he aggressively approached this armed security guard and a shot was ultimately fired. now, this exchange happened here at this playground, all because this security guard asked the man to secure his dogs. we're told that they were not on a leash. he did not comply. that's when the verbal confrontation took place and the security guard shot the man before calling police. now, the victim then left the area with his dogs and we're told he then drove himself to a home nearby. police discovered him in a drive way suffering from this gunshot wound. >> he had two unsecured dogs. there was concern from the security officer because there is a day care here on site and the children were going to be getting out for the day and so that situation escalated and eventually ended with the security officer firing one shot. >> reporter: again, this man wa

aggressively approached the armed security guard. it is likely that he will face some type of charges. again, he was rushed to a nearby hospital. police say that they were able to find this suspect because this quick thinking security guard spotted his license plate when he called police, he was able to provide police with that information and they were able to track that to this dog owner. tisha lewis, fox5 local news. >> ♪ >> the words from a judge. "are you a danger to the community." that's what a judge told tyler tessier before denying his bond. he sits in jail charged with the first degree murder of his girlfriend laura wallen. she ws a beloved teacher and was four months pregnant. her father had this to say outside the courthouse today. >> we were praying for a good old fashioned miracle god did not give us the

asked for but he did give us a miracle, nonetheless. we have our daughter back. >> matt ackland is following new developments in the case. he's in rockville right now with more. matt. >> reporter: jim, the wallen family walked into court today, a lot of them and sat in the front row. they watched as a man accused of killing their daughter stood in front of a judge. this is through closed circuit tv. then prosecutors laid out this case. they started with a missing persons case. that's what we knew last week. and they wrapped up by talking about a shallow grave. it was at a damascus farm where police made the sad discovery a shallow grave about 10 by 10. prosecutors say in court clothing was seen protruding from the ground. >> he is a monster and he is a liar. >> reporter: mark wallen laura's father says tyler tessier was the only reason he and

he says as the investigation moved forward police asked him and his wife to appear at this press conference. they were told to act if they supported tessier even though they knew police were suspecting him. >> it was the hardest thing to do is to sit next to him and hold his hand. she had to hold his hand with two hands because she was shaking so badly but we did it because as any father would do, if your child is missing and someone has that child, we were pretty sure it was tyler. >> reporter: authorities believe the motive is likely connected to a love triangle. tessier was engaged to marry another woman and wallen had recently contacted that woman for a face-to-face meeting possibly to tell her she was four months pregnant. >> obviously there was a triangle going on here. he was involved separately with two women, one of whom he was engaged to and

of whom he was out looking for a house with. >> reporter: police used cell phone information to lead them to damascus where laura's body was found. they say tessier had returned to this spot over and over again and when asked why, he told police he was searching for laura. prosecutors say police got five to six statements from tessier adding up to hundreds of inconsistencies. including these text messages sent from laura's phone last monday. police believe tessier sent them to throw police off. >> he lied to my face when i asked him about the other -- the other girl and said i haven't seen her in two years. i haven't talked to her in two years. and i believe her -- i believed him. he's a very believable guy. >> reporter: at this point no bond for tyler tessier until his next court hearing.

in your hand. >> reporter: well, we want to show you this. this is the carnegie library here in mount vernon square. it is in the process right now of undergoing a multi-million dollars renovation. why? well, apple is in the process of turning this into one of its world class apple town halls. we are also now getting our look at the new iphone. not this one. tis is an old iphone but the new one, the iphone x. it is going to allow you to use facial recognition technology just by looking at you it would unlock your phone but it's also unlocking some questions from privacy experts about whether or not this kind of technology would make it harder or easier for law enforcement as they launch an investigation. we spoke to the aclu's director of speech, privacy and technology, jay stanley. he says so far the laws have not caught up with the technology. >> the courts

about whether the police can force you to show a fingerprint to give your pass code or to show your face to unlock your phone. most of the rulings have been that they can force you to use your fingerprints but they can't force to you give up a pass code. >> reporter: now, what you might not know is that warrantless police searches of your phone, well, they were ruled unconstitutional by the united states supreme court way back in 2014. as it stands right now if police want to search your phone, they have to get a warrant before they do that but this new phone on the way, the iphone x, it is raising questions all over the privacy spectrum. think tanks here in d.c. are issuing opinions on both sides as to whether or not this kind of bio metric technology can be used for or against individuals. iphone users we spoke to today say they have varying opinions about this kind of technology and where it will

appears to be a track field nearby. we're hearing from witnesses that there were children in the area. this is the mount vernon square area of northwest d.c. right now that victim we're hearing is a man. he is unconscious and not breathing per police. it appears to be a homicide investigation. just last night close by also in northwest also on m street the unit block of m street northwest a double shooting. that is also a homicide investigation. of course we're still getting all the breaking details. as soon as we get more we will pass them along. sarah, jim. >> ♪ >> four days after a deadly house fire in bethesda investigators are still not sure what caused the fire or how the victim died. >> firefighters found a man dead inside of a base room at a home on danbury road sunday afternoon. no idea on his identity but officers are watching that house around the clock. >> fox5's paul wagner is joining us live from the scene tonight with more on the story. paul. >> reporter: well, jim and sarah, montgomery county police are officially calling this a

but earlier today, this fence was put up around the house. you can see here an evidence sticker is there holding that fence together. there's still crime scene tape right along here and around the house and then take a look at this here on danbury road. this police officer is sitting here. they've had a cop sitting here watching this house for the last four days around the clock. there are still so many questions about what happened here inside this house. listen now to firefighters and police as they responded to this home last sunday afternoon. >> there's possibly one person trapped inside of the basement. >> we got a person trapped in the basement. >> we got a basement fire. >> we found a victim in the basement, in the process of bringing him out. >> reporter: but that did not happen. officials on the scene determined the man was dead and his body was left inside the house until the medical examiner and police could examine the scene. neighbors here on

they heard a man screaming for help, saying a person was in the basement and he could not get to him. those same neighbors who did not want to go on camera say the man screaming for help lives in the house alone. they described him as a 26-year-old who lives there. he was burned and taken to medstar but one neighbor says she has seen him in the neighborhood since. police say he is cooperating in the investigation. the mystery surrounds the victim. who is he? at this hour the medical examiner has not ruled on a cause or manner of death and the fire marshal is not -- has not determined a cause. officially police are calling this only a death investigation but there's intense curiosity in this neighborhood as to what happened here. now, there's also intense curiosity as to something that firefighters and police found inside the basement of this house. according to two sources familiar with the investigation after they found the man's body they found a lot of items inside the ba

to investigate they found what appears to be a bunker or one official described it as a series of tunnels inside this basement here and under this house. they described it as coming out to as far as the street here. they said there's a bed in there and a computer. now, we have no idea what this might relate to as far as the investigation is concerned but it's just an odd circumstance that the officials found inside this house when they found this man's body. we're live in bethesda, paul wagner, fox5 local news. >> ♪ >> new tonight a d.c. woman is under arrest accused of trying to kidnap a seven-year-old boy on a metrobus. metro transit police say 39-year-old thalia brown approached the victim o an metrobus back on august 30th and asked where his parents were. the boy told brown he was with his sister and that's when brown allegedly told the boy "when i get off this bus, you're coming with

at that point other passengers stepped in got the kids onto another bus. police were able to identify her through surveillance video. >> new video of a child screaming and acting out on a school bus is making the rounds on social media but it was what the driver was doing that's creating a lot of controversy. >> (screaming). >> have a seat tyrell. tyrell. >> all right, the video was posted to a school bus driver group. she asked what she would do. she works for dcps and in the comments several people pointed out she should be fired because she's using her own phone driving the bus with students on board. if you see in the shadow she's recording the child using that front facing camera. the office of the state superintendent of education put out a statement that reads in part both the bus driver aren't the attendant in that video have been placed on administrative leave and are not transporting children.

to develop there and a few more as we get out toward mount jackson and wardensville s everything moving from west to east and as we look at our futurecast it's also seeing that there won't be a lot of development but pretty insistent that we at least track a few showers and an isolated rumble of thunder between now and about 11 o'clock and then it's a quieter overnight period. we start out pretty quiet tomorrow morning as well. maybe a hit or miss shower in the afternoon tomorrow. so, we're going to keep this little bit of a summer taste of late august going for a little bit longer. we've got up to at least about 82 degrees today. we're do town 79. it's a little bit humid but not unbearable. 80 in frederick, 80 in fredericksburg. dulles is about 78 degrees. just a couple showers around maybe a rumble of thunder at 7 o'clock with a temperature of 76. by 9 o'clock, 73 and again if there's anything left, it will be really winding down by then and we're pretty quiet by 11 o'clock with a temperature

advocate. >> reporter: he's part of a fan coalition based in the d.c. area. he's a redskins fan so he is putting his weight behind this. >> you imagine some people are excited but they say there's much more than just excitement. there's other things to be considered here. >> reporter: right. because all the time especially in other places, you see these stadiums built and you're giving hundreds of millions of dollars on taxpayer money and money on leases that the taxpayers foot the bill for billionaire football teams. >> right. >> in the coming years politicians from d.c., maryland and virginia, they're going to negotiate with the redskins on a new stadium. they're offering up potentially billions of dollars in taxpayer money without a taxpayer seat at the table. well, that's where brian hess comes in. he's rallying support for fans to have a say in how the stadium will be used once it's built. >> we're trying to accomplish the s to get the leaders of the dmv to pledge to make

build a new stadium or renovate fedex field that comes some public good. it could be discounting tickets low income seating lotteries, better end seating lotteries, use for the public schools and youth leagues in the area. that's all kind of ways that state how public funds can be used for public good. we hopeful we get enough signatures on the petitions to get all of the leaders of the dmv to pledge not allow money to go to the redskins or really any other professional sports team to build a new stadium unless these conditions are met. we would love it if the virginia gubernatorial candidates would make that pledge as well since they'll be the ones involved in negotiations next. the maryland state legislature and the governor as well as the d.c. council members and the mayor but there can come a good from these sports stadiums. they become great sources of pride, culturally significant to the teams and

>> ♪ >> this is fox5 local news at 5:00. >> 5:30. checking your headlines at the half. a judge denying bond for the man accused of murdering his pregnant girlfriend. tyler tessier appeared in court for the first time today since being charged in the disappearance and murder of laura wallen. she was four months pregnant. detectives and cadaver dogs found her body in a shallow grave last night on a wooded property in damascus. you see tessier with wallen's parents at a press conference earlier this week. authorities believe the motive behind the killing is connected to a love triangle. the mother of a toddler shot with an unsecured gun is facing child abuse and neglect chars

destinie. a two-year-old boy found a gun inside of the car accidentally shooting a four-year-old girl. the father of the kids isaiah davis was also charged. a maryland middle schoolteacher is facing charges for soliciting a minor for sex. this is 39-year-old kenneth fischer. he was busted after a two week on line investigation. a detective posing as a teenaged boy was contacted by fischer. police say he solicited him for sex and sent explicit photos of him to the teen. fischer is teacher at westminster middle school but he's been suspended without pay. >> the man accused of setting his pregnant girlfriend on fire inside of her prince george's county county apartment has been ordered to undergo a mental evaluation. la quinn phillips is charged with attempted first and second degree murder. the alleged attack forced his give andrea grinage to give birth early. she and the baby are still in the hospital.

this has a lot of people talking about domestic violence. joining us live tonight are some of the people are who are leading the fight against it in maryland. angela alsobrooks is supposed to join us. she hasn't been able to make it at this point. she's the states attorney for prince george's county but also joining us is la torah pierce and rodney gray a domestic violence survivor. thank you both for making it in. >> thank you for having us. >> thank you very much. >> we hear about these incidents and does it ever, la toria it's like a never ending cycle. what is it like seeing all these cases day after day and how are you able to combat this issue. >> yeah, well, i mean, as you said, cases happen sporadically. you can't put a time to these thing and at family crisis center we just try to make sure we have wraparound services that we have elements of protection so we have the county's only 24 hour crisis

available as well as of course counseling programs for the offenders and the survivors. so, it's just -- that's the best way to be prepared is to make sure we have key services and safety in place. >> how d-, what's the most difficult part? is it to get survivors to come forward? what is it you would like [inaudible] services to get those people into a safe place? >> well, we are client driven. we're client led and it does start with the individual speaking up and asking for help and from there we can get them what they need. i think the key thing for folks at home to know is that once you come to us, safety is priority. after that, we can help with other things. we have legal advocates and a full team to help with an array of different things but as far as, you know, people's assets and things like that, we like to get them in a safe position first and then turn around and take care of those other things and so it's making sure people know that once you're safe, we can help you with jobs and housing and so much more. >> and it's its important for people to know thathi

genders, male and female. >> correct. >> rodney. >> absolutely. >> you speak to. you're a domestic violence survivor yourself. >> yes. >> it's brave i think for men, it's something they should be able to do to be able to come forward. tell us a bit about your story and what is you would like men out there to know. >> well, my story was 20 years ago and it was a five and a half year relationship that was purely physical. purely physical in the abuse side of it and so it was something that i didn't really see it as -- as tragic as it was at the time because i never really felt in any immediate danger but it wasn't until sometime later that i realized all the effects that it had on me so i think it's important for men to come out because they'll find a safe place and they'll find a place where they can gather strength from. >> i know you have an event that's coming you called the band of brothers going on this weekend; is that correct. >> that's right. >> actually october 7th is the weekend. >> okay. >> so, what is

>> we're going to be talking about all aspects of domestic violence and so, you know, men can be survivors as well. but there are a lot of things that go into why men find themselves on either side. so, we're going to cover the whole gamut of things regarding domestic violence. it's going to be great time. again, it's going to be a safe place for men and we're just looking forward to men coming out and being vulnerable because that's what it's really about. >> people don't realize how common domestic violence s is. it's like one in three women and one in four men. >> very close. one in four women, one in seven men but men are a part of the conversation and they do need to be at the table and they do need to be considered on both ends and so our executive director sophie ford this has been her brainchild for awhile and so we're excited to make it happen. a key thing we want the gentlemen to know who are attending is that this is not just an october thing. it starts in october but we're looking for this to be, you know, a

continued relationship between our band of brothers and all the men who will be in the room. we want as rodney have been saying the gentlemen to have a voice and know they have a support si system as well. >> are you working with state lawmakers on legislation and what kind of things have been doing in that regard. >> yes, we are. actually today i have been with the house and senate just in conversation we are looking to impact legislation for both the advocate organization in having a safety but also of course making sure that, you know, concerning gun laws, concerning the safety for survivors. levels of protection that different things are happening and that we're involved in that as well so it's an ongoing conversation. >> yeah, it certainly is and we appreciate you both coming in. >> absolutely. >> and being part of this conversation. latoria pierce and rodney. >> thank you. >> more on the alleged murder of a teacher laura wallen.

there yesterday but we feel like we need to keep them as part of the equation and what we're looking at for tomorrow is just a little bit unsettled with a few showers as the last of irma's energy kind of exits the east coast. so, we aren't quite in the clear there and lagging behind it is a warm and humid air mass and that could kind of prime the pump as well for a couple of showers as we head into the weekend. it is warm out there today. it is certainly not unbearable but the humidity is up a little bit. we're mostly finding temperatures in the upper 70's to near 80 degrees and tomorrow afternoon just a little bit warmer as well right around 84 degrees is what they think the district will top out at it. 80 degrees for hagerstown and martinsburg. 82 for manassas quantico. annapolis about 81 degrees. this has been a pretty decent day. good amount of sunshine but now you can still see very weak remnants of irma continuing to spin very slowly drifting really in our direction and it has prompted a couple of

this one near the district line into prince george's county, kind of the same thing blowing up over and over. one went by and exceeded the atmosphere another one near glenarden, walker mill. we slide farther to the west we find few more showers starting to pop up here and there between woodstock and front royal. keep an umbrella handy. most of you won't have to use it but i think the futurecast has spotlighted how the activity is going to go through the rest of the night. by 8 o'clock we track a few showers, an isolated thunderstorm even into 11 o'clock but then we're pretty much looking at good weather for our andrews air show visit tomorrow from fox morning news and as we go into the afternoon you can see we bubble up a couple more things and kind of the same thing on saturday. futurecast i think has a good handle on that. looks worse than it actually will be. this is josé. we've got winds of 70 so drops it down to tropical storm category. still moving toward the west but i also wanted

for those of you who watch the tropics there are two other disturbances coming off the coast of africa. nothing that is developing right now but tropical weather certainly not out of the picture just yet and the latest on josé has that track getting just a little bit closer to the east coast. now, look at the cone and you can see it kind of brushes by the beaches. that's the cone of uncertainty, what you need to watch, but we're still thinking that it stays at least through tuesday off the coast but you know, we're going to have watch new england down the road and see what happens with it in the wednesday, thursday, friday time frame. so continue to watch josé and the tropics as well. saturday looks like the warmest day on our seven-day forecast at 85 degrees and then we're in the low 80's sunday, near 80 on monday and we keep those temperatures low to mid 80's but dry as we head into the first part of next week. that is your seven-day forecast . but come on back fox5 local news at 5:00 much more to talk about when we return.

>> more news right now. alexandria police trying to figure out what caused a fatal stabbing earlier this morning. it happened just before 1:30 on north henry street. 30-year-old barksdale was stabbed at the home and later died at the hospital. there was a second victim who was taken to the hospital with life-threatening injuries. the suspect is 23-year-old man stabbed himself, he is in critical condition. d.c. mayor muriel bowser introducing legislation to step up the time line for getting arrest records sealed. council member david grosso proposing a bill that would fully and automatically expunge records of a person arrested but not convicted. advocates say it would make it easier for those people to get jobs and qualify for housing. the current record clearing process takes years to compete even for someone who is arrested but never found guilty.
