>> he has been attacked viciously on social media being called a racist and all sorts of things that border on down right threats. >> reporter: and that was attorney peter greenspan who represented bonds. i did get a chance to speak with him today. he says his client is out and about. the video that you just saw in totality lasted about eight minutes. you see people cleaning up and also you hear arguing, bonds again was found not guilty in this murder after a mistrial was declared this summer. tisha lewis fox5 local news. >> ♪ >> now to the latest on the las vegas shooting that left 58 dead and nearly 500 others injured. tonight investigators are not any closer to determining a motive for the mass shooting despite the fbi interviewing the gunman's girlfriend marilou danley. they say paddock may have intended to escape ali

concert committing suicide may not have been part of the original plan. during the rampage, police learned paddock shot at a nearby jet fuel tank but it did not explode. he was spotted gambling for eight hours with a woman who was not his girlfriend before the shooting. he booked a hotel in august that overlooks a park where the lol lollapalooza festival ws held. >> today it took a significant step forward with several high ranking republicans, the white house and even the national rifle association opening the door to possible new regulations concerning those bump stocks. lindsey watts is live on capitol hill. lindsey, surprising the nra is saying this. >> reporter: absolutely. so, extremely rare for the nra to be in favor of anything that would impose new

regulations on the gun industry but that's what we're seeing today. the nra saying they do that want to see regulations on bump stocks. we'll show you some video now so you can see what these devices look like. a bump stock allows a gun to fire at a rate of 400 to 800 rounds. the las vegas shooter used these on 12 of his rifles according to authorities. automatic weapons are all but banned in the u.s. it's not impossible to get one but they're extremely regulated. yet these bump stocks are legal, very, very easy to get ahold of and they became that way in 2020 over the obama 2020. it says despite the fact that the obama administration approved the sale of bump stock at least two indicationing the national rifle association is calling. the nra believes that devices desied

automatic rifles to function like fully automatic rifles should be subject to additional regulations. republican speaker of the house paul ryan and the white house press secretary also weighed in on this today. listen. >> we all have to get more educated as to what these are, how it -- how they became available in the first place, was it -- was it a regulatory misstep by atf some number of years ago and we all know and believe that will fully auto weapons are illegal and so is this a big gap that needs to be closed and if so, how to close it. that's -- we're all just beginning to go through that analysis from the investigation still continues to be in the very early stages. we know that both -- members of both parties and multiple organizations are planning to take a look at bump stocks and related devices. we certainly welcome that, would like to be part of that conversation and we would like to see a clear understanding of the facts

see input from the victims' families from law enforcement, from policy makers. >> reporter: this week several democrats in congress introduced legislation to ban bump stocks. we will see what happens with that. it looks like this has a strong possibility of passing. also worth noting that this week several retailers have decided to stop selling bump stocks including wal-mart and cabela's. live on capitol hill, lindsey watts fox5 local news. >> breaking tonight embattled gop congressman tim murphy of pennsylvania has resigned in the wake of reports he was involved in a sex and abortion scandal. murphy is known as a strong opponent of abortion but recently a pittsburgh newspaper published text messages that show the congressman asking his mistress to get an abortion when he thought she was pregnant. murphy's last day will be october 21st. >> a 26-year-old woman behind bars tonight after fairfax county police say she lef

three young children in a hot car while she was at work of the investigators say they found the kids suffering from heat exhaustion with temps inside the car at 150 degrees. >> fox5's anjali hemphill is live in falls church where she spoke to the woman's employer about what happened. anjali. >> reporter: we've learned alexa faulkison had just started a new job here at a law office and that's where police say she was on tuesday afternoon while her three children were here in the parking lot less than 100 feet away locked in a hot car with temperatures inside in the triple digits. this is a mug shot of 26-year-old alexa faulkison. investigators say she told them she left her kids ages five, six and seven in her car because she did not want to bring them in her workplace. investigators say a passerby called police after noticing the kids had been left unattended in the car for at least 45 minutes. police arrived around 2:30 tuesday, which as you remember was

in the 80's and discovered one of the kids had that punched a hole through a taped up window in order to get air in the car. they say temperatures inside were up to 150 degrees and the kids were all suffering from heat exhaustion. now, we did speak with faulkison's boss, he's an attorney, who tells us she started working there six weeks ago as a filing clerk. her job involved driving her car to the courthouse several times a day to file documents. he says he's shocked at what happened and would have let the kids come inside if he had been at the office or aware of what was going on but he says faulkison has been a good employee, the short time she's been there. >> just recently moved here. i think that her children were not enrolled in school. her babysitting fell through. she just moved here. her lease just started. her babysitting fell through and i think she probably thought she could keep the kids with her in the car as she went back and forth to court. it was terrible judgment but i think she didn't think that she would be out of the car for

i think she's a very frazzled mother. she's a young mother and she has three young children that she's trying to get in school and all that and probably some things fell through. >> on a 93-degree day in 20 minutes your car can be 120 degrees. so, it was 85 degrees that day. >> that's why we put this story out to remind people that even though it is fall it still can get very hot in your car so do not leave children or animals in your car even for a quick errand because you never know what's going to happen. you might be prolonged on that errand and it's in triple digits. >> reporter: we did go by faulkison's home. people who identified themselves as family say they did not want to talk on camera. faulkison is in jail held without bond due back in court on november 6th. we're told her kids are all doing okay. and that they are currently staying with their stepfather. live in falls church, anjali hemphill fox5 local

>> ♪ >> all right, we had another beautiful october day. you can see as we take a live look outside, sun is out, clouds are out. you couldn't ask for much more than this. >> no, you couldn't. it's absolutely beautiful but caitlin, there may be some rain on the way, hm. >> yes, there is some rain on the way marina and sarah but not for a few days. in the short term for the first half of the weekend this october warmth like it or not is going to continue and actually really through the seven-day forecast temperatures stay well above normal. so, pretty amazing here as we take a look at these temperatures in the afternoon of october 5th. normally in the low 70's but we're doing low 80's. 80 in washington, 82 in gaithersburg, 81 in baltimore. 82 frederick. 81 in martinsburg. we started this week off pretty cool and it is

tomorrow morning, low temperatures much warmer than the way that we started out the week. now we've got a cold front moving across pennsylvania. you can see the showers associated with it east of pittsburgh and headed towards philadelphia but most of these rain showers have stayed off towards our north. the exception being extreme northwestern maryland, hagerstown seeing a little bit of rain right now. this already moved through cumberland and dropped the temperature. it looks like it may cross through frederick county and then head towards baltimore a sprinkle or two but for the most part these rain showers will stay north of washington and even i think decaying before they even reach baltimore so any rain will be confined to areas off our north this evening and will be fairly light. evening forecast for us, we are looking at a warm night. 77 by 7:00 p.m., 73, 9 p.m., partly cloudy skies. low temperatures overnight, no 40's here. 65 in washington. upper 50's north and west. let's go to the tropics. we now have tropical storm nate. it is a weak disorganized system with winds sustained at 40 miles an hour and moving northwest

you can kind of see it's this blob of convection right here off the coast of nicaragua and honduras. even though it's disorganized and fairly weak it's bringing mudslides to honduras and nicaragua. it will move over the center of honduras and set its sights on the yucatan peninsula. it's expected to strengthen to a stronger tropical storm before grazing cancun. this would be sometime during the day tomorrow, friday. from there a northward track through the gulf of mexico is expected with potential to increase into a category one hurricane. the northward track has been pretty consistent meaning there could be a land falling tropical storm or perhaps a hurricane over the weekend along the gulf coast and that cone encompass the new orleans area but there's wiggle room east and west. from there it looks like the remnants will bring us rain which will end our dry streak going well over 20 days by the time we get some rain. much more on tha

your seven-day forecast. for now that's your forecast. >> dreamers on a deadline. tonight at midnight the time when expire for dreamers immigrants brought to the u.s. illegally as children to apply for protection under daca. >> president trump announced last month he's ending daca and today a major lawsuit was filed in a last ditch effort to block that decision. fox5's tom fitzgerald spoke to both sides. >> reporter: daca stands for deferred action for childhood arrivals but as of midnight tonight, there will be no more deferments, at least on these applications that have still not been filed. midnight is the deadline. the trump administration put people on notice last month saying that they were ending the obama era program but with this clock ticking down now, coming in under seven hours until we reached that point, the pro-immigration group casa filed a federal lawsuit today hoping to block the trump

administration's action. >> we are standing here today to challenge the arbitrary mean spirited and awful end to daca by the trump administration and to raise the voice of the warriors who fought for daca and won. >> reporter: this lawsuit today is that they are alleging that the trump administration in their views did not file proper procedures in deciding to cancel daca. they say this is discriminatory against mexican and central american immigrants and they want the court to assure that the trump administration would be blocked from moving ahead with its plans to cancel daca altogether this spring. there were about 700,000 people that fall under this category and administration officials say they are still processing nearly 150,000 applications since this announcement was made but you talk to some

immigration watchdog groups, they will tell you, while they may be -- well, there may be an effort to keep daca in place, this still does not address the major problem here that anywhere upwards of 12 million illegal immigrants still in the united states right now. >> what do you do with people who have broken our laws. if there's 11, 12 million people here illegally why do some people get to stay and some people don't. more importantly how do you give the american people assurances that we're going to get illegal immigration stopped and under control. >> reporter: the question and so far there are no answers on that tonight. incidentally, this midnight deadline, this comes this evening but the daca program is not scheduled to end officially until march fifth. we're live in northwest tonight tom fitzgerald fox5 local news. >> look the aftermath of this derailment. a train slams into a house injuring the homeowner while he's sleeping inside. >> jeff

>> ♪ >> back now in atlanta georgia where a freight train derailed and slammed into a house. at least a dozen cars were involved in this with many of them flying completely off the tracks. one of them slammed right into the bedroom of a home where a man was sleeping. he is said to be in stable condition suffering from a leg injury. fire officials say the train cars were carrying materials such as sand and rocks. the cause of the derailment is still under investigation. >> and in new york city police are investigating a grisly murder-suicide at a construction site. it happened this morning at a luxury building under construction on the upper west side of manhattan. police say a disgruntled construction worker who was recently fired shot his former boss multiple times and then turned the gun on himself. police have yet to release their

>> ♪ >> attorney general jeff sessions is reversing course on a law that protects transgender people from discrimination. in a letter to u.s. attorneys sessions said the justice department will no longer interpret title vii of the civil rights act to include discrimination based on gender identity. the protection was initially introduced under the obama administration. the american civil liberties union slammed the decision calling it another low point for the department of justice. >> and former maryland congresswoman donna edwards made it official today, she's running for prince george's county executive. >> and we're going to create a government in prince george's county that is transparent, that is open and that is accessible. >> the long time maryland lawmaker says she wants to improve schools expand healthcare and grow the economy. she also pledged not to accept any money from developers for her campaign. the primary election for prince george's county executive will be held in june. >> coming up a virginia state trooper

arrested two men wanted for attacking a bus driver. police caught 19-year-old eric holmes and 21-year-old john paul after reviewing surveillance footage from the bus attack. yesterday three men tried to bring a gas leaf blower on the x2 bus near 14th and h streets in northeast d.c. the driver told them they couldn't bring them on the bus. one of them threw a gas can at the driver. no one was injured. the two men were also charged with committing two violent robberies. and take a good look at these pictures. howard county police need your help finding these suspects wanted for stealing from the macy's at the columbia mall. it happened around 10 o'clock in the morning yesterday. the surveillance images show two suspects with a handful of hoodies. police say they got away with a black acura with temporary tags. if you've got any information on these men contact police. >> ♪ >> d.c.'s attorney general said today he will not go to the supreme court in hopes of saving the city's conceal carry handgun law. karl racine said an appeal of the federal court ruling blocking the law was too risky. >> it's

backed by the mayor and members of the city council. fox5's paul wagner joins us live tonight from mpd headquarters with this story. paul. >> reporter: hey, there ladies. in order to get a conceal carry permit here in the district of columbia, you have to supply what's called a good reason, for example, you have a verified threat on your life or you have a job in which you carry a lot of cash. however, a federal appeals court has blocked that law and today the district said they're not going to fight it. the district's gun laws were forever turned upside down in 2008 when the supreme court used a d.c. law to affirm a second amendment right to gun ownership. going there again the attorney said could turn gun laws upside down which would have an impact on the city. >> if we were to lose this case before the supreme court, it true that the district of columbia worried i think for good reason that

illegal guns, but also from the north so that was a factor. >> reporter: the attorney general said today the decision not to appeal was based in part on the possibility that other good reason laws in four other states could have been in peril. >> i have received several phone calls from folks around the country, both elected officials and nonelected officials weighing in on the -- you know, the seriousness and difficulty of the decision that we have before us. >> reporter: no longer will a person applying for a permit to carry handgun have to supply a good reason for wanting one. however, it does not mean that anyone can carry a handgun on the streets of the city. a point driven home by chief peter newsham. >> you need a carry permit in the district of columbia to carry a firearm. if you do not currently have a carry permit and you carry a firearm in the d

columbia, you will be arrested, you will be charged and you will be prosecuted. >> reporter: to date the d.c. police department has only granted 123 conceal carry permits to people who have demonstrate add -- demonstrateda good reason to have one. now, there are a number of requirements just to get a conceal carry permit and i asked the attorney general today if you can meet all of those requirements, does that mean that you're likely going to get a permit and he said, yes, that good reason rule is now gone. the police department today confirmed that 425 people have already been denied permits because they couldn't come up with that good reason. live outside d.c. police headquarters, paul wagner, fox5 local news. >> d.c. fire crews are investigating the cause of a fire that injured a firefighter. >> the fire started this morning in northwest d.c. near logan circle. fox5's matt ackland has the story. >> rep

beautiful historic building right here behind me. that's where the fire happened to give you an idea of where we are, we're about a block away from logan circle. this all happening right around the noon hour. in fact, people all over the city could see is the large plume of black smoke rising up from here. i want to take you to some video sent to us from some of our viewers. this first piece of video shot at 11th and m, just a couple of blocks away from here and then this one right across the street from the building that was on fire. take a look at the smoke. here's video from our fox5 camera. a firefighter was taken away after being overcome by the heat but a little bit later the chief says that that firefighter was just fine after cooling off. at first there was a concern people might be trapped but firefighters rushed in and were able to determine that everyone got out safely. we spoke to one resident earlier who grabbed her cld

to really listen to those things that might be of concern to them. >> so, to say like, oh, don't worry, is not the way to address it or is comforting them the way to kind of -- you know, you're going to be okay, you know, we're safe. >> well, they're going to worry because, you know, that's the nature of a child, but to comfort them, let them know that you're there for them, you know, providing just, you know, basic details but not details to the point where, you know they're becoming more concerned and then keeping your composure as an adult because at the end of the day, you know, they're taking their cues from you. >> right. >> so, if you're nervous then they're probably going to be nervous as well. >> what are the signs that maybe a child is having difficulties coping? what should parents be looking for? >> as a school counselor, you know, one of the things that we see with students, if there's a concern it's going to show up in their grades, in their performance in the classroom. they may be withdrawn. you might see things like they're not eating like they normally would. you m

asking you questions that maybe they didn't have of interest before so they're just -- their daily behaviors that you see that you should really look for to make sure that they're kind of acting in the normal routines that you would see in any adolescent or for a parent what you would see on a day to day. >> which would just be a child in distress no matter what those signs are fifty two absol. >> you can't just dismiss them. >> what about the community as a whole, that the line is that it takes a village kind of things. >> it's very true. >> there are resources in the community for children. where do parents go to find that? >> [inaudible] school counselor, we're connected to a variety of resources whether it's the community services board. many of us have services right in our building. we have new horizons at the school that i work at. you have mental health workers in there as far as social workers, we have school psychologists. we have rou

harassment. the times reports two company officials say at least eight women have received settlements including actress rose mccowan. the report includes ashley judd's account in an incident from two decades ago in which she was asked to meet weinstein in his hotel room. in a statement weinstein acknowledged he behaved inappropriately with colleagues but did not address any specific allegations in the times piece. >> panthers quarterback cam newton under fire for sexist comments he made towards a beat reporter after she questioned him about a teammate's running routes. >> brody logan joining us with the latest on this story. brody, still no apology either from newton right. >> reporter: still no apology. he says he regrets it, it's also now -- he might regret it more because he's losing money from sponsorships. >> uh-huh. >> reporter: cam newton is taking heat for sexist comments he made toward a panthers beat reporter after her question about one of carolina's receivers running routes to

ni we've got some high clouds here but i think they will start to thin out late. high clouds courtesy of this front off towards our north which is bringing showers across pennsylvania and even into far northwestern sections of maryland, so as we zoom in a little bit, you can see those showers just from the hagerstown area moving down through across frederick county, maybe a sprinkle getting into northern montgomery county but this is very light stuff and even though we're seeing lightning in parts of pennsylvania with a of couple thunderstorms none of that here. the i-70 to 270 stretch just a little bit of light rain which will quickly move eastward. fox futurecast shows that complex weakening quickly this evening and staying far off towards our north and east. cloud cover may dissipate a little bit so we should start off with sunshine by tomorrow morning but it will be kind of broken sunshine, partly sunny skies expected for tomorrow. so our surface setup we've got that front off towards our north, that's bringing the showers and thunderstorms right now. that's going to allow the warm and, yes, kind of humid air to build for another day into tomorrow, very warm

high temperatures probably in the low 80's and i think with full-son sunshine by saturday we'll be into the mid 80's. here's your planning forecast for friday the last day of our work week warming up quickly, 60's in the morning, 80's by the lunch hour. we're dry. 83 degrees partly cloudy skies later on in the day. we'll get back to the tropics. this will be the story dominating the weather scene over the weekend. tropical storm nate formed kind of quickly and not too far away and it's moving very quickly off towards our north. the center of it is right over eastern honduras. it looks pretty disorganized with winds of 40 miles an hour. it is expected to move due north over the next 24 to 48 hours. tropical storm warnings for the coast of nicaragua and honduras and the yucatan peninsula including cancun. this will bring flooding rains and tropical storm force winds before strengthening to a

this is the man accused of threatening to murder african-american students at howard university. on november 11th 2015. according to the affidavit john edgar rust posted online on a site called 4chan.org using the n-word repeatedly promising that "any n's left at howard university after a certain time would be the first to go." his preliminary and detention hearing was today at the federal courthouse in alexandria and a couple of big things came out of it. an fbi agent took the stand, the prosecution verifying the evidence gathered and the defense questioning why it took them almost two years to make an arrest. even though they interviewed rust on the night in question. the fbi agent referred to the affidavit saying that it takes a period of time to access those devices. many of those devices taken into evidence were encrypted and she added it takes time to make an a
