the last year because investigators have been looking into his claim that the incident that involving nate mckinnon in which mr. bauer ran him over in this parking lot he claimed it was self-defense but now a grand jury has indicted him on not only second degree murder charges but manslaughter as well. let's show you some video from the scene from last february. it was last february in this upper marlboro shopping center parking lot police say gregory bauer struck and killed nate mckinnon with his suv. at the time police said bauer and his daughter had been following mckinnon and his mother while calling police. now the night before mckinnon was killed here's the back story he was allegedly involved in a dispute with the firefighter's daughter. police said guns were pulled in the incident and one man was arrested and charged with assault. for reasons still not clear mckinnon wasn't arrested. the firefighter and his daughter went back to the neighborhood where the assault occurred and spotted mckinnon g

with his mother. they followed them for several miles. that's when they pulled into the strip mall off of brown station mall. according to mckinnon's mother her son got out of the car to talk to the firefighters daughter. according to a source familiar with the investigation the gun was in mckinnon's pants and the question all along has been whether he pointed it at bauer and his daughter before bauer ran him over. we talked to mckinnon's mother at her home last february. here's what she had to say. >> this man refs his car directly into my son's body, you know. instantly his body just goes limp and i'm looking in the rear-view mirror like this is not real. this has got to be not real. this did not just happen. he drove back and then rolled over him and crushed his

bleeding and his nose was bleeding and i was so -- i couldn't even move. i was in a state of shock so i come over standing over bite body and i said you did this to my baby. you did this. >> reporter: now, i spoke with miss jones a couple of hours ago. she just confirmed that there was an indictment but i have not been able to get back in touch with her. i did speak with glen ivy. he's representing the firefighter. he's told me that they are now making arrangements for the firefighter to turn himself in. he said we are disappointed and surprised by the second degree murder charge. he said that we do this as self-defense and we will seek full vindication. he said that there is a video of the incident. he says that supports theirself defense claim. we're live outside police headquarters, paul wagner, fox5 local news. >> you may have seen this video yourself that's sparking outrage in maryland across the

>> a woman left out on the street in just a hospital gown and a man standing by caught it all on camera. the man desperately pleaded with security guards not to leave him out in the cold. fox5 speaks to the man who captures that video and now there's new information about that woman's condition, too. >> fox5's tom fitzgerald live with this story tonight. fitz. >> reporter: good evening, this is just chilling to watch but that video you just saw was taken by dr. amanu baraku. he was there when this played out. first the news for you tonight. the doctor says that woman you just saw tonight, she is safe. back with her family. she has been missing for days and they had no idea where she was until they saw her on that recording that went out on facebook. as for what exactly happened, well, the doctor says he was on his way home at midnight tuesday when he saw what he thought and knew was a woman

in deep trouble wearing only a nightgown in a freezing cold night. security guard from a hospital here in baltimore were leaving her on the sidewalk. >> my objective was to get clear about what was going on. to hold them accountable and what was happening in my head is that not on my watch. you're not going to do this on my watch today like this. >> reporter: now, the woman in that video we are told now is 22 years old. this happened midnight tuesday the doctor says and he quickly went to get out his camera to record the scene. now, this took place at the university of maryland's midtown campus, that is up aways from the regular campus that most people are familiar with near camden yards. he says he approached the security guards but he says they blew him off. and th

it was recorded that the doctor posted on facebook. >> okay, ma'am, come and sit down. come on. they just left all of her stuff out here, right? >> reporter: so, how do you process something like that when you see that spilling out in front of your very own eyes. the doctor says he went through several stages. shock, fear and then finally he says rage. rage when he could not get the security guards to listen to him and bring that woman back into the hospital. tonight the hospital says it is investigating this. however, the doctor says that is not nearly good enough in his view. >> what's concerning to me is that the institution that did this is investigating itself. how is that even

was informed that those officers still have a job today. if you're investigating them, they should be on leave of some sort. >> reporter: there you have the doctor. let's hear from the hospital now. late this afternoon in the last hour they held a news conference. this is their explanation. >> we believe firmly that we provided appropriate medical care to a patient who came to us in need. but where we absolutely failed and where we own that failure is in the demonstration of basic humanity and compassion. >> reporter: well, they can own this in their view but they are not going to be the last word on this. late this afternoon, the department of health and the state of maryland informed fox5 they have opened up

>> ♪ >> two men with dementia who went missing were found dead this week. >> although the cases are unrelated, the circumstances surrounding their disappearances have ignited new concerns about what to do when someone encounters a wandering person with mental illness. fox5's tisha lewis joins us tonight with the story now. tisha. >> reporter: sarah and jim 65-year-old daniel dehaven reportedly wandered away from his wife in costco parking lot. 81-year-old delmar mosley was last seen in a northeast neighborhood. their deaths have prompted even law enforcement to review encounters with people with dementia.

seminar last night presented by the alzheimer's association. basically a lot of times folks like that are very confused they might be scared. they may be not aware of their surroundings or what's going on around them. the best thing to do is just talk to them in a slow manner, reassure them that they're safe and just to obviously we want to try to get help to them as soon as possible. >> reporter: stafford county sheriff's office is the first in the region to offer this project lifesaver. participants wear this personalized bracelet that emits a tracking symbol. it helps to locate people with dementia people who off become loss. in the cases involving daniel dehaven and delmar mosley it may have helped. both men with dementia were missing for days before being discovered deceased. >> i think it's a program that everybody should have just to help keep the community safe in terms of the folks who might have a disease or an is

to get them home as fast as we can. >> reporter: a reported six in 10 people with dementia will in fact want. the alzheimer's association says people with dementia may have problems with short-term memory keeping track of a wallet and paying bills. tisha lewis fox5 local news. >> all right, well things have definitely warmed up now. can you believe 57 degrees out there right now? >> i did not wear a jacket today t i know if i were six or seven years old your mother would say wear a jacket anyway but it was not bad at all, sue. >> and if i find that in your backpack later tonight. >> right, right. >> we actually hit 62 degrees today. you can see the numbers behind me. that is more typical of early april. and you know, speaking of april, some april showers will be accompanying these warm temperatures as we go through the next 24 to 36 hours. how about these numbers, though? and as i show you temperatures around the region, you're going to see some startling difference because while it's very

travel a little distance over to annapolis and it's only 43 degrees. so, what's the deal there? it's because it has been so icy near the water that ice is actually influencing the air temperature down there but everybody else is well into the upper 50's. 45 stevensville, 59 for leonardtown. those are the two exceptions. a lot warmer than yesterday. how about 15 to 20 degrees warmer. definitely is a nice little break but wow the break will not last long. i don't think you have to look too far on this weather map to find the change coming. check out the change in colors from those warm greens and blues to the dark blues and purples where it's 8 degrees in minneapolis, five below in fargo. 18 in lincoln and bye-bye to the heat in chicago. it won't last much longer because that's another push of cold air that arrives in here during the day on saturday. i mentioned some showers. most of the day has been dry, just delightful but we're begi

showers pop up through central virginia and those will be moving in our direction in the evening hours from south to north. this is not going to be a very wet evening. in fact the rain that is coming for us is -- looks like the bulk of it is going to hold off until tomorrow so heavy rain expected friday. and some of the heaviest may be now around the noon hour where yesterday it looked like it might be for the morning commute so it's holding off just a little bit. wanted to show that you while we'll have rounds of rain, some of which is going to be heavy at times, the bulk of it is tomorrow. and it still looks like we're going to pick up a very beneficial inch to an inch and a half around the region. i say beneficial because we're in a moderate drought t now, the problem with this is that is going to melt a lot of ice. watch for ice jams if you've had a lot of ice on your local dam, creek in your street or neighborhood t by 11 o'clock not a lot of rain in our area but as we go to the morning rush hour, it's picking up in intensity. you still will need some extra time. don't be shocked if there's even a rumble of

wow the noon hour is when it really looks like it's going to be coming down in buckets and that's where we get the bulk of our rain. we still get a few dry hours tomorrow. your evening commute on friday looks like it's going to be fairly dry and boy, will it be mild. we're forecasting 65. it could be as warm as 67. that's not going to last long, either. and here comes a little bit more rain late night that will taper off on saturday and could end in a few spots north with a bit of wintry mix. that's how fast the temperatures are going to crash from the 60's back into the 30's between friday and saturday night. we'll have the details, the timing with the rain again and a seven-day forecast that will feel in two seasons in about 24 to 48 hours. sarah and jim that's coming up a little bit later. >> ♪ >> itjust needs more people, more police action out here. >> ♪ >> it's not so much that we've noticed an

evasion itself but what we have detected is a significant increas in the number of metro employees being assaulted. >> it was hot in the train so it was not only the station it's hot inside the train. >> ♪ >> even on the regular times the trains break down a lot. >> we could raise fares 35 percent which is unrealistic. people wuld just stop riding metro. >> i don't know how anyone in the government is able to, you know, look at this and say this system is working and i honestly don't know how comfortable i am getting on the metro again. >> if you receive bad service you may be hesitant to return to that place of business, right? well, that's why metro says it is stepping up its efforts to convince riders to give it another try. >> getting riders back is not the only issue they're dealing with. they talked about this at the board meeting today. fox5's matt ackland is here to explain about what metro is doing about it all. >> reporter: hi jim. how would you like a refund if things don't go so well. that's being

metro's general manager is talking about kind of a money back guarantee. if things don't go well, well, you'll get the money back for that trip. that was talked about today. also, there was a lot of talk about all the aggression towards operators and what's being done about that. that were recommendations. and the next time you are in a metro station maybe on a bus you might hear about a new plan to stop sexual harassment along that trip. >> securing the homeland. >> reporter: metro management knows it will take more than just this fans video to get riders back on board. millions have been spent to make safety and reliability improvements but now how do you convince riders to come back? well, the general manager says let's offer riders a money back guarantee on their registered smart trip cards if metro is 15 minutes late. he calls it the rush hour promise. >> at some point we have to say, yes, you know, we, y

>> ♪ >> this is fox5 local news at 5:00. >> all right, here's your headlines now. first up the search is on for the suspect who shot and killed a man in the district. police say someone shot 19-year-old harris brown last night along sky land place southeast. the victim was found lying on the sidewalk. no word yet on a motive. >> in stafford county three people arrested after multiple people were stabbed over some kind of drug related incident. happened in democracy circle. the victims attacked by austin edwards devon edwards. they face several charges including malicious wounding. >> and police busted this man for stealing from vehicles in frederick. officers responded to reports of a disturbance in

blockly bigs avenue. several people told police fouch has been opening cars and several items were stolen. he's now facing charges. >> wal-mart kicked off the day announcing new benefits for more than 1 million hourly employees and another announcement for some of their sams clubs locations seemed to clear that that thunder. >> a closer look at the meaning and timing of the headlines for the company. ron. >> reporter: this morning wal-mart announced it will pay it forward passing on the benefit that of corporate tax relief sharing it with some of their employees. let's take a look. well, eligible full time hourly associates, they will be given bonuses based on the length of time they've been with the company the maximum amount a thousand dollars will go to those who have been with the company for at least 20 years. now, in february, new starting hourly wage, it's

$11 an hour. and for parents who are full time hourly associates, they're going to receive a handful of benefits from 10 weeks paid maternity leave to six weeks paid parental leave and also if you want to adopt they're going to be able to receive a $5,000 credit to help with the cost associated with that. now, hours after this positive news broke for wal-mart, we learned that the company will be closing a reported 63 of its sams clubs locations across the country. the closings will undoubtedly result in layoffs. well, i spoke with mark avalone about what this announcement means. >> sam's club is still going to have about 600 stores nationwide. it's still a formidable part of what wal-mart does on the retail footprint. as a shareholder this could represent significant cost cutting and indicates that it's not

retail is changing dramatically. and store traffic across-the-board is dropping. this could be a move well thought out by one of the nation's best realtors to remain competitive with amazon. >> reporter: no matter what the reasoning behind the decision, the timing of the announcement has undoubtedly raised some eyebrows. it has some asking if those increases for wal-mart employees was to distract from the sams club closings and layoffs we heard about this afternoon. we took to the streets for the pulse of the people. >> i doubt it was a coincidence. i think they're probably trying to balance out, you know, not making it seem like it was such a bad thing to close the sams clubs. >> sometimes i know businesses have to make tough decisions but at the end of the day that doesn't help anybody who worked at those locations, so maybe they -- maybe the timing could have been better but who knows. it's hard decisions to make i guess. >> it's really unfortunate if there is a causal relationship between the two but i am glad at least that a they're increasing the

and giving more leave to their female workers at wal-mart. >> probably a pr move in order to balance out the good with the bad. >> reporter: in a tweet, sams club said of the store closings in part, closing clubs is never easy and we are committed to working with impacted members and associates through this transition. back to you, jim and sarah. >> the trump administration announced it will allow states to impose work requirements for medicaid. so, this means they would support states that want to require able bodied adults to work or volunteer as a condition to be eligible for medicaid. right now people are not legally required to hold a job to be covered. about one in five americans are on medicaid. the plan is expected to face strong political opposition. >> on this vote the yeahs are 2256. >> the house passing legislation to renew the foreign intelligence surveillance act known as

take down the holiday decorations, return to a more normal state of life as we were kind of just stuck in the deep freeze for two weeks but now as we take a live look outside it's down right balmy with high temperatures in the low 60's today. we're now only in the 50's. guess what? we're going to stay in the 50's all night and we'll be well into the 60's tomorrow. so, yes, that will be accompanied by some rain. a trade-off. but the deep thaw instead of the deep freeze continues. until the deep freeze returns 'cause that's in the forecast, too. here's your weather headlines. yes, i know, i'm sorry to say. another round of arctic air will be here way before the weekend is even over. so, much warmer air has arrived and a nice reprieve from the cold. showers do move in overnight and we will have rounds of some rain, heavy at times throughout the day tomorrow into tomorrow night. once the rain exits, it's replaced by the cold air and that will be pouring in, excuse the pun, it won't be raining but the arctic air will be pouring in throughout the day on saturday. 62 we hit at reagan, 62 at dulles, remarkable. 61 at

these temperatures are 15 degrees above where we should be. after spending so long on the minus side of the average we are now well on the plus side. 58 d.c. 56 baltimore. i know sue mentioned this earlier 43 in annapolis. when you're right along the water it is still frozen in parts of the potomac and chesapeake. you get the southeast wind you can't see -- although quantico 52 degrees right now. but primarily we all felt some very springlike temps into the 50's and 60's today. now, elsewhere we are seeing 49 in new york, 46 in boston, 40 -- 63 there in pittsburgh. it was the actually the national temperatures which i'll have to have sue show them later they are pronounced with the cold air that's coming in across the central part of the country. hopefully she'll get to show you that in a little bit because that's pretty impressive. the cold air coming in in places like the northern plains down into the midwest is behind all of this. two rounds of rain here. you can see one just moving into western

pennsylvania, another one back by chicago and even some snow showers across minneapolis. sole, this is going to come through the next 36 hours in several rounds. you see just a little bit of moisture moving into d.c. and a heavier stuff is still far off towards our west. it's all about storm track always but in the winter we've been seeing mainly these low pressure systems slide south of us. enough cold air in place we've gotten snow. this is a totally different storm track, a totally different pattern and when they go west of us straight up the appalachians in this case, we're on the warm side. we see the rain and very little, if any, snow. fox futurecast through this evening mainly just clouds but showers will push in overnight. light rain probably as you head out. now, it does look like the shrug of heaviest rain will occur during the day tomorrow. which could compromise high temperatures but it still should be very mild. but anyway we've got several rounds of rain that could be pretty heavy and i wouldn't even rule out a rumble of thunder or a flash of lightning or two. it's just that

street burglarized before christmas and it happened again on sunday. cori coffin talked with the owner and she has more on what he had to say. hey, cori. >> reporter: i did yeah and he was able to tell me kind of everything he knows about the case so far. owner ken stein believes the person who busted through this door on the top and on the bottom with a brick is the same person who came back a month later with an accomplice. we want to show you that first video of the first burglary on december 13th. now, in this video you can see the suspect immediately going for the watch cabinet a pretty easy mark getting into the other display cases though isn't so easy he kicks at them several times. but with no luck he leaves and gets into the waiting van. now, in the second burglary, you can see two people busting in actually. this time the thief is prepared with a hammer. they smash several cases, stein tells me they got away with $33,000 worth of merchandise and now he's going to make some changes here. >> i think we'll try to get a gate and kind of protect the windows better w
