explosive allegations against senate candidate roy moore. reports of him having sexual contact with ten when he was in his 30s was leaked by moore's political opponents. this morning, moore remains defiant is ready to fight back. kristin leon live on cap capitol hill. good morning, kristin. >> reporter: good morning, holly. defiant is one way to describe it here. moore is adamant in this case that these allegations they're not only outlandish, but they're also cruel and vicious attacks and he stands by saying that they are false as well even calling these allegations as far as calling them fake news in this case as well, and so he is now suing the washington post for the latest article posted about him and these allegations. to give you a little bit of background information here on this story, it all starred when a woman came forward claiming that moore sexual al abused her 40 years ago when she

years old. well, that obviously became a political controversy very much a political scandal here going forward especially in the alabama senate race and since then the washington post they recently published an article saying that four other women have also come forward claiming sexual abuse when they were teenagers as well. look i mentioned, moore is adamant that this is simply not true and he will not be stepping down from the alabama senate race. he will continue to pursue and persist in this case and defense his character. >> there are some new polls that are out there, and all polls aren't really in agreement as to how this is affecting him. >> reporter: surprising, holly, you're right. i mean the polls, they play a telling store in this case essentially. so it's showing that moore is actually not too far behind from his democratic opponent

jones in one of the polls actually showing that he's down by 4%. 42% of voters to 46%, and, you know, a lot of political analysts they came out saying that they thought in this case that with these allegations that he would be losing dramatically, but as of right now, it's not showing that that's the case and even moore came out as well talking about how a lot of people thought that these allegations would simply not be good for his campaign, but he's essentially saying, ha, ha, look at the numbers this is the case going forward. some republicans like i mentioned they have called for him to step down in the senate race here, and we're also told that trump once he comes back from asia that he, too, will also call for moore to drop t of the race, but like i mentioned before, moore continues to defend his character, calling these allegations false allegations and saying

going forward in this senate race. >> all right. it will be interesting to see how it all plays out. thanks kristin. >> almost a gift to the president who didn't want to be him a candidate in the first place. not the cam candidate he back. maybe my candidate should be the write in candidate. we'll see. >> this morning police in prince george's county are still investigating officer involved shooting that happened last night. now it happened on newton street just after 9:00 o'clock. police say they got call about a man with a gun after officers arrived on the scene and one of them shot the suspect. now the man survived and is in the hospital. right now fox5 is still trying to learn more about what led to the use of force. over in montgomery county, today county executive ike leg get expected to sign a bill to raise the minimum wage into law. earlier this month the council approved that bill to raise the county potions minimum wage to convenient dollars an hour by 2020. the current him mum wage is 11.5 tee an hour. he'll sign that bill at noon today. the hollywood

minute. we'll tell you that mayor bowser will be here. this is dupont circle park at 3:00 o'clock this afternoon. she's going to meet here with ward two council member jack evans, and look you see the guys here are cleaning up garbage. this is a prime location for rats. it's dark here right after sunset all the way up just before dawn rats run rampant here at dupont circle, and she's going to go from here up to 117th and r streets through the business district here along dupont circle. what she's going to find we can show you the first picture i took it this morning. garbage cans, trash bins overflowing, and those are great attraction for the rats that have been plaguing the downtown area for decades. centuries probably, guys. and then what she wants to do is encourage businesses to lease or buy the second photo i can show you these new solar trash bins. they're popular in other cities. boston has them. the mayor will talk about a waste chiropractor grant

to help up to 60 businesses to buy or lease these new trash bins to try to keep the rats out of their alleyways. of course, just what you want to see first thing in the morning, guys, we can show you some video tape of rats we've gathered up this video in recent weeks and months. anywhere in the downtown area where there are businesses with garbage cans, with those grease pitts, it at tract the rats. mayor bowser says she's going to try again encouraging people to call 311 or text 311 if you want to report an infestation or a rat siting. it's an on-going problem. the mayor says she's just wants to try to make another effort encouraging those new garbage cans for people to do better job of containing their garbage to try to get rid of the rats, guys, it's a public health matter, and it's clearly an eye soar and a thing that freak people out here in the downtown area. >> sure does freak people out. i'm looking at the pictures side by side with you bob. one person just tweeted where has the mayor been? did she not know is

james mcmillan entertainment lawyer. we appreciate you so much for taking the time this morning. >> thank for having me holdly. >> where can all of this really go legally? >> well, it depends. it depends on, one, how long ago the allegations happened. so in a certain instances like for harvey weinstein, you've got pastor got the new york prosecutor's office considering bringing criminal charges against him. and they're actually gathering evidence as we speak. then you've got someone like kevin spacey whose been accused of sexual assault but it was so long ago that there's a question as to whether or not the allegations actually can stick. you've got two things. you've got the court of public opinion, right, which all of these men have clearly been demonized in the court of public opinion. >> um-hmm. >> whether these allegations can be proven or

then you've got an actual of court of law where you're innocent until proven guilty and all about how much evidence you can bring forward to show that you're actually guilty of a crime. >> it will be test interesting to see how those all play out in the legal system. >> right. >> we'll have to watch that. right? and see what happens. but i think the thing that, um, really is damage damming for these people right now this court of public opinion. so the question is, can they get passed it? can they have a resurgence that their career? you have someone like louis ck who literally has said, yes, i did it. but i did it because i didn't understand at the time what i was really doing was wrong. is that a tactic that can work? >> you know that's -- i think that's a better question for pub look relations crisis expert. >> um-hmm. >> but you know clearly you've got like you said you've got different ways of approaching it. by the different celebrities some like louis ck have come forward and he's actually admitted that he actually was, you know, he's done

then you've got people like harvey weinstein who have come forward and said, yes, i'm sorry for actually using my power in certain instance but i never raped anyone he admits on one hand that he did some inappropriate -- did some inappropriate thing but on the other hand he says they didn't amount to an actual crime. good didn't do anything illegal. >> exactly. >> when we talk about since you're more versed on the legal side of things when a celebrity gets accused and even it's probably fair to say more will be, right? or politicians or whoever media people whoever it may be is it smart for them to legal up? >> i think so. >> immediately. >> absolutely. i think so. >> coming from an attorney. [ laughter ] >> absolutely. absolutely. >> doesn't that have for make you look guilty or just a smart decision. >> i think it's a smart decision because you never know. and you want to make sure that the things that you say or -- we're talking about public figures. for the most part or people in power

whatever and they all have, um, something to lose. so in the instance when you've got something to lose or you can be libel either criminally or civilly, you should lawyer up. >> you know i do think we're also in this time frame now there are there are people that start to question the validity of some of the accusations. >> right. >> you're right. accusation can be out there and the court of pub look opinion, you know, they're guilty right away. >> but for someone that's thinking about coming forward, um, and believes that they have been done wrong, what do they really need legally for there to be action that is taken? >> well, ideally you have proof. you have some form of prof. now, that speaks to the statue of limb takes in at love instances the depends. >> when it's said versus she said what kind of proof can you have? >> it's tricky, because in that instance you've got to be willing -- you've got to have a victim willing to go through a rigorous criminal trial which could b
