>> ♪ >> ♪ i'm still not jim lokay, you are still not shawn yancy. >> it may be next week. >> fitz and sarah sitting in with you tonight 5 at 6:30. the gun control debate heating up on capitol hill as the investigation into the deadliest mass shooting in america continues. >> as from you can see on the run down, the big story tonight here at 6:30 so let's get to it. federal investigators they are taking a very close look at las vegas gunman stephen paddock's background. investigators in chicago say they are beefing up security now for this weekend's chicago marathon. >> you know, this comes after news that stephen paddock had booked a hotel room in chicago during another large outdoor music festival back in august, another news report says he appears to

possible attack locations in boston. we're going to start things off here 5 at 6:30 by going over to caroline shively live in las vegas tonight for an update. what's the situation caroline. >> reporter: sure we're getting more information about the time line, guys. it's very interesting how fast first responder police and even the security guards were on the scene. the fire department giving an update today when they were asked how long did it take first responders, the fire department to get on the scene the answer was literally five seconds. part of that was luck. they were on the strip, there was a traffic accident. they were coming back from that traffic accident and the captain alert captain on that truck heard the gunfire. he was trained. he didn't think it was fireworks like so many concertgoers did. he heard that rat-a-tat. they jumped off and started responding as quick as possible so some amazing response stories coming out at this hour. >> just about possibly what the gunman had planned. investigators now saying there was a

car bomb that was part of his plan. >> reporter: yeah, called tanarite. it was in his car parked at the mandalay bay hotel. that can be set off by a high powered rifle. you you shoot it and it explodes it could have taken off a big part of the hotel. he was planning to carry it out survive it and escape. was the car the next step. it all depends on what he wrote down what he found in his electronics. >> chilling details we've heard that there were bullet holes found in jet fuel containers at the airport which is not far from where you're standing right now caroline. >> reporter: 500 yards to my right. >> give us a sense of what the city is like tonight. we know areas clearly had to be cordoned off as this investigation has gone on but are

vegas now to resemble some air of normalcy if that's even possible after what's happened. >> reporter: yeah, i think you're right, i think a little bit. for one thing they've opened most of the roads. they've been blocked for most of the week people couldn't get to their jobs, couldn't get their kids to school. are you seeing some of these memorials, i think we and talked about that earlier this week, some crosses have cacross have beenput up. there are now helicopters in the sky still doing that tour. they're indeed getting back to normal a little bit but this city is forever changed for the people who live here definitely. for the tourists they may not notice the difference but the folks who live here who we talked to say they'll never forget it. >> i'm sure they won't and the whole country as well. caroline shively in las vegas for us tonight. thank you. >> that shooting is drawing new attention to what some people say is an obscure gun accessory. this is called a bump stock. it allows semi

automatic weapon. >> congress is picking up support. it has the backing of more than two dozen democratic senators but some republicans said they would be opening to considering it. it's unclear though whether president trump will support the bill but the white house says he is willing to talk about it. >> we certainly welcome that, would like to be part of that conversation and we would like to see a clear understanding of the facts. >> meanwhile the debate on gun rights is really heating up. filmmaker michael moore is getting a lot of attention today after proposing a 28th amendment to the constitution that repeals the second amendment. moore called that second amendment ancient and outdated. >> this is part of an ongoing debate. let's bring in mark levine former congressional attorney mark thanks for joining us tonight. let's start now with this idea of michael moore's because this is getting a lot of viral attention tonight online, a lot of

about it but given the logger heads that both sides are at these days on this isn't this really just kind of a pipe dream and not helpful to the larger argument about what does or does not need to be done with gun control. >> i do think that the repeal of the second amendment is a tough lift. you need two-thirds of both houses of congress and three thirds of state legislators but you really don't need that to do for example the bill that i proposed in virginia that they're proposing in congress to ban those bump stocks. the second amendment protects the people it's right collective to defend themselves. that's what the text says. people should actually read the text of the second amendment. it does not say that you should have a particular kind of gun or anything like that in the second amendment so, you know, i don't think repeal is necessary in order to get this legislation through. >> you bring up a point about the bump stocks and it's interesting that the nra coming out today saying

should be regulated. they didn't necessarily word it as a ban but do you think it's more of a political positioning on their part by saying this, or do you think they really believe at the nra that needs to be banned. >> it's hard to get in the mind of the nra. i can tell you this. they didn't support it before and they do support it or apparently are open to the idea now. good frankly. good to have their support on this. i don't agree with the nra very much. i have an f rating from the nra as my grade but if the nra and gun owners agree that lunatics shouldn't have access to machine guns, well, that's a start. there is a law a 1986 law banning machine guns but these bump stocks allow semi automatic rifles to act like a machine gun and so if congress can ban machine guns it seems to me they can ban a device that makes a semi automatic like a machine gun. >> as someone who probably positioned yoursf

side that you would like to see more regulation and more gun control aren't you arguing over the margins here. we're talking about bump stocks not the actual weapons that carried out this attack. >> i don't consider 59 dead americans and more than 500 injured to be the margins. this guy could not have done what he did. >> but the weapon mark, we're not talking about the weapon, we're talking about the bump stock. >> the bump stock is what made that man's semi automatic weapon into a machine gun like weapon. he could have done a lot of carnage and frankly i would like to go farther, i would like to see ammunition clips limited, i think assault weapons ban or something similar to it. it has some flaws but something similar to it. i would be opened to going farther than this. i agree we have to go farther. but if this is one thing we can agree on that would have saved lives in las vegas. >> mr. levine thanks so much for coming in tonight. we appreciate split my pleasure. >> dreamers on a

midnight is the time where they are going to have an expiration date on their applications to continue on as daca recipients. these are people who were illegally brought to the united states as children. they're going to be allowed until midnight tonight to reapply for protection under the obama era administration program known as daca. >> president trump announced last month that he is ending daca. today pro-immigration group casa filed a -- last minute lawsuit asking a federal judge to block president trump's move and keep daca in place. >> we are standing here today to challenge the arbitrary mean spirited and awful end to daca by the trump administration and to raise the voice of the warriors who fought for daca and won. >> all right, that's gustavo torres the head of casa. let's break down the numbers. we're looking at nearly 700,000 immigrants who are affected by daca. u.s.

told fox5 this morning about 154,000 daca permits are set to expire sometime between now and march 2018. of those 112,000 renewal applications have been filed. >> but while the president, democrats and some republicans have said they'll come with a solution before march, some say that still doesn't solve the bigger problem. >> what do you do with people who have broken our laws? if there's 11, 12 million people here illegally why do some people get to stay, some people don't. that's always the quandary. more importantly how do you give the american people that we're going to get immigration stopped and under control. >> that's dan stein. >> they argue the trump administration didn't follow proper procedures in ending daca. it claims the move was motivated by an unconstitutional racial discrimination against mexican and central american immigrants. >> now, we took a look at

today. it goes ton allege that it wants to reinstate daca as it was and shield the personal information from the daca recipients, block all that of information from federal law enforcement officials. they are concerned that if that information is turned over to federal immigration officials they could be using that later on to deport them. >> big concern there for sure. gop congressman tim murphy of pennsylvania has resigned in the wake of reports he was involved in a sex and abortion scandal. murphy is known for being strongly against abortion but recently a pittsburgh newspaper published text messages that showed the congressman asking his mistress to get an abortion when he thought she was pregnant. murphy's last day will be october 21st. >> going to advocate something you shouldn't get caught later asking someone to do it. >> hypocrisy. >> caitlin ross, gorgeous day. >> we were both s

and maybe and hopefully you all got a chance to be outside. nice and warm. doesn't feel like early october but this warmer air is in place for awhile, it's sticking around through the weekend into next week. looks dry for both tomorrow and saturday. game one and two of the division series for the nats with the cubs in town. however, tropical showers putting a damper on the second half of the forecast. they arrive sunday bringing us much needed rain courtesy of tropical storm nate formed earlier this morning in the caribbean. it's right off the coast of honduras and it will be moving northward through the weekend. it will be approaching places like the yucatan peninsula cancun mexico tomorrow and then following that looks to make landfall as either a strong tropical storm or a weak hurricane sometime over the weekend in the gulf coast from new orleans to the florida panhandle. sunny and warm the next couple afternoons. 83 tomorrow. 86 on saturday with full on sunshine. that is very warm for the nats. now, sunday showers look to be moving in pretty early so high temperatures while still warm in the upper 70's

behalf of eight transgendered individuals. >> last month the president signed a memo instructing the defense department to stop accepting transgender people who want to enlist in the military. shannon with axios to join us with more on this. what is your take on this moving forward? it was sort of a proposal that's never really been written out or anything like that, so to come out with a lawsuit beforehand prejudging, do you think it's going to be able to stand? >> so, the department of justice today is asking a court to dismiss a challenge to the ban. >> right. >> and the department of justice's stance is this ban hasn't rolled out yet. >> right. >> this is prejudging it, this is really premature but from the other side of the coin, a lot of transgender allies and lgbtq community members and individuals are saying transgender troop members are already

this. >> one of the things that was clear from the get go when the president announced this on twitter was that it wasn't quite clear that the pentagon and the military hierarchy in the armed forces were completely on board with this policy. you have the justice department asking for this lawsuit to be thrown out you have the peg pentagon over here. which department has the louder weight in this? >> i think we'll see that coming more clearly in the months to come because at this point the pentagon is holding -- having its panel right now assess what its options are in interpretation of interpreting the military ban on transgender individuals. what i'm hearing from military experts, however, is that mattis doesn't necessarily have that legal room to really interpret what this ban is and that instead, transgender troops are going to be operating under the assumption as trump laid out in his tweet in july that they're unfit for the military which any member of the transgender community would tell you that's not really what's happening

we're not less lethal at all. >> what is it you're hearing because you said you mentioned they're already feeling the effects of this? what in particular are you hearing from military experts as it comes to the atmosphere inside the military and transgender troops. >> in the first couple of weeks, what -- what these military experts were telling me is they weren't hearing a clear policy coming from mattis per se but that's part of this whole rolling out the process. they have until march 23rd to put forward what's happening for transgendered troops so it's still, we'll still see some of the policy coming out in the next several months. >> quickly, from the administration standpoint what is their standing and their argument on this? are they saying because this power as a civilian leader and commander in chief as the presidency that he alone has the ability to make this policy or are they demonstrating in some way before the court this position that they have that transgendered individuals are

arrived on september 13th, happy and healthy but two weeks early. the council had that scheduled a hearing on a number of nadeau's bills five days later thinking that they could get it all in before the baby was born but that wasn't to be. so, the brand new mom was there five days after giving birth to see her legislation through. today was the first time that she brought zoey along to work with her and this will be the plan for the next few months until nadeau feels that she's ready for outside childcare. you may be wondering doesn't d.c. have a new maternity leave law allowing new moms to take 12 weeks off from work. while it was passed in this building it doesn't apply to the elected fish officials who k here. nadeau says the entire process is helping her relate more to those she serves. >> when i first got elected i was a single girl living in the 14th street corridor and now i'm a married lady with baby and a house so what that means is i've had all of these different experiences that
