las vegas gunfire. a close friends speaks to fox 5 as had he continues to fight for her life more messages of hate found on a maryland college campus. why the accused vandals' identity may surprise. the news at 10:00 starts right now. we begin with the latest on death threats against a faulkier county student. >> administrators discovered an online chat called operation will to kill. it was taken place among students. fox 5 krysten leon joins us with the latest. kristen? >> reporter: the case is officially closed. like you both mentioned. no criminal charges will be filed here, according to the sheriff's office, because there's not enough evidence and also because the current laws here in virginia do not reflect on what happened in this case. now, a lot of parents in the community a

wandering going forward, what will have to be done what will change at liberty high school in order to insure their students safety. now, tonight, about 100 people from that community, they attended liberty high school for the town hall meeting. again, questioning why these students accused of threatening another student's life on an ap are not being criminally charged. a week ago, administrators say several students were on an ap called discord, under operation will to kill. we're told on that ap, the six students threatened to kill another student and went into disturbing details how to go about that. well, again, county sheriffs are not charging these six students and the community as you can imagine, not only in disbelief, but outraged over the outcome. >> this is my community. those are my kids. this is in the ok with me and it shouldn't be with anyone. there needs to be an arrest. we need to

children need to be arrested. this was a threat, this was conspiracy to commit a felony, anything less than arrests of these children is a gross misjustice. >> reporter: the sheriff told us he shares the frustration. they would of course make an arrest. however, they say no crime was committed according to virginia law. now, parents here have told me that they seen a number of cases at liberty high school dealing with cyber bullying and bully be in general, so they're now riding to their congressional and state leaders to advocate for a change when it comes to virginia law. and again, the sheriff's office is also encouraging these folks to do just that, as far as the punishment for the six accused students. the sheriff told us that he will not be disclosing any other information in regards to that. krysten leon fox 5 local news.

scattered storm in las vegas, a maryland native who was shot and injured is makings progress. 27-year-old tina frost is a graduate of arundel high school. shot in the eye and remains in a chemo, but her family said her condition is disable and she's starting to breathe on her own. lindsey watts is getting the latest from a family friend. lindsey? >> reporter: tony, tina frost has a long recovery ahead. family still waiting to see the extent of her brain damage. they're focusing on all of the positive steps she's they know this she's taken. we learn it was a stranger had helped save her life >> it's hard to keep their spirits up but they made a packet when they're with

they're only positive. >> reporter: family friend amy clinicer said she continues to heal in intensive care after suffering devastating injury >> the bullet went through her right eye and traveled into her forehead. she had to have three hours of surgery at which time they removed her right eye. and her forehead was shattered. >> reporter: frost was at the country music festival in las vegas with her boyfriend austin. as gunfire rained down on the crowd of 22,000, it was stranger who helped get frost to safety. >> her boyfriend and this man name shane who we have come to learn was a first responders from california who happened to be a concert goer. austin and this man carried tina about 300 yards from where they were standing within the concert area to the see

found a pickup truck that had space on the back of it. >> reporter: the distance they carried her the length of two and a half football fields. austin made contact with shane since the shooting and the frost family can't thank them enough >> he saved her life. austin probably could not have made it through the crowd that distance on his own. and this man without blinking an eye helped you know, get her to safety, and get her to the hospital as quickly as possible. they are you know, beyond grateful for that. >> reporter: support for frost has stretched across the country. from where she was currently living in san diego back here in maryland >> this one really hit home >> she had a passion for sports and student, fellow student athletes. >> reporter: faculty and students at arundel high school were quick to share their love and prayers for frost and for her family as

hospital hanging on to home. >> the outpouring they got from the company has really warmed their hearts at such a difficult time. >> and this is the gofundme page created for frost and her family's expenses. the goal was $50,000. it is nearly $500,000. there are also several fund-raisers happening in maryland this month to support frost. we'll have those details on our website fox 5 dc.. lindsey watts fox 5. developing right now in fairfax county. police are investigating a deadly pedestrian accident on route one at gunston and lor ton roads. the driver of the car that hit the pedestrian did stop and stay on the scene. at this point, there is no word if any charges will be filed. we're learning details about the investigation into the las vegas shooting. authorities say the

stephan paddock shot and killed 58 people and had stock-piled his car with explosives. he also had personal protection gear as part of an escape plan. investigators continue to talk with paddock's brother and girlfriend but they say they still have not pinpointed a motive. >> currently, we do not believe there is one particular event in the suspect's life for us to key on. we believe he decided to take the lives he did and he had a purposesful plan that he carried out. . victims relatives and survivors were allowed to return to the shooting site to reclaim belongings left behind in the panic as they fled. university of maryland in college park. last week, police charge add a man for spray painting a swastika. according to court records we learne

fox 5 evan lambert is live with the latest on this one. evan? >> reporter: university of maryland police say 52-year-old ronald alfred senior is the one who painted that swastika here on campus. we went by an address for him today in hyattsville, take a look what happened. >> are you ronald? i've evan with fox 5. we just have a couple questions for you. are you the one that was accused of painting the swastika on umd campus? can you tell us why you would do that? did you do it >> no comment. >> reporter: as you just saw, a man who came to the door at alfred's home didn't quite respond to my question about whether he is the man police have charged in the swastika incident on campus at hagerstown hall. but he did say no comment. several times, when i asked why he might do something like that. police say on september 27th, alfred somehow accessed hagerstown hall on north campus and spray

a trash cart. police identified him and issued him a court summons thursday, charged with malicious destruction of property and disturbing the operations of a school. we spoke to students about the incident and the fact that the suspect is from a historically oppressed minority group but remains accused of the hateful incident. >> when it happened, we thought it was a student that went here and lived in the building, so i was kind of like i have to live here. what if he still goes here. i guess it's kind of scary a random guy got in the building. if he's being held accountable i guess it's better. i guess it proves that you don't have to be a certain race to hate people. it's just you would think that someone like, especially like someone from a race that has been subjected to hate before, you would think why would you want to reciprocate that? i guess that's the world we live in today. >> reporter: alfred is not allowed on campus, we asked the university of maryland police and the school's communications team how he had access to that resident's hall or

some kind of connection to the campus. we are waiting to hear back on that answer. live in college park, evan lambert, fox 5 local news. to prince george's county high school students have tuberculosis. the students attend henry wise school officials notified teachers, staff and parents. those affected students are under going treatment. health officials say there's no risk of additional exposure. the system is now working with the county health department to offer screenings to anyone who may have come in contact with the students affected. there was heartbreak for the nationals in the windy city this evening. nats lost to the chicago cubs two to one. despite a great outing by matt scherzer pitching a no hitter then the wheels starting falling off. the nats had a one nothing lead but the cubs tied it in the seventh and played the winning run in the eighth. nats trail the best of five division series two games to one, it's not over yet. they're back in action tomorrow evening for game four.

where she later died. the condition of the officer, who she allegedly hit with the car is unknown at this point. the officer who shot and kill her has now been placed on administrative leave pending an investigation. developing, ten people have died and two hurt in wildfires in wine country in california. destroyed at least 1500 building and charring thousands of achors of land. the flame sent hundreds in a frantic middle of the night scramble to evacuate their homes. many communities and churches are opening their doors to i vacate what wases. residents in anaheim are spraying water on their homes to keep them from burning to the this after wildfire

screaming at the driver to stop, some of the students are telling the driver to stop. this happened last week in parkville maryland. police say laverne durant was trying to stop the bus. someone on board threw a bottle outside and hit his car. the bus driver decided he wanted to drive slowly to the police station to get help but ended up getting stuck in traffic. police got there and arrested the man. . caught on camera, a man driving a stolen ambulance led police on a wild chase in michigan. the driver swerved to avoid police. the ambulance slid off the road into a field, turned around and kept going. chase eventually ended at some point here, sliding off down the road into the field. the chase eventually ended police arrested the man as you can imagine, he's facing multiple charges. following some breaking news just coming into the newsroom from texas. a texas tech university police officeras

back in tomorrow night and into wednesday. we'll look at that futurecast. unfortunately. we cool off a little bit this week then we warm back up for the weekend but the good news for the weekend, we like the weekends to be dry. we've had such a run of dry weather in september and early october. this weekend looks like it will be dry and actually looks like it will be delightful. look at these high temperatures today, average high is 71 for this time of year, 87, dulles, bwi and reagan hitting 86 degrees, and tomorrow will also be on the warm side, 84, might be a few degrees cooler than this because we will have more cloud cover. but it certainly looks like we may be able to certainly get into the 80's. wednesday a chance for showers, 75 degrees. that's not because a front is coming through, it's because the wind direction will change and will cool off because the flow will be off the ocean but still load us off with clouds and give us more of a feel that's out of of the ocean direction.

most places are in the 70's, but well into the 70's around this area and i just wanted to continue to show you these crazy high due point temperatures, few spots aren't that bad. most everybody is uncomfortable to oppressive tonight with due points well into the 70's, which makes it feel a lot warmer than the actual air temperature. for example, 80 in dc feels like 85 when you factor in the humidity. of so we watch our tropical remnants of nate which is a post tropical system, no more advisories being issued on 98. a little bit of a weak trailing front will go through and kind of wash out over central virginia but i wanted to show you tomorrow morning, we start out dry. could there be a couple of spotty showers in the form of drizzle? yes, mostly a lot of clouds and tomorrow evening, afternoon and evening, that front that passes by to our south and kind of stalls down here may develop an low pressure system on it that would bring stash rains according to the futurecas
