anchors this morning that an internal use of force board had determined that it was unjustif ied because brian train er had broken a number of protocols. i'm here at intersection where terrence was shot back in september of 2016. this was a controversial shooting from the scr start mainly because i was revealed right away by the mayor that officer trainer, even though he was wearing a body camera did not turn it on until after the shooting now the department says trainer should lose his job. the mayor has previously said he should resign. this is what the mayor had to say about the process earlier today. what's important to me is that we have kept trust with the public so we know that we had a very unfortunate circumstance where a person died and now we have our administrative process that we follow in the district. so what i

is that we done exactly what we said we were going to do in being transparent, in following the law. in the early morning hours of september 11, 2016, zc police officer brian trainer shot terrence sterling while he was on his motor vehicle in the intersection of third and m streets northwest. after an 11- month investigation the us attorney's office concluded that there was not enough evidence to bring criminal charges against the officer. the evidence showed sterling was intoxicated as he drove through the streets at a high rate of speed. the officers gave quhais and against protocol blocked his path. investigators say sterling rev ved the engine of his motorcycle and hit the side of the cruiser as officer trainer was attempting to get out. witnesses say sterling was attempting to drive away from the cruiser and the collision was unavoidable. officer train er has never given his account publicly of why he opened fire. chief new sham today declined to say what

disobeyed. here's the position that i'm n. i don't want to get into too many specifics. that information will become available once there h is a final -- you know, once this h thing is final, but at this point in the proceedings let's say that it goes to a hearing and there's an out outcome. if the member wants to appeal that outcome, that appeal comes to the cheer chief of police. i'm in a very precarious position where i can't make any comments bioequivalent cervix of the vietion. we reached out to the sterling family today for comment. they declined an on camera interview but h they did release this statement and it reads in whole. our family has continued to pray that the truth will come to light. we are encouraged by the use of force review board's findingsing ternlings' sterling was un justified which brings us

director says under the trump presidency in his view his agency is finally allow to fulfill its true mission. if you're in this country illegally and you enter this country illegally which is a crime in itself and yet you commit a crime against a citizen of this country, there's no immigration law. now, consider the numbers in our area. in d.c. and virginia remember they combined those numbers two between those two jurisdictions, 401,636 people were arrested in maryland . they were looking at 1,666 people arrested in 2017 alone in immigration enforcement operations. now, understand what was also surprising about all of this today was what was going on down at the border that we learned about, illegal border crossings, those are down, way down. customs and border protection tonight saying that this

longer, but it won't be denied for tomorrow. i thought i'd run through you the futurecast so you have an idea what to expect just so you have plans this evening that are going to have you hitting the road. by the time we get to seven, 8:00 this is starting to swing through the i95 corridor. we're still only thinking this amounts to maybe a quarter inch of rain if we're lucky. we could use a little bit more, but at least the timing is toward the end of the evening rush hour so that most of you hopefully get home without having to deal with rain because we know that people skid out and have problems wets ' been a while since we've had wet roadways and we certainly have leaves down, too. by midnight most of activity is going to be east of d.c. and by the time we get to seven in the morning we're back to a mix of clouds and sun with lingering showers only hanging out here toward the southern portion of the del ma va. so your wednesday morning commute is most likely going to be drive. while you leave the umbrella home, don't

heavier jacket. 65-degrees at reagan, dulles and bwi coming in at 61-degrees. it's still very mild out there now but while we're still 58-degrees and everybody well above freezing which is fantastic as we watch the colder air coming in it will be getting colder tomorrow and we're going to see temperatures dropping through the 50s in the evening hours, 9:00 56, 11:00 55 but we don't recover much tomorrow. we may start in the upper 40s to near 50 and it will just be heading on downhill and a little bit of a wind kicks up later tonight so get ready to face a blustery, more december- like day tomorrow even if you won't need the umbrella. that's a look at tomorrow and we'll talk about the fact that maybe a few flakes could still be in our few tour. >> take a look at this video out of southern california a homeowner in ventura could do nothing more than just watch as a massive wild fire burned his home to the ground. the fast moving glaze started 12 miles east

helped fuel the flames that help ed destroy his home. the former olympic swimmer was able to get out safely, but he wasn't able to get out of his medals in time. i've been an owner for 40 years. this was going to be my die in it house, the only thing is my house died before i did. i have some important things from my athlete lettic career. i had one world record and i didn't get the certificate out for that and some medals that i had gotten from pan american games and gold medals and a world record there. my wife got some pictures and some other things like that, but basically everything is gone. nearly 8,000 homes have been evacuated in ventura county, la fire department says there's also a new fire on the north edge of the city. the dry and windy conditions are helping to fuel the out

southern california. firefighters are trying to get& upper hand on the fire that has turned deadly. bill is live with more. we're seeing the fires ripping through southern california. >>reporter: that's exactly right. this one is called the thomas fire and it is an absolute monster, more than 50,000 acres have burned so far more than 1350 homes have burned to the ground and they all look like this one right here. take a look. we've seen some of these scenes earlier this year up in northern california with the santa rosa fire. the skeleton of these homes completely burned to the ground we can hear some of the natural gas still preu sprewing from some of the pipes. both next door neighbors their homes burned down to the grund as well . take a look in the backyard. the only thing that made it through this fire at least on this little block is a boat in the backyard. take a look at some of the vehicles. i want to show you some of you guy s

metal, molten glass, just metal turning to liquid right here and then we talk about the embers how they're able to travel because of the santa and a winds . there's one home that burned to the ground right across the street and then right next door there's a like one. that one made it through completely untouched and the reason why this happens is because of these notorious santa and a winds we have out here in california. the embers get carried by the wind. they get underneath the eaves and that's when it starts picking and choosing different homes to burn . this started off as a little spot fire around 6:00, only 50 acres, but once the winds kicked in we're in a red flag. the rate was extreme, it went 25,000 acres in just under six hours. fire official say at one point it was moving at 50 acres per minute. is that absolutely unprecedented and

there's now a state of emergency declared here in ventura county keep in mind our firefighters also stretched extremely thin. a creek fire in sill marijuana. mar. they are stretched extremely thin there's one of the reasons why there is zero percent containment for this thomas fire. it is looking like the only natural barrier is the pacific ocean. you had quite a time with the fire around napa as well. is there any sort of a hope, are the winds going to die down? >> i wish i had some good news on that front but i don't. this red flag warning is expected to last here in south southern california through thursday night. they're worst at sunrise and later in the night. so we're kind of in a calmer period right now and it's still very windy.

>> we absolutely should and we look to as you trail and a the southern hemisphere to help us predict what our flu season is going to be like and this year they said they've had a very severe flu season and a the vaccine was only ten percent effective. you should get vaccinated because it protects you around, those around you and the elderly and small people as well. i know we have some information, too, we want to put up on the screen about the vaccine. everybody is always wondering how old should you you be when you get the vaccine. >> yes. >> and that type of thing. >> the flu vaccine is approved for everyone six months of age and older and you you should get vaccinated, if you're first vaccine, those babies are getting two doses. only the injectable flu shot is available this year we don't have that nasal vaccine. we found that it wasn't as effective and then the high dose vaccine is available for those 65 years of age and older. it could be potentially less effective for specific

other strains that you get it could be up to 50 to p 0 percent effective. you absolutely should because it can still protect you. when you get the vaccine, if you do unfortunately come down with the flu it's less severe and shorter in duration so that should convince you you if you do t still get the flu or minor symptoms from it, you have some symptoms that you want to be aware of people should be taking. >> get vaccinated, other ways to protect yourself, frequent hand washing. we pick up the flu through respiratory contact, but it also can live on surfaces so hand washing is very important and then if you do come down with it it's important to note what the symptoms actually are. so high fevers, body aches, runny nose those upper press press proprietary type symptom. you are going to feel like you can't get out of

tweeted out this photo of a car sitting on center blocks in atlantic a.m. a maryland man walked out of his adisel phi home to find someone stole awful his wife's tires for a second time in just a weefnlgt the were stolen last tuesday and then replaced by the opener. he's installed a high tech alarm system. >> surveillance video showing one of two suspects wanted in connection with a try ovechkin armed robberies in prince george's county. the suspects targeting convenience stores. it shows making a purchase in temple hills just a few moments before the robbery happened. this toyota corolla with d.c. tags was the get away car used in two of the incidents. the district's mayor and police chief came together to announce a reduction in the number of robberies. two years ago a robbery task force was formed and since that time robberies have dropped 33 percent. about 2,000 this yeemplet matt ackland is live in northeast where a

are 7600 new electronic eyes out there paid by the d.c. surveillance camera rebate program. i cannot tell you how valuable it has been for us on the metropolitan police department to have these cameras capturing suspects involved in this type of behavior. a focus has also been on repeat offenders, the attorney general helping in that area. so we double down and what we did was we started relying more on video evidence, phone evidence, social media. mayor boirs says she believes the cities the safest it's ever been in her lifetime you but knows even one robbery is too many like the one that ended zair kelly's life. i personally believe throb is scare people more than anything else because when you have robbery sprees they are seemingly random and they're seemingly involving people who are otherwise not involved in violence or any other

activity. so we randomly just came to this park in northeast today before the mayor's press conference and just by chance one of her representatives was out here talking to neighbors. now, the neighbor that we talked to that said things still could be done, he was complaining a little bit about the lighting in this area. if you take a look up, there are lights in this area. all of them seemed to be working together, but according to him he'd like to see this area brightened up. also the land scaping taken better care of. but we noticed a lighting professional come out earlier today, just about an hour ago and take pictures of the lights all of them are working once again because this neighbor believes that if they were a little brighter in this area maybe the crime would be reduced around here. for now, live in northeast, matt ackland, fox5 local news. >> it is a battle that has gone through the courts for the past five years. today they arrived at the sup

arguments about a baker who re fused to make a cake for a gay couple. ronica cleary live at the supreme court with more. >>reporter: well, the baker in question believes that if he were forced to bake this cake for the gay couple in question, it would force him to create a piece of artwork that goes against his religious beliefs. let's take a look at some of the details of this quais. now, when this case was heard in the lower courts they ruled against the baker. the baker has denied other cake orders in his defense he has cited other cakes that he won't make. not just those for a gay couple, but cakes that celebrate divorce, halloween. even one cake he was asked to make to celebrate say the and's birthday. so the question is is this a case of discrimination against the gay couple or is it a violation of the first amendment rights of the baker?

this cake violates his freedom of expression since the cake is his art and he says that he shouldn't be forced to create artwork for something that violates his religious faith. the oral arguments were heard today at the supreme court. let's take a listen to remarks from the baker and the couple from this afternoon. take a listen. i'm here at the supreme court today because i respectfully decline to create a custom cake that would celebrate a few of marriage in descrek direct conflict with my teaching on matters. i offered to sell the two gentlemen suing me anything else in my shop or create a design on a cake for any other occasion. for that decision, which was guide by an established set of religious beliefs i've endured a five-year court battle. >> so our reception planner suggested to us that we use master piece

she had used them in the past. we looked online and thought their cakes looked good. so we made an appointment and we went in. we had a binder full of ideas and concepts, but we never even got a chance to open that binder. as soon as we sat down with the owner, he asked who the cake was for. we told him it was for us and immediately he informed us he would not make a cake for a same sex wedding. >> you've heard the lines basically that this baker won't cross in his bakery or at least doesn't want to cross that landed him at the supreme court in lieft today's hearing we asked a few bakers in our area, do they have a line that they do not cross when it comes to things that customers request? take a listen. basically the only place that i draw the line are doing explicit cake

but otherwise we do everything else. of course everyone has different taste in design and art and people will come in with these ideas that, yes, i can visualize, but maybe i'm not in love with. we do them every day of the week because we're here to make the people happy. i guess where we would draw the line if we were ever put in a predicament like thank thri we have never been, but the only time we would draw the line is we wouldn't enable people to use our product to deliver hate messages of any kind. that would be where we draw the line and not just because of my beliefs verse vis-a-vis hate speech or hate messages, but also to protect our brand. as i told you our brand represents loving connection. >> as you can imagine, many people will be watching for the outcome of this case because of the effects

in our area. they got a warm welcome into the washington redskins skins locker room which the team turned into a santa's workshop. they helped the us marine corpse and santa himself shower gifts on the children r. it's all part of the toys for tots campaign. it's in conjunction with the washington redskins charitable foundation. it is truly special. it means a lot being that i'm from here and i know what these kids go through so to put smiles on their faces and to put joy in their hearts is truly amazing. the skins attending the game against the arizona card unless are asked to bring an unwrapped toy for part of the toys for tot s program. >> a great cause there that's for shunchts when i got to work about 4:00 today it was dark and i think that's what's stick around, right? a. you could kind of tell something was up. something was brewing.

that most of this rain has taken a while to get into town. it's not going to get denied. we're going to start seeing this rain pushing into the beltway area and this has changed just in the last few minutes. we're in the going to get a huge soaking out of this but we're going to have a wetter evening commute, at least the second half of it and these showers will be pushing their way through the overnight hours. by 11:00, the bulk of this rain is going to be over to the eastern part of the viewing area. this is a strong front. there is a lot of cold air behind it. maybe you can see a little bit of the snow that's starting to pop across the lower peninsula of michigan. yesterday was so mild just like we were today. we got into the 630-degree range, of one at dulles, but we will be much cold er on wednesday. we're going to seat temperatures dropping tonight and then they don't really recover tomorrow. wednesday is a dry day, 50- degrees and dropping through the afternoon. thursday only 49 for the high temperature. so

>> a major crack down is happening on the funeral home industry in the district. the attorney general's office is flagging nearly a dozen of funeral homes for a variety of issues. live in northwest where we're learning about new legislation to protect grieving families. that's right we're here at austin rider funeral. and all of eight d.c. funeral homes investigated officials say that austin funeral home is the worst case they have seen. we first reported to you in november about this case. accused of operating without the proper licenses and a of taking money for services not provided now, in one of those cases the family accuses the funeral home of taking $47,000 from a life insurance payout. because they lacked the proper

austin rois ter could not provide death certificates dozen s of families have come forward seeking help. it's been incredibly difficult for our team because our team, while we're lawyers and investigators, we're seeking to do our job we also care very deeply for the individuals who we work with and who live in the city. we have seen, you know, firsthand famil ies understandably show a lot of emotion around the uncertainty regarding the remains of their loved ones. take a look at your screen here the attorney general also identified nine other funeral homes that they suspect may not be in compliance. these names were determined through a series of things, through audits of their materials as well as price sheets posted online and secret shoppers. the attorney general 's office found violation s like inflating third party costs for profit not informing customers of their full range o

disparaging outside casket vendors. in this industry in general, the ag office has filed legislation establishing the funeral bill of rights. the funeral homes will have to post their three price list, the general price list, the casket list on any website that they maintain forth business. this means that consumers won't have to go door to door or make a bunch of phone calls which could be embarrassing and could be a big strain on them at a time when they may not have the emotional resources to make that extra effort. now, this law would also require that businesses like austin rois ter funeral home post that bill of rights provided to the customers and the attorney general's office is also taking it a couple steps further. they're pries providing some pricing sheets and some planning options for any consumers who need to deal with funerals services. all of that information is up on their website and we've got links and information up on our website,
