maryland school choir's performance goes viral. >> ♪ >> your news starts now. >> ♪ >> first up tonight we're following breaking news out of seat pleasant maryland. police there are investigating a deadly accident involving a pedestrian. it happened shortly before 9:00 tonight in the area of central avenue and old central avenue. we're told the man was in the middle of the street when a car hit him. the driver did remain on the scene. part of the area is shut down now while police investigate. also tonight an emotional day in court for a northern virginia family. a man accused of killing a 17-year-old muslim girl appeared in court today. >> but things quickly spiraled out of control when the victim's parents lashed out at the accused killer. fox5's evan lambert is live at the fairfax county courthouse with the details on this. >> reporter: sarah that happened during a preliminary hearing for the accused killer of 17-year-old

and a family attorney is telling us that the parents of nabra just got so distraught when they saw that accused killer for the first time in court. extra security had to be called in to the courthouse after that outburst.urst. that and friends of 17-year-old nabra hassanen who came to the courthouse to show support for her family today. there are several reports that say the parents of the murder victim started yelling at the accused killer, 22-year-old darwin martinez torres. according to witnesses they heard nabra hassanen's mother shout she would kill martinez torres and saw her throw a shoe at him. the commonwealth attorney's officers confirms after the chaos, martinez torres waved his right to preliminary hearing. what that means is the case will go to a grand jury as a felony case on monday. hassanen's father and family say they want the accused killer held responsible. >> we're

them through this difficult time. >> reporter: the grand jury proceeding is the next step on this and that is monday at 9:00 a.m. of course we will keep you posted. live in fairfax county, evan lambert fox5 local news. >> now to montgomery county. and new information in the murder of laura wallen. the pregnant teacher from olney was found shot to death and buried in a shallow grave. police say her boyfriend tyler tessier killed her. today the state's attorney says he will not prosecute tessier in the death of wallen's unborn child. fox5's lauren demarco joins us now with more details. >> reporter: despite the fact wallen was nearly four months pregnant her boyfriend tyler tessier had only been indicted of one counts of murder. the montgomery county states attorney explained today why under state law he can't hold tessier accountable for the unborn baby's death. >> her child was autopsied. medical team established

murder the child was 14 weeks old. based on medical testimony, the child was not viable -- not viable independent of miss wallen. based on those medical findings and as a matter of law in maryland, as a result, the defendant is not chargeable with a second count of murder related to the child. >> reporter: the popular social studies teacher had been missing for several days when police held a news conference and asked tyler tessier to attend. at the time investigators had not disclosed publically that he was a suspect. her parents knew hadn't to play along. investigators wanted to see how he behaved. tessier was arrested a few days later and we then learned while he was dating laura wallen he was engaged to another woman. wallen had discovered that herself and according to a court document asked for a meeting woman to woman. detectives have a

showing tessier and wallen together at a safe way the night of september 2nd around 8:30 p.m. hours later the pregnant 31-year-old was dead, shot in the back of the head and buried in a damascus field. if tessier is convicted for the murder of laura wallen the judge at sentencing may be able to consider the death of the unborn fetus. the state's attorney says he's also considering filing a notice that would make tessier eligible to be sentenced to life without the possibility of parole if convicted. in the news room laura demarco fox5 local news. >> investigators in anne arrundel county made their first arrest to help combat the growing opioid epidemic there. gabriel duval is charged with involuntary manslaughter in the death of a man who overdosed in january. police say he sold fentanyl to the man which led to his death. if convicted for involuntary manslaughter duval faces up to 10 years behind bars. he

ame church. the 19-year-old was found murdered behind a church in charlotte north carolina hundreds of miles from where she was last seen in norfolk virginia. they're offering a $10,000 reward for information about ashanti's sudden disappearance and death. >> an update to a shooting at a wal-mart in ellicott city. howard county police say they have arrested and charged diondre eason. he shot matthew spencer on sunday after the two exchanged words. spencer survived his injuries. take a look at the sketch right here of one of two suspects wanted for robbing a gaming -- a game stop store in wheaton. that incident happened last tuesday at a game stop along veirs mill road. police say one suspect confronted an employee at gunpoint and demanded cash while the other stole merchandise. there's a $10,000 reward for

an arrest so if you know something, please give police a call. >> ♪ >> president trump followed through on a major campaign promise today by taking the first step in pulling the u.s. out of the iran nuclear deal. the president announced his refusal to recertify iran's compliance with the deal. while the move does not kill the agreement the responsibility now falls on congress which must decide whether to impose sanctions on iran or attach new conditions to the agreement. >> we will not continue down a path who's predictable conclusion is more violence, more terror and the very real threat of iran's nuclear breakout. that is why i am directing my administration to work closely with congress and our allies to address the deal's many serious flaws. >> lawmakers now have 60 days to decide whether to reimpose u.s. sanctions on iran.

wildfires continue to rage through northern california tonight. at least 35 people have died in the deadliest week of wildfires in california history. hundreds more are missing. fire officials say 5700 homes and buildings have been destroyed. and some 90,000 people are now displaced. 21 fires are still burning. yesterday congress passed a bill to send disaster funds to california. >> ♪ >> now to the latest on the investigation into the las vegas shooting. at a news conference today the sheriff cleared up the time line of when the gunman opened fire on the crowd attending a music festival. he says the security guard in the mandalay bay hotel was shot around the same time that the gunman started firing on the crowd below. now, initially there were reports that six minutes had passed between when the guard was shot and when the assault on the crowd took place. >> there is no conspiracy between the fbi, betwe t

police are still looking for the person responsible for her disappearance and murder. >> the sheriff in frederick county says ms-13 gang members are creating a public safety problem and the sheriff is going as far as calling them domestic terrorists. sheriff charles jenkins says frederick county unlike neighboring counties jenkins has taken a hard line stance against the el salvadorian based gang. he's urging law enforcement to follow his lead to help protect communities. >> once we lock these people up get them off the street our greatest progress comes in the fact we're working with ice and the 287 program. once we arrest these folks, we can get them off the streets and then after they serve their sentences they're turned over to ice and they're removed from the country. i don't know why people in law enforcement and our political leaders are afraid to admit the fact we have this problem to deal with. >> five suspected ms-13 gang members are in custody right now in

haven't seen that will return or at least arrive by next week. 63 in d.c. now, 66 in annapolis, 61 out in baltimore, 61 frederick and 60 in martinsburg. visibility is low in some spots due to the low clouds and fog, just showing you this. any time you have below 5-mile visibility gets a little difficult to drive especially in some of the dark country roads but it's nothing too terrible. the fog isn't overly dense. onshore flow has been bringing showers to the coast. no real rain showers here, just that fine mist that we've had really for the past 48 hours. fox futurecast shows into the overnight that overcast hangs tough. so you wake up to cloudy skies kids' activities are fine because it's not really raining, it's just a little drizzly. we'll dry out probably by the noon hour and we'll get a decent amount of sunshine quickly. once you get out to loudoun county, the 81 corridor that's a bright sunny afternoon. peaks of sunshine along 95 and you may still be socked in the further east you go headed towards the bay. it's just a really slow crawl to get back to some clear skies. this mel
