the white house outrage after 30 hours of deliberation a california jury found jose garcia, not guilty of murder. manslaughter or assault charges for the 2015 shooting death of indicate stein nel. stein nel was shot in the back walking on a peer with her father in 2015. the case ignite add national immigration debate because he had previously been deported five times and was wanted for sixth deport teague. he called the shooting an accident saying he thought a gun -- found gun wrapped in a shirt under a bench. his attorney told the jury the bullet ricocheted. the jury never heard about his criminal or immigration history a fact that enraged the president. he fired off series of tweets saying, the defendant quote came back and back over the weekly protected obama border. always committing crimes and being violent. yet this info was not used in court. his exoneration is a complete travesty of justice. bill the wall. his defense attorney disagrees and had message for the white house after the

hiccup out of the north and west at 18. temperatures around the rest of the region little cooler north and west. 40s 45 at frederick and west minster. martinsburg 45 as well. dulles at 48. manassas now 49 degrees. fredericksburg is warming up into the lower 50s as is quantico. eventually i do think most will approach that fief tow degree mark and here in d.c. we may approach the mid to upper 50's later on this afternoon. it's the winds they're strongest in the city 18 right now. but map annapolis at ten. dulles at ten as well. few degrees cooler. take that into account. other than that you can see how quiet it is. very very quiet weather pattern now here for the east half half of the country which will last into the weekend forecast for today 58 degrees. lots of sunshine just a little breezy at times. then as we head into the weekend again i mentioned high pressure sliding north and eve get a little on shore flow. that will bring in few more clouds help keep temperatures 40s for highs north and west here in town into the lower 50's as we get into sunday high pressure sinks into the south that's a warmer direction for us.

statute it simply means that flynn lied to the fbi and the fbi had information that was overwhelmingly clear that was in conflict with flynn's statements. based on the timeline in december it appears at least one of those pieces of evidence is a telephone inter center and electronic communication that showed contrary to what flynn told the fbi. this is a very important moment in the special counsel investigation. flynn will become the most senior person within the trump administration to reach an agreement with special counsel over his actions with russia leading up to the transition in january bill. >> catherine, does this give us any indication that mueller is closer to concluding or just proceeding? >> reporter: well, nine is a very senior individual, and one of the t

it is rare we start the 10a with breaking news that's exactly what we'll do today. thank you very much for being with us. our big story at 10:00 o'clock breaking in the federal russia probe. former national security adviser michael flynn making charged with faking false statements to the fbi due in court in 30 minutes for plea hearing and we hear he'll bleed guilty. let's get to melanie alnwick outside district for the latest. mel. >> reporter: good morning guys much these charges stem back to december of 2016 and flynn has been charged with making false statements to fbi investigators. the first one has to do with -- remember on dose 29th the obama administration expelld 35 russian diplomats from the united states saying they really where just a front for spice closing two waterfront estates one in new york and one in maryland. those were sanctions imposed on are you is a because of election meddling. well, michael flynn we know now had these conversations with the russian ambassador

gay kiss lee yack about those sanctions and the lie here he told investigators that he had not asked the russian ambassador to refrain from escalating those war of words and russia said it would retaliate against the united states for those sanctions. so apparently flynn did have this conversation with the russian ambassador asking him tell russia to go easy on sanctions on the united states. he had lied about that to investigators. the other one goes back to december 22nd. there was a un security council resolution that was pending. it was basically going to say that israel could no longer continue having jewish recements in bag january territory that is an issue that was very touchy. president trump -- president-elect trump had said that he was going to lean very hard toward israel in his foig

apparently on december 22nd flynn asked the russian ambassador to either delay the vote or to use veto power against had un security council resolution, and he told fbi investigators that he did not have that conversation. did not say that. so those are the counts we're talking about lying to the fbi, this information that was filed with the court is signed by robert mueller special counsel. we do not have any information at this point in terms of what penalties mueller is asking for for these counts of making false statements but, of course, as we've seen, these are the domino's that are beginning to fall. people have talk about what happens. you get plea deals and then you get something for those plea deals. we'll be standing by here in u.s. district court. for now melanie alnwick, back to you. >> the information gained pay be more important than the penalties levied. the question with michael flynn obviously came about also his

to do this. >> so as you're taking on this role and you're playing augie who has facial demore empty, how challenging was it for you? obviously had to go through the makeup sessions every day to do this. but how challenging was it for you to embrace this role and knowing that you're such a handsome young man in person to have to play this and really play from the heart more so from your physical appearance? >> yeah. it was really interesting to see all the prosthetics because it was the first time i ever put on prosthetics, and it took two hours to put on, and just half an hour to take off. um, they have a lot of different pieces to the prosthetics as well. they have a neck piece, they have a helmet connect to do a mechanism which pulls down my lower eye lids. the main face piece a wig, eye contact lenses and dentures. >> wow. that's quite a lot to go through. two hours every day just for that. you certainly did pull it off beautifully a b
