stands in the way of something their kids need and they say that he will not pick up the phone to talk about it. the issue is school recess and the fact that a lot of kids go without it. they won over the house but it is a different story in the senate. and we're here to show you why. >> and it is hard to believe that so many kid goes without recess all day long but something that you had two or three times a day has been erased from many schedules. despite a lot of support for the cause, bay area moms worry it will stay that way because of one state senator with a lot of power. >> it is every kid's favorite part of the day but recess is rare.

whole testing thing we'll do recess toward the end of the year. >> a third grader said that his class has not had recess all year. >> according to parents as the district districts prepare them for tests breaks in the day where they can be kids have been squeezed out. >> everyone's goal is for higher achievement levels, higher test scores, focus and the way to get there is not more academic time equals more success. that's the play now. they need time to get the wiggles out in order to have that success and the focus. >> and they require 150 ours of physical education for school kids n most kids get three days of pe. but that means two day as week children go with neither recess nor pe and that can take a toll

>> i get all jumpy and don't pay attention. >> parents across the state are rallying together to bring back recess a new bill would require schools to allow 20 minutes a day of recess for elementary school students. it has 50 cosponsors and breezed through the necessary committees. but it is hit a roadblock in the state senate where john legg, the chairman of the education committee, refuses to put it on the agenda keeping the recess bill from a vote. >> the senator needs to give to let them vote on it. they represent us and vote no if they want. they should not block the process. >> parents say they have sent thousands of e-mails and letters to the senator's office over the past six weeks but have not received a response. they tried calling, too, but they say all they get is his office voice mail. i wanted to ask him why the bill

committee in two months. whether he plans to ever allow it to go to a vote but i have not received a response either. >> mark, kelly thank you. developing now two robberies the same two suspect as worker who was just doing his job at a produce stand recovering. police are releasing video of the man and woman here believed to be behind the crimes. and we have the latest on that one with aaron mesmer. >> reporter: we're talking about two robberies in a matter of days both at this market and the second one could have been deadly. that's why the police want to you take a look at the video. we're told it show as man and woman on january 26th. moments later they approached a forklift operator behind the market one pulled a gun they pulled the trigger. it hit him in the back. they believe the same pair robbed someone else here eight days earlier but did not fire

the owner of a daycare said she hopes police can track them down. >> i pray they hurry up and catch the people. they are making it bad for people trying to make a living. and sit on the porch and have fun or come out and have fun. >> reporter: detectives say nothing was stole non-either case, the victim who was shot survived and will be okay. police believe the suspects are familiar with the area and may live around here. anyone who recognizes them is asked to call the police. >> thank you. nobody knows why the student had a loaded gun and ski mask on his school bus but one thing is for sure. he is in big trouble. today the student faced a judge. and gloria gomez is here with more on that and what the judge had to say, the student got bond but the judge had a few choice words before he did that.

the 18-year-old had a loaded gun and hid it with a ski mask on a school bus that was heading to a brandon alternative school. the judge read the charges against him. before setting bond had a warning for the defendant. , he was observed loading a handgun on the bus. there is no place for guns on school property or specifically in the case a bus. so, i believe the higher bond on that is warranted. i'll leave the others the same f you get out, mr. sims, are you not to possess a firearm under any circumstance. >> he responded yes, weave asked the district what will happen. >> it is a case by case situation. some of the options being transferred to a virtual school or adult education or home-based education.

nine different prisons about 130 people, including prison employees, inmates and others have been indicted since september. in virginia, a log cabin is destroyed by a fire. take a look at this out of green county. the fire started last night as a family was inside. they were able to make it out. the roof collapsed a few hours after the fire started. crews said the safety decision was to allow the fire to burn itself out. it was so large people could see it from miles away. no word on a cause. congress voted today to bar state and local governments from taxing access to the internet. it was part of a bill here revamping trade laws. until now states that imposed the taxes have been allowed to continue. sepen states have been collecting $563 million yearly from internet access taxes.

(kelly) in world news in world news tonight a brutal riot in mexico leaves 52 inmates dead. they didn't have guns instead inmates set fire to a storage area. the fight was between supporters of two rival drug cartels. mexico's prisons notoriously are overcrowded and no inmates escaped. it was six days before the pope is scheduled to visit a different mexican prison. and dozens are hurt after a train derails in egypt. it was heading to cairo when it collided with a barrier. cranes came in to pull it apart. it is unclear what caused it but the conductor has been arrested.
