tomorrow is over the golf picking up moisture, the death l toll is certainly going to rise as rescuers continue to race to make their way to stranded people in texas. just seeing the devastation, the images of people being rescued from roofs you saw that off the roof of a car. the president was in corpus christi, but a bit away from the storm zone. many people are watching president trump's response. he promised texas speedy federal assistance hey, yim and shawn, the president, he spent most of the day, he started early this morningen route to texas. he's on air force one headed back to our region. he didn't really go to the heart of the damage i'll tell you, he's the not getting any controversial over that. i spoke with jason russell of the washington examiner about the president's

points that he made today and why they really were the right decision. take a listen. the one concern is obviously you you you don't want the presidents to become a dis\tax\tacks. you don't want his security detail to keep aid from getting where it needs toking go. that's why i think it was smart he was in corpus christie and not in downtown houston. it's important to go and fly over the damaged areas without becoming a distracts to the aid efforts on the ground which he seems to be doing. now as jason mentioned he was in corpus christie also also went to austin today. interestingly enough when we talk about the stopping points that the president decided to make and his team, of course, a lot of this was done very last minute throughout the day we were getting updates from the white house press pool l who were with the president and we did not have details of those stops simply because of the president's teams efforts to

devastation, but as we said yesterday, the president also mentioned that he might go back on saturday, night go to louisiana on saturday. so that might be a time when the president decides to visit some of these more, you you know, horrifying areas. shawn, as you you mentioned, the inl every images are really shocking and terrible. of course the day wasn't without controversy. some have criticized whosh the partnership was heart full enough or compassionate enough and then there was a line of controversy over melania trum's you shoes. she did end up wearing sneakers. she started off the day in high heels and then changed to more appropriate shoes. some of it silly. the president taking on the role for the first time since he started in office of handling and responding to a a natural disaster. so a lot more in front of us, especially in light of whether or not the funding for harvey relief will be in

way tied to these talks of a government shutdown. so a lot to still look ahead to when people are deciding and grading, if you you you will, the president's response to this horrific tragedy. back to you you. you pointed out earlier, the different tones that pawsm, president bush struck in times of tragedy. this is all part of the job. we appreciate it. as harvey continues to dump on whose torng then \tier\tear it a is feeling the economic impact. >> so the cost of recovery for the storm expected to be anywhere from 30 to 100 billion-dollar. property damage alen expected to be in the 40 billions and many homeowners are not covered with flood insurance. many insurance companies expecting people to foil their claims by thursday. this is going to be a difficult road what i can prose

you you arrested on an outstanding he a lot of democratic lawmakers from new jersey saying we're not going to do what ted cruz did. are they trying to take sides too early or is this all part of the game? a. you're all the right. only one republican from texas voted for the sandy funning. ted cruz made a particular issue over it their contention was there was ex extraneous funding, but that's the exact kind of funding they're going to want in the harvey rescue billion and the reason is it will reduce long term cost. we need to plan our communities better for these floods which they'll call 500 year floods seemed to be happening every five years. we're going to have to plan our communities better to reduce these costs in the long run so some of the funding should go to that. planning those communities and doing this is certainlying whying to cost money. i know that back during when vice-president

he reducing the number for other programs. do you think that we'll see something like that this time around and the wheel ing and dealing in quong. i think they're going to be some in the conservative freedom caucus who attempt to make amenities to that effect but i don't think speaker ryan will be having any of it. i don't think it will become law and ultimately i think there will be broad by partisan support for this funding. i do think however, the irany is that fund ing for harvey will make raising the debt limit easier for republicans and quiet the criticism that had been coming from the house freedom caucus. >> makes sense. please come back because i know there's going to be a lot more to talk about this in the days and weeks and months to come. >> thanks for being here. a lot of have been asking us how can we help. >> there are a lot of people who want to donate food or clothing it does

hukly tropical storm harvey on its way out. the rain is start ing to come to an end in the western suburbs of washington, d.c. we've had a wet, cool day thanks to tropical depression number ten neferl did develop into a tropical storm many we should be clearing out through the rest of the evening so the nats should be able to play ball. tomorrow, wednesday, a nice afternoon and warm on thursday the pardon for ohio ar pio, the question is was it legal, was it illegal. we're going to take a closer look when the 5@6:30 returns.

all options are on the table when it comes to the u response president trump, the gentleman in an's prime minister calling for an emergency meeting of the us security council, the two spoke by phone after korea fired the missile into the pacific ocean. it had the longest range of any of their recent tests. we are going to talk about what else is left to do to north korea. no country should have missiles flying over them like those 130 million in japan. it's unacceptable. they have violated every single us security counsel resolution that we've had so i think something serious has to happen. we hope china and russia continues to work with us like they have in the past on north korea, but i think he enough is enough. the latest missile launch comes after president trump threatens to quote bring fire and furry to the regime if they continue to threaten the united states. a big story that broke on friday, president trump

joe arpaio and so why and how he did it is still stirring up controversy. kim letterly while i a professor at the balance more law school is here with us tonight. >> thanks for being with us. it is unconventional, but did the pardon break the constitution, is it unconstitutional? >> i don't think there's an answer to that question at this point. i think that a lot of the conversation has assumed that the pardon power is unlimit ed and the constitutions is a really old document, 1789 and lots of it is not clear, in my view, including that. we have to acknowledge that some of stuff is gray and in this instance i think with ar pay oh there could be some issues that are different than we've seen in prior circumstances with pardons . any idea what kind of issues we're talking about there ? they're two in particular. one is the timing of it. when you think about most parns

on the way out the door. he's going to be a private citizen. he pardons people, the public gets upset. mark rich, for example rg during the clinton administration, a prime example. >> absolutely. this one was early in his first term and signals a possibility that he might use this power while he's a sitting president and does that shift the dynamics of the govment a little bit and the second thing that i find a little conventional problemmic is the fact that we're talking about a court order that was violated and a decision that, to relieve mr. arpaio for any liability for violating a court order. without courts that function in a way that the public respects and the government respects we're really could get into a constitutional crisis. the president and his folks say, look, the constitution gives him the broad power and the authority to pardon, you know, anybody on a federal level like that. many people are asking do you think he he could he -- if we start to

investigation he could end up pardoning himself. can a president pardon himself? that's one of the key questions that is being asked right now and that's why i think it's important to make clear it isn't clear because with arpaio, again , we're not entirely sure. can the president pardon himself , i think if he wassen geajed in some kind of obstruction of justice or committing some kind of crime it would be really difficult for a court to up hold that. we can look at it from this perspective and say there's a gray area we're not sure where it's going to go from here. we can talk about it, but who is the one out there that says we're going to investigate that or define that in who does that. >> it would have to be the supreme court and in this instance it would probably be difficult to find a plaintiff to bring the casement we have three levers of power, the president, the courts and congress and so far we've seen congress sort of watching things go and weem ' see if they make a decision to move forward on

peachment. what about the justice department? i know that's still a gray area as well . would they have some sort of legs to stand on. >> it's going to enforce constitutional questions to the extent that they relate to the government. you you you really need what i call a broken arm plaintiff. you you need someone that says i was hurt by this pardon. i'm now different from the rest of the world. i can come in and get a judge to re solve my problem. i have on ask you this quickly, onmccain said if president trump ran as the law and order candidate this is proof that he's not respect ing the law. do you you agree with that mp i would definitely a agree with that. you put a driver in a car and you you want the draifer to get out of the car and have the car remain intact. president trump is the draifer of our car, the car is our constitution and we want it to stay in that shape for the next president for future generations. and i think when you start thumbing your nose the at judicial orders. it really is something to be concerned about. i

sent here with clothing that racially denigrates a group. the they say i was in the an easy decision. wearing clothing with the name of our local football team or the logo that's an amath ma t our or mission. i think it's a racial slur much it's deeply demeaning. school administrators say the ban on redskins gear at greenacres school came after long talks in classrooms with questions about the the team logos like the washington redskins that are base ped on race or ethnicity. that's a question we asked virginia democratic governor terry mcauliffe. since charlottesville's violence, the governor declares that he wants all confederate statutes removed to stop hate speech. the govern or, though, has not called for the washington redskins to change
