter who was injured on the job is still in critical condition after three surgeries and a fourth one scheduled for today. members of the department spoke on behalf of dane's family who say they have been overwhelmed by support. even fire departments from around the country have been reaching out want to help. dane's instructor says he's always wanted to be a firefighter. >> the only way i can best describe him as my quiet before the storm. very quiet reserved very intelligent and you ask him a question he just smile give you those big white teeth but when you put him out on the yard dane always performed. very proficient with everything that he did. if he didn't get it right the first time, he definitely got it right the second time. he always wanted to be a firefighter. this is something that was

>> ♪ >> taylor swift details to a jury today in a -- in her trial involving an alleged sexual assault. >> the singer says it happened when the two posed for this picture back in 2013. she said it was a long grab and when she tried to move away from him he wouldn't let her go. swift testified that she didn't stop her meet and greet after the incident because she didn't want to disappoint the few dozen people who had been waiting in line. she says she first told a photographer about what happened 15 minutes later. on muller's side of things he called the photo awkward but insisted he was touching swift's ribs, not her bear behind. muller was fired after the incident and then he sued swift for $3 million for losing his job. she counter sued alleging a sexual assault and is asking

for 1 million-dollar judgment set. wal-mart is on defense today after getting blasted on social media over a back to school sign inside one of its stores the. >> the sign reads own the school year like a hero. the problem, the sign sits above a gun display. the photo went viral. concerned customers pointed out the display sent a strange message. wal-mart first responded to a woman who claims she took the photo of the store in evansville indiana saying that was immediately. wal-mart apologized to another twitter user although wal-mart tweeted the sign had been taken down in evansville a spokesman said it is incorrect. >> the samuel c johnson's imax theater in the national museum of natural history is set to close on september 30th. >> those imax film makers putting up a fight to try to save the theater which is being closed

view and you are immersed in it and that's really what it's all about. it's an immersive film experience so you're inside the frame. you're having like a frameless experience. >> barker's film is currently playing at the samuel c. johnson imax theater but the question is for how long. the smithsonian plans to close the theater on september 30th. >> the museum leadership itself at the natural history museum not the smithsonian overall but at the natural history museum made the decision to demolish the theater and they made it in order to provide expanded cafeteria and food services. so, the message -- it's incredible to me but the message from the leading natural history museum in the country and the world is that what our children need is less nature and more fast food. >> is there not a way that they can do both? >> well, that's the thing that as far as we understand there's been no analysis on how to do both and if you walk into that theater, into that museum and go to the theater you walk through this area that's all

walk towards the theater and on the bottom floor is the cafeteria. there's easy two or three more floors of cafeteria that you could put between the theater and the other wall. >> in an official statement from the director of the smithsonian's national museum of natural history attendance has dropped dramatically since the theater first opened in 1999. >> what they've been saying is s average occupancy so if you take all of the available seats, 20 percent of them are full. i challenge them to go down to regal or any of the other cinema chains and ask them what their occupancy rates is. guess what? they're doing better here than the commercial cinema chains so that's a bogus argument. >> i reached out to the smithsonian for an interview with the director but they declined obviously barker is very passionate about the subject so i wanted to ask what can be done. >> what needs to be done to change the decision is well we've created a web site called save our imax.org. this is a number of the film makers who provide all of the content to this theater. we have a save our

sprinkles. these temperatures though still a terrific bargain and most of the rest of the evening is going to be quite comfortable. 81 degrees, winchester 73, gaithersburg 79, westminster 84, fredericksburg at 82 degrees. and this is what i'm talking about. there is not a lot of rain out there, just a few spots getting very light sprinkles. we had a couple here in the district. you can barely see them but you can see that they're hit or miss. go up through montgomery county there have been a few passing through the 270 corridor and up toward lisbon and damascus and down toward culpeper and little washington to marksville we've had a couple of very spotty showers. i don't think this is going to amount to much. we have increasing clouds, though, from a little disturbance that is getting closer. if you are headed up 95 and going to the battle of the beltways for our first preseason game at 7:30 weather should not be a problem at all. about 77 degrees. we'll definitely see the clouds increasing but a very pleasant night for sure. enjoy it because guess what? the unsettled weaer

tomorrow. not so much in the morning but clouds will be around all day long and chances for showers and storms go up especially later in the day. in fact, a lot of this might hold off until after 6 o'clck or 7 o'clock tomorrow but they are definitely back in the forecast so we want you to be ready for that. i'll look at your friday planner. shows us a temperature of 72 degrees. that's comfortable tomorrow morning. we'll have a little bit of sunshine getting through those clouds. by noon, though, it's more humid. noticeably more humid with a temperature of 80. and that loads us up on moisture and by 5 o'clock we've got to track a few thunderstorms with a temperature of 82. i think primarily they will be west of d.c. but they will be getting closer and if you have friday night plans you'll want to be aware that an umbrella may need to be part of those plans or if you're planning to be outside, you might need plan b. we'll talk about the weekend. we have some improvements to the weekend forecast. at least on one day. we'll talk about that coming up in a few minutes. jim

>> that's a woman a-grown woman getting into a scuffle with a worker at a merry-go-round. this happened last weekend in the island carousel at columbia mall. the woman in the dark jeans on the left allegedly reached into the register and stole some money. when the employee confronted her the suspect threatened her grabbed her hair and yanked her to the ground. she also bit the woman's hand. that suspect is still at large. >> police need your help identifying a man accused of robbing a store in northeast d.c. it happened last month on nanny helen burroughs avenue. the surveillance video showing the man walking up to the counter and when the clerk opened the register he grabbed the cash door and the took o off. >> a mailman in bethesda chucking passengers tomahawk style. the mail carrier throwing that package over the gate. the bethesda resident said it happened tuesday and that wasn't his regular mailman. good news is nothing in that box was fragile

northwest. video showing the suspect walking into the business and demanding an employee to open the cash register. the suspect grabbed cash and took off. if you recognize him call police. >> a virginia college student sentenced to 100 days in prison for submitting fraudulent voter registration forms with the names of dead people. andrew spiels worked as a staff for a group affiliated with the democratic party. he was paid to register as many voters at possible leading up to the 2016 election but the registrar's office found multiple fake registered voters. spiels admitted to preparing 18 fraudulent voter registration forms. repealing and replacing the affordable care act seems less likely but who is going to take the blame. >> fox5's political reporter ronica cleary is live at the white house with a look at this new battle that seems to be brewing now. ronica. >> reporter: hey, jim and sarah. well, you know, the attacks they're still fairly mild for what we've really gotten used to over the past six months of this administration but let me tell you, the tensions are definitely rising between sena

mcconnell and president donald trump. as they look to -- as the future of healthcare really hangs in the balance. i want to take you back to monday afternoon. it was a rotary club meeting in kentucky where mcconnell spoke and he took aim right at the president. >> our new president has of course not been in this line of work before and i think had excessive expectations about how quickly things happen in the democratic process. >> reporter: well, the president has addressed mcconnell on this issue in handful of tweets. here's one where he replied directly. senator mcconnell said i had excessive expectations i don't think so. after seven years of hearing repeal and replace why not done? and then this morning, the president tweeted, mitch, get back to work and but repeal and replace tax reform and cuts an great infrastructure bill on my desk for signing. you can

local news. >> ♪ >> we are following some breaking news right now out of northeast d.c. police are on the scene of a double shooting right now. this is in the 1400 block of saratoga avenue. >> fox5's lauren demarco brought you this first on facebook. she's live at the scene with the latest. hey, lauren. >> reporter: sarah, jim, this is saratoga and montana avenue, definitely an active scene at this point. over my shoulder there is this white car, sedan. what i'm told from witnesses is that there was a female, i'm not sure of the age, a woman or a younger female, but somebody in that car who just happened to be driving by and was caught in gunfire here. that is not yet confirmed from police but you can, of course, seal that the passenger side front window is shattered and the car smashed into another suv there that was parked on the side of the road and this seems to be the center of the investigation at this point. also down the road a little bit out of our camera view there appea t

another part of the scene where police are investigating the forensics team has been called out here. police we know that there is a female victim and also a male victim, both shot. the female victim said to be in pretty serious condition. the male victim was conscious and breathing. there was a lookout for two male suspects. this happened around 3:30 this afternoon. talking to people who live here, they are just so upset. one woman telling me that there's just gunfire around here way too frequently. she said two days ago she heard gunshots. today about 15 minutes before this shooting, she heard gunshots. she was hoping that there would be a larger police presence and there's some private security that works in the housing complex here. she thought that they would would be out but she said, you know, 15 minutes later, the gunfire right here in front of her apartment. she had to dive down to the floor in her kitchen fearing for her own life and then finally to come outside once she saw the police arrive and find out that there was a female

snapchat. a friend of the victim who saw it called police and here's one of the prosecutors explaining how the victim managed to record the rape. >> she was laying down and had the phone located up by her head actually. shooting down. highly unusual that a victim is able to actually capture her rape on video and format and to share that. yet to come across any other cases like it. >> allen is charged with first degree rape and being held on $1 million bond. he appeared in court yesterday but has not yet entered a plea. >> michael vick's dog fighting conviction is long gone. while some have for given him it's long past some animal rights activists have not forgotten. >> protesters gathered outside arrowhead stadium in kansas to
