following this and he never touched the weapon. >> he was never booked into jail. and the deputy was the one that was booked. >> the deputy timothy virden turned himself in on friday after a warrant was issued for his arrest. later he was out on a $2000 bond. this is video of the incident on december 30th. you cannot see the shooting but you hear the 26-year-old taunting the deputy. >> then you hear gunshots. >> at the end of the video, you hear certain words. >> that's at the conference. >> simply put the version of events could not and did not happen. he had no legal justification to shoot the victim. >> it is a reversal from what he said a month ago.

there is no justification for shooting him. >> he is still recovering from the gunshots. he was aware of the arrest but otherwise declined to comment. it is extremely rare for officers in florida to be criminally charged for use of force. in december a deputy was shot after shooting a man with an air soft gun. before that no one had been charged in 26 years. a man was out on bond he was breaking into homes and dozens of cars. police caught up with him. tori davis. in january davis stole a car and robbed a number of homes in tampa and hillsborough. detectives linked him to all the crimes and took him into custody. the judge went over all the, that that filled up two pages. >> during the days that mr. davis was out on bond t is

it looks like 105 additional criminal offenses most are felony charges. >> 105. wow. during the crime spree the public defender said he was a new father but he will not spend time with the newborn. and courtney brantly gets a get out of jail free card but it will not save her from prison. the woman with donte morris was supposed to serve her prison term later this month. instead she was thrown in jail because of beating her girlfriend. pros prosecutors missed the deadline to charge her. and gloria gomez was at the courthouse. what happened? >> reporter: and now keep in mind the prosecutors have a certain amount of time to charge if you think don't that defendant is free to go. that did not happen in this case.

supervisor of a company that works in the meadows neighborhood. he is accused of breaking into two homes and robbing them. the first time was in december, the second last week. deputies say they found his fingerprints at both scenes and they're now working to see if he is connected to more in the neighborhood. >> and a way ward manatee was shivering and shaking and really in need of a few dozen helping hands this morning. it was stranded in a creek in the river oaks neighborhood of tampa. and chris cato joins us now. how did it end up in the shahle low water? >> like a lot of us it wanted to get warm, you know the bay is cold, a mat of manatees have my water. and the creatures are drawn to his spot in rocky creek because treatment plant. that makes the water a few degrees warmer there.

commission spotted five near the treatment plant last week and moved four of them to deeper water but a young male, a teen, hung around and was stranted. he was suffering from cold distress and they moved in. >> it is difficult. fight us. that is involved. a lot of care out of the water. >> and the rescue took three hours it was no quick work but they moved in with a net. they pulled it up on the bank. checked on him there and a tarp and pulled it up into a truck and then put it in a larger truck to take it to lowery park zoo where the staff will check the victim signs and returned to the gulf later this winter. the hospital has treated 380

figuring out the story behind the escape of three inmates from a maximum security jail in orange county. they arrested a 44-year-old woman who works as an english as a second language teacher in the prison. she is connected to the jail breakthrough master mind hussein nyari, she provided maps. there was a relationship that developed between the two as a as a result of a student-teacher relationship. and it developed into a closer relationship. >> it was the first escape from the facility in 20 years. officials say the men cut through a grate and climbed through tunnels to get to the roof, they made it up to the area. compromised the wire and repelled to the ground. >> they are asking for the public's help in locating the men and posting signing offering a reward and serving 36 search warrants on friends and family of the inmates, a number of arrests will be made.
