>> ♪ >> well, a new claim of sexual harassment tonight, this time it is democratic senator al franken on the hot seat. >> as you can see from the run down, this is what we're talking about tonight at 6:30 and man, this one is getting traction in d.c. and around the country. >> yup. >> los angeles radio host leann tweeden alleges senator al franken groped and kissed her without consent. tweeden says the minnesota democratic forcibly kissed her during a 2006 uso tour. the host says franken posed for a photo with his hands on her breast as she slept and you see that picture on the right. the democratic lawmaker is apologizing. >> fox5's tom fitzgerald is live on capitol hill with the fallout and reaction to this. fitz. >> reporter: well, good evening, you know, this has been an explosive del

supposed to be about tax cuts but a lot of conversation was about al franken. let's show that photograph again, the one in leann tweeden has now published herself. she says that she was completely unaware of this and only found this photograph on her camera after she returned from that trip. tweeden had a press conference in los angeles today and said this incident of the groping and kissing happened after franken insisted they rehearse a scene that he had written for a uso show. >> he just put his hand on the back of my head and he mashed his face against -- i mean, it happened so fast and he just mashed his -- his lips against my face and he stuck his tongue in my mouth so fast. and all i could remember is that his lips were really wet and it was slimy. in -- in my mind i called him fish lips the rest of the trip because that's just what it reminded me of, i don't know why, and he stuck his tongue down

remember i pushed him off with my hands. >> reporter: now, for his part, senator al franken took two tries at issuing statements about this today. earlier in the day calling this photograph you're looking at right now a bad joke. he later went on later this afternoon to issue a more detailed statement taking issue with his own actions in this instance and we also saw today a resurfacing of a speech that franken made on the senate floor back in 2010 listen to this describing this uso show where tweeden said this incident took place. >> during the show i would -- i was kind of the co-host with a -- a beautiful, um, woman named leann tweeden and we'd do comedy routines and we'd introduce music, introduce the cheerleaders. i'd go out and do a monologue and this is something i would do, had done for a number

years. >> reporter: tonight there are calls on both the democratic and republican side for senate ethics investigation to commence into this. we should tell you, jim and shawn, there are calls from some groups for franken to resign. however, leann tweeden herself tonight saying she can accept the senator's apology and she is not calling for him to leave his senate seat. >> this is something again fitz we talked so much about roy moore and everything else, look at al franken has really been posturing himself as a voice of the anti-trump movement. this really doesn't work in his favor if he had any aspirations beyond the u.s. senate, that's for sure. >> reporter: well, that's true and i can tell you, you know, we went back over the past year and looked at some of the statements that al franken had made in regards to the allegations against donald trump during the campaign last and october. i can tell you as we went through there, we did not see as many strong statements as we thought

from al franken last year. one of his comments to one interviewer was that he was concerned that the candidate might not be able to concentrate on the job of president of the united states. you know, democrats i should tell you also are very quick to point out the differences in this case of al franken and roy moore. there are almost a dozen women now that have come out against roy moore, some of them teenagers, some of them, you know, as young as 14 years old. they are also making the point tonight that if you are going to condemn al franken, you need to take a good hard look again, republicans, at the exact details of what's been alleged against judge moore. >> thank you, fitz. the other big thing to remember here is that this is not a partisan issue. this is an issue, it doesn't matter your politics here, it's wrong. people are speaking out about it. and i'm glad that they're doing that and i think people need to be held accountable. >> i wonder if you look at some of these cases and you remove the identifying information and say

politician did this and then you put in the party affiliation, how many people's opinions would change. >> it's sad if they do. >> yeah absolutely. >> but it shouldn't matter. >> you're absolutely right. >> all right, meantime news of the allegations against senator franken have been trending on social media. many people including celebrities and lawmakers have been expressing their support for leann tweeden and emphasizing the importance of zero tolerance. chuck schumer tweeted and called for the ethics committee to launch an investigation. senator hassen. alyssa milano posted zero tolerance. tom arnold tweeted i believe you leann tweeden. wish i could have been there to protect you. again al franken apologized. >> he and leeann tweeden used to work on a cable sports show years ago. they worked together so there was a person connection. tom arnold didn't inject himself to the argument. they knew each other. >> back

>> fox5 told you the congressional office of compliance has made out more than $15 million of your money in settlements to more than 230 people since 1997. >> new tonight updated numbers show how much has really been paid out for congressional workplace violations including sexual harassment. most noticeable in 2002 and 2007 alone, $8 million was awarded. that is absolutely mind boggling to me. we as taxpayers should demand to know who those people were. they should be unmasked because the fact that it was our money that is settling these things to me is just outrageous. >> it's wrong. it's absolutely wrong. and again, it's -- how do you get to this point where you can expect that you sign these nondisclosure agreements and obviously the victim they should remain anonymous. >> sure. >> but for these lawmakers who we're covering for, we're covering for, we're paying for their legal fees. >> paying for. >> paying these settlements out. let's move on tonight. a federal judge in new jersey declared a mistrial today in the corruption case

jersey democrat senator bob menendez. the jurors said they were hopelessly dead l locked and unable to reach a verdict. the new jersey senator was accused of providing a doctor with favors in exchange for lavish gifts and vacations. >> i want to thank my colleague, senator cory booker, who has been supportive from day one, traveled the state and spread the good word, was here on the first day of trial and came and testified and was in my mind a profile in courage. >> the prosecution now has the option of retrying the two men. no indication what will happen there. >> ♪ >> a live look at the hill today. victory for the gop tax plan. the full house passed a major reform legislation along party lines. it slashes the 35 percent corporate tax rate to 20 percent. it trims personal income tax rates and cuts some deductions and credits but critics say it benefits the rich and hurts the poor. meantime the bill may have trouble with republicans in the senate at

senator said he will not vote for the bill as it stands because it doesn't do enough for small businesses. the gop has only a two seat majority in the senate so the measure again could be troubled if they try to pass it. another sore spot for some senators could be the rollback of the obamacare individual mandate which is now part of the senate tax bill. >> it is not part of the house bill that passed today and remember, we talked about the has passage, this is huge but keep in mind the house also passed repeal of the affordable care act and that didn't go anywhere. we didn't see a rose garden celebration this time around like we did last time around. so stay tuned. >> yes. we'll be watching. >> major crackdown on gang activity across the country has led to more than 200 ms-13 arrests nationwide some right here in our area. >> tisha lewis joins us from ice headquarters in southwest with more on the massive sting. >> reporter: this massive bust was led by federal state and local law enforcement here at ice headquarters, ice's top boss reiterated combating ms-13 is a priority. today's announcement is the culminatn

month long investigation. >> this successful operation continues our efforts to attack ms-13 both domestically and abroad disrupting their financial networks. ms-13 terrorizes communities through violent crime and its mission to rape control and kill. this is a great operation but we are not done and we will not be done until we totally dismantle this organization. >> reporter: and that was deputy director of ice thomas holman. he says the goal of the operation was to disrupt the gang's global financial network. in baltimore, four ms-13 gang members were arrested and indicted on charges including violent crimes in aid of racketeering and conspiracy to commit murder in aid of racketeering. ms-13 is described as one of the most dangerous criminal organizations in the country and our area is no exception. in september ice announced the first phase of this operation raging bull which led to 53

arrests in el salvador. the second phase took place in the united states. >> of the 2 214 arrests made in the u.s. 93 were arrest on federal and or state criminal charges. the remaining 121 were arrested on administrative immigration violations. 16 of those arrested were u.s. citizens and 198 were foreign nationals. of which only five had legal status to be in the united states. >> reporter: individuals are reportedly classified as gang members if they admit to gang affiliations or gang ties which is often hard to prove. operation raging bull is the latest effort by ice to target gang members and their associations. tisha lewis, fox5 local news. >> all right, we saw tisha out there bundled up with a scarf on. getting a little bit chillier out there tonight. >> earlier today it was nice, had some shorts on worked out, did a little walking, it was nice.

[laughter] >> no, i'm asking for a friend. >> oh, sure. >> hey, listen, the shorts will not feel good later tonight because we had a frontal boundary come on through and behind it pretty gusty winds so we did have a warm afternoon. it was lovely getting up to 64 degrees but the breeze has really kicked in and while it will still be somewhat breezy overnight it won't be quite as gusty as it has been this mid and late afternoon and into the early evening where we've seen some places gusting to 30 miles an hour. now, it is a nice day tomorrow. it will be a little bit cooler and it will certainly be a chilly start. we'll probably drop into the upper 20's to low and mid 30's tonight. we have more showers in the forecast but they don't get here until late in the day on saturday. sunday is going to be getting chillier by the hour. we'll see temperatures starting in the 50's and head down to the 40's but sunday should end up being mostly a dry day. and so far so good in the

eight stories high. this is significant. >> it's a major museum. this is a $500 million project funded basically by the green family. it is over 430,000 square feet of exhibition space and that means that it's comparable to the african-american history museum. >> they've put the majority of money into this, they've also been collecting artifacts from their own collection that will be a part of this. how do they keep themselves out of this? >> well, of course they're claiming that they want to stay out of politics and if you look at the exhibitions as i did over the last couple days, they're not explicitly political. this is not a museum that's hectoring at you particular biblical world view it's not asking that you vote a certain way or believe certainhi

christian family and they were the family behind the supreme court case in the hobby lobby decision which allows for profit corporations to a assert a certain individual's right of religion to say this is against my conscience and she don't have to do it. in this case women were denied contraception coverage through the hobby lobby insurance plans. >> we were talking about the museum and getting a view of it over the last couple days. what was your take away from going through it? what did you notice? it certainly looks impressive on the video, yeah. >> beautiful. >> from a purely professional point of view in terms of design and the exhibition layout and the density of content it is a very accomplished museum. i think people who come here would be hard-pressed to tell the difference between many of the exhibitions there and anything they would see at the smithsonian. you have to dig a little deeper and look at some of the fundamental assumptions behind them. >> and i'm

>> brody logan live from the supreme court tonight. >> jim, that's not nice. >> jim you look great in front of the supreme court. >> reporter: it's a landmark moment for me. and it could be a landmark case for sports and america. so, it's interesting to think about just how far we've come when it comes to sports gambling in this country. just five, 10 years ago you heard the commissioners of all the major le leagues coming out against sports gambling. we'll have multiple pro teams in las vegas and even adam silver the head of the nba says he welcomes sports gambling as long as it's done correctly. in a case that's going to be heard in these halls on december 4th could be what shakes up the game. so, currently only four states have the option to have sports gambling and las vegas nevada is the only one that has full sports gambling but new jersey has sued for the right, say that they as a state they could have sports gambling if they want it and if that happens that's going to open the door up for multiple states, 14 states already have legislatio

talking about a lot of money. we're talking half a trillion dollars potentially that currently is going from the u.s. bet and offshore books. now, that's the upside. you can tax that money. the downside, well, it's pretty substantial. >> the gamblei fica tion of sports with the emphasis or the passion for the sport but whether the line was covered or whether some particular player may not have, you know, given too much of an effort because maybe he had something on the line there will be suspicions potentially if do they have account level oversight of every bet that is placed in the market. that allows a regulator to understand where the are the problems, which are matches bet on in a auspicious way, do we need to help them make sure they're not getting involved in addictive behaviors. >> reporter: and that's going to be something to follow if ts

do have legalized sports gambling in america. the problems with gambling addiction could be greater from just what we have with casino gambling and people have the option on their cell phones to go to over 500 different sites and gamble off shore. there's the concept like you were hearing the competition of the game. people are going to be focused on the line than what's happening in the game and the integrity of the game, referees, college players are susceptible to these kind of payments from bookies and the like. i did a poll on twitter i wanted to see what people thought about this and in just a few hours we have 76 votes and 74 percent of the people say online our viewers that sports gambling should be legalized and this is actually a wide ranging decision because, jim, and shawn, this is a tenth amendment issue. so, if they say that sports gambling can go to the states, and that is a states rights issue, that is a federal law saying there's no sports gambling so that is something that could have wide ranging im
